Gracious God, help us to do justice, to love mercy, and to walk humbly with you. All this and more we ask in your name. Amen. [00:03:09] Mr. Chairman, we have a request for the approval of minutes from the regular meeting of January the 9th. [00:03:43] Motion would be in order. So moved. Motion made by Mr. Smith, seconded by Ms. Whitehead. All in favor say aye. Aye. Any opposed? Thank you. Mr. Chairman, with your indulgence, I do have, it is one comment involving two individuals this evening. [00:04:06] And I sadly want to take a few moments to recognize the passing of Jay Cox Jr., who passed away peacefully in his home. He was surrounded by family this past Saturday. [00:04:22] He is survived by his wife, Mary Ann Bell Cox, his three sons, James, Andrew, and Clyde, daughters-in-law, Kelly and Stephanie, and beloved grandchildren. Jay was a graduate of Douglas Freeman High School, where he played football, and then he ultimately ended up being a coach at Tucker High School for many, many years. [00:04:44] He served on our Mental Health and Developmental Services Board and Parents for Community-Based Services for many, many years. He was one of those folks that made Henrico what it really is. [00:05:02] We also have an employee who was a member of our Henrico family for five years. Her name was Alexis Pirro. And the reason I'm mentioning both is because both Coach Cox's service is going to be on Friday. [00:05:18] Alexis is going to be on Saturday. But Alexis was a member of the Henrico family for five years as a peer in substance use outpatient services with Henrico Mental Health. She was the first peer to participate in the county's mobile substance use services unit, and she was a strong presence in our community. [00:05:41] She just celebrated her five-year anniversary when she passed from complications from a previous heart attack. She passed earlier in November of 2023, but her service is going to be this weekend. So in honor of both Alexis and Coach Jay Cox, I am requesting that all flags be lowered for the day of Friday. [00:06:09] I know Mr. Massey is in the audience, so flags will be lowered at all of our county buildings for these two public servants. Thank you, Mr. Chairman. I have no other questions. Thank you, Mr. Manager. Any comments from my Board of Supervisors colleagues? [00:06:25] Mr. Chairman, I have a comment. I was inspired by the awards presentations that were done during our work session earlier today for our public works employees, and it brought to mind an email I received that I just want to read out. It was by a constituent in my district writing about the great job done by county workers, police, fire, and public works in a storm that had occurred very recently since the last board meeting. A large tree had fallen across the street. The neighbor called county police non-emergency number. They were very quick to respond with lights flashing to make sure no one crashed into the downed tree which was very hard to see in the storm fire and public works arrived shortly [00:07:01] thereafter and a phalanx of trucks and equipment they made short work of the task at hand and cleared the road in what seemed like two hours or less and this is the part i just wanted to highlight she states the day-to-day work of public service is often done quietly without much fanfare or recognition and as citizens we take that for granted i didn't want to let this work by county employees go by without telling you about it and thanking them for it i'm sure i'm expressing the gratitude of the whole neighborhood for a great job well done by everyone involved in last night's effort so just wanted to share that kudos by a citizen and thank you to public works as well [00:07:36] thank you miss way any other colleagues yes mr chairman i have two quick remarks if i may first i want to take a quick opportunity to publicly thank an individual who i know my colleagues on this board have worked with for years some of us decades mr jack berry the The president of Richmond Region Tourism has chosen to retire. [00:08:00] And I will tell the folks who are tuned in today, the folks in this room, Mr. Berry deserves to retire. He's probably been talked out of it more times than people I know begged for him to stay. But Mr. Berry deserves his well-earned retirement. [00:08:15] He has served our region for, God bless, over 40 years when it was the Convention and Visitors Bureau. This is an individual who's been an advocate for every jurisdiction in our region, an advocate for tourism, for our visitors, for residents, for businesses, and really a friend to all. [00:08:33] I expect within five minutes after telling us on the board of Richmond Region Tourism that he was going to retire, he already listed two or three things that he'd like to get started on working on. So projects are going to find that man. And, Jack, if you're listening or if you see this later on behalf of everyone in this county and my fellow board members, we thank you for your service. [00:08:55] Mr. Chairman, my second item is I'd like to congratulate a Brooklyn District resident who recently turned 103 years old. Mr. Matthew Odie lives in the Brooklyn District, originally a resident of New Kent County. He made a wise decision to become a resident of Henrico County. [00:09:13] Mr. Odie was successful, owned his own trucking business, successful entrepreneur, served in World War II in the U.S. Army. And I'd like to thank him for not only his service, but congratulate him on 103, turned 103 recently. So happy birthday, sir. [00:09:29] And I hope to, we'll be sending you a letter and sending you a notice. And I hope to have a chance to shake your hand. Mr. Chairman, that's all. Thank you. Thank you, sir. Any other comments? I do want to take a second and, again, thank our staff and everyone involved last week in the announcement about the county's purchasing of Varana Farms, over 2,000 acres of land in Varana, one of the most historic properties in the United States. [00:10:00] I want to thank our county manager and his team and everybody who was involved in that historic purchase, and I look forward to great things that property will be used for going forward. [00:10:19] There is no news media here. and so we move forward with appointments mr manager we do mr chairman the first item 31-24 is the resolution for appointment of member in this case to the board of real estate review and equalization this board paper would appoint marion j martin to that board from the fairfield district for a one-year term that expires december 31st 2024 mr chairman is there a motion all right motion made by reverend cooper second by miss whitehead all in favor all right any opposed thank you The motion has been made. [00:10:58] It's Ms. Martin here, and if you would come forward to receive your oath, ma'am. And then the board would like to thank you, so if you would just walk up the deus. [00:11:53] Mr. Manchin. [00:12:38] Mr. Chairman, agenda item 32-24 is a resolution for appointment of member, in this case, to the Key Penrico Beautiful Committee. This board paper would appoint Gwen Miller from the Brooklyn District to that committee for a two-year term expiring December 31, 2025. Mr. Chairman. [00:12:54] Is there a motion? Yes, sir. Mr. Chairman, move the resolution. Second. All right, motion made by Mr. Smith, seconded by Reverend Cooper. All in favor, say aye. Aye. Any opposed? Ms. Miller, if you would come