First, I'd like to let everyone know that Sean Davis is on the way. He is running a little late. He's on his way from an out-of-town government work event, and he should be here before 3 o'clock. [00:02:21] In the meantime, Supervisor Pritchard will be filling his role temporarily today. As is customary, we will begin with an invocation led by Mr. Jeff Stoneman. and the Pledge of Allegiance led by me today, Mr. Stoneman. [00:02:40] Would you bow and pray with me, please? Father in heaven, Lord, we humbly come before you today giving thanks in all things and acknowledging you in all our ways. Father, we just want to ask that you would bless this body, Lord. It's a privilege to serve the citizens of Hanover County. [00:02:55] We pray, Lord, that you would be with all the presenters today as they present their cases and their budgets. and Lord, just clear our minds, Lord, and our hearts, Lord, that we would receive each other and that we'd be thoughtful in all that we do. And Father, I just thank you so much for this wonderful place that we have to live called Hanover County. [00:03:15] And Father, we just ask that you'd be with us throughout this day. It's in Jesus' name we pray, amen. Amen. Please rise as you are able. I pledge allegiance to the flag of the United States of America and to the republic for which it stands, One nation, under God, indivisible, with liberty and justice for all. [00:03:41] Thank you, Mr. Stoneman. Next on the agenda, consideration of amendments to the agenda, Supervisor Pritchard. Thank you, Mr. Chair. I move, first of all, to remove item C2 for the Pamunkey Regional Jail from the consent agenda. [00:04:05] That will be item 5C2. Yes, sir. Is there a second? Second. Second. All in favor of making that change to remove item 5C2, please indicate by saying aye. [00:04:23] Aye. Any opposed? Item is removed. Supervisor Pritchard. I believe Mr. Hudson would like to make a motion for an additional change to the consent agenda. Yours is first, ma'am. Mine is first. All right. In that case, I would like to make a motion to revise the item for the resolution for the county treasurer, make a motion to revise that to update the languages provided at our desks. [00:04:54] Is there a second or any discussion? Do you have a question? Okay. Supervisor Dibble? This particular item was fully vetted by the Finance Committee and brought to this board with the unanimous recommendation by the Finance Committee should this board wish to have a assistant County administrator in this role in this resolution I would suggest that we don't need both the assistant Jay [00:05:33] Brown and the finance director one or the other seems a little overkill for what we're doing here and I'm actually just personally fine with it the way that it is because dr. Brown was at our meeting and was comfortable with it the way that it was but one I would suggest one or the other or just leave it the way that it is thank you sir thank you ma'am my understanding that when the policy came out of Finance Committee that the policy was going to include the deputy county administrator with the finance director and the county attorney [00:06:12] And so if this is not unanimous at this point, then we should make a motion to pull it from consent and have it as a separate item and let the board vote, in my opinion. Or why can't we just amend the amendment? [00:06:30] So what I will say is I know that Mr. Davis has an interest in this, and if we are not going to approve it as it is, as the amendment is presented to us, then I will make a motion to remove it from the consent agenda, and we will take it up as the end of our regular agenda. [00:06:46] Yeah, I'll second that motion because I don't believe the language is unanimous at this point all in favor of removing it from the consent Agenda and having discussion and a agenda item later on today's board meeting. Please indicate by saying aye aye All right, any opposed motion has carried mr. Hudson. Thank you. Mr. Chair I make a motion to add item 5d 3 request for approval of committee appointment or reappointment and I move that we reappoint uh mr ricky ladd to the transportation committee representing the mechanicsville [00:07:20] magisterial district for a term ending december 31st 2026 second there is a motion and second all in favor please indicate by saying aye aye any opposed none congratulations mr ladd next on the agenda is agenda item 3 comment period it's beginning with chair and the board member comments i'd like to [00:07:47] recognize chief Anderson is in attendance with us today welcome fire chief do that here so mr. [00:08:05] chair I make a motion that we accept the rest of the consent agenda as amended there is a second a motion is there a second second all the favor please indicate by saying aye aye any opposed the remainder of the consent agenda has been approved welcome fire chief my comments today will center Welcome, Mr. Boshan, our treasurer. Glad to have you with us, sir. [00:08:39] My comments today will center around the procedures and summary of the appointment of school board members pursuant to authority granted by Title 22.1 of the Code of Virginia and the voters of Hanover County, the board is responsible for making appointments to the Hanover County School Board. [00:09:01] The standing rules and procedures for the Hanover County Board of Supervisors as readopted in September of 2024 sets forth the following schedule for making appointments to the Hanover County School Board. [00:09:19] For appointments for terms that begin on July 1st, the board shall hold a public hearing to receive and consider names for appointment at its second Wednesday meeting in April, which is April the 9th. [00:09:35] Notice of the public hearing shall be provided as required by the Code of Virginia. At its fourth Wednesday meeting in May, May 28th, the board shall make its appointments. Information about the nomination and appointment process will be on the county website following this announcement. [00:10:02] Individuals interested in serving may indicate their interest to board members and county administration up to two weeks prior to the public hearing, which will be March 26th, by completing the online interest form. [00:10:20] All names must be put into consideration at the public hearing on April 9th this year. Interested parties or someone on their behalf must be present at that public hearing. [00:15:52] Thank you, Mr. Badesky. That concludes our comment period. Next on the agenda, item four, citizens time. Do we have any citizens who wish to address the board today? Citizens time is an opportunity for members of the public to present comments and information to the board regarding any matter within the board scope of the board's authority that is not on today's agenda for a public hearing. [00:16:19] There are cards available in the back of the room. You are not required to fill out a card. however it does make it easier for the board clerk to get the spelling of your name correct and it gives us contact information in case we need to follow up with you after your comments speakers who wish to address the board are request to follow the following guidelines each speaker is asked to give your name and your magisterial district in which you live speakers will have up to five minutes to adjust the board the vice chair will keep track of each speaker's time and And we'll try to give you a warning before your time is expired. [00:16:57] Speakers are asked to address their comments to the board and not to the audience. Okay, we will now open citizens' time. Please approach the podium, ma'am. Please state your name, your magisterial district. [00:17:16] You will have up to five minutes. Afternoon. Having just completed the inaugural Engage Hanover program, I'd like to thank the county staff who put all of this together. [00:17:32] It was a great opportunity to be in smaller session with the different departments that actually put in the work to keep this county operating. And I really hope you all realize what a hardworking and dedicated staff you have. There were some late nights that they were out with us. As of late, I've spent more time silently observing than speaking, but these are the concerns that keep circulating in my thoughts over the last couple of months. [00:17:56] We'll start with committee appointments. Please stop encouraging citizens to apply for open committee appointments when you have no intention of appointing those who apply in good faith. The most recent example will be your personal agenda choices of reappointing Ms. Schumacher and newly appointing Ms. McMaster to the Library Board of Trustees. [00:18:14] You had a well-spoken, impeccably-resuméed citizen who you chose not to appoint because she would have been supportive of the mission of the library. Instead, your most recent appointees are known to favor book banning and restricting access to books based on their personal beliefs. [00:18:30] Your appointments have now pushed out to library directors because why would they want to work for a system that does not respect their professional training? There are plenty of other examples of friend of supervisor appointments. In fact, I'd be willing to present a section of the next Engage Hanover who's tied to whom in Hanover County. [00:18:49] As far as school board goes, Mr. May claims they are an open and transparent, but every single time I request that they live stream their work sessions when they are meeting in this very room at this time, the response is no, not going to happen. When I ask why, the only explanation I am given is that no one else streams their work sessions. [00:19:09] That to me is the reasoning equivalent of because I said so, which all of us as parents have given our children when we just don't want to do something. You all know you've done it. I've done it. I'm not asking for closed session information that I know legally can't be shared. [00:19:27] I'm asking for the opportunity to be able to hear the discussions that they have prior to meetings in the evening. i work many of the parents that are interested work it gives us