I will begin by recognizing Sheriff Dave Hines. He's here with us today. Thank you sir for being with us and also Chief Anderson. Thank you for being with us sir. [00:07:08] Monday, Mr. Badesky and I, we met with Governor Youngkin at the Patrick Henry building. We also met with officials from the city of Richmond, Henrico County, and Chesterfield for the purpose of discussing strategy to improve the regional public water system. [00:07:28] The first goal in my mind when we are looking to improve the public water system is to improve confidence. And that was a word that Governor Youngkin used that I supported. And what I've seen since the water crisis is we have citizens who have lost some confidence. [00:07:47] So we're going to be working and discussing and planning and strategizing by beginning to improve the confidence of our residents in our public water system. I will say that our partners and our regional partners from the city, Chesterfield, Henrico, and Governor Youngkin, as well as myself and Mr. Badescu, we were all united in a spirit of collaboration to work together to build more confidence with our citizens and to make the public water system better. [00:08:21] We are dependent on it. We need it. Nothing's going to change overnight. So the best strategy is to start working on what we have and what we've had since the mid-1990s and making it better and more efficient. We have additional meetings planned. [00:08:40] This is not to create a big fanfare or posturing. This is about work, and it's working on a collaborative level with our regional partners to make improvements to bring stability and confidence to our residents. [00:08:58] This is a board initiative for 2025, and we're going to keep working on it until we see these improvements and this confidence restored. Any other comments from board members? Seeing none, Mr. Badeski. [00:09:14] Thank you, Mr. Chair. just to piggyback on your your comments on the meeting with the region and I don't say this because my evaluations today the chair represented this board in this community very well in that meeting we were able to I think that the benefits not only did it make sure that we were working in tandem with our regional partners it also allowed us to really focus on the urgency of this need and expedite this process and so I think we're going you're going to see that work continue not only at the elected official level but certainly at the the director level [00:09:53] and administrator level so we'll keep that work moving today Matt will also be presenting on some of the issues that were unrelated to to the early outages and challenges we had with the city that were local challenges. And so at the end of my comments today, Mr. Longshore will augment that conversation with some facts as it related to both last Friday's incident in the courthouse area and last Friday into Saturday's incident that impacted the Dawesville area and largely King's Dominion. I do want to welcome my newest deputy county administrator, Brett Chardain's here [00:10:30] with us today. Brett, welcome. I told him to keep his speech to under 30 minutes here today. And so I wanted to welcome Brett. Believe it or not, he has to go back to Powhatan today for his going away party. So he will be with us for a short period of time. But Brett, we're extremely excited to have you on the team and welcome. [00:10:51] You know, this opportunity when we were growing our family, we looked all around the region and decided to settle in Hanover about 12 or 13 years ago and had just a incredible quality of life that the county has afforded us growing here. So now excited to be part of the team and the community that makes some of those things happen. [00:11:09] And so, again, thank you to the county administrator and the board of supervisors for that opportunity and excited to officially be part of the team. Thank you. Mr. Chairman. Mr. Davis. Mr. Chairman, I just want to say, Mr. Dardine, it's great to have you on board. I've had an opportunity to work with you in other areas throughout the region, obviously up in Powhatan. [00:11:27] And you've done a fantastic job. Your reputation precedes you. And I, for one, was very happy when the county administrator called and talked about the finalists and your name was in there. So thank you for that. hope you enjoy your your time and power to you you gotta take pto you're with us now so if you go back you're taking that but uh please send our best to those folks out there but really really glad to have you on the team uh you enjoy a very good reputation and we're excited to have you thank you so much thank you sir i'd also like to recognize miss lauren knoll i believe this is her [00:12:02] very first meeting formally as our our finance director so lauren congratulations to you uh you've obviously served us well in an interim capacity we have full confidence moving forward so thank you for all you do for us um do want to recognize uh just a couple of events that have occurred and some things that are coming up um but none less important than everyone that's in this room just walked in from some pretty severe heat and that's obviously impacting our region and community just want to remind members of our community that all of our public libraries [00:12:36] are open as cooling stations and so if you know someone that may have less access to some of the public information or or that's you're living through challenging times right now without AC please help share this message help them know what options are available to them and if there's anything else we can do please let us know but we know it's going to be a tough time and anticipated through this week at least also we're really proud recently to celebrate with our animal protection [00:13:08] division, a generous donation from our community from the late Phyllis and Albert Bishop, long-term residents, animal lovers, very passionate about animal adoption. They made a $25,000 donation that allowed us to enhance our adoption areas. I encourage anyone just to stop by and take a look and also please take home a pet with you. We did not have socialization rooms available for the public prior to this that we were very constrained really the socialization was the [00:13:45] outdoor animal runs and now for both cats and dogs there are private rooms that socialization could be done we also were able to enhance the efforts that we do when we do community adoptions and events due to their donations and while through with in addition to that we've just recently redone all of our kennels, some HVAC drainage. It's made a major change for both the staff and animals in our care and just those kinds of things. It's really heartening when we see members of our community step up and be part of that solution. So really want to thank the Bishop [00:14:22] family and their daughters for representing them there at that event. Not long ago I had to share with this board that the members of fire station six had to be awakened due to a red mustang that was in the side of that building once I realized it wasn't my red mustang we really I have to just first commend the staff of that building just minutes prior some of our staff were in their bunks and you know someone was looking over that team that day but they not only did they [00:15:01] made sure everyone was safe there they immediately provided care and and that that young driver is doing well he and his mother came back to visit the folks at the station but I also want to commend our safety team our general services team certainly the members of fire and EMS all for coming together we've been able to put that station back into operation and not have to displace the members of that crew and that made a big difference for the community and just wanted to thank everyone [00:15:36] for coming together and certainly glad that that young man is doing well. I do want to remind everybody that coming up on July 12th and 13th that Polgreen Park is our tomato festival and if you recall we've changed this event a little bit more while both nights are family friendly. [00:15:57] Friday night is a little more adult oriented. Our vendors will be there both Friday and Saturday with bands and music and events. And Aaron tells me it's the biggest and best ever this year, right? And so we're excited. Last year, we were a little wet. [00:16:14] Well, we hope we're not in the heat wave. Hope for great weather and a great family-friendly event and look forward to seeing everybody at the Tomato Fest. And the last announcement that I have, I just wanted to recognize that our Pamunkey jail superintendent just retired, James Willett, and there's a proclamation for his acknowledgement of his service, but he has faithfully served this community extremely well in the regional jail system. [00:16:48] I know a number of folks got a chance to say goodbye to him. We may or may not be able to get him back here for a proclamation. He's not a person that looks for pats on the back. He just valued the opportunity to serve and did some great work, and we wish him and his family well. [00:17:03] You may know that his wife was also a warden at another jail, and they're both now enjoying retirement together. So career public servants and just wish them extremely well. Last I have today, Mr. Chair, and I would ask that the board, if you're comfortable, one of the things we pride ourselves on is the value of public service. [00:17:23] and starting that public service as early as possible. We have grown our focus on supporting interns as a county and will continue to develop that program. Both this month and next month, we will have the opportunity to celebrate the intern service of those that were working with us this summer. [00:17:43] And today we have two of our interns here today. Cole Hayes, who's been working with us with our finance department, and Jackson Malanke's been working with communications locations and community engagement i'm proud to have them with us they're they're both from all accounts giving great service to us i hope you're getting as much from us as we're getting from you and really wanted to show you our appreciation for your service and would ask that you come up and and join the board i will not ask you to give a speech but if the board wouldn't mind if you'd come down and join us for a photo with our interns we'll [00:18:21] do the same again with those in january entire board if you don't mind yeah thank you board for [00:20:25] that opportunity and thanks to our interns look forward to seeing others in in july and tiffany thank you for all your work you do to coordinate this program it's bigger and better each year so thank you um mr longshore i ask that you come up and give us an update on the recent water events all right thank you mr burdesky mr chair members of the board matt longshore director of public utilities. So I appreciate you all having me here today to give a brief update [00:21:00] of the operational events that happened this past weekend. First, I'd like to start out with the timeline of the incident that happened here in the courthouse system last Friday, which really started due to severe weather on Thursday evening, Thursday afternoon. Due to that severe weather, the courthouse area public well system lost the primary service at around 5 13 pm that evening and so when it lost that primary service it automatically switched over to our backup generator which kept it running under normal operating conditions until about 3 30 friday [00:21:39] afternoon so what happened at 3 30 friday afternoon is we experienced a generator failure on that system when we experienced that the operation staff quickly mobilized out to the well site for the courthouse system here to troubleshoot the generator issue once they realized it was a voltage regulator that went out on that generator and i will add that generator is only three years old it was replaced a few years ago unfortunately it had a failure of a voltage regulator once our operation staff identified that they were able to mobilize another generator out [00:22:17] to the site our electricians got that connected and got that system back operational at 5 45 friday evening the primary power service was restored by dominion just after eight o'clock that evening out of an abundance of precaution we decided to conduct some bacteriological