Is there anyone here who wishes to address the board at citizens time? I see one [00:18:49] Okay, yeah [00:22:03] no it's it's it's no it's it's no it's no chance no chance i don't know why they even thought about that's what i say [00:22:17] 60 seconds the time is now 2 23 the board is back in session [00:23:50] we will pick back up at agenda item 4 citizens time Citizens time is an opportunity for members of the public to present comments and information to the board regarding any matter within the scope of the board's authority that is not on today's agenda for a public hearing. [00:24:09] There are cards available in the back of the room. You are not required to fill out a card, however, it makes it easier for our board clerk to get the spelling of your name correct and it gives us your contact information in case we need to follow up with you after your comments. [00:24:25] who wish to address the board are requested to follow these guidelines. Each speaker is asked to give your name and the magisterial district in which you live. Speakers will have up to five minutes to address the board. The time will be kept by Mr. Stoneman, our vice chair for this evening's, this afternoon's meeting. [00:24:48] Speakers are asked to address their comments to the board and not to the audience. The board does not permit the use of slideshows or other projected materials during citizens' time. However, speakers are invited to provide printed copies of any materials that they have the board. [00:25:07] They can be delivered to our deputy county administrator seated right here. The board requests the audience refrain from interrupting speakers during their recognized time. This rule applies to citizens' time in any public hearing on today's agenda. [00:25:23] The board appreciates the public's input and cooperation during citizens time Citizens time is now open ma'am. Please come forward. That's lavender Please state your name in the district in which you live. You will have up to five minutes [00:25:48] My topic today is the library and books I have repeatedly over the course of years requested more transparency and a set timeline for the appointment to the Pamunkey Regional Library Board of Trustees. [00:26:05] I believe it was a couple years ago I was promised that that would happen, that the positions would be listed, the timeline for application and interviews would be set, and people would have a clear, accessible way to know about these positions and to make an application. [00:26:28] I still don't see that happening. Positions stay open for random amounts of time. They use old pools of applicants sometimes and say they didn't need to open it because you had applicants from the previous round. What I'm requesting, again, is that we take this board seriously, give everyone in the community an opportunity to apply, to understand the process, and for it to be transparent so everyone has a fair shot. [00:27:00] As you probably know, there was a recent report from JLARC highlighting the fact that Hanover County schools are by far the largest book banners in the state by more than 100% numbers. And I am hoping that you understand how that looks to the state and even the country. [00:27:23] messages that families, parents, teachers aren't able to monitor and discuss these things with their kids when they use libraries in public schools. The argument is that if they can't get a book in the school, they can go to the public library. Well, on that topic, we now have people sitting on our board of trustees, and from several on this board, the message has been that there are certain books about certain demographics that you do not want to see in our libraries, in our public school libraries and our public libraries. So the argument that you can go to the public library and [00:28:02] get a title that has been banned in the schools, quite possibly, if the train ends up at the station, I believe it will, will not be available in our public libraries either. That is possibly illegal. [00:28:19] It sends a message to the wider community that LGBTQ people, people in minority groups, people who have different perspectives are not welcome or acknowledged or included in Hanover County. I hate to think that that's what the message is on purpose, that that message is intentional. [00:28:43] I would hope that you would argue with me and say that it's not. But actions are what we see on the front page of newspapers for years now. That is what's getting out there about Hanover County. So I'm just here to ask you to monitor the library situation, to not let's go off the rails and be in danger of denying people their First Amendment rights and that everyone should be included and welcome in Hanover County. [00:29:19] Thanks. Thank you for your comments. Is there anyone else who wishes to address the board during citizen's time seeing no one citizen's time is now closed Next on the agenda agenda item six is the presentation. Mr. Rook Rogers Please approach quarterly connect Hanover broadband initiative update. Mr. Rogers is the assistant broadband administrator Thank you for being with us, sir. Thank you. Mr. Chair. I appreciate it, sir. You know what? I'm sorry, sir [00:29:57] I had written a note here. We have to go back to agenda item five and approve the consent agenda. Got my apologies Thank You Supervisor Dibble next on the agenda is agenda item five, which is the consent agenda. Mr. Stowman Thank you, Mr. Chair. I'd like to make a motion that we approve of the consent agenda Second there is a motion and a second any discussion all in favor of approving the consent agenda. Please indicate by saying aye [00:30:35] Consent agenda is approved now. We go to agenda item 6. Mr. Rook Rogers. Thank you, sir Thank you, sir Appreciate it. The supervisor board boss job. Mr. Badesky. Thank you, sir. And the other boss Lisa Thank you very much as well. I'm taking a situation here in replacement of Todd for for today. This is the Broadband initiative. I am the assistant broadband administrator [00:31:14] We have worked together as a team with our Mr. John Badesky, Todd and myself so we would like to go to Slide you go that'll show you that the Board of Supervisors John Todd and myself Fiber construction is well underway for both providers Brightspeed is at the current time 57% complete their design permitting and installation. I think that's a little low [00:31:48] Talking to Chris Dillon this morning, but that's what was reported on the report all points broadband VATI last update we had for the board was 40 miles We were appreciative of what the work is that's taken place and now they're up to 168 miles installed Which is 51% of the project. We're very happy about that. This is something Mr. Herzberg you and I talked about on on Thursdays It is a situation where the homes are being connected and the survey is being done. [00:32:25] You and I were discussing with Mr. Ennis, there were 31. Actually, there's 46 homes that are connected and 205 in the survey-slash-scheduling process. Continuing to update the Connect Hanover website, monthly updates from Bright Speed, we continue to do that. [00:32:46] All Points Broadband pricing is up online. What our plan is, through Mr. John Badesky and Todd, is to place a spreadsheet for all points to allow everybody to understand and to see where we are in the progress of the 326-mile build. [00:33:08] That is being vetted as we speak. We do have a spreadsheet being approved. It's some proprietary information that's kind of caused a delay for this, so we've straightened that out. And Mr. John, that's going to come to your desk hopefully next week. [00:33:27] The next slide is the Virginia Make Ready Initiative. As we spoke before, there was close to $5 million granted for all points to put the infrastructure underground instead of the overhead installation due to expediting the project and delay that was involved, as we all understood what it to be. [00:33:50] So that is under progress, which is HANO 7, and a lot of that's been completed. This is the Broadband and Equity Access Deployment, the BEAD grant that's coming forward. [00:34:06] As it stands right now, the BEAD grant will be deployed, and we will know who the providers are in September, with a deployment in December. five percent is the unserved and underserved quantity or percentage we would like to tweak that the GIS team and Todd and I are working together get the total addresses to make sure that's accurate we're pretty sure it is there's no county funding required for the bead grant which is great news for us due to the recent federal changes localities will be notified in the winter September [00:34:43] and October as we discussed this is a large spreadsheet that we've created as team it is the actual spreadsheet that captures the citizens that call me and we actually carry it on our t-drive so whoever wants to see it can see it and in the county administration it actually if we go back a little bit we [00:35:18] have over a hundred calls each month it's not shown here but the hundred calls basically are 50 we record and 50 are the pricing scenarios like Sue you and I talked about earlier today as a devil that fees for actually installing a fees for hookups things like that this slide I would like permission from the board and Mr. Badesky we created this slide to place it [00:35:53] up on the website as well the majority of the questions that I get I'd say 80% of the questions I get. What is infrastructure? What is testing? What is marketing? How am I going to be contacted? So instead of getting down in the weeds, there are some sub processes here in each one of these. [00:36:14] I figured we would take a one, two, three, four approach and put this up on the website so everybody can understand there is a process involved. Any questions? Are you finished with your presentations? Yes. Yes, sir. Thank you for your presentation. Any questions from board members supervisor Pritchard and this is not a question so much as is two comments one if that slide goes up I don't think it's ready for prime time I think it needs a little context and a little introduction and and I'm sure [00:36:51] whoever's doing comms can can take care of helping you with that second thing is that you have this slide up right now and other providers