an opportunity to tune in and have an idea of what is going on if you want to be transparent be transparent school board appointments let's stop that pretense that there is a drop of transparency in that process you can hold public hearings and allow citizens to put themselves in for the opportunity but it is abundantly clear based on the last handful of appointments that not a single one of you on this board have any intention of appointing a qualified person who will not [00:20:05] bend to your will. As far as the superintendent hiring, this may be the single most important choice the school board makes this year. The permanent hiring of Dr. Penny Cuff out of a pool of potentially 35 people from across this country will only solidify what anyone who has been paying attention to the actions of this county know. The opinions of the citizens, the teachers and staff don't matter. This will be the one and only time I probably agree with Jack Dyer last night when he spoke at the school board. [00:20:33] saying that we really want a superintendent that has a heart of gold and has the best interests of our students at heart i absolutely agree with that dr penicuff is not the one when you have a whole cohort of citizens from her previous county and school system coming forward and saying she aided in an alleged child abuser and allowed him to keep working that should have been a red flag and she should have been gone then but we still have her i don't want to see her permanently appointed and and I know a lot of teachers feel the same way, and parents. [00:21:09] The teachers really need someone they can trust, for someone that can advocate for them, and not be a lackey for the school board. They need someone who's gonna be a bridge between what their needs are in the classrooms and what the school board wants to see accomplished. - You have one minute. - Thank you. On the budget, the one thing I did learn through Engage Hanover is how many of our community services depend on federal funding. [00:21:29] I hope there are plans to supplement these vital services with funding when federal monies are frozen. Additionally, as it relates specifically to the school board budget, I do hope someone questions the need for the spending of an additional $97,000 to consult with A Better Way Athletics. I'm aware it's a result of the recent poor choices of our county athletic teams. [00:21:48] However, if we are going to use a consultant to teach our athletes how to be better humans, there should be money somewhere in the budget to consult with the NAACP or the like to teach our students and staff how not to be racist. And yes, that is still an ongoing issue in our county schools. I'm beginning to think if it wasn't for Hanover County, the local news would have nothing to report. [00:22:07] Finally, I'd like to thank Mr. Sohnman and Mr. Hudson for being willing to hold their town halls and speak to their constituents directly. I sincerely hope you guys listen to what they have to say and make decisions based on their best interest, not yours. Thank you. Is there anyone else who would like to address the Board of Citizens' Time? [00:22:27] Please come forward, ma'am. Please state your name, your magisterial district. You have up to five minutes. Thank you so much, Supervisor Herzberg. My name is Patricia Jordan, and I am in the Cold Harbor District. [00:22:47] I am here this afternoon to address some of the same concerns. We seem in Hanover to feel as if one group of people makes Hanover, but that is not the case. [00:23:07] And if you look at other counties, other towns, you will find that the more you embrace cultural diversity, number one, it provides more economic development. It is a better way to bring people together, to work together, to learn about each other. [00:23:32] And I find that we are missing that in Hanover County. We do not embrace that. Last month was Black History Month. It was never acknowledged by this board. [00:23:49] And what is wrong with acknowledging that fact? Yes, we are Americans. We were not bought here on our own accord. We were stolen from our homeland and bought here. [00:24:05] And so why not acknowledge our history that has impacted this county as well as everywhere else in America? It is the same for other cultures. Just because I am not Greek does not mean I don't attend the Greek festival. [00:24:27] And I think we should become more inclusive as a county. I also think that we should remove politics from all of the appointments and discussions that take place from this board. [00:24:45] It is apparent that you must be a GOP-er in order to be appointed. If we look at our school board, that is what we have. Now, it is interesting and it is a factual note that in order to have the best information, you should have people with differing opinions surrounding you. [00:25:16] And we don't have that. Everything here is the same opinion for the majority. And we need to get away from that. We need to understand everybody in this community. [00:25:33] Last night, yesterday, during the work session, I listened to our school board, and some of them were amazed that in Hanover County, there was this program that told them about drugs and how to identify that. [00:25:53] We've had that in Hanover County for years. They come out to our community to present that program to parents. It's in our schools. It's from our counselors. [00:26:10] Our health department comes up. For me, that shows that culturally, everybody is not aware, and we need to be. I, too, am concerned about the school appointments, because in the last round, we had two black people who had their doctorates in education, and neither was chosen. [00:26:38] One minute. One minute. Not one. Before that, we've had Dr. Ross, who had five earned degrees, not chosen. So why is it that these people with that background in education are not fit to serve on our school board? [00:27:00] I fear that with the onslaught of what's happening in the federal government, with the cuts, we're facing some hard times. So I hope we look at what we're doing here in Hanover to be inclusive of everyone. [00:27:17] Thank you. Is there anyone else who would like to address the board at Citizens' Time? Seeing none, Citizens' Time is now closed. Next on the agenda is Agenda Item 6, a presentation. [00:27:36] Senior Connections, Span Center, Ms. Angie Fallon, Chief Program Officer, Span Center. Welcome, ma'am. Hi. I appreciate the opportunity to be here today. [00:27:58] And again, I'm Angie Fallon, Chief Program Officer with the Span Center. And I have included with, sent to you some handouts that I think you have. One of the things we want to just place some emphasis on our name change. It's a big, big thing for us. [00:28:14] And we're getting used to being called the SPAN Center instead of Senior Connections. And also the second sheet has just a really high-level overview of some of the services that we provide. As you know, the SPAN Center is an area agency on aging. [00:28:34] And we cover Hanover, Powhatan, Goochland, Henrico, Richmond, Chesterfield, New Kent, and Charles City. And we offer a range of home and community-based services for older adults, caregivers, and persons with disability. Our funding comes heavily through federal, state, local. [00:28:53] We also write grants, and we accept donations. Today, I'd like to express our appreciation to Debbie Preston, Director of Community Resources for your county, for her service on the SPAN Center's Board of Directors. Also in your packet, the last two pages are some specific data as it relates to Hanover County that we wanted to share with you. [00:29:14] The first one being our last fiscal year, and we were able to reach 6,647 persons, and these were through in-person events or contacts that we made through our outreach efforts, providing one-way rides to our friendship cafe to promote socialization, physical activities, and fun. [00:29:41] We also have serving nutritious meals at almost 18,000 with our Friendship Cafe, which is located at the Mechanicsville Methodist Church, also our home-delivered meals program, and then some meals that we had delivered directly into the individual's homes. [00:30:03] Also offering support through our in-home and respite program at a little over 6,500 hours. We also have a care transition team that talks to older adults, caregivers, persons with disability, and helps connect them with resources and services that would benefit them. [00:30:24] In Hanover County, we also, last fiscal year, were able to work with five homes and make them safer for the residents that live there. So these are just a few of the things that we have done. And then I took the opportunity just to share you with our last quarter, which is on the last page, of what is happening currently, and we've reached over 1,147 persons. [00:30:50] And again, through the review of this, I think you get an idea of what some of our services are through our cafes and the promotion that we do with socialization, and then focused on nutrition and health and wellness. And we also offer some health and wellness education, and we've done that for 34 residents, caregivers and the importance of self-care and supporting them through offering respite through adult day and in-home services. [00:31:22] Emergency services fund could be like helping someone pay a rent or perhaps with their water money management program of helping individuals write their checks, balance their checkbook, and then a lot of volunteer time spent in different programming. [00:31:39] we appreciate the opportunity to work with hanover county and look forward to doing that in the years to come thank you well thank you for your presentation ma'am any questions or comments from board members supervisor dibble thank you mr chair um thank you so much for being here um i just had a question about the uh friendship cafes and i said we have one at in mechanicsville um Are we looking at expanding one to serve more of the other half? [00:32:14] We have talked about that, and we would like to do that, and we definitely will. We've got currently 20 Friendship Cafes