sampling throughout the weekend here in the courthouse area both of those samples passed through the weekend But knowing that that incident happened just prior to what happened in Doswell Friday night, we do understand there could have been some confusion, especially with some of the notices [00:22:54] that went out that the two incidents could have been related. So I wanted to put up a map for everyone to see of where these systems are located geographically. You can see circled in red is the courthouse well system right there off 301 just south of the Caroline County line. Everything shaded on the map represents different pressure zones in the Hanover Suburban water system. And the green shaded area is the Doswell pressure zone. So you can see just geographically, these are two very different systems. The two incidents that happened on Friday were isolated incidents that had absolutely nothing to do with each other. [00:23:34] Unfortunately, they happened back to back, which is why it could have been perceived that they were related, but they were in fact not. So just zooming in to the courthouse water system just to get your bearings. It's a very small, very simple system. To the eastern part of the system, just east of the Pamunkey Regional Jail, we have our well site, which pumps well water into a storage tank located at the jail site. Where that storage tank is, it has a booster station that then takes water out of [00:24:06] storage tanks and booster pumps apply pressure to the rest of the system. So there are 19-meter connections on that system. Most of the customers served are the government buildings here in the admin complex as well as the courthouse building, the Pamunkey Regional Jail, and just a handful of residents and businesses in the area. So right after that, later Friday night, we had another incident in the doswell service area that happened at around 10 pm that night [00:24:43] when staff at the water treatment plant noticed there was a higher than normal discharge flow coming out of the plant once they noticed that they notified our on-call staff that there's a potential leak in the area our on-call staff arrived shortly after to start looking for the leak. They ended up locating the leak about three quarters of a mile away from the plant on one of the two discharge lines coming from that plant. Once they located the leak, they had to locate the isolation valves. These are large lines which have large valves on them. They take [00:25:18] a while to get turned, a while to get the line isolated. And so once they located the valves, which valves to isolate, they began turning those valves. Unfortunately, by 11 30 p.m., because the main break was so large and so significant and ended up draining the million gallon tank we have in the doswell service area and again at 11 30 we saw the flow and pressure of that tank go to zero field staff was out working throughout the night by 1 50 a.m the leak was isolated by field staff pressure was restored to the service area to to 20 psi which [00:25:58] which again is that threshold number that we look for and then subsequently to normal operating pressures by mid-morning. Because the pressure dropped below 20 psi in the area for a prolonged period of time, we contacted the VDH after hours line, so that's the Virginia Department of Health after hours line at 1.52 a.m. We had multiple conversations with VDH staff throughout the night just trying to relay the situation we were dealing with, but also making sure we were maintaining compliance as we were addressing the situation. Throughout that morning, in the wee [00:26:37] hours of the morning, it was decided we needed to issue a boil water advisory. So we started gearing up to do one of those, making sure the right people were contacted and we could get the wording right on that advisory and push that out through the appropriate channels. And so at 6.20 a.m., we ended up issuing a boil water advisory. [00:26:57] With all boil water advisories, you have to do subsequent testing. We completed two rounds of bacteriological sampling on Saturday and Sunday, the 21st and 22nd. All of those samples came back with passing results, and we were able to lift the boil water advisory just prior to 11 a.m. Monday morning. [00:27:19] Also wanted to give a map to kind of show folks the location of the break and what that looked like. So again, the shaded green area is the Dotswell Pressure Zone. In that zone, we have approximately 50 residential and commercial customers. [00:27:36] However, some of those commercial customers are very large, very good utility customers of ours. And those included Kings Dominion, DLP, Cascades, Meadow Event Park, all familiar names. if you're from the area. So their operations were definitely impacted. But I wanted to show where the break happened, what it looked like. What you're seeing in the photo now is the excavation of the break. You're seeing the two discharge lines coming from the plant. The bright blue stuff is the brand new pipe that's been put in by our construction crew, which was completed earlier this [00:28:16] week so um we will we'll be doing um final testing of that pipeline later this week early next week making sure it passes all testing standards and be able to put that back in service next week uh is the plan so far so with that if you have any questions i'll be happy to uh to answer those thank you for your presentation sir any questions from board members i have one sir okay so it seems that there were two separate incidences the power outage and the backup generator failure [00:28:52] and then separately the water main break but they both occurred in the same area on the same day so are they somewhat related or completely unrelated they are completely isolated from each other the uh the main break it's is they happen to die as well you know it's one of those things we do experience main breaks in the system uh rarely just as any public water system does rarely is our main break significant enough that they drain a storage tank this was one of those breaks it was very significant it leaked a lot of water really fast but again that that water [00:29:29] system is completely isolated from the courthouse system and the incident that happened earlier that friday well thank you very much unfortunate a couple of events there but do appreciate your quick and efficient response so thank you sir absolutely any mr stoneman thank you mr thank Thank you, Mr. Chair. [00:29:52] So a break like that, is there any idea, I mean, is it structurally bad pipe? You know, something like that is usually a damage from construction or something like that, some good reason. Do you have any ideas on that? [00:30:07] It could be. That break in particular had an older, what we call repair band, which is a device we can use to seal up leaks. So it had a break in the past. And how long it had been there? Sure. no clue. It could be 20, 30 years. We just don't know. It held up well a long time. Breaks happen for a lot of different reasons. And as infrastructure ages, it's something we have to contend with a lot. And that's why we try to stay diligent, just like with the generator issue at the courthouse, to make sure we're replacing infrastructure as needed. And so, unfortunately, it's one of those things that we have to contend with. I guess that was what I was getting to. Is [00:30:47] it aging infrastructure? I mean, so the pipe itself, but it sounds like it was a ban there. it already had some issues for for whatever reason there was a ban with that one uh we've seen breaks happen from a multitude of reasons though you know just how they were originally constructed to aging infrastructure to i've dealt with breaks in in um in the past uh in other places that you know there's hairline fractures in the pipe from the manufacturer right don't show until 20 years later so there's a lot of different reasons main thing is we were able to cut that section of pipe [00:31:21] out and get a permanent repair put in there okay thank you yes sir any other questions from board members seeing none mr pedesky thank you mr chair i just i did want to make sure that the community and the board was aware that there was active communications with king's dominion saturday sunday and into monday morning with the testing obviously a major impact to them that has not happened before uh to king's dominion certainly losing a weekend's worth of business i certainly shared with them that we were committed to doing what we could on our side as quickly as possible [00:31:56] once the boil water notice was issued certainly it's always done out of an abundance of caution we've done two tests and determined that their everything was clear and and fine however we have to follow deq's requirements it wasn't just a matter of not having water at the park they had water restored but as you can imagine in a heat wave with large attendance on a weekend they weren't able to produce ice and other kinds of things for crowds of which were anticipated to be you know in the teens uh large numbers and so they made the business decision to close um certainly [00:32:31] recognized the the challenge that that creates for them but wanted to make sure that they knew that you know certainly as a county we value them as a major customer and business partner and communicated with them the best we could and our teams worked hard to make sure that they got everything done as timely as they could so they could open up on time on Monday and they were able to. Thank you. Thank you, Mr. Badesky. Okay, moving on next on the agenda is agenda item four, citizens time. I do have one card here for citizens time by a show of hands. Is there anyone else who would like to [00:33:09] address the board during citizens time? Seeing none, ma'am, you will have five minutes. Citizens time is an opportunity for members of the public to present comments and information to the board regarding any matter under the authority of the board. There are cards available in the back of the room. You are not required to fill out a card. However, it does make it easier for the board clerk to get the spelling of your name correct, and it gives us your contact information in case we need to follow up with you after your comments. Speakers who wish to address the board are requested to follow these guidelines. Each speaker is asked to give your name and the magisterial district in which you [00:33:49] today speakers will have up to five minutes the vice chair will keep track of time speakers are asked to address their comments to the board not the audience the board does not permit the use of slideshows or other projected materials during citizens time however speakers are invited to provide printed copies of the materials that do have for the board to the deputy County administrator who is seated right there the board requests the audience refrain from interrupting speakers during the recognized time. This rule applies to citizens time and to any public hearing. The Board appreciates the public input [00:34:25] and cooperation during citizens time. Citizens time is now open. I have a card here for Pat Jordan of the Cold Harbor District. Please approach. You will have five minutes. Thank you, Mr. Chairman. Pat Jordan of the Cold Harbor District. [00:34:45] First, I'd like to say I'd like to thank Ms. Pritchard, the only supervisor that was in attendance for our Juneteenth event on this weekend. And so we thank, and she's been with us every year at our Juneteenth events for the five years that we've had them in Hanover County. So we'd like to thank her. I'd also like to thank the board for the collaboration with Henrico that I saw the other week for the water issues that we are all having, it seems. And I was glad [00:35:23] to see us come together with them to try to find a solution instead of working on this on our own, let's say. We have to work with all of our communities, and to see that collaboration was good. [00:35:41] I was also happy that in that meeting, Supervisor Tyrone Nelson from the Henrico Board stated that he was concerned about the water issues, not for business, but for his people, his citizens. [00:36:01] And we're hoping that that is the same attitude that will be taken by this board, that the decisions that will be made will be in the best interest of our community and our