starts with glow Glow Fiber. I'm sorry to say that I continue to get complaints about Glow Fiber and they range anywhere from you know they're messing up my yard and not putting things back to the one I've gotten the most recently is that they're coming into subdivisions and they're doing one street and leaving all the others undone and so I'm getting a ton of calls for people like well how come they [00:37:29] can get it on Linderwood but I can't get it over here and I did talk to Todd about that and he said in some cases if we can reach out to them and let them know hey the rest of this neighborhood would be well served here so I would encourage people who have questions about how it's being laid in their neighborhoods to please call either the county or their supervisor because we can at least we can at least touch base so exactly we have a good connection with glow fiber so if anybody [00:38:02] has any questions we can get those those two together uh as as this particular slide presents uh we will have two presentations in august for bright speed and all points thank you for your comments ma'am any other questions or comments from board members mr stoneman thank you mr chair i just have a quick comment uh mr rogers i really appreciate your help as you know out western hanover we've experienced a lot of challenging uh opportunities with the fiber going in and um and people not knowing where to go and it's it's been a huge blessing to me to be [00:38:40] able to just forward that email and and get that great response and and the citizens do reach back out to me and they're so thankful for for the way that you handle them and all the work that you're putting into it and i certainly do appreciate it myself thank you sir appreciate it thank you thank you for your comments anyone else mr badeski mr chair i just want to also clarify just a few things. You heard Mr. Rogers talk about the infrastructure piece. We're passing the 50% completion mark. The contract requires all of that infrastructure to be completed by the end of December. We believe contractually they're they're on track to have the main passings and core [00:39:19] infrastructure installed by December. The other piece and probably the most important pieces is when me what day do I get connected and that's an important issue because if you recall when we agreed to uh our partnership with all points they had agreed that from one year from notification up for for 365 days there will be no excess charge for connections to the home so if your home is a mile from the street in that first year there's no additional charge for you to receive [00:39:55] that connection to your home that clock has not begun yet even though you heard that there were connections already beginning and in progress that clock so to speak has not started and so once that clock starts and they've been a little cautious to start that clock formally partly because as the work moves along they've been doing different testing there's private roads within certain areas but most of hanover one through three which we all have said is east of 95 is predominantly constructed in fact a substantial amount of han hanover four through seven which [00:40:32] is western more western hanover is well underway as we speak now in fact a lot of the calls we're getting um our folks on the western side saying what's going on there's been some confusion about certain uh mr stumman you mentioned an issue that you had uh recently all points was blamed for that it turned out it wasn't all points but there's a lot of activity going on in our community And you're seeing a lot of the work, which is what we've been all hoping for. [00:40:59] But at the end of the day, it really comes down to when will my home be eligible for connection? And we're finally getting to that point with the eastern side of Hanover. We have pressed them on picking up their pace on the connections. And also we're cautioning them that if you're not able to go make that connection within a fairly reasonable period of time, don't notify them of availability for connection. [00:41:25] because some folks were paying in, but it was taking them 60-plus days to go back and make a connection. That's not really the service we're expecting, and they have now contracted with additional subcontractors to assist with those connections, so we believe that pace will get picked up. That is a change because initially, if you recall, they said they were using subcontractors for the fiber installation, but that their own team was going to do it. What they found in Hanover, and we actually knew this all along, but they had some delays. [00:41:58] Hanover's take rate of people wanting to sign up for service, percentage-wise, is substantially higher than any of their other service territories. But what that means is it's a good thing from a demand standpoint, but they've needed to staff up to meet the demand, and they have been a little bit behind in that. [00:42:15] So we're seeing the connections pace pick up. But going back to that first notification, since that clock has not started, we anticipate for the greater part of 2026 which will be most of the connection time period folks will be able to connect with no additional uh charges to run to the homes which that's that's the benefit of the delay the downside of the delay is people are very eager to get this service uh miss dibble and mr stoneman you both have been strong advocates for getting service in the western end it is moving now at this point and we're seeing real progress now's the time where [00:42:53] They really need to pick up the connection side, though. And we've been leaning on that. Ms. Dibble, Mr. Herzberg's been on these calls. Ms. Dibble's engaging with us on the Western side. That's where you're going to see our push. If you recall, the delay originally was make ready work. [00:43:09] They kept calling make ready. That's getting the polls ready or getting the right-of-way approvals. Well, we got through that. The next phase was getting all the contractors on board, getting in. We're seeing that progress is finally on track now with the revised contract through December of 2025 to be on time. [00:43:29] It's the connections that we're pushing on now. And so I think I'm eager to have the providers here in August to help emphasize that need that we better be well over the 40 that you heard here today come the August update. [00:43:45] But this is finally when the rubber is meeting the road and we're delivering on what we promised a number of years ago. And so we're excited to see it come to fruition. And I will tell you, the folks that have connected have been pleased. The service and speeds that they're getting, they're extremely pleased with. [00:44:01] But the pace of getting those connections to them in the all-point service area is not at the level that we expect and will be pushing on. And Mr. Rogers also touched base on that 5%. If you're in the 95% and you're seeing progress, you're at least seeing hope. [00:44:18] But if you're not in the 95% right now, there's not a project planned in to get to your home. That BED program is that gap filler. But I will say that we haven't fully banked on the BED coming through. So if the federal funds, people are asking me, well, what if the federal government claws back some of that money or doesn't award some of that money? We've been working with the providers. We knew from day one that there were gaps. [00:44:45] And the providers have said that once the contractual obligations are met, they're looking to expand in other areas regardless if we get beat or not that is that is an obligation we should hold them accountable for and make sure that until the last person that wants service gets it we're going to keep pushing on it and I know it's been a priority of this board to make sure that that happens and at a staff level on your behalf we're continuing to make that push but we're far from the finish line we got a lot of work to do appreciate all of Mr. Rogers work and Mr. Kilduff's work in the board's advocacy but it's great that we're able to tell you we're seeing this progress [00:45:24] but we're going to we're not going to stop until until that last person gets it so mr chair thank you for the chance to fill that in thank you for your comments mr bedesky i have a couple things i just decided to go last okay and i'm kind of glad i did because mr bedesky had covered uh several of the things that I had on my mind. One thing I wanted to mention was the information page that you had. I do think it would be good to have some good information for these commonly asked questions. Originally, a few years ago, it was, you know, what is VATI? And what is this? And [00:46:01] what is that? Those questions are old. So I think we do need some new updated questions. You know, what is a drop? What is a survey? And so there's a difference between a drop and a connection. because as you know the drop is just the line up to the house and they put the box on the wall outside and then they have to come back. I think it's important that we list that the final connection requires an inside appointment with the provider and we should list that phone number and so if we have a resident has the box and maybe they got an email from the provider or a phone [00:46:38] call and missed it they're sitting there waiting they they're like when are they coming back I haven't heard anything we should let them know call here's phone number you can call once that once that box is on the outside of the house call this 888-217 whatever the other four digits are number schedule your inside appointment and I think that will help us get some of these people connected sooner the other thing I think is worth pointing out is a lot of our citizens they don't know what bead is they just see bead they don't know what that is so the five percent these are [00:47:12] people that are technically unserved they're not part of the VATI program they may have very long driveways or the other issue is more commonly that Comcast or another provider runs down their road or in front of their road but it's not on their street so in their mind they're unserved but in the VATI program they are served because Comcast is on their road or at the end of their road And