that we have open throughout our localities, and we're in the process now of revisiting those and looking at attendance and the possibility of consolidation. [00:32:30] So that is something that we could look at and we have in the past to find. We'd be finding a location and then assuring the, you know, we've got attendance there for that. Or I might even suggest maybe, I don't know how often they are, one month being on one side of town, another month being the other, so we can hit without adding a totally new location until we can build it up. [00:32:58] Because I know there's a lot of interest in Western Hanover for this service, and I would love to be able to serve these people better. A lot of these folks still drive, but that's a long drive for a lot of our folks, you know, a 45-minute drive. [00:33:15] So just wanted to throw that out there and appreciate all that you do, and thank you again for being here. Thank you, and I will definitely take the suggestion forward. Supervisor Pritchard. Thank you, Mr. Chair. We still have our Friendship Cafe in Ashland, do we not? [00:33:34] I think so. I'm pretty sure we do as well. I know that I have been to visit that one, but it's been a little while, and that is a very valuable part of our community. [00:33:51] For those of us in the room who are a little bit older, we remember when Ms. Shelton went there until she was 107 years old, and I firmly believe that one of the reasons that she was able to continue to live on her own is that she took advantage of Friendship Cafe, and those connections were very, very important as they are to many people in our community. [00:34:12] So I thank you for that good work. We have another resident at another cafe that's 100 years old as well. And I'm like saying, could this be a press release? It's very active. Any other board members? [00:34:29] I have one question for our audience. If someone wanted to learn more about the SPAN Center, where would they go? Or what number would they call? They would call 804-343-3000 to get through the phone. And, of course, spancenter.org is another way to get that. [00:34:48] And certainly like us on Facebook and all that good stuff, too. Okay. Well, thank you very much. All right. Thank you. Thank you very much. Okay. Next on the agenda is another presentation, Airport Master Plan Update, Agenda Item 7, Mr. Chuck Sabrito, Airport Manager, Mr. John Bicalmot, Parish and Partners. [00:35:10] welcome gentlemen mr chairman members of the board my name is jock sabritto and i am your airport manager and with me is john mccalmont he is a principal and a primary on our from our airport consultant team and we kind of tag team this presentation a little bit for you and hopefully provide you with a pretty uh pretty brief update on where we're at with our airport master plan now i do recognize since we came to you guys in late 2023 that we've got some new faces so if you would indulge just a minute i'm going to back up just for a single slide and kind of recap [00:35:50] a little bit on uh on what exactly an airport master plan is there we go by the faa definition uh the airport master plan provides a framework to guide future development that will be cost effectively satisfy aviation demand while considering environmental associate economical impacts now that's a lot packed into that statement right there um i think i i kind of I prefer to say it's a good opportunity for a check-in, an opportunity to kind of make sure everybody's on the same page, the funding agencies, the county, the citizens. [00:36:25] And out of that, we come out with a host of graphic representations of what we plan to do in the future, what that build-out looks like. Our last – the FAA requires us to do this every 20 years, and our last update was 2002. [00:36:45] So since then, you guys are pretty familiar with the build out of the east side, the new terminal, some of the, you'll see a picture up there, the couple hangers that have been built, the additional hanger that we just recently started in on. And it's time really to have a checkup. [00:37:01] You know, have we, we still have some check boxes, but not everything's been completed, but it's a good, good time to check in and make sure we're still on the same page. Also for the bean counters, it's also an opportunity to create a good financial plan. [00:37:16] What does our CIP look like, you know, into the future? What type of grants would be available to get us through some of these processes? So with that said, I'm going to hand this over to John, who's going to help deliver some of the goodies. [00:37:37] Thank you, Chuck. As he said, we're here to kind of give you just a brief idea of kind of where we are and what's included in this master plan document that you're putting together for the airport. And we'll run through some things very quickly, but obviously there'll be time for questions if you have any that come up during this so what is what is going to be in the master plan it's going to try it's going to be a big document over 500 some pages plus a plan set and the whole intent of this is to have a document that integrates the growth needs of the airport with the community and and kind of pulling those things together making sure everybody's aware of what needs to be done and why it needs to be done so three general [00:38:16] components. One's going to be basically like an overview, just a summary, taking this massive document together and summarizing it into a short form that you can pick up and read, kind of like an executive summary. Then the big portion of it is the page, 500-some page document that's text and exhibits and charts and tables that's going to be the technical report aspect of it. So that's going to include all the meat and the justification to what is needed and what backs up the plan set, which is the airport layout plan, which is a series of plan sheets that describe the [00:38:54] airport and the proposed growth. So putting this document together, there are some sequential approvals that are required, as you can probably imagine. The FAA wants to see this document at various steps. So there are various phases that it needs to go through. The first being what they coined as working paper one. That's just kind of the phrase they use, and that takes into account the forecast. So they look at that, and they make sure that what we have prepared as what we think the needs of the airport are going to be over the 20-year period, they make sure they agree with that. So then once they agree with that, we move forward, and then it's step by step by step by [00:39:30] all the next of the phases that go. They sort of agree with it. They don't approve it. They approve the first step, but they agree with all the rest of the steps, and then when it's finished, They take the final document and adopt it, accept it. So that's our goal of what we're trying to get to with the concurrence of the funding agencies. [00:39:48] Now, the airport layout drawing, it's going to turn into where you're basically going to see everybody's causing the ALP. If you're in the airport speak, you hear airport layout plan. So that's the page that shows the growth and what's going to be proposed for the airport. [00:40:04] We're taking into account the hangars and the runway changes and taxiways and whatever needs to be on there or any specialty items. If there's like the additional parking or additional company that comes in that wants to develop a new business on the airport or taking into account electric aircraft, chargers, that kind of thing. [00:40:22] We want to have a place for all these things to go, basically. So what have we done? So, so far, we've gotten through the data collection aspect of it to where we've taken a look at all the existing facilities and the infrastructure that's on the airport. [00:40:40] We looked at the operations, what aircraft and what users are currently there today. You can see the little pie graph there kind of gets lighter as the aircraft get bigger. Okay, that's kind of how that is. So you can see, obviously, the majority of the uses of the airport are smaller aircraft. [00:40:58] There are a few little bit larger corporate-sized jets, but that's minimal. That's not a whole lot. So that kind of tells us what our base year is by size. And then the other charts are just a snip there of some of the various exhibits that are going into the report that describe the facilities that are on there. [00:41:15] So we take the base information and the existing conditions, and then we move into what I called previously the working paper one, which identifies the forecast. That's basically we take where are we today, and then we project out using these various forms of FAA guidance and tables and charts and algorithms to figure out where is the airport going to be in a 20-year period based on how things are operating today. [00:41:41] So you can see on the left side of that picture is the operations, and operations at an airport is any time an aircraft uses the runway to either takeoff or land. So takeoff is one operation. Landing is two. You always hope you have two, right? so the what we have today you can see there's basically a little less than 100 air 100 operations a day at the airport that's what we're experiencing over the next 20 years based on the data that's been presented you're looking at approximately 115 that's the growth so you can see that it's not [00:42:15] dramatic but that's that's what's being projected similarly you look at based aircraft so then you look at not only how many aircraft are there but what size of aircraft and what type of aircraft because that dictates how the development needs to be put together. So that chart over there shows you kind of a graphical format of types of aircraft, and you can see across the bottom that gives you a picture of what the types are, the corresponding colors with the little outlines. [00:42:43] Again, the largest being the single-engine piston aircraft. That's the biggest blue color there, and even have some helicopter operations, obviously. You can see those mainly the medical helicopters. So