forward. [00:13:36] Mr. Mantle. [00:14:05] Mr. Chairman, agenda item 33-24 is a resolution for appointment of member, in this case, the local emergency planning committee. This board paper would appoint Herb Dunford from the Brooklyn District to that body for an unexpired term that ends December 31st, 2024. [00:14:23] Mr. Chairman. Is there a motion? Yes, sir. Mr. Chairman, move the resolution. Second. [00:14:27] Motion made by Mr. Smith, seconded by Mr. Rovers. All in favor say aye. Aye. Any opposed? Thank you. Mr. Dunford, if you would come forward. Chairman, agenda item 34-24 is a resolution for appointment a member in this case to the Library Advisory Board. This board paper would appoint Patricia Bayan from the Brooklyn District to that board for a term that expires December 31st, 2024. Mr. Chairman. Is there a motion? Yes, sir. Mr. Chairman, for the trifecta of appointments tonight, please move this resolution. Second. [00:16:04] All right, motion made by Mr. Smith, seconded by Mr. Rogus. All in favor say aye. Aye. Opposed? [00:16:39] Mr. Manager. [00:17:24] Mr. Chairman, we move into public hearing, rezoning cases, and provisional use permits. The first two items out of the Fairfield District, Agenda Item 316-23 and 317-23, there is a request for General Land Company, LLC, for this case and the associated provisional use permit to be deferred to April the 9th, 2024. Is that correct, Mr. Emerson? Yes, sir, Mr. Madger, that is correct. [00:17:56] All right. Being though this case is proposed to be deferred, just checking to see if there are any persons here to speak to this case. Is there anyone here to speak to this rezoning or PUP case? [00:18:16] All right. Seeing none, is there anyone on Webex? Oh, there are persons? There's no one to speak to this item okay um if you can just go to the back to the lectern let us know your name and give us your address and my name is kitty boyt not i'm the president of the mountain laurel townhomes [00:18:50] association i've been playing phone tag with mr cooper for the last few weeks trying to let him know that our board members are extremely concerned about this proposed rezoning we don't think it would be a good addition for our community it would look out of place frankly on the corner of Woodman Road and Mountain Road the last time this type of facility was proposed for that general area was for the opposite corner a couple of years ago and ironically at that particular meeting I [00:19:27] attended to speak against the storage unit being put on the opposite corner and there was a report from one of the directors of the Brooklyn area talking about the general rural aspect of the Brooklyn area in that particular neighborhood. [00:19:48] We feel like a three-story storage unit would take away from that rural feel and that it would be a definite detriment to the traffic situation at the corner of Woodman Road and Mountain Road, which is already very congested. [00:20:04] And the addition of traffic coming out from that parcel would create an additional traffic hazard, we feel. So that's what I had to say, and I appreciate your time. Thank you. My name is Deborah Cooper. [00:20:21] I own a townhome at 2615 Mountainberry Court. I'm also a member of the board of the townhome for Mountain Laurel Townhomes. And I talked to you all last month. Well, it was different folks last month, and I won't belabor it. [00:20:38] Initially, I thought questions were available tonight. I want to thank Mr. Michael Morris, the planning department. We'd had a question about some of the trees coming off the property, and he clarified that for us in a very quick way, indicated it was a sewer easement for another property. [00:20:54] Anyway, there are several from the residents in that area here tonight, and we just wanted to reiterate our concerns about the project, and we understand we'll have another opportunity. Thank you. Thank you. Good evening. [00:21:12] My name is Ann Carol Johnson, and I reside at 2080 Mountain Road, which is about a half a mile from where this proposal for these storage facilities are going to be unholy rezoned for. [00:21:30] I really would appreciate it very much if those of you who are new to the zoning board, those of you who are new to the board of supervisors, that you yourself will come out and look at that area and see that that area is a residential area. [00:21:47] It has been a residential area for over 50 years. And so by putting storage units there, it would be detrimental to our community. Not only that, but at that corner, diagonal to where they would like to put these storage units, they've already rezoned for $600,000 homes to be built there. [00:22:13] And I'm sure these people wouldn't want to know that a storage place is right diagonal across from where their homes could be devalued by having it there. So I'm pleading with you all to please, please take another look at this situation. [00:22:32] And those of you who are new to the Board of Supervisors, I thank you for your time. I thank the old ones for their time. Please go out there and look at it before you make a decision to disrupt our community. [00:22:48] And there's a school that's being renovated right down the street. So think about this real hard before you make a decision, please. Thank you. Thank you. Anyone else? All right. [00:23:06] Is there a motion for this particular case? Ms. Chairman, before I make the motion, can I just tell Ms. Bortnacht, Ms. Bortnacht, I'm sorry we've missed each other. [00:23:23] I will be reaching out to you this week so we can have that conversation. Perfect. Thank you. Yes, ma'am. Thank you so much. Yes, ma'am. Ms. Chairman, I move that RZ2023-00027 by General Land Company, LLC, be deferred to the April 9th, 2024 meeting at the request of the applicant. [00:23:42] All right. Motion made by Reverend Cooper, second by Ms. Whitehead. All in favor? Any opposed? All right. Now we need a motion for the PUP. Ms. Chairman, I move that the PUP, General Land Company, LLC, be deferred to the April 9th, 2024 meeting at the request of the applicant. [00:24:03] All right. Motion made by Reverend Cooper. Second by Ms. Whitehead. All in favor? Aye. Any opposed? Thank you. Ms. Manger. Next, Mr. Chairman. Agenda item 35-24 out of the Verona District is Harsh Thacker and Dorado Capital LLC with a request to amend proffers with a previous case. [00:24:22] The applicant proposes to amend proffers regarding concept plan density, architectural treatment, and wiring for generators. In this case, the Planning Commission voted to recommend that the Board of Supervisors grant this request. Mr. Emerson. Thank you, Mr. Manager, Mr. Chairman, members of the Board. [00:24:41] As the manager noted, this case is a request to amend proffers accepted with REZ 2022-00034. That was approved by the Board in December of 2022. And there is a case that preceded that one, and that case is known as C49C07, the original zoning case that was amended at that time. [00:25:07] This proposal or this request revises the conceptual plan, provides for additional foundation landscaping, reduces the unit count to 46 from 50, revises the architectural requirements, and removes the proper requiring wiring for generators. [00:25:28] The applicant has provided updated architectural elevations that are shown in front of you. We do have several of these, and they are updated in addition to the elevations received with the original case and with the subsequent case. [00:25:51] Opposed amendments