citizens. We're not worried about what the data centers need, but we need to be worried about what our citizens need here in Hanover County. [00:36:28] They do seem to have a citizen-focused attitude, and that's what I'd really love to see more of here in Hanover. One of the things that I see often are the beautiful parks in Henrico County. [00:36:46] And I think if we put more focus and more funds into our park system here, we could have the same in Hanover County so that our citizens wouldn't leave Hanover to go to their parks because they are gorgeous. [00:37:03] One other thing that I'd like to bring forward is the fact that, again, the huge raises that we have been giving recently, I'm concerned about those because I believe that the comparisons used were not equivalent comparisons. [00:37:23] It was said that we compared the school board members in Chesterfield, in Henrico, and Richmond. Their populations are three times ours. [00:37:42] The school board systems, the school boards there only have five members. Ours have seven. So they have more people, and they do more with less board members. Now, if we had a great comparison, we would have used Albemarle, Suffolk, and they would have been more in line with what Hanover County's population is. [00:38:14] So the next time I hear a request for us to have more tutors in our schools, I don't think we should hear that we don't have the money because it is being freely given for raises. [00:38:31] Our teachers only got 8%, and we gave 100% raises to the school board. And so I believe we should be a little more fair about the distribution of the funds and make sure that all of our students, all of our kids, have what is needed. [00:38:57] Math tutors, literacy tutors, English tutors, and our kids can't write in cursive. So, please, make sure that those funds are allocated where they should be. [00:39:14] Thank you so much. Thank you for your comments. Is there anyone else who wishes to address the board during citizen's time? Seeing none, citizen's time is now closed. Agenda item 5, consent agenda, Mr. Davis. [00:39:31] Mr. Chairman, I move that the board unanimously pass the consent agenda as amended with the removal of item 6. Second. Just a point of clarification, sir, the removal as amended line item 6 on agenda item 5B3. [00:39:51] Any discussion? Second. [00:47:40] There is a motion and a second in any discussion. All in favor of that motion, please indicate by saying aye. Aye. Motion passes. Mr. Davis. Mr. Chairman, I move that after a satisfactory performance review of the county attorney, a salary increase effective July 1, 2025 of 4% as well as a concurrent 4% in deferred compensation and all other benefits that Mr. Walter receives remain the same and in place. It means a lot here. Thank you for your comments, Mr. Davis. Any other comments or discussion? All in favor of the [00:49:56] motion please indicate by saying aye motion passes any other matters we are now in recess time is six [02:20:43] o'clock the board is back in session first on the agenda for the 6 p.m. is citizens time is there anyone here who wishes to speak at citizens time i have one card in addition to the one card that i have okay so just the one you'll have five minutes i'll call you up in just a minute citizens time is an opportunity for members of the public to present comments and information to the board regarding any matter under the authority of the board that is not on today's agenda for a public [02:21:22] hearing. There are cards available in the back of the room. You're not required to fill out a card. However, it makes it easier for our board clerk to get the spelling of your name correct, and it gives us your contact information in case we need to follow up with you After your comments, speakers who wish to address the board are requested to follow these guidelines. [02:21:44] Each speaker is asked to give your name and the magisterial district in which you live. This evening, speakers will have up to five minutes. The time will be kept by our vice chair, Mr. Davis. Speakers are asked to address their comments to the board and not to the audience. [02:22:04] The board does not permit the use of slideshows or other projected materials during citizen's time. However, speakers are invited to provide printed copies of any materials that they have to the board, and those materials could be given to the deputy county administrator who's seated right over there. [02:22:23] The board requests the audience to refrain from interrupting speakers during their recognized time. This includes citizens' time and also any public hearing on today's agenda. The board appreciates the public input and cooperation during citizens' time. [02:22:44] Citizens' Time is now open. Joseph, please proceed to the podium. State your name. The district in which you live, you will have up to five minutes. Good evening, members of Hanover's Board of Supervisors. [02:23:05] If you are not aware by now, Buckstone is planning a construction of a new quarry site on Verdon Road in the historic Knoll area. This project consists of a stone quarry, asphalt plant, and cockery plant, all on a 1,300-acre site that is currently wooded and leased by Hunt Club. I encourage you to look further into this project if you have not started to already. [02:23:23] I come to you tonight to specifically speak to the proposal of the quarry as many of my comments that are specific matter addressed later in the meeting. I come tonight asking you all to look at the bigger picture when considering development of the county. [02:23:41] While industrial revenue stimulates our local economy, all too often the residents and visitors feel the negative effects. As our county continues to grow, our infrastructure, emergency spots, and services need to grow accordingly. When proposals for large projects are considered, you need to consider what burdens they will place on the residents and county services. [02:24:02] While growth may bring additional revenue to additional services, it should not come at the expense of destroying the rural areas many taxpaying citizens enjoy in the county. I have noticed a trend in Hanover County of building massive warehouses and manufacturing facilities. [02:24:17] Route 1 is slowly becoming a line of concrete walls where one small business has stood. The infrastructure of rural Hanover County cannot support the additional heavy vehicle traffic associated with these types of businesses. The roads are narrow with no shoulders, limited areas to reroute, and our bus routes are for school-aged children. [02:24:36] Furthermore, the roads are often the last roads to be cleared of snow and ice and receive no sand or salt treatment. This creates additional hazards that lead to the long-lasting effects on the environment, safety, and well-being of the residents. Industrial manufacturing facilities will cause major increase of the use of aquifers that many of our residents use for their homes and farming through drilled wells. [02:24:57] As we found out earlier this year, and as of recent last week, the county cannot currently support the demand for those already in the system without the help from Richmond, never mind expanding it. When industrial manufacturing facilities move into our backyard, so do hazardous materials for the products they produce and use. [02:25:16] The chemicals include oxidizers, corrosives, poisons, carcinogens, explosives, and many more. All of these carry their own specific hazards and effects. These type of chemicals and facilities require specific types of training and response from our emergency services to mitigate safety and reduce its impact on its environment. [02:25:36] Hanover Fire MS is currently not equipped to handle these types of incidents without relying on the activation of state regional teams that is based in Henrico County. With multiple stations in Hanover County still cross-staffed, the same crew responsible for multiple pieces of apparatus, having the responsibility of responding different types of apparatus based on the needs at the time, it is never guaranteed that the closest fire suppression piece of apparatus is staffed properly to handle the emergencies in the areas. [02:26:02] When it comes to fires, hazmats, and accidents in these types of facilities, they require specific training, equipment, and resources that currently does not adequately exist within Hanover Fire and EMS at no fault to the dedicated professionals in that organization. The commercial vehicle traffic that is required to keep these facilities operating also creates additional issues the county cannot handle. [02:26:23] These vehicles have a separate set of laws and pertain to them to ensure safe operation. With limited officers trained in the regulations and results in the dangerous roads for all residents and visitors of Hanover. I have witnessed myself more times than I can count dump trucks without uncovered loads, failure to lower their drop axles, flat tires throwing rubber down on the road, unsecure loads, failure to stay in their lane, and many other violations. [02:26:45] Without proper training and increased enforcement, these incidents will continue to happen and result in vehicle damage, accidents, and deaths. Finally, the development of the rural areas destroyed the charm of Hanover County. I live between Beaverdam and Doswell. I work in the city of Richmond. [02:27:00] The peacefulness of western Hanover County is bliss. I do not have to worry about traffic, smog, or criminal activity out there. Like many others, I enjoy my space and freedoms of having the distanced neighbors that share my values. I don't mind getting stuck behind the tractor during the hay season, and I understand the emergency services may take a bit longer to arrive at my house in an emergency. [02:27:21] Most of us out here have plans and preparation in place for those situations. Further mixing industrial and manufacturing facilities with the agriculture and residential ways of life will force citizens out of Hanauer County to places that value their beliefs, resulting in abandoned farms, fewer tax dollars, and fewer boats for you. [02:27:37] You have 30 seconds remaining, sir. I'm complete. Would you mind stating your last sentence? I just didn't hear that. Further mixing the industrial and manufacturing industry with the agricultural and residential ways of life will only force citizens out of Hanover County to places that value their beliefs, resulting in abandoned farms, fewer tax dollars, and fewer votes for you. [02:28:04] Thank you, Mr. Chairman. Thank you. Thank you for your comments, sir. Anyone else who would like to address the board during Citizens' Time? Seeing none, Citizens' Time is now closed. Agenda Item 9 is a public hearing. [02:28:19] Ms. Shelley Wright, Proposed 2025 Real Property Tax Rate. Thank you for being with us, ma'am. I'm the Budget Division Director. [02:28:37] So I'm going to start with why are we here? We held the public hearing with regard to the tax rate and its equivalent tax rate back in April. Subsequent to that, in the last month, I would say, we found out that the advertisement that pertains to this one specific public hearing, not the ones on the capital plan, not the ones on the budget, but the specific one on the real property rate, this has very specific requirements within the statute. [02:29:11] And every year, it's been that way for a number of years, and so every year we are very careful to send to the Richmond Times Dispatch our advertisement along with, in red italics, these very specific requirements. Two of those requirements I've put here in front of you, it has to do with the size of the advertisement as it relates to the the size of the printed newspaper that it's in and the other one is that the the headline shall be no smaller than 18 point font so subsequently we found out that they had not met those two particular elements of [02:29:47] our advertisement the ad was placed in the paper but those two those two items that the font was not in the headline was not a full 18 points and the size of page was was not did not meet the requirements either so a couple of things to point out there one is that that to be fair to the Richmond Times dispatch they were under a cyber attack at this point so we were communicating with them miss McGee your clerk I think in particular