we take all that into account because that's going to help us identify how do we show this development and how does it need to be laid out on a piece of paper, so to speak, to identify how are we going to prepare the airport in a way that it can accommodate the anticipated growth that's coming because you've got to be ready for it. [00:43:13] you know that from any planning aspect so one thing we'll jump into that's unique about this one and unique about the hanover project in general is the the integration of the community involvement so it's not typical with airport master plans to include a separate group that's solely specific for community reaching information we we typically have what we consider an airport users group some call it a technical advisory committee it's that group of smaller group of people that have a technical understanding of the development that you're going to want to do so you take into [00:43:51] account their their expertise so they're a user they're a property owner they have some sort of knowledge about what's going to happen at the airport so that's the in this case airport users committee so that's always included but in this case we have also a community outreach group which is this the cog right there that you see so what that is is because of the the the desire to involve the community and the proposed development and what's happening here we wanted to understand how can we get the message out to the community and how can we receive the community's information [00:44:26] because it could be different there's different stakes different opinions out there so we have this special group that we've already met with twice as you can see on this chart here that it's members of all the involved communities they come together we talk about what's happened so far what we've learned what we're preparing for and we get their input on how can we present this to the community what are their questions how do you think they'll receive this information that way we can best show the document in a way that they can understand why we're showing what's being shown so it's kind of kind of like a filter if you will to make sure the message is is correct [00:45:06] in that sense so this this chart is is really just a schedule so to speak to show what meetings have been had so far there are a few key diamonds up there that we have received approval from faa for the forecast mentioned earlier as well as doav that's department of aviation in virginia so we've received those approvals by the end of late last year so now we're moving into the next step to take that information and prepare it all in a way that we can keep moving down the road and [00:45:38] start putting this document together in a sense. So what this helped us gain was we're hearing a lot of questions, right? So with the community involvement, that's been a really, really good thing that people have been able to present and submit their questions to whatever they're curious about is it just simple curiosity or is it a concern one way or the other so you know what is a master plan you get that all the time so we put that out on the website and by the way that qr code up there that'll take you to the the county's website where the master plan documents are saved [00:46:15] so they're housed up there and every presentation that's been made publicly and a lot of flyers and those documents are are on that page so people can always go back to it and click on where we are and how we got to what we got to and when the master plan gets finished it's going to be available also it's for it's for public consumption so it's not a private document by any means so again one we hear a lot is is there going to be commercial service are you going to have airlines coming into to hanover you know the numbers don't show it so that's not that's not anticipated so but we don't we don't want a lot of when you go through development at an airport people can get scared [00:46:54] and they think a lot of stuff is coming or you know screw up our nice little quiet community it's not necessarily the case we just need to be able to accommodate the growth that's already coming and accept new business that can come into the airport while still maintaining the the life that everybody kind of has so what's coming up next i'll throw it back over to chuck as he goes through if there's any lingering questions don't hesitate to ask so uh last slide here and uh you'll see right there with the orange line we're moving into a pretty busy springtime where we're [00:47:30] working towards our our first public information meeting which is identified by that star so early april we'd like to get together with the community outreach group which will help us prepare for this meeting this meeting is going to be done in a how do you say a open forum open house format but we'll have a lot of stations be six to eight in the evening and um we'll identify some of the primary uh objects or issues with our community outreach group that they want to see and make sure that we have that information available so uh this will be our first release of a lot [00:48:08] of the information that we put together our alternative our favorite alternative would be out lots of drawings and things like that and everybody of course is welcome to attend and encouraged to as we work through you see a bunch of the little slide there the gray slides yeah we have a lot of moving parts going on right now and it'll be a very heavy back and forth spring into the summer and we hope to achieve a final alternative towards the end of the summer in august is our time our shooting star so to speak and then of course we would be returning to the board for hopefully board approval and agency approval as the FAA and the DOAV. [00:48:47] So for the most part, that's it for now. You know, any questions or comments y'all like to make? Supervisor Pritchard. Thank you, Mr. Chair. Nine years ago when I inherited the airport committee because it's in my district, I had no idea what we did and I had no idea what I was going to do on this committee. [00:49:13] But I want to say this is one of the most efficient committees I've ever worked with. We have very little turnover because we have an incredibly dedicated airport committee, people who care about it intensely. And when Chuck came on board two years ago, are we at two years? [00:49:31] Three years ago. Three years. Things only continued to improve. We've been really happy to work with John. One thing that was so important to me about this master plan is that we handled it much like we did when we did our comprehensive plan, that we really talked to the community and got input from them so that this was not something that happened behind doors, but in fact the community would embrace the airport as part of the community and the airport would embrace the community as their neighbor as well. [00:50:02] And I couldn't be more pleased with how that's gone. And I'm very grateful to both of you for all the work, but also all the members of our airport committee. I would be remiss if I did not say that this week Ray Tyson, who was one of the original architects of our Hanover Airport, passed away. [00:50:25] And I know Ray was at the airport with us just a few months back when we did the plaque for those folks, and I know he'd be very proud of the work we're doing now. Thank you. Mr. Stoneman. [00:50:42] Thank you, Mr. Chair. Maybe I'm crazy, but a while back, I think y'all did a presentation at the airport about battery helicopters, EV helicopters. Is that correct? Yes. [00:50:57] It's electric aircraft. Yeah, electric. Yeah. So I guess how's that project coming along, and if that were to culminate, how does that factor in with the traffic that you see at the airport? it so we're in lease negotiations still with with the company right now so that it's moving along nicely I think and I think we brought it to the facility committee is yeah where you may as well so it's moving along what we it's it's unknown this new deck you know new technology right I think it's an excellent opportunity personally therefore the airport to dip their toe [00:51:35] into this they call it advanced air mobility and some exciting things could happen in reference to the master plan we will identify areas where this type of activity would be appropriate and you know from a land use perspective so that's how it would relate into the master plan yes so electric aircraft are here they're flying today the company we're working with is is almost uh officially certified you can say but they are operational so the airport is [00:52:08] working to have an electric aircraft charger on the airfield so it's not like it's similar to the car chargers that you see in some of the gas stations and hotels and whatnot but it's a little bit bigger um so but that is we're identifying a place on the the apron it's going to be kind of away from a lot of the operations so they can they can go over there and charge the the company we're working with they say it's about a 45 minute time frame to where if the aircraft is is basically empty or whatever you call an empty battery they go up there and you charge it 45 minutes it could be 100 so then they can take off they can last about two hours or so two and a half hours [00:52:47] so as far as integration with the existing operations it's a typical aircraft so right now what we're seeing there's a lot of they call them VTOLs so that's the ones that they vertical take off and then vertical landing but they still fly like an airplane so it kind of rotates when it gets up in the air. The one we're working with currently, that's a standard aircraft. So that's a standard. It's going to taxi out onto the runway, take off just like a normal single engine airplane, and then come back and land just like normal. So the others that are the VTOLs were at this point considering them kind of like a helicopter. So when the helicopters are still [00:53:25] supposed to operate on an airport similar to an airplane. So they still are supposed to come into the runway environment, get down to a hover