these are people that we don't want to leave out. [00:47:48] So we're still working on these people. For example, we have Sandy Valley Road. Comcast runs down Sandy Valley, but there's a side street called Oak Trail something. Well, none of those people have internet, but the VATI program says they're served. [00:48:04] So it's groups like that, and the people behind Cold Harbor National Battlefield is another area. It's Crossing Oaks Trail. the people behind Cold Harbor National Battlefield. That's a pocket of people that's tough to get to. [00:48:19] You have federal lands, there's only one way back there, and Comcast goes down Beulah Church Road, so they were kind of left out. So we want to make sure that these people are not left out, that they're included in Bede, and that we work with all points to make sure that they put together a good plan and have a good plan and a competitive number so that we can help these people also. [00:48:42] I do appreciate all your work. You're very diligent on the weekly calls with All Points, and I think those calls have been productive to let All Points know that we mean business as far as staying on top of this. I can confirm that they're behind in Old Church on the connections. They did promise that they would bring on an additional crew, and I can confirm that they did do that. How do I know that? Because I went out and met with them in Christian Ridge on a cul-de-sac and watch them work wasn't there to manage it not there to oversee anything but i [00:49:19] was i was there and i saw them pull up and i said who are you and i had the all points decal on the truck we're here to do this and they were going underneath the road they were going underneath driveways but they weren't going to the houses so uh this kind of work continues to be done i think they did uh four residences yesterday on one cul-de-sac and then on my way out of christian ridge going down old church road there was an all points truck at the church there on old church road and they were working over there so so that's encouraging and i bring that up for any citizens who are watching the meeting uh today that we are working on it uh it's taking longer than [00:49:58] than we thought some of it's been all the rain some of it's the snow some of it's high demand and some of it is just these things take time and it's a lot of work and in some places in the west We know that the polls weren't ready. So they made a decision to go underground that takes longer. It's more work But it is taking place. So that's good to know for our citizens that we're not forgetting. We're not giving up I think that's all I have for you, sir. Anything else? Okay. Thank you for your presentation. Thank you very much [00:50:29] Okay, moving on agenda item 7. It's a presentation transportation update highway matters. Mr. Philip Fraser, please approach sir Virginia Department of Transportation Thank you for being with us. [00:50:44] Good afternoon, members of the board. Mr. Badeski, it's a privilege to be here in front of you guys. First time as the resident engineer in Ashland Residency. [00:51:01] My name is Philip Frazier. Hopefully I'm not a familiar face. I'm not going to, I don't have a specific formal presentation this afternoon. I think you guys have the maintenance report in your packet, so I'll be happy to take some questions on that. [00:51:17] But what I want to do for a few minutes is just give you guys a kind of a fresh introduction of who I am, my background. So I've been with VDOT for 10 years. I started out in a trainee program. I was working in a residency down in Petersburg, spent a couple years doing that. [00:51:37] Then I moved on to our project management office at the district in Colonial Heights, spent two years doing managing capital projects. After that, I had an urge to get back to the residency where we really do day-to-day operations on the road and can support local government through, you know, all things transportation. [00:51:58] So for the last six years, I've been the assistant resident engineer. I've worked with you guys on many different things, whether it's been a through-truck restriction or package of through-truck restrictions, small projects like the one at McClellan and Old Church, Mr. Herzberg and all sorts of things so I've worked a lot with your guys's teams staff level Mr. Vidunas Mr. Hardman Mr. Kildoff I've spent a lot of time with those guys it's a privilege like I said I'm actually a Hanover resident so it's it really is an honor to be able to represent [00:52:34] the department in this forum you know at Hanover County it's really important to me so So with that, what I really want to maybe ask you guys to think about, previously for the last few years, you've received this maintenance report, and then Marshall Wynn came up here and kind of took questions, and I'm more than happy to continue to do that. [00:52:57] I don't see that changing. What I want to maybe propose is I want to be intentional about my time with you guys in this role. So what can I bring to you guys in a presentation style that might be important and impactful for you and the community? [00:53:16] Things that I've thought about and I've kind of spitballed with some of the other localities is maybe, you know, in January or February, I come here and we talk specifically about VDOT's upcoming resurfacing program. So and that's the whole gambit, how much money that the state provides for resurfacing, how much the Richmond district gets for resurfacing and how much Hanover County gets and then where we are prioritizing those funds which roads and how we make those prioritizations and then also the type of applications that we use I know we use words like cape seals and surface treatment chip seal plant mix asphalt sometimes that's a we know what that is and [00:53:56] sometimes we don't so I think that would be an opportunity for me to be a little bit more intentional and provide you guys some information likewise as you get to the end of the year you know we really start ramping up our our snow program getting ready for the winter season so there's a lot that goes into that so I'd like to maybe propose you know kind of a seasonal presentation that is important gives you guys kind of a peek behind the the VDOT curtain and it's just more a little bit more transparent so with that I don't have anything else I'll take any questions about the maintenance report. I'll take any questions about projects, if there are any. [00:54:37] That's all I have. Thank you for your presentation, sir. Any questions or comments from board members? Mr. Stoneman. Well, thank you. Mr. Frazier, I appreciate you coming out here and giving us an update, or at least reintroducing yourself. [00:54:53] As you know, the western Hanover is kind of struggling with our roads out there, and I appreciate any effort that y'all can make out there, especially with the shallow church. I know that that's on the schedule, and I think you've got some work going on on Parsons at the current time, and I saw some e-mails on that. [00:55:11] They were really excited about that. So, you know, I really appreciate that. And so anything you can do to forward some of that priority toward western Hanover would be very much appreciated. But anyway, I just want to thank you. You know, you are very responsive to my e-mails and to my citizens out there, and I appreciate all that you do out there. [00:55:32] Appreciate that. Any other questions or comments from board members? I do have some, sir. First of all, Mr. Stoneman, we want to have a countywide, even balanced approach. And I'll say that the Beaverdam District, I believe, has the most and the longest miles of roads. [00:55:54] So it's one reason why I invited you to serve on the Transportation Committee because I figured that you would see more because you have more miles. And I appreciate you serving so well on the Transportation Committee and also you too, Mr. Frazier. [00:56:09] You're a valuable asset to our committee. We appreciate the time and your feedback. You did bring up some good questions. You know, what would you like to see? So I do have some feedback for you to answer your question. I think it is good to inform our citizens, you know, what is the process on maintenance concerns? [00:56:30] And we've talked about this in Transportation Committee, the VDOT website. You know, grass cutting, fallen trees, limbs, all those types of things. And, you know, so for citizens to write their board members sometimes, you know, I probably won't be checking emails till tomorrow. [00:56:52] So if somebody writes me at 11 o'clock about a tree falling, I'm not even going to know. And I think to be efficient, it's good for our citizens to know there's a process for that. And if it's in the VDOT right away, the process is through VDOT. [00:57:07] That is absolutely correct. Every opportunity I get to give a plug to our customer service center or CSC, I do so. And that is exactly how we like citizens and all members of the community to report maintenance issues. Or if they're looking for information on a project update, they're requesting a speed reduction for a road, any of those items can actually be submitted through our customer service center. [00:57:32] The number is 1-800-FORROAD. So that's 4ROAD. I think it's a 1-800-837 number, but really what happens with that system is you make the phone call and you actually get routed to the location in Salem, which is where our call center is located. [00:57:56] They will collect the information from the citizen, cross street type of problem, whether it's a pothole or a down tree, and then what they do is they then route it to the appropriate group. So if it's a maintenance need, a pothole, then it gets routed directly to that area headquarters. [00:58:14] So we have three area headquarters in Hanover and Montpelier, Ashland, and then actually it's four. We have Mechanicsville and Elko actually serves both, Hanover and Henrico. But what happens is when you submit that work order, it gets routed to the appropriate area headquarters for response. [00:58:32] Now, if there's an emergency, then that gets handled a little bit differently. it can go directly to our Traffic Operations Center down in Colonial Heights, which then our superintendents