had a lot of communication with them we were working with them to try to get so that they could even print [02:30:25] and that was why we had to print in the Richmond Times dispatch instead of the local where we prefer um to print um so i think there was a little bit of chaos on their end we typically have a very good um response and relationship with the richmond times but as soon as they were notified immediately they accepted um they accepted responsibility for that and offered to um to run the um ad for today's public hearing um as the as requested by the finance committee um at no cost to the county both in the richmond times where it had [02:30:58] been improperly placed and also in in the local and you know just wanting to point out this is important the finance committee felt that it was important to make sure that we offer this opportunity again meeting all of those requirements however this as Mr. Badesky always says in his presentations this is only one means by which we have open communication with with the public and And so we don't feel that that font size necessarily impeded what we hope to be open lines of communication through all sorts of venues and opportunities with our public. [02:31:34] But that is why we are here holding this public hearing again. So the topic of the public hearing is our tax rate. Our tax rate is still at 81 cents, which is no change from 2024 and no change for many, many years. [02:31:52] However, the equalized tax rate, that being the rate that we would need to set in order for real property taxes to not increase more than 1% on the reassessment value, that would be 79 cents. That would be two pennies on the tax rate or 2.5%. [02:32:10] And our total assessment increases 3.1%. All of this information was presented in the advertisement. It is it has been online and that was the topic of many of your presentations during our process in March and February March and April With that mr. Chairman if there are any questions, I'm happy to take any questions And then otherwise we will Have the public hearing. Thank you very much for your presentation any questions or comments from board members seeing none Thank you. Thank you. This is on the agenda for a public hearing. We will now open the public hearing [02:32:48] Is there anyone here who would like to speak in support or opposition to this agenda item? Seeing none, the public hearing is now closed. [02:33:03] Mr. Davis. Thank you, Mr. Chairman. I commend the Finance Committee. Thank you, Ms. Wright, Mr. County Administrator. Mr. Chairman, at this point, I move that we reaffirm the board action of April 2025 as it relates to the real estate effective tax rate. [02:33:21] Second. There is a motion and a second. Any discussion? All in favor of the motion, please indicate by saying aye. Aye. Motion approved. Next, agenda item 10 is also a public hearing. Mr. Dennis Walter, county attorney, Ordinance 25-06, County Code Change for Date of Disclosure Form Submission. [02:33:43] Mr. Walter, thank you for being with us. Thank you, Mr. Chairman, and good evening, members of the board. We are here for the public hearing on Ordinance 2506. A little background. As you all know, the State Conflicts of Interests Act includes a number of provisions. [02:33:59] Some deal with what at times when folks are prohibited from participating in transactions or contracts. But it also contains, which is relevant for tonight, provisions with respect to providing for disclosure of financial and personal interests of certain officers and employees. [02:34:18] It's to enhance and increase the transparency of government at both the state and the local level. So, the State Conflicts of Interest Act includes a list of individuals who are required to file those disclosure forms, and it also provides that local governing bodies can also add individuals to those who work at the local level to the list of those who are required to file those disclosure forms. [02:34:48] This board has adhered to those requirements, and back about 20-plus years ago, the board last updated the Hanover County Code Section 2-3, which specifies not only the additional county employees that are required to make those filings, but also included the date by which those disclosure forms were to be filed. [02:35:13] At the time that that was submitted, all of that information was current and accurate. Since that code change was made in the early 2000s, the General Assembly has made a number of changes, including they've added a number of individuals who are required to file disclosure forms, and they've modified the date by which those forms have been filed. [02:35:35] We'll say that the county has adhered to those state code requirements over time, but we realize that there's an issue because our county code doesn't conform to the expanded list or the changed filing deadline. So Ordinance 2506 would conform our county code to the state code provisions. [02:35:57] We would update the list of those individuals who are required to file those disclosure forms, either those that are required by state code or those that the board has in the past added to that list and it also would indicate that the deadline for filing will be the date that's set out in the Code of Virginia. That way if the General Assembly changes it in a year or two, the Board won't need to update that. It sort of is a cross-reference for that. The proposed ordinance does not add any new positions to the list of those additional individuals. The Board can do that at any time. Those additional individuals are set out as ones that if you all [02:36:34] feel that people occupy positions of trust, such that in order to increase transparency and confidence in government, you would want those disclosure forms filed. You can add that, but this ordinance is not expanding that list at all. [02:36:51] I would also note at the bottom of this slide, internal audit is currently undergoing a review of county administration processes and procedures, and this is one of the items that they have found should be updated, mostly to avoid confusion. [02:37:09] They have not identified any issues over the past two decades where individuals who should have been filing weren't, or that forms were not being filed on time. Ms. McGee does a wonderful job of tracking all that individual and reminding individuals that they need to file. [02:37:27] And when members of the public request that information, they are provided with it in accordance with state code. This is to ensure that what is in our county code matches what is in state code. So at this point, these changes can only occur after a public hearing. [02:37:45] And if the board is inclined to adopt these changes, staff's recommended motion would be to adopt the ordinance as presented tonight. I'm happy to answer any questions either now or after the public hearing. Thank you for your presentation, Mr. Walter. Any questions from board members? [02:38:03] Seeing none, thank you, sir. This is on the agenda for a public hearing. The public hearing is now open. Is there anyone here who wishes to speak in support or opposition? Seeing none, the public hearing is now closed. [02:38:19] Mr. Davis. Thank you, Mr. Chairman. Mr. Chairman, I move that the Board of Supervisors adopt ordinance 2506 county code change for date of disclosure for the form submission. Second. There is a motion and a second. Any discussion? All in favor of the motion, please indicate by saying aye. [02:38:38] Aye. Any opposed? None. Thank you, Mr. Walter. Okay, next on the agenda, agenda item 11, plan and public hearings. Mr. Andrew Pompey, Deputy Director, Planning Department. Thank you, Mr. Pompey, for being with us. [02:38:54] It involves a request to permit a preschool within the existing church building. That property is zoned A1, so a preschool requires a special exception. [02:39:10] And the church we're talking about is the Church of Creator on U.S. Route 360, Mechanicsville Turnpike. This is the location of the church. Again, it has frontage on Mechanicsville Turnpike at its intersection with Meadow Drive in the Mechanicsville District. it's designated suburban neighborhood residential in the comprehensive plan as part of our suburban service area. This property, while it's in a more developed portion of the county, is still zoned A1 agricultural, and again, a preschool requires a special exception in that area. This is an overview of the site. Again, the church is on Mechanicsville Turnpike, but the entrances to the parking lot, which remain unchanged, are from Meadow Drive in the Spring Meadows subdivision. [02:39:50] So with this request, if it's approved, the applicant will be able to operate a Montessori school within the existing parish hall at the Church of the Creator. It would serve three to six-year-olds in one classroom with a maximum of 24 students. Per the conditions, the hours of operation will be limited to 8 a.m. to 2 p.m. Monday through Friday. [02:40:08] The applicant is intending shorter hours, but that provides some flexibility as their operations grow and develop over time. This is the sketch plan that was submitted with the special exception request. The site is going to remain unchanged with the classroom occurring again in the existing parish hall and the existing playground and parking lot used to serve the proposed use. [02:40:30] So again, in terms of blending in with the neighborhood, this is adjacent to Spring Meadows, which is an established residential neighborhood. There are no exterior changes to the site except for one new sign that promotes the preschool. Parents and caregivers will park in the existing parking lot and there won't be a drop-off lane to prevent queuing on the Meadow Drive. [02:40:47] That was a concern from VDOT. And there was a similar use on the property for several years. Preschool did operate at the church. And so this use would bring back that use to the property, which, again, was a use that has occurred in the past. These are the staff recommended conditions, limiting the site to 24 students. [02:41:05] Parents and caregivers will park to drop their students off. There won't be any queuing in the existing drive aisles that could impact Meadow Drive. The hours of operation are limited at 8:00 a.m. to 2:00 p.m. Monday through Friday. And then the last condition, standard with all of our special exceptions, it will adhere to all development related regulations that concludes staff's presentation the applicant is here tonight but she does not have a presentation or formal comments planned as available to answer any questions the board may have thank you mr pompey any questions from board members seeing none sir thank you i do understand the applicant is present do you wish to make a [02:41:41] statement at all ma'am don't have to okay thank you we will now open the public hearing is there anyone here who wishes to speak in support seeing none is there anyone here who wishes to speak in Opposition seeing none the public hearing is now closed Mechanicsville district. Mr. Hudson. Thank you. Mr. Chair We are always happy to be able to work with the Lord and his children So with that I move that we approve SC 2025 - 0 0 0 1 1 as submitted [02:42:16] Second there is a motion in a second any discussion seeing none all in favor of the motion. Please indicate by saying aye aye aye any opposed none motion approved congratulations mr pompey the next zoning public hearing is a case in the beaver dam district this is a request to amend the proffers approved with a previously approved rezoning to eliminate the cash proffer so again this is in the beaver dam district off of taylor road which is northeast of montpelier the property is zoned ar6 it was rezoned in 2004 [02:42:54] with proffer conditions including the cash proffer the property has been subdivided surrounding properties are zoned A1. When the property was zoned to AR6 in 2004, a cash proffer was accepted, and that cash proffer included a contribution towards a variety of public services, roads, public schools, community parks, libraries, and rescue squads. At that time, the amount that was proffered was $8,700 per lot. That amount escalates with the consumer price index over time, so right now, the cash proffer that we do is $14,484. And that cash proffer is due before issuance of a [02:43:31] certificate of occupancy for a new house. 