would not significantly change the intent of the original proffers. Staff supports this request, and the Planning Commission recommended approval at their December 23 meeting. If you have any questions, I'll be happy to try and answer them. [00:26:07] Any questions for my colleagues? Hearing none, Mr. Emerson, Stone and Brick, was that Proffert? Yes, sir. Okay. It is a public hearing. Is there anyone here to speak in support of or against this case? [00:26:25] If so, there's a microphone in the back. All right. Hearing no public comments in the room, is there anyone on WebEx? There's no one to speak to this item. All right. Thank you, staff that worked on this case. I move that we follow recommendations of the Planning Commission and approve REZ 2023-00026, Harstacker, Dorado, Capital, LLC, with the profits dated August 24, 2023. [00:26:56] Second. All right, motion made by myself, second by Mr. Smith. All in favor, say aye. Aye. Any opposed? Thank you. Mr. Mentor. Next, Mr. Chairman, agenda item 36-24 out of the Tuckahoe District is Parham Island Oz, LLC, with a request to conditionally rezone a piece of property. [00:27:16] In this case, the applicant proposes a commercial expansion of the Regency Square Urban Mixed-Use Development Planning Commission voted to recommend approval. Mr. Emerson. Thank you again, Mr. Manager, Mr. Chairman, members of the board. [00:27:32] REZ 2023-00042 is a request to add 1.19 acres to the Regency Urban Mixed-Use Development approved with case REZ 2019-00021 and amended by REZ 2021-0007. [00:27:51] The subject site sits at the southeast intersection of North Parham and East Ridge Roads and was previously used as an access drive to the Regency Square Mall. That right-of-way has subsequently been abandoned by the board and the entire mall is now undergoing redevelopment. [00:28:11] And along with this residual property, with the abandonment, the property was conveyed to the Economic Development Authority. The majority of the adjacent area is commercial in nature, with B3 Business District, B2 Business District, B1 Business District, O1 Office District, and Urban Mixed Use District surrounding the site. [00:28:41] With this request, the applicant is proposing to incorporate the subject property with the Regency Square UMU development. The same proffers accepted with the previous cases in 2019 and 2021 would be applied to the subject property with additional language restricting residential use, clarifying the method of calculating open space, and limiting building height to no more than 60 feet, among others. [00:29:12] These proffers also include a commitment to develop the property consistent with the Regency UMU pattern book, which provides design requirements for new development on the site, including extensive streetscape and urban design details consistent with the goals of mixed-use development in the urban mixed-use district. The 2026 comprehensive plan recommends commercial arterial for the subject site. The request is consistent with this designation and would facilitate redevelopment of the subject property in a manner consistent with the neighboring Regency Square [00:29:49] urban mixed-use. The proffers and exhibits provided with this request would also be consistent with Those already approved for the adjacent property staff supports this request and the planning commission recommended approval at their December meeting. If you have any questions, I'll be happy to try and answer them. [00:30:07] Any questions for Mr. Emerson? Any questions, colleagues? All right. Hearing no questions. This is a public hearing. Is there anyone here in the audience that wants to speak to this case for or against seeing no one? Is there anyone on Webex? [00:30:31] There's no one to speak to this item. All right. Thank you. Is there a motion? Mr. Chairman, I move that we follow the recommendation of the Planning Commission and approve REZ 2023-00042, Param Island Oz, LLC, with the proffers dated November 29th, 2023. [00:30:49] All right, motion made by Mr. Rogish. Second. Second by Mr. Smith. All in favor, say aye. Aye. Any opposed? Thank you. Mr. Major. Next, Mr. Chairman, members of the board, agenda item 37-24 out of the Brooklyn District is DE Solutions Solar Development, with a request for provisional use permit that would allow the installation of an operation of a solar array on a parcel that is located on the north line of Ford's country lane. [00:31:21] In this case, the planning commission voted to recommend approval, but Mr. Chairman, we also have a companion case in the general agenda, which is agenda item 50-24, and this would basically find this project to be substantially in accord with the comprehensive plan. [00:31:40] So the suggestion is that you hear the public hearing, vote, and then move on to the general agenda item 50-24. Mr. Emerson? Thank you, Mr. Manager, Mr. Chairman, and members of the board. As the manager stated, under consideration by the board are two actions, an SIA and a provisional use permit. [00:32:00] The substantially in accord study was undertaken by the planning department in coordination with other county divisions and departments to determine whether the proposed site for a solar electric generation facility is substantially in conformance with the county's adopted comprehensive plan. [00:32:17] The subject property is located on Ford's Country Lane and is the site of the county-owned, decommissioned Springfield Road Landfill. Surrounding properties are zoned A-1 Agricultural District and C-1 Conservation District and consist of large acreage residential, common area owned by neighboring subdivisions, The Chickahominy River, Hanover County, and a quarry. [00:32:40] Interstate 295 is located to the south. The comprehensive plan recommends government and environmental protection area for the subject property, reflecting both the landfill use on the site and environmental features present on the property and the surrounding area. [00:32:59] The government designation includes a variety of public uses and facilities that are government-owned. The plan itself also supports co-location and multi-purpose use of existing public facilities. The proposed solar facility would be cited on an existing public use and would be used to power an existing county-owned sewage pump station, which would be consistent with the government designation. [00:33:27] For these reasons, the analysis found the proposed use to be substantially in accord with the Henrico County 2026 comprehensive plan. In addition to the SIA review, the Henrico County Zoning Ordinance requires approval of a provisional use permit, or PUP, for solar arrays. [00:33:45] The PUP request is located on the same property as the aforementioned SIA and would consist of a solar array sited on the easternmost capped hill, which you can find. [00:34:05] This isn't quite as clear, but it's right in this area, and of course you can see it on the lower photo. Generating electricity to power the Allen's Branch sewage pump station. [00:34:24] The proposed solar use is consistent with the property's governmental designation and policies outlined in the comprehensive plan that support co-location and multi-purpose use of existing public facilities. Staff also believes the use and unique nature of the landfill site provides an opportunity to efficiently utilize already impacted land. [00:34:45] A solar power purchase agreement and site lease agreement were approved