might get a phone call at 1 o'clock in the morning to say, hey, there is a downed tree with the road blocked, and then we can get folks out there immediately. [00:58:50] So I would always encourage folks to use that hotline, you know, and, you know, we do our best to provide a response back within 10 days. I will be honest that, you know, after certain events, we get an influx of calls and sometimes folks get missed so i understand that that that can be a concern when folks uh are told to use the hotline but we we really try to do a stand-up job of providing good customer service in response is there an emergency hotline number that you share or when you say if there's an emergency [00:59:26] is that different than the 1-800-4-ROAD no it's the same number same number okay okay well that's good to know and then the other thing that i uh as you brought that question up i processed what you what you said and here's another one for you you know what vdot maintains and what vdot does not maintain uh so grass cutting in the median at 360 twice a year whatever that is how that works no matter how much rain we have whatever that schedule is those types of things are would be would be good i think for board members to know because we do get those questions you you absolutely [01:00:06] do and i i totally understand the pain because um you know i wish i wish sometimes we could cut our grass every week but you're right there's kind of a certain number of times that we cut our grass but i would be happy to kind of prepare a presentation in the upcoming future to kind of discuss our maintenance operations that's that's no issue well that would be good my final comment is 606 and mcclellan when drivers follow the posted advisory my opinion is it works and so you have the yellow sign you have the yellow flashing lights it's clearly marked 30 and when [01:00:44] i go through there at 30 and i'll slow down hit the brakes whatever when i go through there 30 it it i think it works and i want to thank you for all the diligent work you did on that that doesn't mean everybody follows the advisory but that's drivers so i encourage everyone to follow the advisory at 606 mcclellan that's all i have sir thank you very much okay i appreciate it look forward to working with you guys okay next on the agenda is another presentation road project status reports mr. Randy Hardman director [01:01:18] Hanover Department of Public Works thank you for being with us sir so chair members of the board for the record my name is Randy Harbin director public works today I'm gonna walk through the quarterly status update first project we have there is a u.s. route 301 third southbound lane currently we're in a delay for that project when we started pre-construction activities we found that more utilities had been installed in the area since we did our utility surveys so we're currently working with those utility service providers to get [01:01:57] plans together for relocation as soon as those relocations occur we will move forward with construction we're hoping that happens in the next few months Shelley Drive paper street paving that project we have finalized our stormwater management plans for that project, and the contractor is engaged. We are hoping that we can begin construction out there in August of this year. The fall line trail construction should be [01:02:32] complete at the end of this month, early next month. Also for that project, the county has just bid a Godway sign contract that we will be installing signs for the fall line trail. We're working on awarding that contract currently. Route 1 and Route 30, turn lanes and traffic signal, we're in the design phase there. We started right-of-way acquisitions on two of the four properties impacted. However, the stormwater management basin there that you see, we're still under design, so that has delayed right-of-way acquisition on those affected properties. We had [01:03:11] a meeting today regarding that design, and we're pushing forward for that to be worked out. Once that has been finalized, we will update the schedule and we will begin right-of-way acquisition for those parcels. The Route 301 Hanover Courthouse Sidewalk Improvement Project, we're still in the design phase, but what you're seeing there is the latest and greatest hot off the presses. [01:03:39] We've been going back and forth with VDOT on trying to figure out how to make that northern crosswalk work. That northern crosswalk is a little challenging because on the other side of 301, there's really nowhere to land. And VDOT has this term, logical termini, that you have to put somebody in an area that it's safe to travel. [01:04:01] So we've accomplished this by putting in kind of two different refuges. The one refuge is directly adjacent to 301, is a place where a person could stop, and then they can continue to that far south refuge. Now, that would be logical termini from the perspective of if you get there and you're unable to continue in any direction, you could turn around and go back across 301, and that would meet the ADA requirements. [01:04:28] The other challenge we had, VDOT was looking at this. If you're familiar with the intersection, there's a lot of pavement out there right now across from the Bale Bondsman and the cafe. So their concerns were operational, and they didn't know where traffic was going to go if we put a crosswalk there. [01:04:44] So what we decided on and what their recommendation was to reorient or realign St. Paul's Church there. So what we've done is basically turned it up to more or less a 90-degree intersection. The red hatched area there is the suggestion from VDOT that we go ahead and eradicate all that pavement and install gravel just like the bail bondsman business as well as the cafe have so it looks like it's not part of the road to separate it. [01:05:14] We have gotten concurrence from VDOT on this, but we haven't got official approval. We are submitting this design for approval from VDOT in order to move forward with official design activities, and that will be the next step. Lewistown Road, Ashcake Roundabout, we are in the right-of-way phase. [01:05:37] The next step, once we clear right-of-way, we will start utility relocations. The Attlee Road, Business 360, Cold Harbor Roundabout, the roundabout in downtown Mechanicsville, It's at 40% design phase, and we continue to coordinate with utilities in that area. [01:05:57] It's very challenging. As you can see, there's businesses in all four corners, a lot of utilities underground, so we've been working through that. Our next steps are really to develop the 90% right-of-way plans so that then we can start right-of-way acquisitions in that area. One opportunity that's presented itself is we've heard a lot of comments from the communities about how this is going to impact their daily activities, not only from the businesses, but just getting through that intersection. [01:06:22] And with roundabouts, roundabouts aren't made in a day. The concrete in that center island is a, I mean, it takes a while to pour. You have an external curb and gutter line, you have an internal curb and gutter line, and then you have the truck apron. [01:06:39] That could take a month just to have that concrete cure. What VITA has proposed, and this is something they're doing in other places, is using an asphalt truck apron. So it's still going to be curb and gutter on the front, curb and gutter on the back, but in the middle it's asphalt but the treatments that we've seen VDOT use it looks like concrete they can dye the asphalt they can stamp it so really there's no aesthetic difference however it can be installed in a day so it greatly increases the construction and the potential for detours in that area which we've heard quite a bit of a consternation from the folks out there [01:07:18] so we're hoping to investigate that further and figure out if that is something that you know we can implement on this project. Creighton Road left turn lanes, that project is underway. The design continues. We're advancing to 60% utility field inspection plans. The next steps, we're going to put our standard public works road improvement signs at either end of the corridor so people, when they see the activity starting out there, they can call us and we can give them an update. [01:07:48] And then also, one of the next steps will be to advertise for a willingness to hold a public hearing. The Route 301 54 roundabout right down the road here. We're finalizing the 40% public hearing drawings with the anticipated public hearing in later August. And then the next steps will be to begin the 60% right-of-way plans to begin the right-of-way acquisition process. [01:08:19] Creighton Road and Creighton Parkway, Walnut Grove Road roundabout. Again, we're 60% design phase. We have begun right-of-way activities out there and we have obtained right-of-way authorization and notice to proceed from VDOT. We have completed the MOT analysis for the project and submitted to VDOT for their concurrence. The next steps will be to continue with the right-of-way activities as well to prepare for utility relocation services and finalize the MOT for that [01:08:55] project. Sliding Hill, Peaks, Ashcake, and Mount Hermon Road roundabout. We've held the public hearing, had the utility field inspection. We received VDOT design approval, and the next steps will be to prepare the right-of-way plan submission for right-of-way acquisition. Ashland, Ashcake, Greenwood, Blanton Road, Roundabout. We held the citizen information meeting in May. We have begun preliminary MOT discussions with VDOT. We actually had a discussion, about an hour-long discussion [01:09:32] with them yesterday on this project, and I wanted to point out that on the status report sheets you have in there. There is a baseline schedule, a revised schedule. The revised schedule is wrong on that one. It reflects a 10-28 construction start date. It should reflect a 12-27. So it's going back a year. So we should be starting a year earlier than what it shows on the plans. [01:09:58] And then the next steps would be to continue to develop the 30% design plans and finalize the scope with VDOT in September. Route 54, Goddens Hill, return lanes. We changed engineers a couple months ago, so we're in the process of