2004, the rezoning was approved. 2012, the Board of Supervisors eliminated its previously approved cash proffer policy and evaluated cases on a case-by-case basis. 2013, we adopted and started implementing a transportation policy, and that looked at transportation impacts for subdivisions that are 40 and more lots based on the TIA. [02:43:53] The TIA would help determine what the cash proffer amount would be based upon impacts to the local road network and plan projects. So since this particular subdivision, Randi's Woods, only has three lots, it would not be required per today's standards to complete a TIA or propose a transportation proffer, cash proffer, to address community impacts. [02:44:15] So eliminating the cash proffer in this case is consistent with current policies. The remaining proffers that were accepted with the rezoning in 2004 remain in place. Adherence to conceptual plan, dedication of right-of-way, and tree preservation, those remain unchanged. [02:44:32] But this request, if it's approved, would only eliminate the proffer related to the cash contribution. The Planning Commission reviewed this request at a previous meeting. No members of the public spoke during the public hearing, and the Planning Commission recommended approval with a vote of 6-1. That concludes staff's presentation. I'd be happy to answer any questions the board may have at this time Thank you, mr. Pompeii any questions from board members seeing none. Thank you, sir This is on the agenda for a public hearing. Is there anyone here who wishes to speak in support? [02:45:04] Seeing none. Is there anyone here who wishes to speak in opposition seeing none? The public hearing is now closed Beaverdam district. Mr. Stoneman. Thank you, mr. Chair Since this is in alignment with our current policy regarding cash proffers, I'd like to go ahead and make the motion to approve REZ 2025-00005 with proffers updated day 27th, 2025. [02:45:35] Second. There is a motion and a second. Any discussion? All in favor of the motion, please indicate by saying aye. Aye. Any opposed? Motion approved. Mr. Pompey. The next public hearing involves amending the proffers accepted with a previously approved zoning request in the ashland district at the intersection of patterson park road and airport air park road the property is located near the airport and interstate 95 again at the intersection of air park road and patterson park road it's designated industrial on the comprehensive plan [02:46:11] as part of the suburban service area most of the properties in this area are zoned with an industrial classification this property was rezoned to m2 in 2003 originally with another proffer amendment in 2019. This is the aerial view of the site. The property has been partially developed and I'll show some photos of the conceptual plan that illustrate that later but the portion that we're talking about is the easternmost part of the site near the airport which is circled on the screen above. So again this is in an industrial area the Hanover Industrial Air Park adjacent to [02:46:47] the airport. The property was rezoned to M2 in 2003 and then there was a proffer amendment in 2019 that included the conceptual plan that's now requested for amendment. Most of the site has been developed and again I'll show the phases in the conceptual plan on a later side but phase two which is currently vacant the area I showed on the previous slide the applicant is proposing some modifications to the conceptual plan to accommodate future development. So 2019 the last proffer amendment this is the conceptual plan that was approved phase one in green phase two in pink. The green buildings have been constructed and the applicant's looking to amend the area [02:47:24] that's outlined in yellow where those pink buildings are shown. So that's what is approved in effect today. This is what the applicant's proposing. I'll take a deeper dive into this in the following slides, but rearranging those buildings, which is now classified as phase three on the easternmost portion of the site. This is a close-up showing the U-shape of the roads with four buildings proposed. There is an navigation easement on the easternmost part of the site to help facilitate travel at the airport and that future building in blue would not be built per the proffer conditions and conceptual plans if this request is approved [02:48:02] until that avigation easement is vacated. This is a comparison of the two conceptual plans. So what is currently in effect, the original plan on the left shows two buildings in this area with an access to the existing portion of the site and an access to Patterson Park Road. [02:48:24] The revised that's proposed that the board will be considering tonight is on the right. The crossing across the wetlands has been removed to the rest of the site, so there's two access points to Patterson Park Road. Again, that U-shaped access road with four buildings, and they're all one-story flex warehouse buildings. [02:48:43] And that blue building is a future building shown in the navigation easement. What is the navigation easement? It's on the eastern side of the property. It's a legal agreement between the airport to use and control airspace above the property, again, to help ensure the safety of flights coming in and out of the airport. [02:49:01] The easement crosses the location of that blue building, and that's because where the ground elevations are, the proposed building would violate the conditions of that easement. So even if this request is approved tonight with the amended conceptual plan, that building shown in blue could not be constructed unless the navigation easement vacated and removed that's a proper condition and a note in the plan the airport is undergoing a master plan right now so that could result in changes to where those application easements may be appropriate or not but again no building could be constructed until that easements removed and this is the specific proper proper number nine that's been added with this case that [02:49:38] talks about the building cannot be built and also in that portion of the site where the building pad is during construction there can't be any parking equipment storage etc again to maintain the integrity of that easement area these are the building elevations is going to be one story buildings about 17 feet tall metal with garage bays and entrances this is an industrial part of the county that's designated for industrial growth and already zoned for industrial uses this area is a designated industrial to accommodate a wide variety of industrial uses and this type of office flex use is recommended appropriate and can be [02:50:16] found in this part of the county there's 10 total proffers that have been submitted with this request some of these proffers or many of these proffers are the same as what was last revised in 2019 proffers one and two are changed to recognize and proffer the new conceptual plan architectural elevations proffer nine again it relates to that navigation easement no future building until that navigation easement is removed but all the other conditions are similar or the same as what was approved previously the planning commission held a public hearing on this request at a previous meeting no one spoke during the public hearing and after discussion they recommended approval [02:50:55] subject to the submitted proffers and conceptual plan with a vote of seven to zero that concludes staff's presentation the applicant and their engineer are here tonight they don't have a formal presentation plan but are available to answer questions thank you mr pompey any questions from board members seeing none sir thank you very much i believe the applicant is present would you you like to make a presentation or a statement no sir okay I do have a question any other questions from board members please come forward sir we will [02:51:31] now open the public hearing for the record please state your name the district in which you live or the entity that you represent Joe Gray and I represent DKD development okay sir any questions from board members first seeing none okay so my question is and it's really just a question of curiosity Okay Why would you come before the board to amend the proffers not knowing about the [02:52:04] Avigation easement? Well, I believe we will speak on this. My name is Steve King with Silvercore the engineer if you Recall the slide previous had the two pink buildings It just a previous firm had done that in 2019 I believe and we were trying to maximize the use of the site and also Set this up so it could be sort of phased and when we met with the county On a couple different occasions. We heard that the navigation easement might actually be in the next couple years [02:52:44] Lifted completely from the property So we were trying to you know come out with a layout that he could get some of it built in the meantime And then not kind of lose part of the site when that aggregation easement goes away Which would kind of be what it would happen if you would put stuff with the first layout Okay, I think I understand but let me repeat it back make sure I understand it correctly. So even if the aggregation Easement is not removed for whatever reason if you get the approval tonight You can still build that third building is that we could build the tree brown buildings the long [02:53:24] Okay, the three brown buildings. I understand. It's the blue one that would would have to be phased to a later date When the easement goes away and we still have to go through the site plan process and building permit process So there's still some review to happen But just the conceptual plan being revised so that we wouldn't have to come back and do this again If we were going to add a building in the future. That was the reason. Well, that makes sense. Thank you very much Any other questions from board members Supervisor Dibble? Yeah, I'm gonna sort of piggyback on that while I respectfully understand your perspective from a developer and engineering perspective. It [02:54:03] concerns me that this board is going to be approving a conceptual plan that is not buildable tonight. And it's almost like for me approving something maybe if our zoning ordinance got changed or approving something maybe if the comp plan got changed. It's unsettling for me not to have a conceptual plan that meets current building requirements. So I'm going to be approving a plan with the building that's not buildable tonight, but might be buildable [02:54:41] in the future, just to save you time and money. Basically. And is that where we really want to be? Well, I just have just not sure I can get there approving something that's not in conformance with our requirements tonight. [02:55:05] understand I think the intention is that we were you know we're trying to show you the overall product and not sort of piecemeal it you know three of the four buildings would be buildable now and the intention I think was maybe two-sided slightly but it's more to save everybody time and not have to come back here and waste everybody else's time to do this twice that is thinking bad precedent I'm I'm not sure I can get on board with that. [02:55:46] Sorry. Any other questions from board members? Anything else you'd like to say, sir? Question, Mr. Chairman. Mr. Davis. I'm sorry, sir. Right, you can, so if it's not approved, then you can't build the ones that are there now. [02:56:07] So, I mean, I guess my question is, you need us to do this so you can build the ones that you need to build. If the other things don't take place, then you can't build it anyway. but I would have a concern with stopping a business in an appropriate area from being able to go ahead and do what they want to do. [02:56:27] Now, I see why you put the plan together. You're like, this is what it's going to look like all built out, right? I'm not putting words in your mouth. Right, right. Let me phrase that as a question. Are you putting it together saying this is what it would look like all built out? However, I do have a prohibition because of it, but this is what the total plan would look like. [02:56:43] Is your plan to go ahead and start building some of these anyway? Yes, sir. Right, so if I don't prove it tonight, then I've stopped you from being able to build that. Yes, sir. [02:56:52] Yeah. Okay. Thank