by the Board of Supervisors at its January 24, 2023 public hearing. Staff supports these requests, subject to the conditions found in the Provisional Use Permit Staff Report, and the Planning Commission recommended approval of both the Provisional Use Permit and the accompanying Substantially in Accord Report at their December 14 public hearing. [00:35:11] As noted earlier, this presentation does cover two items, so separate motions will be necessary. If you have any questions, I'll be happy to try and answer them. Any questions from my colleagues? All right, no questions. [00:35:28] This is a public hearing. Anyone here to speak to the PUP case 3724 or the corresponding resolution 50-24? Anyone here to speak to it? All right, seeing no one here in the audience, is there anyone to speak to it on WebEx? [00:35:49] There's no one to speak to this item. All right, thank you. I need a motion as it relates to the 3724 presentation. Thank you, Mr. Chair. I'm seeing no one here to speak, and let's thank staff on the working list. [00:36:06] We've been working on this for a year since we approved the land use. Yes, sir, that's correct. Mr. Chairman, I move we follow the recommendation of the Planning Commission, approve PUP 2023-00016 DE Solutions Solar Development LLC with the recommended conditions in the staff report. All right, motion made. [00:36:21] Second. Second. Mr. Rogus. Motion made by Mr. Smith. Second by Mr. Rogus. All in favor, say aye. Any opposed? All right. Corresponding resolution for 5024. Mr. Chairman, this is not a public hearing item, so I move we follow the recommendation of the Planning Commission for SIA 2023-00001, DE Solutions Solar Development LLC, finding the proposed solar facility to be substantially in accord with the county's comprehensive plan. [00:36:49] All right. Motion made by Mr. Smith. Second by Ms. Whitehead. All in favor say aye. Any opposed? Thank you. Mr. Manager. Next, Mr. Chairman, 38-24 out of the Fairfield District is Godsey Properties with a conditional rezoning request from R5AC to C1 Conservation District, part of a parcel containing 7.6 acres. Parcel's located on the north line of Creighton Road, approximately 600 feet west of Stonedale Drive. In this case, the Planning Commission voted to recommend approval. Mr. Emerson. [00:37:27] Thank you again, Mr. Manager, Mr. Chairman, members of the board. This property is probably better known as the former Glenwood Golf Course. This property and those adjacent to the east and west were zoned R5AC in September 2021 to construct a residential neighborhood. [00:37:47] Proffer number nine of that case requires areas within the 100-year floodplain be rezoned to C1 Conservation District prior to final subdivision plan approval. With Sections 1 and 2 of the Fairways Subdivision Plans having now identified the precise boundaries of the floodplain, it is appropriate to move forward with this request to fulfill the proper obligation and preserve the remaining environmentally sensitive areas. [00:38:14] This would be consistent with the site's Environmental Protection Area designation in the 2026 Comprehensive Plan. It would reflect the property's identification as a Chesapeake Bay Resource Protection Area. Staff supports this request and the Planning Commission recommended approval at their December 14, 2023 meeting. [00:38:33] If you have any questions, I'll be happy to try and answer them. Thank you, Ms. Amundsen. Any questions from my colleagues? No questions? Is anyone here in the audience to speak to this particular case? [00:38:52] All right, seeing no one. Is there anyone on WebEx? No one to speak to this item. All right, thank you. Stay in motion. Mr. Chairman, I move that we follow the recommendation of the Planning Commission and approve REZ2023-00038 Godsee Properties. [00:39:13] All right, motion made by Reverend Cooper. Second by Mr. Rogish. All in favor say aye. Aye. Any opposed? All right, thank you. Mr. Manchin. Next, Mr. Chairman, 39-24 went out of the Fairfield District, Winfrey Road, LLC, with a conditional rezoning from RTHC Residential Townhouse District to C1C Conservation District, a piece of property containing almost 4.3 acres located on the northwest of the intersection of Woodman Road and Rivermere Lane. [00:39:50] The Planning Commission did recommend approval. Mr. Emerson. Thank you again, Mr. Manager, Mr. Chairman, members of the board. as noted by the manager before you as a request to rezone approximately 4.3 acres from RTHC Residential Townhouse District to C1C Conservation District. [00:40:08] This is a part of the River Mill subdivision to help orient you better. The property was rezoned to RTHC by REZ 2016-00002. That was one of the zoning cases included with the River Mill subdivision itself. [00:40:27] Profer 11, if that request, requires the developer to rezone the areas within the floodplain to see one. And this action request fulfills that requirement, very similar to the last case you just considered. Staff supports this request, and the Planning Commission at their December meeting recommended approval. [00:40:47] If you have any questions, I'll be happy to try and answer them. Any questions from my colleagues? Hearing no questions, this is a public hearing. Is there anyone here to speak to this particular case for or against? [00:41:04] Seeing no one. Is there anyone on WebEx? There's no one to speak to this item. Thank you. Is there a motion? Mr. Chairman, I move that we follow the recommendation of the Planning Commission and approve REZ2023-00039 Winfrey Road, LLC, with the proffers dated September 12, 2023. [00:41:30] Second. All right, motion made by Reverend Cooper, second by Mr. Smith. All in favor, say aye. All right. Any opposed? All right, Mr. Manager, public hearing, other items. Mr. Chairman, members of the board, Mr. Anthony is going to guide us. He's got the next six items. 40-24 is a resolution for signatory authority. [00:41:48] This is an easement agreement in the Brooklyn District. Mr. Anthony. Good evening, Mr. Manager. Thank you very much. Mr. Chairman, honorable members of the board, ladies and gentlemen, this board paper would authorize the chairman of the Board of Supervisors to execute an easement agreement allowing Loomis Networks Incorporated doing business as SEGRA to install underground fiber optic cables on county property located at 8600 Dixon Powers Drive. [00:42:15] The Real Property Division has processed this request through the Departments of Planning, Public Works, and Public Utilities without objection. The Director of Real Property recommends approval of the board paper. The county manager concurs. I'll be happy to attempt to answer any of your questions. [00:42:31] Any questions from my colleagues about this resolution? All right, this is a public hearing. Is there anyone here to speak to this case for or against? Seeing no one, is there anyone to speak on WebEx? [00:42:48] There's no one to speak to this item. Thank you. Is there a motion? Move the resolution. All right, motion by Mr. Smith, second by Reverend Cooper. All in favor say aye. Aye. Any opposed? Mr. Mantra. Next, Mr. Chairman, 41-24 is a resolution for signatory authority for the trail easement agreement for the fall line trail. [00:43:09] This is in the Fairfield District. Mr. Anthony. Yes, sir. Thank you once again, Mr. Manager, Mr. Chairman, Honorable Members of the Board. This item and the one to follow, Mr. Manager, are associated. Our office, our