getting them under contract, and once that occurs, we will start the process with the new engineer. Pole green widening. Right-of-way activities continue on this project. If you can see up there, we've got 54 different properties. We need to [01:10:32] acquire some portion for right-of-way. We have cleared 36 properties, so that leaves 18. We are still negotiating with all of those folks. So the next steps will be potentially to hold a public hearing in September to request authorization to file certificates of take for those properties we can't get to voluntary settlement with. Again, we are talking with property owners daily to try and get to that point, but that is something that may happen. Atlee Station Road Widening Phase 2, [01:11:08] I will give a shout out to our IT and GIS department for this map. This is something that we're going to implement on future projects. The previous map that I just showed you with pole green was just something we did in-house. This is actually real GIS. So those colors will change. It looks a lot better. But as you can see there, there's 38 properties on phase two that need to have some bit of acquisition. We have started the right-of-way acquisition package preparation process, but we have not submitted those to any property owners yet. So that will [01:11:44] be the next step as we look towards future months to start getting those in the hands of the property owners out there. And then phase three of Attlee Station Road is just a continuation of phase two. [01:12:01] 10% plans have been submitted to VDOT and we've met to discuss their comments. The next steps will be 30% design submittal to VDOT and the county for review and we're planning for a citizen information meeting in the fall. Rule paving and safety, full depth reclamation that used to be trench widening, but now it's full depth reclamation. The past quarter, the board approved the FY26 road segments, which are shown on the top there. The next steps over the next quarter will be that VDOT actually puts that contract out to bid and a contractor is identified, and then we [01:12:37] move forward with the work. In the Hickory Hill road improvements, we've completed the survey, the utility location and field work activities, and we have begun the preliminary 30% design plans. The next steps will be meeting with VDOT to discuss preliminary findings to establish agreement on what the road design looks like out there, as well as speed limit and overall design approach. I would just let the board know that we do have routine meetings with not only air [01:13:14] consultant who's doing the road design, but for the engineer for tract. And as we design air road, we're making sure that air road and their improvements fit together. So it's a coordinated effort. And that was the last project. If you have any questions, I'd be happy to answer them. [01:13:34] Thank you for your presentation, sir. Any questions or comments from board members? I believe I have maybe two, sir. Okay. So I was reading through the status report on the Creighton Road left turn lanes. [01:13:49] Yes. I'm sure you know this document better than I do. The way I read it is some of the dates have been pushed back on the milestones, and it seems like that's possibly because it was a change to alter the curb and gutter or add curb and gutter on Creighton Road let me find that one there that would be on page eight of the project status report so so one of the things when I was putting this together it appeared that um on the left side you know that's where the big ditch is that's [01:14:27] where um what is the subdivision sleds on the sleds run side so there was a conflict there with having a ditch and new storm sewer right beside each other so they decided to put curb and gutter to help make it easier to construct in that area as well as limit the impact of those property owners so that has changed the design slightly but it was from a perspective of making sure we were being one efficient and and two not taking more than we needed or not requiring to do something we needed when we didn't need to do it so minimizing that footprint i understand and i [01:15:04] I remember a year or two, I don't know how long ago it was, we discussed that large amount of area. And so this seems to be a good thing. Do you believe that this alteration is worth a good consideration if it's approved? [01:15:22] I think it is. I think that, again, the devil's in the details on what exactly it means, but from a conceptual perspective, it's moving in the right direction. Okay. I attended the Mechanicsville Library's chair of the Transportation Committee for the old Mechanicsville Roundabout and you know, we heard the citizens you were there. I was there I think it's a good idea to look into that other The asphalt concrete, you know, that was highly you know, the detours are tough there and when I've read that A couple weeks ago, maybe it was in this. I thought that sounds like a good idea [01:16:00] We're gonna try it. The other thing I mentioned with that, you know there's some serious detours in the plan for the Creighton Walnut Grove Creighton Parkway let's see how this goes you're the professional not me but I would ask you just to kind of keep this in mind for the other one also we were spoiled in the first few roundabouts we've done where we were able to keep traffic open without having a really detour Creighton Coal Harbor as well as Studley Real Point as constrained as that one was with the skewed roads the Blanton it's we're looking at some some some detours on these projects that we're [01:16:40] looking at every Avenue possible to one cut down construction duration and to avoid those long-term detours sounds like good good ideas to consider well thank you very much that's all I have thank you for your presentation okay moving on next on the agenda is another presentation agenda item 13 US route 33 gateway small area plan miss joanne hunter senior director handover community development and planning thank you for being with us good afternoon mr chair members of the board mr podesky this again today is just a project update for the route 33 small area plan no action is [01:17:19] required today there will be a public hearing as a comp plan amendment for the small area plan on your august agenda next month so as you know when we worked on the comprehensive plan that was adopted in 2023 we took a long look at our economic development zones they all used to be categorized the same way we went through and categorized it into three different types of economic development zones one was an emerging zone which has had a lot of greenfield sites revitalization zones and then some of our existing uh zones such as like the hanover air park and [01:17:57] things like that um and then with the adoption of that the envision hanover plan we determined that we should do a small area plan for each one of those economic development zones back at our retreat in may of 2024 the board went through each economic development zone and prioritized an order of how to address the small area plans which ones would come first all the way through and route 33 was determined by the board to be the highest priority it was having a lot of development pressure it had a lot of land availability and it also has proximity to [01:18:35] public infrastructure so the goal of that small area plan was twofold one to work collaboratively with the community to find a unified vision for the corridor and then it's also we heard during the comprehensive plan that people didn't know these were economic development zones so it was another opportunity to get that word out to our citizens and our community when they are live near an economic development zone so the small area boundaries for this project was to the north is Winds Church Road south the Chickahominy River or the Hamrico [01:19:12] Hanover County line Grassy Swamp Creek to the east and to the west about a thousand feet west of route 33 on we started this small area plan back in January visioning and meeting with the public was the highest priority we met with them in January did that in January and February we did some surveys and other engagement as well as our public meeting through March and April we analyzed that information that we got in May we reviewed again with the citizens [01:19:49] what what we heard from them and our plan to address their concerns so the public the Planning Commission held a public hearing on the small area plan last week at their meeting they did recommend approval and as I said this would be going to the board next month in August for public hearing and it would adopted as part of the comprehensive plan if that's what the board chooses to do so like I said transparency and getting the community's viewpoints was significantly important we spent a lot of time trying to engage our citizens we [01:20:26] had a project website that had over 4,000 views well over 300 active participants and over 580 comments on that does this plan our first meeting we held our meeting in at kitchen 33 trying to be in the corridor it was standing room only we had 94 participants in kitchen 33 after that meeting we had did a survey that we shared with them at that meeting we had 251 people respond [01:21:01] and complete the survey and then in our in-person meeting number two which is in May to tell them what we heard and how we were going to address their concerns we had 76 participants so it's pretty robust I'm very grateful to the South Anna residents who participated and I think we're really were able to come up with a plan that's really full reflective of the community so one of the some of the key themes that we tried to find out from the community at the first meeting was what were their concerns with the corridor traffic on Route 33 was a concern, appearance of some of the commercial and industrial buildings. [01:21:41] The assets they found was the access to major transportation corridors and the opportunity for natural resources in the study area. And then when we talked to them about what would they like this to be in the future, they really wanted it to maintain the rural character and feel. [01:21:58] They wanted the area to provide some neighborhood-oriented services. They preferred economic development that