you. Is that correct? Yes, sir. Thank you, sir. I guess I would disagree. I would suggest that not we. Are you finished? Yes, I'm finished, Mr. Chairman. Okay. Mrs. Dibble. I'm not saying take the whole thing and can it. I appreciate the master planning always, but I would feel better approving the three buildings tonight, knowing that there may be a fourth building in the future if the easement is taken off, which we don't really necessarily know. [02:57:24] yes ma'am no I understand that was my question for easement taken off you can't build it anyway right yeah yeah I mean it the whole plan I think with the county with the airport is to move that easement down the runway and if that does it completely takes it off our property so there's really no need to have to come back to go all through that again just to you know put the one building there if we can just put it in now show it and we still have to go through like Steve said go through all the site plan stuff and that that was specifically why we added the proper I'm done mr. I was specifically why we had [02:58:04] the proper just noting that that future building couldn't be built until that vacation any other questions or comments from board members seeing none thank you yes sir thank you thank you guys okay this is a public hearing is there anyone here who wishes to speak in support of the application is there anyone here who wishes to speak in opposition of the application seeing none the public hearing is now closed this is in the Ashland district supervisor Pritchard [02:58:40] thank you mr. chair I will respectfully say I have no problem with this whatsoever and in fact I'm gonna say words I never say other people say them all the time this is the highest and best use of that property I like industrial development in an industrial place and and that's what this is and I what it does is it lays out a plan and says here's our goal but if in fact the aviation changes then we're just not going to do that part and that is part of the proffer so I don't think it sets a bad precedent because I think we've [02:59:16] already covered that so with that I'm going to move to approve rezoning 2025 - 0 0 0 0 7 subject to submitted proffer second okay there is a motion and a Second any discussion amongst board members. I have a question for mr. Pompey. So you've heard that the dialogue in the discussion Is there a proffer just want to make sure I understand it correctly that addresses the [02:59:56] Avigation easement where the applicant understands that they can't build it unless the Advocation easement is removed. Yes, sir proper nine, which is on the screen lays that out and there are notes in the conceptual plan Okay, that answers the question sir. Thank you very much So my comment is with proper not I'm going to support the application any other Discussion or comments from board members. Okay. Well, I guess my comment would be I'm not going to approve a conceptual plan [03:00:34] Proposing a building in an easement ever any other comments or discussion from board members Okay, seeing that we'll call for the vote all in favor of approval of the application. Please indicate by saying aye [03:00:52] Any opposed? No. Madam Clerk, please hold the board. Ms. Pritchard, aye. Ms. Floyd, aye. Mr. Davis, aye. Ms. Dibble, no. Mr. Stoneman, aye. Mr. Hudson, aye. Chairman Herzberg, aye. Motion carries. Next, Mr. Pompey. [03:01:14] The next public hearing is a conditional use permit associated with a fire station at D'Oswell, which is in the Beaver Dam District. So again, this is a replacement station for the existing D'Oswell station, which is located on Route 1. [03:01:31] This is within our suburban service area, the northern part of the suburban service area and designated suburban center on the comprehensive plan. There's a mix of zoning districts in this area. this property itself is zoned A1 agricultural and government facilities including fire stations require a conditional use permit in that zoning district. There are some industrial and commercial zoning north and then some business commercial zoning near the intersection of Route 1 and Route 30 Kings Dominion Boulevard. So again there is an existing fire station on this site, Fire Station 4. The building can no longer accommodate the increasing size of the fire company and the existing buildings proposed to be removed and replaced with a new building. [03:02:09] A conditional use permit was never obtained for the existing fire station, so this would be the first conditional use permit for the site. The blue outline shows the parcel and the pink is the existing building. There was recently some additional land that was obtained to extend the property to its current boundaries, which is in orange. [03:02:28] This is a sketch plan showing what the fire station would look like if this request is approved. The existing building would be removed, the new building built farther back towards the west behind where the existing building is, and there would be some buffering and screening provided with an entrance off of route one. The top shows what the building looks like today and the bottom look shows what the proposed building will look like. It looks similar to the new fire station that recently opened in the Mechanicsville area off of Lee Davis Road. The comprehensive plan talks about the need to renovate or replace fire station number four. So this is a community need that's been identified in the comprehensive plan. There was a community meeting and no members of [03:03:07] the public were in attendance or decided to share their comments uh based on commerce of plan recommendations and similar conditions imposed with other fire stations that are recently approved in the county staff is recommending six conditions limiting the height of parking lot lighting requiring shielding to prevent impacts to adjoining properties monument signs would be required that match the building trash receptacles must be within an enclosure that with materials that match the main building a 50-foot thoroughfare buffer is provided with the plantings that are shown in the sketch plan it'll be valid for two years that means construction would have to start in two years and then the standard condition with all of our cpu's compliance with [03:03:44] development regulations the planning commission held a public hearing on this request no members of the public spoke and the planning commission ultimately recommended approval with a vote of seven to zero that concludes staff's presentation presentation i'd be happy to answer any questions the board may have at this time thank you for your presentation sir any questions from board members Seeing none, thank you sir. This is on the agenda for a public hearing. Is there anyone with the fire department who wishes to address the board and make a statement? [03:04:17] Seeing none. Is there anyone here who wishes to speak in support or opposition of this conditional use permit application? Please approach sir. Please state your name, the magisterial district in which you live. [03:04:34] You will have up to five minutes and please state whether you're in support or opposition. joseph signorelli beaver dam district i am in support of this this is the exact kind of investment we need to make into our county to assist our firefighters in living conditions the current station is cramped i personally know many firefighters who work in that building and this would be a great improvement to the services that provide fire protection to my home and my neighbors thank you thank you for your comments sir anyone else who wishes to speak and support our opposition seeing none the public hearing is now closed this is in the beaver dam district mr [03:05:10] stoneman thank you mr. chair it is a privilege to be able to to bring a project like this forward and I'm super pleased that we can provide the kind of accommodations and and protections and and that our fire and EMS need in order to be safe and to continue to support the community and and take care of us in a way that's very very meaningful to each and every one of us so with that being said, I'd like to approve, motion to approve COP 2024-00021 as submitted. Second. There is a [03:05:48] motion and a second. Any discussion? Seeing none, all in favor and support of the application, please indicate by saying aye. Aye. Any opposed? Application approved. Thank you, sir. Mr. Pompey. The last public hearing is for another public facility. It is a request to amend an existing conditional use permit for Washington Henry elementary school in the Chickahominy district. [03:06:15] So the school is located at the intersection of Shady Grove road, man drive and academy drive. There's the existing school on site of course, and this replacement school will be built in the same property. It is within the suburban service area in an area designated suburban neighborhood residential primarily. [03:06:31] The property of the school extends on both sides of Shady Grove road. Most of the property is zoned R1, including where the school is, and then a portion on the eastern side where the bmp is located is zoned a1 and a conditional use permit is required for a school in these zoning districts so again this is a request to replace the existing elementary school with a new school to be built on the same site we've had similar conditional use permits approved recently for similar concepts beaver dam elementary school and battlefield park elementary school where a new school was built on the site of an existing school as part of a phased approach so the new school will be built while the existing school is in operation and then the [03:07:07] the existing school would be demolished. This shows the concept of phasing of the site. So the green shows where the new school is and the red is closer to the intersection. That's the existing school. So the new school will be built. And then once it's completed, the existing school will be demolished. You can see the final layout. Again, in this slide, the school is on the northern part of the site in red. You have the orange parent drop-off loop that has an entrance from Shady Grove Road and then an exit on Mann Drive. Faculty and visitor parking is accessed from Mann Drive. The bus loop is in purple on the western side of the building, accessed from [03:07:46] Mann Drive. And then you see the different play areas. These are the elevations that were submitted with the conditional use permit application. Again, they're similar in concept to the other replacement schools that have been reviewed for a conditional use permit. And this is a rendering of the front of the school. In terms of transportation, with all conditional use permits. We look at transportation impacts for this particular project a turn lane warrant was turning warrant analysis was done as well as an access management review. Based on the number of trips that I [03:08:20] projected in the time of day, the peak hour in particular, a northbound left turn lane is warranted on Shady Grove Road into that parent drop-off entrance student drop-off entrance I showed you in the previous slide and that is would be that is designated for growth part of our suburban service area. [03:08:42] And there are suburban single-family residential neighborhoods surrounding the site, as well as some small-scale businesses at the intersection of Shady Grove Road, Mann Drive, and Academy Drive. But this site has been used as a school for several decades. So the proposed use should be compatible with the surrounding area, as well as the Conference of Plan recommendations. [03:09:00] The capacity for the new building would be 550 students. So that traffic analysis, internally warrant analysis, was based on that. To address possible impacts to the community based on the feedback we heard at the community meeting lighting is minimized so that front recreation area will not be lighted after hours of darkness there's increased parking on site and that left turn lane that was shown to be warranted in the turn lane analysis will be provided and is required per the conditions from shady grove road into the student drop-off area there was a community meeting held and there were some questions and comments about enrollment construction phasing and traffic, traffic to the site, parkings, particularly parking during events, emergency [03:09:40] access and lighting and the conditions and the site design address many of these comments and feedback received from that meeting. So there are 14 proposed conditions. Some of these conditions are from the current conditional use permit for Washington Henry Elementary and some are new. [03:09:57] The building must adhere to the elevations that I showed you. Landscape screening is provided on the northern and western boundaries of the site. equipment needs to be screened from public roads and adjacent dwellings. A fence is required around the BNP. Existing trees will be preserved. A new landscape buffer will be right along Mann Drive as well as Shady Grove Road. Construction hours. There are some limitations on construction. The planning commission recommended longer hours during hours or during times of the year when there's more daylight so they are adjusted in the summer months to accommodate additional [03:10:31] construction events must end by 10 p.m. the left turn lane i mentioned must be constructed signs must be monument signs lighting limited to 25 feet with house side shields right-of-way dedication along the adjacent public roadways and the standard condition that developments comply with all regulations the planning commission held a public hearing on this request at a previous meeting no members of the public spoke there was discussion about construction hours and allowing earlier construction during the summer months when there's more daylight condition 8 has been revised to reflect the planning commission's recommendation that concludes staff's presentation the school [03:11:08] architect also has a presentation to show you what the school will look like and provide more information about the proposed project thank you for your presentation sir any questions for mr pompey from board members seeing none thank you sir is the architect present present please approach state your name the entity which you represent we'll now open the public hearing Good evening chair board. I am Josh Bauer architect of the Crabtree Warp on Associated Architects. I am here on behalf of the Handover County Public Schools. Okay [03:11:47] So good evening. I am here to To give a little bit more enhanced to mr. Pimentated a wonderful job of presenting tonight We're gonna give a little bit enhanced version in this in this presentation So project wise we're we are just getting we're just wrapping up design development here at the end of June Going into construction documents. So basically the design for the most part is pretty well under control Now we're going to go into the documents that the contract can actually build off of so some of you have had Has spent some time with us and I appreciate everybody's input And giving us feedback during the design process and so we're excited to get ready to do the construction documents [03:12:25] Our goal is to go out to bid in the October time frame and start construction before the end of this year So as stated this the site is actually broken up into two pieces as you as you may very well know On the left hand side and the right hand side with with shady groves separating the two pieces The both the existing building and the new building are going to be on the the left hand side in the the main portion We are going to have some some stormwater management on the right hand side Which is currently where the pond is we're going to be expanding that a bit to be able to accommodate for the for the additional [03:12:58] The additional impervious on the site. I'm in 2018 the there was a facility done on the on on the building I believe there's also one done in 2009 and these were some of the findings one thing I do want to stress is that looking at the existing building which was built in 1938 with additions in 72 and 85 is that the the the architect at the time of 2018 assessed that 65% of the building was either in fair or in poor condition and that led to the decision To move forward with the building replacement as opposed to an additional renovation So construction wise we are super pleased [03:13:35] It is a very tight site, but we're super pleased that we're able to put the construction entrance as far away from the parent drop and bus drop-off so the the The access for construction is going to be on the top side So again, we're to try to create as much of a separation as possible We're gonna have a nice contractor parking area both at the main site And then we also will have some overflow across the street where the stormwater pond Will be expanded on on that side. We have to make a small modification of the parent drop-off The good news is from parents. We're not going to change anything It's just gonna be a little bit a little bit of a shift down about 20 feet But I said from the standpoint of overall flow where the buses and the cars will remain the same even during construction [03:14:14] I said and with the the positive notice separating construction The construction traffic as far as we possibly could in the site We think that there's going to be low to minimal impact on the daily on the daily activity The other part of this I want to stress is that we are going to be creating a temporary playground. So the current playground that's there in the play area, we're going to have to move that down so the students will not have any less of a play area and that we are going to make sure that we accommodate for that. [03:14:40] For those of us who enjoy the playtime, we always rank and say, hey, what's your favorite part? It's usually lunchtime and playtime, not a handover because the students are awesome. But at my school, it's my school division, it was definitely food time and play and we want to make sure that gets stressed on this. so a couple things that are super important on this is that with the intersection of Shady Grove and Mann Drive is that we're really able to to separate as most much as possible the car and the buses so we found that everywhere we can do that it's a it's a part of experience for everybody and the the buses are going to enter off of Mann Drive loop around and and then exit off [03:15:18] of Mann Drive the cars will enter off of Shady Grove on the farthest part of the site, go down through the Securitas route, and then exit off of Mandrive. So what that does is it kind of has similar traffic to what exists now. VDOT so far has been super supportive of how we have this. [03:15:35] And then the left-hand turn lane off of Shady Grove is absolutely going to be incorporated into the overall design of our project. I believe that we've already submitted and received some amazing comments from planning already. A couple important things is that we're not quite doubling, but pretty close to doubling the amount of cars that can park on the site. [03:15:56] But what's one thing that the public in the hearing and before that heard is that we are right now there's about 66 cars that we found to be sitting at any one time. And in the morning and afternoon is kind of the maximum. We're doubling the amount of cars that can get off of the street. [03:16:13] And what we heard is a lot of positive from the folks in the neighborhood said, hey, you're able to get more cars off the street it's going to have less of an impact on both Shady Grove and Man Drive. So here's just a quick rendering give you an idea of where the play areas are. Separation of kindergarten pre-k and then three four five on the on the bottom side with a with a play area. [03:16:33] The area in blue is going to be grass. We're just kind of showing it as there is to highlight that. As stated we may have some really low level lighting in the walking track but that would be but that would be turned off after hours to not disturb the neighbors from a light standpoint. [03:16:52] So the building itself, if you've had an opportunity to see Beaver Day on the battlefield, it's very similar. This is a modified prototype where you see Main Street in the center. On the right-hand side is your large common spaces. Going from the bottom to the top is your admin nursing guidance, the gymnasium and the cafeteria with the stage in the center. On the left-hand side of Main Street is going to be your two two-story classroom wings with pre-KK all the way through fifth grade. You can see here some things that that were special about this building is that we have five collabs, we have the media center on the second floor, and then both of the art [03:17:29] classrooms are on the second floor of this building. So a couple pictures of the existing building. I know everybody's familiar with it. The original building was actually kind of tucked behind an addition some some folks don't realize that the the gable with the circle the circle window are actually part of the original building and there was an addition that was created for the admin it kind of hides that piece I wanted to just point out that piece that is the what we see is not really the original building unfortunately it was kind of tucked you know in the 70s architects were really not putting out some good work and what we find is that [03:18:05] they hid really amazing stuff with with new architecture maybe not the best idea idea here. So as presented, here's the elevations in sketch format. The final elevations will look very, very similar to that. A rendering of what the facade looks like may be very, you know, very familiar with some other buildings here in Hanover. We wanted to pay homage to the historical nature of the original courthouse, but give it a little bit of its own flavor. You can see kind of the precast bands. This building will be all brick and the media center, that big one [03:18:40] the big window above the colonnade is actually the media center. So we're going to have some really fantastic daylight coming into that space. So this, if it goes well, I'm going to show you the quick video. So this is kind of a fly around of the videos showing the front entrance. Again, man drive is to our back. So this is what the entrance, the elevation you'll see from man drive. [03:19:02] We're going to wrap around. The one story piece is your admin nursing guidance. What we're going to do is we're going to turn a little bit to the right. Now Shady Grove is right off to our right. It's going to be to our back so going from the one-story piece which is the admin nursing guidance then you have your gym your stage and music area which is kind of the the lower the lower middle roof now the cafeteria the dining space and the and the kitchen which is also that one-story space so a shady grove is to our back now we're going around the loading dock area i'm going to wrap around this is where the the kindergarten and pre-k and first grade playgrounds would be the two to the the two-story classroom we're going to wrap around see the bus loop on the [03:19:41] right-hand side one really one thing that we're really pleased about with this design is that we're able to separate the bus loop and the car loop so both in the morning and in the afternoon the students will be coming in from different locations to help to reduce the amount of overall stress on on the students and all the staff you can see the the the outdoor learning commons in the center between the two tours or two tours class rowings on the right-hand side is going to be the the three four five playground as we're kind of wrapping around here you see the front entrance and what we're gonna do is we're gonna fast Fast forward time in 5, 4, 3, 2, 1, and we're going to go from daytime to nighttime. [03:20:24] And again, we're still in design, so as I said, we're going to wrap it. We're going into construction documents to make sure that the contractors have the best documents possible. And with all that being said, so we want to give you just an update of where we are. So some of you guys have had an opportunity to spend some time with us. [03:20:41] So are there any questions or thoughts anybody has that I'd be happy to answer them? [03:20:47] Any questions from board members? Seeing none, sir. Oh, I do have one. Yes, sir. You mentioned the 1938? The original building? Yes, sir. The original building. What was that used for? A school. School? Yes, sir. Was it the high school? I don't know that fact. Okay, but it was a school. It was a school, yes, sir. To my knowledge, it's always been a school. I just