division did receive contact late yesterday afternoon. [00:43:26] VDOT will be doing a re-approach. They need temporary construction easement as well. This board paper authorizes the chairman to execute a permanent trail easement agreement with VDOT for the construction and maintenance of a portion of the fall line trail on county-owned property located on Winfrey Road. [00:43:44] The Real Estate Division has processed this request. The Department of Planning and Public Works, without objection, the Director of Real Property has recommended approval of the board paper. The county manager concurs. I'll be happy to answer any questions. Thank you. Are there any questions from my colleagues? [00:44:05] I ain't hearing no questions. This is a public hearing. Is there anyone here to speak to this resolution for or against? Seeing or hearing no one, is there anyone on WebEx? There's no one to speak to this item. [00:44:24] Thank you. Is there a motion? A motion made by Reverend Cooper, seconded by Ms. Whitehead. All in favor, say aye. Mr. Magic. [00:44:40] Next, Mr. Chairman, 42-24 to Mr. Anthony's point is identical to the previous item, except this is on Woodman Road. Again, you are in the Fairfield District. Mr. Anthony, anything you'd wish to add? No, sir. Thank you, Mr. Manager. Okay. Anyone have any questions? [00:44:59] All right, this is a public hearing item. Is anyone in the audience here to speak to this particular resolution for or against? All right. Seeing no one, is there anyone on Webex? There's no one to speak to this item. [00:45:14] All right, seeing no one or hearing anyone, is there a motion? All right, motion made by Reverend Cooper, seconded by Mr. Rogus. All in favor say aye. Aye. Any opposed? Mr. Manager. Mr. Chairman, members of the board, 43-24 is a resolution for declaration of surplus property. [00:45:34] This is in the Bloomingdale subdivision, once again, for the Fall Line Trail, again, in the Fairfield District. Mr. Anthony. Thank you, Mr. Manager, Mr. Chairman, honorable members of the board. This board paper authorizes all actions necessary to exchange lots 4 and 8, owned by the county, and lots 10 and 11, owned by Joyce Catherine Luck, in Bloomingdale subdivision. [00:45:57] The county will reserve utility easements, permanent trail easements, temporary construction easements across lots 4 and 8, acquire additional permanent trail and temporary construction easements across 5, 6, 7, and 9, and delineate permanent trail and temporary construction easements on lots 10 and 11. [00:46:16] The exchange will allow the county to extend the fall line trail across lots 4 through 11. Real Property Division has processed this request with the Departments of Planning, Public Utilities, and Public Works. The Director of Real Property recommends approval of the board paper. The County Manager concurs. [00:46:33] I'll be happy to address any questions. Any questions from my colleagues? All right. Hearing none. This is a public hearing. Is anyone here to speak to this particular resolution? Four or against. C-N-O-1. [00:46:49] Anyone on WebEx? There's no one to speak to this item. There's a motion. All right. Motion made by Reverend Cooper. Second by Mr. Rogus. Y'all in favor say aye. Aye. Any opposed? Mr. Manager. Next, Mr. Chairman, 44-24 is an ordinance vacation of drainage easement. [00:47:07] This is in the Brookvilla's apartment complex, which is in the Fairfield District. Mr. Anthony. Yes, sir. Thank you once again. Mr. Manager, Chairman, honorable members of the board, this ordinance would vacate a drainage easement across a property known as Brookvilla's Apartments. [00:47:25] Brookvilla's LLC owns the property that would be affected by the vacation. The county does not need the easement to be vacated. property owner already conveyed a replacement easement to the county. The Real Property Division has processed this request to the Departments of Planning and Public Works without objection. [00:47:42] The Director of Real Property recommends approval of the board paper. The county manager concurs. I'll be happy to answer any questions. Questions from my colleagues. All right. No questions. This is a public hearing. Is there anyone here to speak to this particular ordinance? [00:48:01] For or against? Seeing no one. Is there anyone on Webex? There's no one to speak to this item. Is there a motion? Second. All right. Motion has been made by Reverend Cooper, seconded by Mr. Rogan. All in favor say aye. [00:48:16] Aye. Any opposed? Thank you. Last one, Mr. Mantle. Next, Mr. Chairman, 45-24 is a resolution for signatory authority that would amend a cell tower lease at Fire Station 2. The station is in the Verona District. Mr. Anthony. Once again, Mr. Manager, Mr. Chairman, honorable members of the board, this board paper would authorize the county manager to execute an amendment to a lease with Verizon to permit a sublease and co-location of T-Mobile's equipment on the cell tower located at fire station number two. [00:48:47] Director of Real Property recommends approval of the board paper. The county manager concurs. I'll be happy to answer any questions. All right, any questions? No questions. Public hearing, anyone here to speak to this particular resolution for or against it? [00:49:04] I ain't seeing no one. Anyone on Webex? There's no one to speak to this item. All right, so move the resolution. Is there a second? Motion made by myself, seconded by Mr. Smith. all in favor say hi any opposed mr manager public comments yes sir mr chairman members of board we move into public comments this is the time on tonight's agenda where individuals may address the board on any item which is not on the agenda or does ask that you begin your comments by stating your name and address for the record and that you limit those comments to five minutes or less so we do have a number of individuals that have signed up we begin with brenda coles miss coles [00:49:42] are you here? Okay, so I know there were some other individuals that also wanted to speak on this item, Waterfalls Road address. Is there anyone else that wishes to cover what Ms. Coles was going to cover tonight? Okay. So you're not connected to Ms. Coles? Okay, [00:50:09] but did you sign up separately? Okay, okay. You don't have to sign up to speak. If you'd like to speak just come to the podium yes okay okay I do have is this Willie plus two additional [00:50:38] support reps okay so who are you ma'am okay if you would come to that microphone no absolutely [00:51:02] not yeah so I'm I'm Bernadette Lark as I said I drove from southwest Virginia wasn't sure about your board meeting policies but I'm glad to be here and thank you for having me I want to get [00:51:40] right into it I understand we have five minutes per person all right so I'm glad that at the beginning of this very meeting we placed our hands on our heart and said justice for all and I traveled to your community because unfortunately there is blatant bold public corruption and discrimination I start by sharing with you I received this email from Miss Latindra Denise at the bottom she signs that she is a senior assistant county attorney what blew my mind was I had received a request from National Action Network ex-president who works with Al [00:52:16] Sharpton, and this got to them through someone local. And they said, hey, this person really needs you to advocate because something's going on. So when I got the email, attached was some