did not generate an extensive amount of traffic, more of low traffic generator users, and they wanted greater recreation opportunities. [01:22:15] And then, so we got that information from them through their surveys. They gave us some good guidance on how they wanted the design features of the area, talking about providing -- feeling very strongly of providing landscaping and buffers, that they They were okay with industrial development if they could drive down the road and it was hidden behind trees and they didn't see it. [01:22:39] They preferred limited building heights. They wanted more traditional architecture instead of modern buildings, reduced prominence of parking lots, and smaller signage. So that was all great information. With that, we were able to take that and put it into a plan. [01:22:57] So the small area plan will have a conceptual plan with it that shows how the corridor and area can be developed into a cohesive campus environment. There's four character zones, and we'll go into those in more detail next month at the public hearing for this, but it addresses things like site design, building design, and placemaking techniques in each one of those character zones. [01:23:23] So as I said, we did have the public hearing. Having all that participation up front seemed to really work because at the public hearing we only had four speakers. The plan was approved by the Planning Commission with two minor modifications which we're working on to have that included in the information that goes to the board. [01:23:46] And as I stated, we'll have a public hearing next month, August 27th, on this plan. the board did direct us to do two small area plants a year this was our first one we now are currently going to number two which is the route one corridor that one will be very different that focuses more on a revitalization area where this one was more of an emerging area we have a RFP under review right now and we're [01:24:19] looking at scheduling that first community meeting for that corridor and working on that plan next and then the next ones that come after that is the route 30 corridor which is also a revitalization area mechanicsville village creighton road pole green then the 95 old ridge area atley elmont hanover industrial park and lewistown road so those last three are more of our existing business areas and then the first seven sort of mix between revitalization and emerging [01:24:57] economic development zones does anybody have any questions or comments if not we will thank you for your presentation ma'am Supervisor Dibble were there any other comments I can wait if there are I just have one question the route one corridor that the request for proposals under review what is considered the route 1 corridor yes so the study boundaries would be from the Ashland [01:25:33] County line all the way to the Hanover Hemrico County line would go about 500 feet on either side we are picking up some areas like out to the interstate we're like the Home Depot that area is and you have those vacant gas station we're picking up some of that area as well so the home depot area and the gas station would not be considered the atley elmont interchange they a lot of them overlap right so i i guess i was wondering maybe should those two the route one corridor and atley elmont interchange maybe go [01:26:09] back to back because they kind of overlap just food for thought and i know that we are having another work session mr brideski this coming up fairly we could look at the priorities again yeah the board it's not scheduled yet but we're looking in the September timeframe to do a board workshop if you recall this priority list came out of your last board workshop the only challenge with combining those two right now is we've already bid number two number eight [01:26:48] wasn't planned until substantially later we can certainly look at that if it's the board's uh desire but that would delay the award on the route one one at this time and so i'm not sure if we want to delay that at this time um or or keep it as two separate as we discussed [01:27:10] last time any other questions or comments from board members route 33 supervisor dibble yes thank you uh mr hersberg i just want to um give a big shout out to miss hunter and mr pompey from our planning office for the professional process that they worked on and I think it was very [01:27:43] successful. The outreach in the beginning from your department, from Ms. Walker and her team were spectacular. We got the people out. We actually, I think we had more than 94 people because there simply wasn't space for people to get in the door. So South Anna does show up. We care and we love who we are. We talked a lot about what we want, but more importantly, what we do not want in that corridor. And the view shed is very important. And I think that the document that we [01:28:20] have come up with truly reflects what we heard from these citizens. And Mr. Ledbetter and I have been in the community taking a lot of phone calls and emails and talking to these people. And I think we really have a document that reflects what we heard and reflects who and what Western Hanover is and wants to be, not just today, but in the future. So again, I want to really thank you for that process. And it worked very well. And I look forward to getting started on Route 1. And we are, [01:28:58] of course, focusing on Route 1 next as economic development zone because of the tremendous opportunity that Henrico has created for us with their new sports center. So we're trying to use that and boost that economic corridor in through there. But again, we want to make sure that we have design guidelines so that it doesn't look hodgepodge, that it really looks like a planned linear area and has some continuity. So I look forward to getting started with that one. And again, appreciate all of your work, Ms. Hunter, and look forward to making those [01:29:37] tweaks in the next 30 days and getting it right in August. Thank you. Thank you. Supervisor Floyd. Sorry, I just want to circle back again about the Atlee-Elma interchange, what Ms. Dibble had said about using, you know, the gift that Henrico has given us of their sports center right there. [01:29:58] I love that we're doing the Route 1 corridor because of that, but it does kind of blend then over to the atley elma interchange area so i would like to possibly revisit you know the order of this list i think the atley elma interchange should go after the route one corridor because they after the route one corridor one is done and i don't want to screw up the request for proposal um but that might then show us then what would be good then to do in the atley elma might have a better flow okay does that conclude your comments ma'am yes maybe we can discuss it at the uh retreat okay [01:30:38] thank you for your comments any other questions or comments from board members mr chair mr bedesky um can i address discussion on it at this moment because we are about to award a contract and if not we will be delaying the award of a contract if it's the board's desire to combine the two just understanding the the time and effort that goes into these so route 30 would be pushed back mechanicsville village would be pushed back um and we basically take the rest of this fiscal year into or i'm sorry the calendar year into next fiscal year to combine them and if that's the board's desire we're glad to do it we were working from your desire with this list there is certainly [01:31:17] logic to your to to the comments but if we do this we are likely going to be delaying um and i don't know how we issued the rfp if we can expand the scope or not that's something we'll have to explore um but likely any other studies will get delayed because of the additional scope of work and staff uh this is at the board's desire and if it's the board's desire to do that we're here to to do that for you um i just want to be honest with what what that means to other projects i know other colleagues have wanted to see other areas addressed sooner than later [01:31:53] if we add additional scope it just adds some additional time mr chair ah sorry ma'am can i piggyback on that supervisor pritchard i know we all hate making sausage from the desk right and i i share this in our intersection or interstate you know what i mean with ms floyd i think the two of us need to sit down with ms hunter and and understand this process a little bit better for our interchange and and we can go from there because it's a big decision to make [01:32:32] Sitting right here, right? And I just want to make a logical decision here and not throw good money after bad. Okay I have a question for you. You know, I'm not an expert on this plan. It's not in my area Is it finished almost finished? Are we at a point where we're I see you have the green check mark? [01:32:53] Does that mean it's complete? Yes, the plan is complete. It went through public hearing from the Planning Commission. We have about two or three minor tweaks to be made as part of the Planning Commission recommendation But you will have a copy of the plan in your packet next month, but it is a complete document Okay, and you know, I've heard some comments about the at Lee. I'm on again. It's not my area I'm not an expert. I would like your your opinion on the geography Are these are these two areas close enough? You I heard you use the word overlapping. Mm-hmm [01:33:33] Yeah, should these two areas be considered together at least to some degree not trying to put you on the spot But to some degree, I think I think they have slightly they may overlap a little bit, but slightly different focuses So the route one corridor was more of a revitalization corridor The it does have some greenfield sites, but but pride and primarily we're going to be looking at things like design standards and things like that where I think that Atlee-Elmont will have different things, that there are some existing, [01:34:10] but there are also some large, large properties that could be very impactful on how the community develops. So I do think that they would almost have a different group of people representing the two plans. Okay, so it sounds to me, just so I understand better, that's all I'm trying to do, [01:34:33] I'm not trying to make