position, and then they can hover to where they to go so as far as integration into operations it basically shouldn't have an impact on changing things thank you not too much any other questions or comments from board members seeing none thank you gentlemen thank you next on the agenda agenda item 8 presentation budget presentation related [00:54:03] to the proposed fiscal year 26 budget and capital improvements program fiscal year 2026 through fiscal year 2030 ms shelley wright budget director finance and management services welcome and thank you thank you mr chairman good afternoon mr chairman members of the board for the record my name is shelley wright i am the budget division director and today's presentation is a follow-up to mr podesky's budget presentation a few weeks ago today i'll be going over highlights of revenues [00:54:39] and expenditures and the capital improvements program and this presentation along with all of the presentations to date will be available online the fy26 general fund as was presented to you before is 413.1 million dollars this is up 6.9 percent from the current fiscal year local governments provide services so it is no surprise that the majority of our expenditures do fall into the personnel category that's represented here in blue for the county personnel as well as [00:55:18] Most of the contribution to the schools ultimately goes toward personnel as well. The school operating fund increased 8% in the FY26 budget. The majority of that increase is funding the merit increase, the teacher pay scale adjustment, and changes to health insurance. [00:55:35] Same information as you were presented by Dr. Pennykopf. In addition, $29.4 million is used for capital improvements to cover debt service on prior capital and commitments. A properly sized and properly equipped public safety team is essential to the health of our community, and at $111 million, this budget continues our strong investment in public safety. [00:56:02] Human services and direct aid to our most vulnerable citizens continues to be a focus of this budget as it is every year. This includes staff to provide needed mental health and social services assistance, as well as the board's continued proud support for our tax relief program for the elderly and disabled the fy26 general fund budget is expected to bring in 393.7 million dollars in ongoing revenue the steady increases are due primarily to market driven factors in the area of housing and favorable [00:56:38] interest rates that ongoing revenue does include revenue from state and federal government this makes up only 11 on average of the ongoing funding each year these intergovernmental revenues are generally targeted to specific programs and i'll show you a little bit more about that in a future former future slide real property personal property and sales tax these make up 84 of all local revenue we see revenue from real property continuing to increase but at a slower [00:57:12] pace than in recent years. The 2025 reassessment is 3.3 percent, whereas the past three years have ranged from closer to 7 to 11 percent. In personal property, the growth has been steady over the last few years. For FY26, we are expecting another moderate increase. And finally, sales tax annual growth has slowed to 3 to 4 percent compared to the 6 to 13 percent growth that we had been experiencing in the past five years. The shift in these major revenue sources to what I would call [00:57:44] a more normalized growth pattern was projected within our five-year plan. So while we talk about that they are slowing down from year to year, this was projected in our five-year planning process and has had no negative impact on our financial position. Here's an overview of where we receive state and federal aid. We receive $15 million for the state's share of PPTRA, or Personal Property Tax Relief Act. Per state code, this amount remains unchanged since the [00:58:22] inception of the no-car tax program. The Compensation Board provides funding to help support the county's five constitutional offices. This $7.6 million provides for only 14% of the total cost to run these offices. In Mr. Badesky's presentation and in the presentation by the schools, it was noted that state aid is not keeping pace with actual costs of some of their mandated programs, and that is true for the state's share of constitutional offices as well. [00:58:54] For example, while the comp board provides partial funding for 132 positions, the county supplements those salaries along with an additional 249 locally funded positions to meet the need of our citizens and the largest single category of state and federal funding is in human services this includes services to assist with mental health support for families in need senior transportation and many other services at 41 of the total state and federal aid this is the area [00:59:27] where intergovernmental funding has the most impact directly on our general fund impacts to federally funded programs are of particular concern recently so i wanted to give the board a very high level look at areas where hanover does rely on federal funding the fyi 26 budget assumes that school programs and the school nutrition fund will receive 13 and a half million dollars of combined federal funding the county expects to receive 5.2 million dollars to support residents in need of services including foster care support for substance use disorders and [01:00:06] transportation through our dash program among many of our other programs within the community Services Board and Social Services. There are also federally funded capital projects, including roadway and airport improvements. This takes us to the portion of the presentation focusing on investments in our capital improvements. Before we start to look at funding being allocated within our new or expanded projects, I think it's helpful to recap some of the projects that we have that are already underway. This slide shows examples of existing [01:00:42] projects that are currently funded therefore they are not in the fy 26 to fy 30 budget document we have over 120 million dollars already in currently budgeted roadway projects there are three fire and ems stations ongoing and of course the broadband initiative which has been receiving updates many times in in front of this board schools also have a lot going on with three elementary schools funded and underway roadway improvements is always a large component of our cip on the left i've outlined the projects that are in the five-year capital improvements program [01:01:20] and on the right we see funding sources the cvta or central virginia transportation authority is the entity that receives all the sales and fuel taxes set aside for transportation funding in the region then disperses them to the localities that funding source covers 56 percent of the cost of our roadway improvement initiatives looking now at park improvements in the upcoming fiscal year we have a strong investment in parking improvements to improve safety for our residents that visit our parks throughout the plan we have investments across the county and additional and improved [01:01:58] restroom facilities pickleball courts field enhancements and playgrounds these initiatives are all part of a larger plan to focus on amenities and tourism opportunities after years of planning the public safety building has made its way to the first year of the cip this building will serve as a public safety hub and will enhance our ability to collaborate train recruit and retain the best of the best we saw on an earlier slide that laurel meadow doswell and montpelier are already funded and being designed as fire stations this cip plans [01:02:35] to add station number 10 chickahominy to that list of station replacements rounding out this list we have annual investments in our public safety vehicles and equipment as well as some upgraded technology set aside for the sheriff's firing range dr penny cuff and mrs stone covered the school projects in their presentation so this is just a recap and reminder of those capital investments that are included in this budget the highlights of course are the two planned school replacements and the year one expansion of the Hanover Center for trades and technology other projects of note [01:03:14] include the final phase of renovations at the Wickham building here on this campus we will also be rebuilding a wall of the Mechanicsville convenience center to mitigate impacts from soil settlement over the years and thereby extending the life of that very highly used facility. We have funding set aside to study the potential uses of the former cannery building and the county looks forward to providing or bringing in citizen feedback into that planning process. And finally the public safety building will provide an opportunity to renovate the Vaughn Bradley building once the sheriff's office [01:03:49] operations have moved to their new facility. And the last projects in today's overview are with regard to the airport capital improvements the east side taxiway parallel is the largest project by far and design and construction being planned for fy 29 and fy 30 in this plan the west side taxiway rehabilitation is appropriated in fy 26 and 27 and then tying back into our look at federal funding 84 or nearly 18 million dollars of the anticipated revenue for these projects would be [01:04:23] from federal sources um mr budeski and his comments reminded you of the budget timeline so again we will plan for a budget work session and a discussion of potential amendments on the 26th of march with public hearings and budget adoption to follow in april those are all my prepared remarks and i'm happy to take any questions mr chairman any questions or comments from board members for Shelly Wright seeing none thank you very much for your [01:04:59] presentation ma'am thank you I do have a question for mr. Badesky this mr. Badesky do you think this is a good time for a discussion to see if board members would like to schedule or maintain the budget work session for the afternoon of March 26th thank you mr. chair we certainly