exhibits. Now, mind you, these exhibits had a deadline so that I could serve as an expert consultant advocate and emotional support to mr jones they sent that at 4 56 pm that left me four minutes in the business date i wasn't going to bother so what i did do was when i transcript that [00:52:55] was sent by miss latindra to use at mr jones's panel hearing during a grievance process that was scheduled january 12th which unfortunately i didn't make it to but they did have it This exhibit was submitted as a transcript, actual recording of this meeting. [00:53:18] Now, what's disturbing to me is when the county sent that exhibit, they had no knowledge that I had the actual recording from that exact meeting. So when I started reading the exhibit, a light bulb went off and said, wait a minute, I actually heard this terminal language on an audio file sent to me months prior. [00:53:41] When I put the transcript in the county's exhibit in front of me, next to the recording, I discovered they took pieces of things this man said at the end of the meeting, pieced it throughout the transcript, things that he never even commented, put it on the transcript. [00:54:02] And then, at the beginning, they started off correct, but they skipped Michelle Taylor's comments. John Zanino is this person here on the transcript, and Mr. Jones. There was only three of them in the meeting. I gasped. I actually called the Henrico prosecutor, and I said, if Mr. Jones had did this during a due process, sitting in civil circuit court, he would be charged for fraud. [00:54:30] That is blatant deception. what is the charge that you all are going to move now to stop this from happening unfortunately i could not get here because i was actually out of the country mr jones you go into your grievance but you tell them you have the speaker and if i hold up the transcript and hit play you're going to gas because i believe derrick chauvin would have gotten away with murdering george floyd had [00:55:07] had not been for 21st century technology. And so I am thankful that Mr. Jones was brilliant enough to feel something was wrong and to record. Without that recording, everyone, including me, would have thought these comments were made during his investigation. [00:55:29] Excuse me, ma'am. Can I? Yes, sir. Just for the sake of my colleagues, I don't, I don't know if they are aware. We're not really sure. So I'm going to ask the county manager if he can kind of brief us on what this is that you actually are making a comment about so mr chairman um believe miss clark is lark say again lark l-a-r-k you said clark lark okay i i'm sorry i heard i heard clark um but so this is a um this is a step four grievance that uh has gone through the process [00:56:05] and the grievance was not successful the um the reality is that miss lark and the employee have the board has no redress here the redress was the step four grievance process that was undertaken mr newby correct me if i'm wrong but miss lark and her client may be able to take go to circuit court have some sort of what is the next step if they because it's it's not here before the board of supervisors with these comments and statements mr manager mr chair members of the board yes there [00:56:43] is a four-step grievance process. The Board of Supervisors' only role in that grievance process is a pointing slate of individuals who can serve as the third member of a grievance panel, which of course occurred here. The grievance panel heard the grievance. The grievance was not successful, as the county manager stated. There is no appeal to the Board of Supervisors. There could be, could be, I stress could be, an avenue with circuit court, but I don't know enough of the details of the case to say whether that would be a fruitful enterprise or not. But there is no redress to the Board of Supervisors to re-hear a grievance. What I'm hearing for the public comment speaker this evening, Ms. Lark, is that instead she's asking [00:57:21] for the Board to initiate some kind of investigation or charge related to whatever occurred with the grievance. I would submit that her contact with the prosecutor would be the avenue for that. I don't think that's the Board of Supervisors' role either. So did you, you said you talked to the When you say the prosecutor, do you mean the Commonwealth's attorney? [00:57:45] Henrico County Prosecutor, and I didn't come to you all for any type of redress. I came to expose what happens when a Henrico County staff commits this type of deception and fraud during a grievance process. [00:58:02] I think you all would applaud knowing this. I don't care if you turn a blind eye and not do anything about it, But it is important that the public and you all know that there must be a level of integrity. Ms. Lark, you making the supposition does not make it true. [00:58:20] I don't know what you're speaking of. You have gone through the legal process. I haven't. I'm not talking to you all as lawyers. I'm not certain what you're talking about. The supposition that somehow staff has done something immoral or illegal, I take strong exception. [00:58:36] You should. We do too. Mr. Chairman. So why am I being interrupted in the five minutes from presenting something the public should know happened during a grievance process? So, Ms. Locke, we're going to – hold on for a second, Ms. Locke. [00:58:52] We're going to give you your five minutes. Thank you. But there – I do want to just reemphasize what was shared. Share it with us. There's nothing that our board can do per se. If you want to move forward with criminal charges, then I think you would need to go talk to the Commonwealth's attorney office, I think. [00:59:16] Which is why I shared that. I knew that. Right. Okay. So just go ahead, and I think you had like three and a half minutes left. Thank you. Go ahead. Okay. So I'm bothered by the level of upset of exposure. You are elected in a public seat. [00:59:32] You would think transparency and what looks to be a Democratic or what have you posture would appreciate a member of a community doing your work for free, not compensated. So I'm not even certain why there's such a big upset of blocking my opportunity to speak, interrupting as if I've asked for some redress. [00:59:54] No, my role of coming to your community was simply to tell the truth of exposure. Anything outside of that is an allegation. You can choose to believe it or not. That's why I brought the enlarged prints, which was presented during the grievance, and Mr. Jones was not allowed to move forward on. [01:00:14] So these things were at the grievance hearing. They actually took a break and recess to say, well, should he play the recording? Should he not? I had no control of that. They did that during the grievance process. But I think you all should be very bothered by what you are hearing alleged by Henrico's staff. [01:00:36] John Zanino, Michelle Taylor, during the grievance, admitted to creating the document. So there you have the names. There's also an email that came from Ms. McFarland that she sent to Ms. Bridget Cease, where she tells Ms. Cease this man had supervised several women. [01:00:56] No, he didn't. The one woman he supervised showed up at the grievance panel and said, I'm the only female and I never submitted a complaint about it. But yet Miss McFarland's email to Bridget Seas said different. This is outrageous. And coming up on the cuff of MLK Day as we celebrate him, you know, he