don't know what the grade alignment was when it was first constructed. That's what I thought. Okay. Just want to make sure I had it correct. Yes, sir. Okay. Thank you. [03:21:25] Sir. Yep. Thank you anyone else from the school division. Please state your name the entity you represent Thank you for being with us. Good evening. Mr. Chairman board members. Mr. Badesky Terry stone assistant superintendent for the schools. We also have dr. Penny cough superintendent We have our facilities director Amanda Washington and so we're happy to take any questions that you guys may have of us non-technical [03:21:57] I'm sorry. We were trying to get some clarification Sure, we would be happy to take any questions. You may have any questions from board members I'm still trying to understand. What was the 1938? That was a school was something torn down over there already I know I have to go back and research that I know that when I look at this report To the best of my knowledge, it was a school. Um, it was a smaller structure. It was across the street [03:22:35] It was across the street. Mr. Chairman, okay According to the Washington Henry Elementary School website, which I will take as being accurate, it says that Washington Henry Elementary School has a long history dating back to 1778, when citizens from Hanover founded Washington Henry Academy, a private boarding school for boys. Not quite a hundred years later, girls could enroll in the school for the first time. In the early 1900s, Washington Henry became a public school housing grades 1 through 11. In 1938, the school was built on its present site as a high school later in the 1950s in [03:23:11] addition accommodated the growing enrollment until 1958 when then Lee Davis High School opened and Washington Henry became an elementary school for grades 1 through 7. Thank you Mr. Walter. And I can add to that we have a group of gentlemen called the Romeos and they still support the schools today and they went to high school or they had family members that either attended Washington Henry or Battlefield Park. So they celebrate regularly those two schools. Okay, so I want to make sure I understand correctly. 1938, that was a high school. Yes, sir. Okay, that's what I thought. [03:23:46] Thank you. Okay, any other questions or comments from board members? Mr. Chairman. Mr. Davis. So I just, I do have one question. Maybe it's for the architect. So there's some, some windows in there that were taken and moved when some different walls were, were taken down and they're exterior windows, but they're interior now. And I know certain things are very important. I know They have some of the doors that have been reclaimed and used for different things. [03:24:12] Some doors are still, I think, on the original hinges. And to Dr. Pentecost's point, it does have a history and a legacy. Is there going to be a way to incorporate some of the legacy aspects of that? I know maybe aesthetically it's going to be the path, not necessarily always functionality and utility, but are we mindful that some of those things that they've saved in the past seems to me it'd be good to go ahead and save those and find a way to function functionally put those in even if it's just aesthetics to go ahead and you're talking about homage school has a lot of uh you know history to it and i know y'all are aware of that but i was just wondering because those doors [03:24:51] and those windows i mean every time i go there and if there's a one of the more seasoned students if you will former students they talk about those doors and those windows and so what would be the plan for for that okay briefly in 30 seconds is fine just don't tell anybody because this is a Yeah, yeah. [03:25:08] So you wouldn't want to say it at a public meeting. Right. But on the public meeting. Cut the mics. So yes. And what you don't see, because this is in progress, is that – so there's a handful of things that we already know about, whether they're elements, whether the doors or windows, but also there's items in the attic. [03:25:23] And the Romeos, which we had breakfast with them, also have additional materials. So what we're going to be doing is both – when you first walk in the door, is that we are going to have the specialty to kind of celebrate the history of the building. the second floor we're actually creating a reading room that will have some of those elements also. So again we're not quite ready yet so the school board is okay this is secret so don't tell them but the school board is soon gonna see some some right you know some renderings and a walk through the building which will celebrate some of those items. One thing that I'm super excited about is that we've been told that there is two different capsules in the building. One of them is in the backyard which we're gonna be digging up here soon then one [03:26:01] One of them is inside at the date stone. So what we're going to be doing is doing select demolition to make sure that anything that is historically of value, we're going to be salvaged and incorporated into the new building. So the idea is that, yes, it's going to be a new building, but we're trying to pull as much of that history and that character of the existing building into the new space. [03:26:18] Thank you, sir. Thank you, Mr. Chairman. Mr. Chairman. Mr. Hudson. I just saw Ms. Principal Shalom Morgan walk in and I just wanted to toot her horn. She and I worked together with the Romeos. I said, the old guys are telling me there's stuff in the attic, Ms. Morgan. [03:26:35] She said, well, I haven't been up there. But anyway, she worked to coordinate it, but not only to coordinate it, but to protect it, to make sure that it would indeed end up in the new school. And as Josh spoke to, she has things and the Romeos have things as well that they want to go back into the school. [03:26:57] those gentlemen got a presentation just like we did and I attended that and they asked their questions and overall they are very excited about this project and about them being engaged to put some of some of their their things on it so that's all thank you sir thank you for your comments any other questions or comments supervisor Dibble yeah just wanted to state that my predecessor Wayne Hazard actually attended this school and so we've been talking a lot about this school and I [03:27:36] know he will and does sincerely appreciate your willingness to try to save as much as that history as we can because it's it's important to everybody it's important to all of us as well and I just want to really want to commend you on this layout it's just superior I mean the separation of the bus and the auto vehicles is so important to the safety of our whole community out in that area and you know the ample stacking on site you've maximized that so we've got the cars off the road [03:28:10] the turn lanes I mean it's just so well thought out and you have really used this site in a really good way that I think that this is going to be a magnificent experience for this community so I say Well done. Thank you for your comments. Anyone else? I think that's all sir for now This is a public hearing is there anyone here who wishes to speak in support of this conditional use permit application? [03:28:45] Seeing none. Is there anyone here who wishes to speak in opposition of this application? Seeing none the public hearing is now closed. This is in the Chickahominy district Supervisor, Floyd. Thank you so much. So we are very excited about this project It's going to be beautiful. I absolutely love the design. I love that it celebrates history and I know we had talked about that And it is really needed to have that more space for the safe student drop-off [03:29:22] So, you know, we're just thrilled can't wait to see it moving forward With that I'm going to motion to approve CUP 2025-0004 Hanover County Public Schools Second there is a motion and a second any discussion amongst board members. So I do have a few comments I'd like everyone to know that I've requested That a review and presentation I'll be done by the county administrator for an upcoming board workshop [03:29:59] As soon as we can believe September on a school replacement process and what's what's been happening is decisions were made in 2018 without a lot of Board of Supervisors input and then It comes to us as a conditional use permit after all kinds of decisions have been made and at the end of the day We're responsible for the money. How much does this school cost? [03:30:30] I think it's 45 million or so This is the fourth one in the last three years that I've seen this will be three under construction at once that's a lot so i have concerns about the spending i do not have concerns about the plan i think it's a good plan and i think the architect is qualified and i know our school division does a great job of prioritizing students their future and the education so i don't have any problem with that i do have a problem with the process that i've discovered in the last two years i think one [03:31:07] thing that we need earlier in the process is more consulting and feedback from industry experts with significant experience on older buildings. And so this is the third one that I know will be torn down. [03:31:26] I'm hoping there's a way to preserve Battlefield Park, but I don't think this is the last one. I think we're going to have another one and then another one and then another one. And I think These are really tough comments for me to make because I really see education in Hanover as a priority. [03:31:47] I have a rising third grader at Cold Harbor Elementary, and I know we have great people working here on great things, and I know there's significant improvements here. But at the same time, I have to speak as a member of the Board of Supervisors. We do have to take a look at the spending at some point and be sensitive to our taxpayers. [03:32:07] And I've heard from many people in the Battlefield Park community, and I'm going to say this on the record, who are very concerned about the amount of the number of schools that are going to be torn down. And I think there's ways that some of these schools can be improved. [03:32:24] I think there's times and cases where some of these schools should be torn down, such as the one in Ashland, the consolidation of John Gandy and Henry Clay, I think was a very good decision that we have a new school there. I watched that process from a distance. [03:32:43] I didn't put myself in the middle of it. I was up in Ashland, and I trusted our Ashland representatives to do their job. But I do know there were significant concerns that created some anxiety between maybe what had been planned and what elected officials would like to see. [03:33:08] Because it's our phones that ring. It's my phone that rang when the historic trees were cut down at Battlefield Park, and they were just left to lay there. for three weeks. And it wasn't until I called Steve Eikenberry, who got right on the job and contacted Terry Stone, that the next day they were cleaned up. That's the type of thing that I deal with. That's the type of thing that we deal with. And I'm not making these comments to be critical [03:33:40] or hard or demeaning or any of that. But I'm making these comments to say that the process has to improve and it has to include industry experts on historic buildings and it has to include this board much earlier in the process especially when we're looking at 45 million times four times five times six at the end of this we're up to 250 million and we haven't done anything on the biggest need which I think is Lee Davis High School now called Mechanicsville [03:34:15] So that concludes my comments anyone else Supervisor Pritchard. Thank you, Mr. Chair You know, I wasn't going to say this because I don't I don't want to I don't want to pee in anybody's cornflakes tonight But the reality is this is a brand new building that gets to keep the name of Washington and Henry I didn't get that option to Nashland. We wanted John M. Gandy is a historic name And so we have applied a completely separate set of rules here And and I do think we need some review in the process [03:34:50] Thank you for your comments. Anyone else? Okay, there is a motion and a second on the floor all in favor of approval Please indicate by saying aye. Aye. Any opposed, please indicate by saying no.