should entertain that conversation uh we do have representatives from the schools here today i know there's been some discussion uh as the plan introduces and recognize the first campus school is identified as [01:05:36] mechanicsville elementary um i and we've added an additional campus school into the plan um there's also been some question uh regarding projects that didn't make it into the plan for instance potentially a high school middle school campus um we're here today to answer those questions and are prepared as soon as today um but we're also prepared to to come back on the 26th and uh either in more of a workshop format um we just want to know what we need to be prepared for uh for those conversations uh so whatever the board's prerogative is mr chair we can we can begin that [01:06:15] today or entertain that on the 26th well thank you mr bedesky what i'd like to do is open it up board members to see where each board member is on the issue on rescheduling potentially bringing up an issue today we don't have a lot of time to get into the in-depth conversation or study today supervisor Floyd thank you mr. chair I think it's a good idea to have the workshop on on the 26th my questions I know we don't have a lot of time today but how was it determined the order of [01:06:54] the next set of schools to be replaced I understand that Mechanicsville has been identified but I didn't hear any discussion before it was identified on how that happened and if we're sure that it needs done this soon or in this order so I think I would be in favor of having a workshop on the 26th thank you Supervisor Pritchard I hate to say it boils down to what she said but it boils down to pretty much what she said I would like the workshop on the 26 and I need to just understand how we came to the timeline a little better [01:07:32] Supervisor Dibble yeah I concur with other board members I think I need some time to sort of digest everything that we've been given and to come up with some questions and a couple areas that I need some clarification on so I would to appreciate that time on the 26th to have a especially just a work session format where we can bounce ideas and thoughts off of each other. Thank you ma'am. Anyone else? Mr. Hudson? Just a [01:08:10] comment. Perhaps if any I would just throw it out there to any of my colleagues that if you would like to tour Mechanicsville Elementary School other than the canned tour that we get I would definitely encourage you to do that because I think that it certainly gives a lot of insight particularly into restroom facilities at that school. Thank you Mr. Chair. Mr. Stoneman anything? [01:08:46] Okay well welcome Mr. Davis we'll we're looking forward to you getting settled in sir. I will also support the work session on March the 26th. I do have some questions. One of the concerns and I stated this previously, is that the boundary adjustment process has become much more than I originally thought it was. I thought it was affecting the area with the overcrowded school. [01:09:14] I have since learned that it affects all the way over to Cold Harbor Elementary and in the Battlefield Park. I have a copy here of the consultant data that shows capacity at Cold Harbor Elementary at 754. My understanding is the enrollment is approximately 500. I don't know the exact number. I'm not trying to be a know-it-all, but the thought that 250 more students can fit in that school and be educated, I cannot comprehend that. I don't think it's possible. So I've [01:09:52] requested from Mr. Eikenberry an opportunity to meet with him and someone from the school division to review some of the capacity numbers that I have seen. And I think it ties in to the boundary adjustment, also ties into the school budgets, because we're looking at replacing schools. [01:10:19] And one of the things I've learned is, oh, some students may not be redistricted until Washington Henry is built. And what effect is the new size of the Battlefield Park Elementary, $45 million, What effect is that going to have on the boundary adjustment and what happens if from what I see in the green plan? [01:10:45] We've got a hundred and forty some students being moved through one elementary school, which is nowhere near the overcrowded School issue for an elementary school. So this is a lot to figure out and you know 45 million dollars per school is a significant number and I have to understand that and be able to explain that to citizens and parents who may have their kids redistricted. Because when that happens, most of them are not following this [01:11:19] process in Cold Harbor. They don't know. Maybe they should, but most of them are not following the process. And if I don't have a good understanding and represent them now when their kids are moved, I know what's going to happen. It's going to be right here. The Board supervisors did this the school board did this so if i get those calls i want to be able to explain it beginning with 754 capacity at cold harbor elementary so i'll be supporting the work session [01:11:53] on march of 26th mr davis i would support the work session sir okay so we have an overwhelming number for that mr budeski do you have your directive for the work session i believe so just to confirm it sounds like there will be a focus on school capital planning and projects uh and certainly in relationship to some of the boundary line work so i superintendents here today and her team with miss stone i certainly would ask that they be prepared to join us then um also would ask are there any other functional areas you'd like us to have subject matter experts available [01:12:28] for that day in particular that i can be certain to have everyone here to address the board's concerns. Mr. Badesky, the areas that you just identified are the areas that I see the need for. Thank you. Any other comments from board members? Just a point of clarification, Mr. Chair. I'm not at all opposed to the budget. It's been on my calendar for four months now. Okay, we have a, we are going to keep the calendar for March of 26, 2 p.m. session for the purpose of discussing [01:13:06] the budget. Thank you very much again, Ms. Wright, for your presentation. Okay. Next on the agenda, Agenda Item 9, a presentation, Payment Arrangement Policy and Agreement, Department of Public Utilities. [01:13:21] Mr. Longshore, welcome, sir. [01:13:34] Sorry about that. Let me see if I can get this position right. [01:13:52] So happy to present to you all in the public this afternoon our department's new Payment Arrangement Policy and Agreement that has recently made its way through the Finance Committee after a few iterations and recently received support from the Finance Committee. [01:14:10] So just to give you all a background of what this really stems from, payment arrangements in the water and wastewater industry in general really started during the COVID-19 pandemic. And if you guys may remember, just a few years ago during the pandemic, there was a statewide moratorium on utility disconnections for non-payment. [01:14:32] And those were for all residential customers throughout the states. As a consequence of that, age receivables and the amount of customers with delinquent account balances really increased for a lot of utility providers throughout the state. [01:14:48] And so to react to that, the state then essentially required that all utility providers allow payment arrangements with all customers. And so that's really where it started. [01:15:06] Payment arrangements are still encouraged in state code today. So you can see in the state code, they strongly encourage payment arrangements as well as bill payment assistance options, or at least for customer service to get information to customers about bill payment assistance options. So what we found is that payment arrangements are actually a really effective tool to prevent disconnections of customers. However, we're at a point in the process where we're really trying to formalize the process to make sure it's consistent and fair and equitable to all customers. So we crafted this policy and what it does just highlights of [01:15:46] the policy is that it formalizes the payment arrangement process. It outlines specific eligibility criteria and that includes that payment arrangements are only for residential and currently active accounts. It requires an initial payment of 20% of the total account balance for a customer, or it gives the customer the option for that initial payment to be the monthly payment amount. So it gives the customer a little bit of flexibility there. 20% as an initial payment will obviously bring down the monthly payment amount, but it does give the flexibility depending on what the customer can afford to enter into a payment arrangement. So [01:16:25] it also caps the maximum term of a payment arrangement to 12 months. However, there is language in the policy that longer terms can be given to a customer for extenuating circumstances. Those circumstances could be an excessive account balance that a customer may need a longer term to get that monthly payment down to make sure they can continue to make that monthly payment as well as their current utility bills. Other circumstances may include a recent health condition or recent unemployment, things like that. So we'll certainly take that into account on a customer by customer [01:17:05] basis. So another thing with the policy is that it requires a signed agreement and it requires the customer to read through the agreement and understand the terms and conditions of a payment arrangements. In turn, the county will also sign their end of the agreement and return that agreement to the customer. So it also includes language at the end of the policy that customers are unable to meet any financial conditions of the policy for whatever reason no matter what the number is or would be it directs our customer service staff to provide third-party payment [01:17:42] assistance options to the customer and if the customer decides to seek third-party payment assistance we will give that customer up to a one-week grace period for disconnection