spoke often about how racial equality cannot be achieved without structural change. [01:01:26] You have people sitting here all turned sideways, hand on the face, all bothered because somebody is standing here speaking up for someone who was stomped in the ground by injustice. He was stomped in the ground by false allegations. What system of democracy don't allow you to expose stuff publicly? [01:01:44] So I'm just bothered by the level of intentional interruption, intentional attack on my moment to speak, and it is bias. So I don't even know why it happened, because it's never happened to me before. But I will tell you this. [01:02:01] This is a clear case of what I pointed out, definitely a civil rights violation. Some of you all sit there smirking. I'm looking straight in your faces, like this guy, your head turned. This is not a laughing matter. You took income from someone. You caused trauma, and it's definitely not funny. [01:02:20] Black men are often highly convicted of wrongdoing. So when one of them decides to stand up and expose what happened, and he's not the only one, there's another black man in this room that will be leaving a formal complaint because he was also involved and also lost income at the hands of this corruption. [01:02:41] You should be bothered. And I'm going to sound the alarm. I am going to take it criminal. I actually know the FBI connection for public corruption and fraud. So you can protect whoever you want, however you want to look at it. You can actually file defamation and slander if you choose to do so. [01:02:58] And I will win that particular allegation against me because we have facts. Slander and defamation is only if it's not true. Everything I presented tonight, I stand on the foundation of truth. So there you have it. Do what you will with my allegation, and you can stop me at five minutes. [01:03:16] But deceitfulness has no place during due process. I was going to give you 30 minutes of wrap-up, but you did. Thank you, sir. Okay. Thank you. Ms. Mantra. Ms. Chairman, we have Jereen Fleming. Ms. Fleming, are you on WebEx, Ms. Fleming? [01:03:35] You can now unmute. Chairman and board, thank you for allowing me to speak to you this evening. I would like to talk about the master plan for Henrico County. [01:03:51] I'm sorry, I'm Jereen Fleming. I live at 2309 Pennyman Terrace in the Brooklyn District. I had an opportunity to speak with you all in 2022 about my concerns with the bus routes into the county, and there's been no action on that since then. [01:04:11] So I just wanted to remind you all that it is part of the Henrico County Comprehensive 2026 plan to continue to monitor citizen satisfaction with the GRTC service and ensure a bus system that provides adequate transportation service to the residents of the county. [01:04:34] That would be all of the county. For those of you who are not aware, bus service has been consolidated so that the express buses that used to leave from Glenside, Parham, and Gaskins only leaves from Gaskins. So about two weeks ago, January 14th, GRT, there's so much ridership on that from Gaskins because the other sites have been closed that they've had to add an additional route. And so what I've been advocating for is that at least one bus route be returned to the [01:05:09] Glenside Park and Ride with the new construction of those apartments and townhomes on Staples Mill. It will add additional traffic congestion to the area, and it's part of our growing green or green growth as a community to make sure that there is adequate public transportation for all. So I would ask that you all ask GRTC to reinstate the express bus to downtown Richmond from the Glenside parking ride. Okay, thank you. Can you do me a favor? And I think Victoria is talking to you on [01:05:49] WebEx. Victoria, can you get this young lady's name and email address so that we can follow back up we are i'm the chair of the grtc board we are doing some major expansion efforts um and so we just as you stated on january 14th um just kicked off some route expansion and we have more things you know coming up so it may just be what you're asking hasn't happened yet but it will happen soon so we can just get your information so that we can um get you connected not just with our [01:06:28] transportation folk, but with GRTC staff as well. And you can share your hopes and desires directly with the board as we are looking at expanding routes. Thank you for reaching out. Next, Mr. Chairman, Jones Bluford. [01:06:47] Mr. Bluford, was that your advocate? Ma'am, can we? [01:07:07] Yeah, yeah, yeah. Ma'am, he just asked a question. Sir, if you're going to speak, just go ahead. Yeah, it's your turn. Go ahead. I'm Luford Jones. I stay at 6921 Greendale, Brooklyn District. [01:07:24] I'm a past employee of Henrico County to work with Henrico Rex and Parks. I have been harmed and damaged by intentional, malicious, fraudulent, and fabricated accounts at the hands of Henrico County because I'm a black African-American male. The documents that she was showing you is fraudulent and created by Michelle Taylor, a Henrico County employee, John Zanino, another current Henrico County employee. [01:07:48] I fabricated these lines in my termination letter. They also used these documents during my grievous hearing on January 12th. This document is supposed to represent a transcript of things that is said during the meeting, but the truth and facts have revealed that I did not say these things as they appeared in the transcript. [01:08:08] Whomever made these documents took place in my statements at different times and pieced things together to mislead and harm me, which was very successful in harming me and damaging me. Documents also stated comments that I never made, which were wholly fabricated against me to result into harm me. [01:08:30] Document finding evidence supporting details through the Regal County grievance process. The deck was already stacked against me because here you have Regal County staff, including human resources, staff creating false information used against me to result into termination, discrimination, and further stress, anxiety, and harm. [01:08:49] I come before you this evening to ensure accountability is held and truth is exposed, as I have been seeking fair resolution during this hurtful time that caused severe anxiety, stress, huge loss to my income, loss of sleep, headaches, and so many other things I can't explain in this very limited time. [01:09:10] Thank you. Thank you. Thanks, Mr. Chairman. Terry Harrison. Ms. Harrison, are you here? Good evening. My name is Terry Harrison. [01:09:26] I live on Ball Eagle Court. I'm in the Viviana District. And today I'm here to talk to you about getting an ordinance for the regulations for trash cans and recycle bins. And to ensure Henrico County has a safe place to live. [01:09:44] Currently, the county has no regulations or ordinance for this. Trash cans and recycle bins can stay on the street 365 days a year. The cans can be placed anywhere on the street, including in front of your home, or as I said, anywhere on the street. [01:10:03] Because of this issue with the cans, sometimes my mail and newspapers are not being delivered. Also, because of the lack of the ordinance, cans are falling down in the street, blocking sideways, sidewalks. [01:10:20] It has been a hazard with kids riding bicycles and citizens walking through the neighborhood. In front of my home right now, there are