the decision, because it's not my area, that the thought or the idea that has been mentioned and discussed here today is not to combine them into one plan, but to have two separate plans that are back-to-back. Is that correct? [01:34:50] That's exactly what I'm saying. Okay. I think that makes sense to look at that. I think it does. At least look at it. Okay. That's all I have. Thank you, ma'am. Thank you. Okay, next on the agenda is Agenda Item 9, Closed Session, Mr. Stoneman. [01:35:07] Thank you, Mr. Chair. I'd like to make the motion that the Hanover Board of Supervisors move the meeting into closed session pursuant of the following authority. Please state your name the magisterial district in which you live no slide Presentations handouts go to the okay, and you'll have up to five minutes the time will be kept by mr. Stoneman I am the advocacy chair of the Sierra Club Falls of the James group of which Hanover Falls in our territory Sierra Club is the oldest Grassroots environmental organization that advocates for the protection of our planet people and places [01:44:33] We oppose Luckstone's proposal to develop a rock quarry, concrete, and asphalt plant known as Project Noel along Verndon Road and believe that the project conflicts with Hanover County's comprehensive plan, which was adopted in 2023. [01:44:49] Our opposition community has legitimate concerns about the irrevocable impacts of this project, including the risk of well water contamination and disruption, air and water pollution from blasted particulate matter, concrete and asphalt production and runoff, overburdened disposal and vehicle emissions, noise and light pollution from industrial equipment activities and blasting, the public safety concerns of increased heavy-duty truck traffic on rural roads and near schools, property damage and devaluation from blasting vibrations and pollution, and the loss of over 1,200 acres of woods, wetlands, and open spaces. [01:45:27] Sierra Club's members are deeply committed to protecting the integrity and character of Hanover County's rural environment, land, water, and communities from polluting projects, and we urge the Hanover County Board of Supervisors to deny Luck Stone's conditional use permit and special exception applications for Project Noel. [01:45:46] And we realize this will come before you all in the fall, but we just wanted to get ahead of you Head of it with our members. We have 400 members currently in Hanover County Thank you very much for your time and the opportunity to speak this evening. Thank you for your comments Is there anyone else present who wishes to address the board during citizens time seeing none citizens time is now closed Next on the agenda is planning public hearings. Mr. Andrew Pompey deputy director planning department thank you for being with us, Mr. Pompey. Thank you, Mr. Chair. The first public hearing is for [01:46:22] a special exception that would allow a dog or cat grooming facility in the Cold Harbor District on a property off or along Peppertown Road, which is east of Mechanicsville. The property is outside of the suburban service area, which is the county's designated growth area and designated rural agricultural. The subject property and most of the surrounding properties are zoned A1 agricultural. In that zoning district, commercial kennels and handling dogs including grooming requires approval of a special exception by the board of supervisors. This is an overview of the property. It's a non-conforming A1 lot about one acre in size and the existing home dates to 1977 [01:47:00] and has direct access to Peppertown Road and there is a detached garage to the rear. So again, this request is to allow a dog and cat grooming facility. This business has been operating and received a notice to violation, but the owner quickly applied for the special exception and spoke with the surrounding property owners about this use to try to bring the property into conformance with ordinance requirements. The applicant lives on the property. They would like to use a portion of their home for this particular business. The business area, which I'll show on the sketch plan, is attached to the existing dwelling where the applicant lives. This business [01:47:34] is solely a dog and cat grooming operation. There's no overnight boarding services. This is a sketch plan, all of our special exceptions require submittal of a sketch plan and it shows Peppertown Road and the driveway off of Peppertown Road that the owners use for personal use and the customers will use when they drop off their pets. The customers will go down the driveway through a gate to the fenced rear yard and then access the grooming area, which again is attached to the home, the yellow rectangle you see, and that will be used for this particular business if the special exception is approved these are views of the site the front of the home on the top left and the [01:48:13] portion of the home on the right is where the grooming facility will be located you can see the rear parking area which is fenced in and then there's some interior photos of the grooming area and where the dogs are kept while they are at the business as i mentioned this property is a non-conforming a1 lot about one acre in size along peppertown road and it's adjacent to the peppertown farm subdivision there's a mix of property sizes in the area it is a rural residential area with lot sizes ranging from 1 to 100 acres. Most of the area, again, is zoned A1. You know, use like this, any home-based business could have the potential to generate additional noise and [01:48:51] traffic in the residential area, but there are conditions that limit how this particular use will operate to help minimize impacts, and I'll go through the conditions on the following slide. Staff is recommending nine conditions to address the specific use. Many of these conditions align with the use standards for home occupations. The use will be limited to pet grooming. No overnight boarding would be permitted. No more than 10 dogs can be on the site at one time, excluding the owner's dogs. Hours of operation are limited to Monday through Sunday, 7 a.m. to 9 p.m. Those hours align with our home occupation standards. In addition to any residents that live in the [01:49:30] dwelling, such as the applicant, there can be up to one non-resident employee that, again, aligns with our home occupation standards. The fence must be maintained around the rear yard as shown on the sketch plan and it cannot be unrepaired for more than 30 days. One sign is permitted up to two square feet non-illuminated again that aligns with our home occupation standards. Parking area three parking spaces must be marked in that rear area aligning with ordinance requirements. To ensure that all these conditions are met including the features shown on the sketch plan planning will inspect the site within 90 days of approval of the special exception should it be approved [01:50:08] and then there's the standard condition we have with all our special exceptions that the use will be in conformance with development regulations that concludes staff's presentation the applicant is here tonight but does not have a presentation planned and is available to answer any questions the board may have any questions from board members from mr pompey supervisor floyd um condition Question number two, number of dogs cannot exceed 10 dogs. Is that per day? [01:50:36] At any one time. So, you know, if... Okay. That makes more sense. Yeah. Yeah. Any one time. All right. Any one time. Any other questions or comments for Mr. Pompei? I have one, sir. Yes, sir. So this is for a special exception. What would happen if the owner were to sell the house? [01:50:54] The special exception would remain with the property. If the use is no longer in operation for more than two years so say she closes the business in 2026 and doesn't reopen it by 2028 it would no longer be valid but the sc itself travels with the owner of the property does it travel with the property itself no matter the ownership yeah so i want to make sure i have it yeah correct so the special exception here would stay with the property for two years and so if [01:51:28] she's sold to a new owner, the new owner could continue the same use under the same special exception. That's correct. But if two years go by and that does not happen, then the SE is terminated or ended. Correct. Is there any responsibility of selling or the owner, the new purchaser notifying us that they bought this? And this is, how do we know about that two years? [01:51:59] That's a good question. We have had in other cases a specific condition that the owner notifies the county when there is an ownership change in the property or when the use is no longer continued. But generally speaking, the only way that we would know is looking at any online records or based on any complaints we may receive. [01:52:20] Okay. We're not going to deal with that here tonight, but that would be something to look at in the future that when there's an SE and the property is sold, maybe somebody should let us know so we know. That's a policy for a different time. Just mention it while you're here. [01:52:36] Sir. Okay, anything else? Supervisor Pritchard. Can I split hairs here about the property in two years and all of that? So let's say they sell their property and they move. The SE stays with the property. But what kinds of changes in the business could be made before there'd have to be, they'd still be bound by all of this. [01:53:04] Is there anything about their changing their business that would trigger the need for a new special exception though? If they are abiding by and operating in accordance with the conditions, there will be no need for a change But say we get a complaint that someone's dropping off their poodle at 11:00 p.m.. [01:53:21] That would violate condition 3 so they either have to correct the situation or come back and amend the special exception Okay, any other questions for mr. Pompeii from board members seeing none. Thank you for your time, sir I do understand the applicant is present. Do you wish to make a statement, ma'am? [01:53:41] So you're available for questions. Okay, this is on the agenda for a public hearing. Is there anyone here who wishes to speak in