to make sure they have time to go through that process with a third-party provider so as part of the agreement you can see in front of you we won't go word from word word for word through it but there's a lot of highlights to the agreement and so there's a lot of good information in there and it really lets the customer know what they're entering into and what's expected of the customer [01:18:17] and the county as they enter into a payment arrangement some highlights of the agreement is that it outlines the eligibility requirements again to the customer it requires a signature both from the customer and the county. Once both parties have signed the agreement, we'll return a signed copy to the customer as well as a tangible payment schedule that they'll have that shows the monthly amount owed and when it's owed. It also requires the customer to pay their current bills and keep their account current from the time the payment arrangements entered [01:18:51] on. Again, it includes the monthly payment schedule for the customer and it defines default to the customer so they know exactly what they're entering into. It also provides consistency when making these arrangements across the board. And that's really what we're trying to get to with this policy and this agreement to make sure that all customers that call in, no matter where they are with their account, they're provided a consistent option as any other customer in their situation. So to make sure this agreement, this policy is accessible to all customers, we're developing an electronic version of customers that may be at the point their account [01:19:31] where they're they're nearing disconnection time is of the essence and we want to make sure we're able to get this agreement in front of them as soon as we can so they can start reviewing it so we are developing that as we speak and we'll make sure that's available to customers soon also one thing to note the attorney's offices has already reviewed and approved the payment arrangement agreement and policy as has the finance committee that's kind of where we stand i'll be happy to take any questions about that thank you very much sir for your presentation [01:20:08] any questions or comments from board members supervisor dibble i just wanted to um thank mr longshore and his staff on behalf of the finance committee for working with us and for hearing us and um i guess uh bringing us a policy that i believe is is fair for everyone and most importantly this will allow us to show grace to our constituents that are the most vulnerable so um thank you for that and thank you uh for your work over the past couple of months [01:20:47] with that i would be ready to make a motion if you're ready sir i have a motion on this oh sorry uh mr chairman i think this is was on for a presentation i think the finance committee and certainly that the chair of the finance committee correct me if i'm wrong is that the thought was to have this presentation given to the full board so that not only all board members were aware of it but also those in the audience as well as those watching online uh would be aware of of this uh this new policy uh and would be able to avail themselves of it if they felt it was appropriate but no motion is needed to approve this policy i understand sir thank you very much [01:21:26] any other questions or comments from any other board members seeing none i have one very simple short comment yes sir i like the phrase consistent policy absolutely and this looks like a policy that that you can tell anyone that calls you this is the policy yes sir it's not special for one person over another and i like that so thank you very much for your presentation yes sir absolutely appreciate it okay it is now 3 21 we will take a recess until 3 30 p.m 3 30 we are in [01:22:01] recess okay it is 3 30 the board is now back in session we will next take up the agenda item that [01:31:10] was removed from the consent agenda which is a request for adoption of resolution any board member would like to open us up with comment continue our discussion from earlier Supervisor Dibble sure we had a motion on the floor to add our assistant one of our assistant County managers to the team that does the review in that [01:31:50] process that was mapped out in the resolution and my only comment was if it pleases the board to have Dr. Brown or whoever is in his position on that team that there's no need for both that individual and the finance director we roll ourselves out as fiscal conservatives and it seems like a bit of an overkill to have all those people making such a small decision so I would just say whatever direction the board wants to go keep it as is I'm fine with [01:32:26] it dr. Brown was fine with it at the Finance Committee but I don't think we need both of them just one of them would be my only comment any other comments from board members mr. Davis thank you mr. chairman mr. chairman I had the pleasure to speak with mr. devotion this morning he called me last night and I was unable to get the call I was in a meeting and then today I spoke with you with him for 51 minutes uh this morning so thank you it was very very productive conversation and actually as a little background uh i'd had a conversation maybe two or three weeks ago mr [01:33:06] treasurer uh with you on a friday afternoon and worked through some things um and this actually came up and he asked about it um and i want to be clear i did ask him if he had a problem with with that and he said no so i think for me that settles the issue one of the things that we talked about because there were a lot of conversations that were going on uh and people were being uh informed some sometimes inaccurately sometimes maybe somewhat accurately about different conversations that different board members had had about different things uh and as we worked through it and realized that there were agreed upon facts i think there was mutual understanding [01:33:43] that some of the things that have been communicated to the treasurer were absolutely inaccurate one of which was uh that somehow or another this was an oversight necessarily not necessarily of his department but uh of of his entire division when i informed uh mr botian that uh we don't have committees that don't have staff resources on them particularly at the county administration that's who the board works with on a regular basis and i can see where there would be a time if uh the deputy county administrator over finance could have a designee there but section 58.1 [01:34:20] specifically 18 and 30, talk about tax and tax relief and those types of things. The board has a very defined role. The treasurer has a very defined role. We have responsibilities that we have in the tax code that we must meet. [01:34:37] And I do want to give a commendation to the treasurer, and we've got to be open. We've not been asked to do this in the past, not until we got a new treasurer. And there is a state requirement for that. So I want to be clear, as uncomfortable as it is, we were never approached by the former treasurer to work on this policy as defined by state code. [01:35:04] And so I don't know how things operated in the past, but I do believe there's accommodation for Mr. Boshan for recognizing that deficiency within his agency and bringing it to the board. So the only thing I asked him is, is there an issue with this? [01:35:21] because we don't have committees that don't have someone from the executive level of administration assigned to it on every committee that we have. And since Dr. Brown was with the Finance Committee and he's the designated representative, I thought that there would be some consistency. [01:35:38] Comma, I didn't want this to be the only committee out there that could be advising the board on policy, which the board is solely responsible for setting within the authority under the state code, that had a departure from consistently having an organizational structure that would have bothered me so that came up during the leadership meeting on monday morning and i assumed dr brown was on there even though i was at the finance committee i do know that miss noel was named or her position was named and so when i asked the treasurer if he had a problem with he said no so i'm willing to support uh having uh the title of the position of dr uh that dr brown holds as the deputy county [01:36:17] administrator over financing those matters mr. treasurer thank you for taking your time uh to reach out last night uh and then have a long conversation with me this morning i think it was productive and thank you for bringing this matter to the board it's more than appropriate thank you any other comments from board members on the resolution yeah i just wanted to piggyback on what mr davis said i think we're sort of saying the same thing i'm just saying i agree that possibly dr brown would probably be a better person on this particular group uh i just don't think we need him in addition to the finance director that would be my [01:36:57] only thing i'd say i would support the resolution if we just switch that from finance director to um whatever dr brown's title is i don't think we need that many people any other comments from board members mr chair supervisor pritchard i i can also be good with that compromise as long as dr. Brown's there I'm good with just one not to or for the record mr. chair if I may or the position that dr. Brown currently holds yeah we have a lot of [01:37:36] trusty confidence of dr. Brown yes I wanted to be clear in my comments to you thank you for letting me clarify for myself mr. chair I'm not clear on I'm sorry supervisor Pritchard I'm not clear on your position could you please restate it sure my position is it is fine with me if we only have right now I think the argument is do we have the finance director and the deputy county administrator or do we have do we have one I'm fine with it only being one as long as that position is the deputy county administrator okay so I'm going [01:38:15] to rephrase that in my so I understand it because we're gonna have to make a motion okay and so you're saying that you would support a revised resolution that shows the deputy county administrator and the county attorney to work with the treasurer is that correct strike director of finance okay from the amended okay any other comments okay so the chair will entertain a motion to revise the resolution for the board to authorize a deputy county administrator [01:38:52] and the county attorney. Supervisor Dibble. Yes, thank you, Mr. Chair. I would like to make a motion that we amend the amended resolution striking county finance director from this document and that we retain the amendment of the addition of the deputy county administrator for administrative surfaces the second there is a motion there is also a second from Supervisor [01:39:27] Florida all in favor please indicate by saying aye aye any opposed resolution passes okay next on the agenda is agenda item 10 a presentation requesting approval by the Board of Supervisors to compromise and settlement of a tax claim mr. Tim motion welcome our treasurer thank you sir and good afternoon members the board uh thank you for um our previous approval and um let me bring us up to date [01:40:02] on the matter at hand we have a um as the chairman's dead i'm tim boshan treasurer for the county and i am requesting consent of the hanover county um if i am requesting consent of the hanover county board of supervisors to compromise pursuant to section 58-13994 of the code of virginia interest associated with delinquent personal property taxes on three vehicles dated back to 2006. [01:40:34] The total amount of the taxes is $4,597.55 plus 10% interest from 11/13/2006. The Treasurer's Office sought to recover a portion of those taxes through a bankruptcy claim, which you all have copies of in your packet, in the amount of 2008/11/52. [01:40:56] the accurate calculation of any interest on the amount due and owing appear under the specific facts of this matter to be questionable because of we no longer have record of that which i'll go over in a minute in our system so the taxpayer reached out to us on january 21st of requesting satisfaction of the judgment and the mistaken belief that it had been discharged in his bankruptcy so again the customer thought that this was paid in his bankruptcy and it wasn't until [01:41:32] january of 2025 where he realized that there was a judgment that we had and he came to find out why it was there and assumed it was air air office the treasurer's office has been unable to locate records relating to the judgment or payments in the bankruptcy in regards to delinquent personal property taxes for those years 2003 to 2005 the circuit clerk court clerk's office was able to provide the abstract of judgment dated 11 13 2006 as well as the proof of claim dated april [01:42:08] 15 2008 the taxpayer in good faith has already made a payment of 178603 this represents the original debt of 495755 less the amount filed in the bankruptcy claim of 2008 1152 with no interest charged in light of the bankruptcy filed on a portion of the taxes for which for which the treasurer's office has been awarded judgment it is difficult to accurately determine the remaining outstanding balance of the debt or to fairly estimate interest charges both from a factual [01:42:47] and an equitable perspective so my office myself in in consultation with the county's legal uh council recommended uh recommending that the county compromise and settle this matter for the amount of 1786.03 and not the interest over the course of the past 19 years we also do not have a specific timeline on when the last payment was made to that account. So we would also have a challenging time determining how to calculate that amount of interest going forward as well. So it would be [01:43:24] difficult to do that, as I mentioned. So that's why the legal counsel and myself came up with this amount of $1,008,786. So that is what I'm bringing before you today. Do you have any questions about anything that um is in in this item and one other thing i'll mention the the judgment is good for 20 years so um if he waited one more year he could pay us nothing so okay any comments or questions from board members mr chairman mr davis thank you sir uh respectfully mr treasurer would you go back [01:44:01] to the slide that says background yes so in my conversation with the treasurer today i based on on the information I got in the board packet and conversations with legal counsel, I was starting to formulate an opinion. I believe that may have changed today after I had an in-depth conversation with the treasurer. Point number two to me is very important. [01:44:30] So the treasurer and I kind of agreed on the phone, not to put words in your mouth, that the point from the bankruptcy forward is really where we come in. We didn't have anything to do with the bankruptcy. It was a different function of government, a different role. That was the judicial branch. And so the taxpayer came in, they paid. Now, it's up to them to pay their full amount, but it was erroneous, no issue. The problem that I have is that the government failed to maintain the records relating to the judgment of the payments and the bankruptcy in [01:45:06] regard to the delinquent personal property taxes. So we have faltered there. And for the record, I know this happened prior to you being a, you're not going to be able to say that, but for so long, Mr. Bosia, but on this one, you can. And so when the gentleman walks in, you see, which I'm looking at this, that also meant that because sufficient records weren't kept, I'm asking this, but I'm asking as a statement, which means that that didn't hit, didn't necessarily hit your ledger as a delinquent tax that you could take enforceable action on. [01:45:42] That's correct. Right. So it's not there. Mr. Boshan comes into office. The taxpayer walks in, go to locate the records. The standard of responsibility for the government was not met, in my opinion. [01:45:58] The person thought they paid it. They were wrong. And so I asked Mr. Boshan today, I said, well, couldn't you just take out a calculator and add it up? And he said, that would be a possibility, not putting words in my mouth, if we actually knew and we had the records. [01:46:15] Not having the records causes me, and that's the government's obligation, it's the taxpayer's obligation to pay those taxes, but not having the records to accurately tell somebody what they owe is a failure on the government side. [01:46:32] And so if it was $1 or it was $1,000, I can't figure that out. And that's an error. Sometimes you pay for your errors and the responsibilities on the government to be right. And so point number two causes me great concern. [01:46:49] If we cannot fairly and equitably assess those late fees, then I believe my position has to be to support the compromise. Those are my comments. And thank you again for your input today, Mr. Treasurer. [01:47:04] Absolutely. Thank you, Mr. Chairman. Any other questions or comments from board members? Supervisor Dibble. I just had one quick question. I'm just wondering what the best practice rules are with regard to record retention. [01:47:21] What are your treasurer best practice, or are there any? Good question. We have everything stored electronically now. So anything like that, we've got it, and we follow the Library of Virginia retention policies as far as retention schedule, I should say, on how long we retain records. [01:47:44] So that should not be an issue going forward, the way we are retaining records in an electronic format. So it's good to know we've somewhat fixed that issue from, we'll prevent it from ever happening again. So thank you for that, sir. [01:48:01] Any other questions from board members? I just have a couple, sir. Thank you very much for being here today. The 1,786, that payment has been made. Is that correct? Yes, sir. um, he, uh, once, uh, he knew that we were in conversation and working on trying to come up with an amount. Um, he wanted to at least pay the, in essence, the principal amount owed on it. And, um, so he did make that payment in January and that payment has been, uh, deposited or the check has been cast. Yes, sir. And that was done, uh, the end of January. So it's been, uh, it's been [01:48:38] a while now. Okay. So he's just waiting for error approval on this so that our attorney can then release the judgment i understand sir so one concern i have is other taxpayers may be laid on payments here or there and they get charged interest or late payment fees yes and so i don't want to get you know just from my perspective we don't deal with this um i don't want to get into a pattern where we just release one person but not all the others and so that's that's the that's a background for my question, just so you understand other taxpayers who may be charged [01:49:14] interest. How many other cases do you think could, that you're aware of? I'm not aware of any that fit this particular scenario and situation. Okay. So as of right now, this moment, you're not aware of any other? Yes, sir. Okay. And would you say this is a highly unusual case? Very, very highly unusual okay and how many taxpayers do you think we have in the county right now roughly accounts how many accounts yes probably 50 000. okay so would it be accurate to say this is a one in 50 000 situation yes sir okay sir that's all the questions i have okay thank you very much anyone [01:49:54] else okay so we will need a motion motion to authorize the treasurer anyone willing to make the motion sure happy to okay mr hudson mr chair make a motion to authorize the treasurer to satisfy a 2006 tax claim by compromising and settling the claim for one thousand seven hundred eighty six dollars three cents pursuant to the virginia code five eight dot one dash three nine nine four second there is a motion and a second any comments from board members all in favor of approvals please indicate by saying aye aye any opposed none you have it sir thank you i appreciate it [01:50:33] everyone okay next on the agenda agenda item 11 is announcements any board member or county administrative with announcements mr.