support or opposition of this agenda item? [01:53:59] Do any board members have any questions for the applicant? Supervisor Dibble. I just really had a general question. Did we have a community meeting? Not the one that y'all consider an official community meeting. [01:54:16] When I got the letter on a Saturday, I was here on that following Monday, contacted Mr. Herzberg on Wednesday. He called me back on Friday and that following Monday, so a week after I got the letter, I had contacted 25 or so of my immediate neighbors and let them know that Mr. Herzberg said he could come on Monday at 9 o'clock. [01:54:38] And so the neighbors that so wanted to come in support of me came, and he met I don't know maybe four or five of my neighbors um so everybody knew he was coming but people work or just didn't care about me being there and um being that I'm up here I'll just mention too that those are way over um what I actually need I only work three days a week and Tuesdays is a half a day and so I'm generally you know it's very small I'm more on a way to [01:55:16] retirement versus building a business I've been doing this since 1992 not at my house but for a little bit at the house thank you thank you any other questions for the applicant mr. Stoneman has a question ma'am please come back well thank you for being here it's not really a question I just wanted to commend you on your business and how well it looks how well you've run it and you've structured it in such a way that it's really no inconvenience for your neighbors and it's probably most likely an added value to living there and so I just say you know because I do have a fondness for the business and and I see [01:55:56] the equipment you have and the way you have everything set up and it's done very well parking in the rear I mean you couldn't ask for a better better situation than what you have and and well good luck on your wind down thank you I very much appreciate your support yep anyone else okay seeing no one else will now close the public hearing. This is in the Cold Harbor District. I did meet with several neighbors and the owner on the property back in May. I believe it was five neighbors, adjacent neighbors, and I did visit the site and tour the [01:56:35] area. I found it to be very clean, meticulously kept. I was surprised. It was impressive and the entire property is clean and neat. The neighbors who were president. We're all in support. I asked, do you have anything to complain about? They said, no. Do you hear, you know, dogs barking that are bothersome to you? None of them said no. I asked a question of the applicant. She had a very good answer that she doesn't allow dogs barking loud that would annoy the neighbors. And I asked what would happen if you got sick and you couldn't work that day. [01:57:12] And she said, the place will be closed. So what that means is she has a good plan for this and she's sensitive to the neighbors. Since then I've talked with approximately ten neighbors surrounding the property and they all had positive feedback. One other thing I want to point out you know in the staff report there's there's a notarized document that says did you talk to the board member before you applied and she put yes she did that's because she did she got the notice she was on the phone with me well I think she wrote a letter first and then I [01:57:50] called her. So she wrote a letter to me immediately. I called her immediately. We set up an on-site meeting very soon. We invited the neighbors. And we did all that before she signed and had it notarized saying that she contacted me. That's the way it's supposed to work. And it was very professionally done. So I think it's an acceptable use for the property. And it's a good, I think it's a good business for the owner and it provides value. If your cat gets fleas, she can help with [01:58:22] that, right? Okay. So with that, I'll make the motion to approve SE 2025-00014, Gary and Patricia Lawson. Second. There is a motion and a couple of seconds. Any discussion amongst board members? Supervisor Pritchard. I just want to say this is a perfect example of why we have special exceptions, that when we've turned down businesses like this, it's because they're problematic for the neighborhood. And we have those special exceptions in place so that we [01:58:54] can make this this kind of thoughtful decision so congratulations anyone else and I'll add to that statement it is a perfect example as to why we have special exceptions so all in favor of approval please indicate by saying aye aye any opposed none congratulations ma'am unanimous okay moving on mr. Pompey the next public hearing item is an ordinance to vacate some unimproved right away within the reserve at Bell Creek. I'll go through this request in particular. It's in the Henry [01:59:33] District, but if it's approved, unimproved right-of-way that was intended for a roadway will be given to the reserve at Bell Creek Homeowners Association. This is an overview of the property as well as a photo of what it looks like today. This subdivision or this right-of-way was recorded as part of bluffs at Bell Creek, two sections of that subdivision, section five and six, And the reserve at Bell Creek Homeowners Association owns either side of the right-of-way. [02:00:00] One thing that's a little bit, maybe a little bit confusing is that this subdivision was recorded as the Bluffs at Bell Creek, but it was developed as the reserve at Bell Creek. So that's why there's two different names. But the reserve at Bell Creek Homeowners Association has requested that the right-of-way highlighted in yellow, which is 60 feet wide, extending from Hardtack Road up to Battalion Drive, be vacated and absorbed into the open space that the homeowners association owns. [02:00:27] So originally this right-of-way again was 60 feet wide and the HOA owns the open space on either side because that was going to be the thoroughfare buffer should have developed. But as you see from the photo and the aerials this property is unimproved. And this is the history of why this right-of-way was dedicated for a future roadway. In 1998 that comprehensive plan in particular the major thoroughfare plan showed a minor collector that would have gone through this area from Verde Lane up to Studley Road across Totopotamia Creek. So it was shown in the comprehensive plan in 1998 and then this development was rezoned in 2000. Since it was shown the major thoroughfare plan [02:01:03] in the rezoning, the conceptual plan that was approved with that case, it showed this future road alignment. Based on the rezoning, the subdivision plat was recorded and the right-of-way was reserved for a future roadway. This road, of course, has not been built yet and then as the conference of plan in 2023 was discussed, we look at our major thoroughfare plan with each comprehensive plan update based on citizen feedback and the topography challenges crossing Totopotami Creek. This proposed roadway, which would have been within the right-of-way, was removed from the conference of plan. Once the future collector road was removed from the [02:01:38] conference of plan, the reserve at Bell Creek Homeowners Association requested that the right-of-way be given to them and added to the adjacent open space since the roadway is no longer needed based on the comprehensive plan. So again, this roadway was proposed. The developer, the original developer of the property dedicated the land for the future roadway. Based on the latest comprehensive plan, we no longer intend as a county to build that roadway. So the homeowners association is requesting that the land be absorbed into the adjacent open space. There's one staff recommended condition, [02:02:13] and that just relates to when the property is transferred, several documents will be recorded at the courthouse on the screen related to the plat itself, showing the right-of-way being added to the open space, some amendments to the covenants for the subdivision, and then an amended open space agreement. That concludes staff's presentation. I'd be happy to answer any questions before the public hearing. Any questions for Mr. Pompei from board members? Seeing none, can you go back to [02:02:46] the previous screen sir I have a question amendment to declaration of covenants is that just taking out the language for this or is it more than that it's just adding this property in as open space for the subdivision so would you say that the amendment would be in line with what we're looking at tonight yes yes that's all sir thank you very much okay this is on the agenda for public hearing [02:03:24] is there anyone here with the homeowners association who wishes to make a statement or be available to answer any questions okay thank you sir is there anyone here who wishes to speak in support or opposition of this case seeing none any questions from board members supervisor dibble i was just going to add my two cents um this really is just housekeeping we took [02:03:56] it off the comprehensive plan and this just closes the loop on that bit of business okay anyone else okay seeing none the public hearing is now closed this is in the henry district i did have a discussion with mr davis who was not here this evening he is out of town we did have a discussion about this and he seemed supportive unless someone came and spoke in opposition we would have to go from there there's no one here to speak in uh opposition so i will make the motion [02:04:29] to approve second oov is that a o oov 2024-00001 a second second there is a motion any and a second any discussion amongst board members seeing month seeing none all in favor please indicate by saying aye aye any opposed motion carries thank you for being here sir okay i believe that that is it for the planning cases for this evening the short-term rental that was deferred so [02:05:08] we do need to go back into closed session while people are here do any board member want to make a comment announcements you know we do that at the end but since we have closed session any announcements from board members I'm just like one of us to tell mr. Davis we finished in 21 minutes okay we can do that anyone else with an announcement before we go into closed session okay Seeing none, the chair recognizes Mr. Stoneman.