three empty trash cans, two recycled and one trash can. Two of them have been there for two years. [01:10:37] I have attempted to talk to the neighbors about this. The neighbors have refused to move them, and they stated if it's not an ordinance or law, they would never remove them. I have also contacted several officers in the county, and they have attempted to intervene, but with no avail. [01:10:54] On trash day, because of the way the trash cans are situated, the trash cans are placed in the middle of the street for trash pickup, and traffic has to go around them, and sometimes cars almost hit them. The county has stated to me, it's nothing they can do. [01:11:15] Most of these issues are usually covered by HOAs, but my neighborhood is not one of them. I have talked to Reverend Nelson on several occasions about this over the last year. He has also talked to people in the county. I'm just very concerned about the safety of the neighborhood. [01:11:35] I would like for the county to possibly do a study or look at maybe possibly having an ordinance to have some kind of regulation or restriction on the placement and removal of the cans and that they will not be allowed to stay on the street for 365 days a year. [01:11:53] Thank you for your consideration and time. Thank you, Ms. Harrison. I did talk to our county attorney again. We had staff last year when this came up. For my colleagues, this is not the first time we've heard this. [01:12:10] I'm not sure if Ms. Harrison actually came and spoke before the board before. No, I haven't. She's talked to me, and so we've had community revalidation of other departments. I think even the police has gotten involved with this particular situation. And so I've asked Mr. Newby, Mr. Manager, I'm asking you if we can get staff to kind of look at maybe what other localities are doing with this particular ordinance. [01:12:36] For it to come to the Board of Supervisors as a work session item has to be two of us. So if staff looks at it, then I can share that information with my colleagues. And if another one of them wants to join on, then we can have a full discussion about it and see whether or not we can get support. [01:12:55] My previous colleagues, I couldn't get that support. So we'll see with this. And I know this is a situation that's difficult for you. I don't know what's going on in their district, so maybe some conversation we'll see. We'll see what happens. But thanks for coming. Thank you. All right, you're welcome. Mr. Mantra. [01:13:11] All right, Mr. Chairman, we have Skyam Carpenter. Good evening. Thank you for allowing me to speak. I'm here on behalf of a conversation that I had with my grandson recently as a concerned grandmother. [01:13:33] And we talked about e-cigarettes and vapes and everything. And he was explaining to me how the e-vape works and all. Basie said that the e-cigarettes create an aerosol by using a battery. So when you get one of them e-cigarettes, it has a battery. [01:13:49] And then it ignites the nicotine or whatever chemicals you have in there. And he said, sometimes the battery could, like, explode. And then if you inhale in this product, you will inhale that acid from the battery also. So this was maybe two or three days ago we had this conversation. [01:14:07] And I just don't, what I'm here for also, I would need, I think the educational department, as far as the school board, when it comes to physical education and health, I think they need to incorporate a class regarding those subjects, the e-cigarettes, the vapes, how harmful it is to the body. [01:14:30] Because these children, young adults, middle school and high school kids, it's like it's so overwhelming with them because they're participating in it. And before I came here, I called the school board, and they did call me back right like at 4 o'clock. [01:14:47] And I was amazed because I said, well, they didn't call me back, so I'm not going to go. So I did get a call, and I spoke briefly with the caller. She's on the school board, and she informed me that they're having their school meeting on Thursday. And I had told her that I kind of wanted to come here and express my concern about the nicotine products, the vapes and cigarettes. [01:15:10] And she encouraged me to come. She said, please go, because they are concerned about the children. They see how the kids coming into the school. I'm not trying to say that we need to make it mandatory, but I think we need to have some type of subject in the school to discuss, so they could discuss this and see the harm that it does to the mind and the body when they vape, when they smoke. [01:15:35] And I think it should be part of the curriculum for the education, the physical education and health curriculum. And so that person that called me back from the school board today, she was like they are so concerned like i said they are really concerned about the students and not only that um it gives she said that they also have to get past the smell because i know i've been in company of people or you know you go in somebody car that may have used drugs smoking and i'm like oh no i can't sit in your car because i'm i don't smoke or anything of that nature so [01:16:10] uh but the teachers also when the children comes to school not only the older of them sitting in their cars or wherever they vaping or doing now it's on their clothes and they're inside the classroom so the teacher have to inherit that smoke also so i just feel like we need to update our system when it comes to educating them about um the cigarettes the drugs that's out there i think that needs to be part of a curriculum and to discuss that just like you discussed the reproductive system you know um stds and all that you really need to bring that subject in the school [01:16:48] so they can see and be vivid about how the videos so they can see when they vape when they smoke when they shoot up or whatever they're doing their choice of uses what it does to the body so that needs to be to me a course added into the education department i think the teachers would appreciate it because you know a lot of them feel these kids they're coming in looking um deranged or looking suspect or i hate to say that word but um and but i've been around people that did drugs i don't do drugs and when i'm in that environment i leave but now they say that they legalize um [01:17:26] marijuana in the state of virginia and so they're doing it recreationally and i'm going like that you know you just don't understand what it does to your body your lungs and i really think this the school system and maybe you all could give them some guidance on what to do about making that a mandatory course in the school to educate our young people so because it's all about knowledge and that's what school is for and we got to bring you know update information on that uses there i know we talk about math english and this and that basic subject but this is a crisis we are in a crisis state right now. [01:18:04] And not being funny, but I got a little something. They say China vape sector. They said, who is the biggest exporter of vapes? And they said China vape sector is estimated to be worth $28 billion. And the U.S. accounts for nearly 60% of the country's vape export. [01:18:21] And this I printed out was dated December 19, 2023. So could you please, please take a look and maybe incorporate educating them about when they vape, they do drugs as part of the curriculum in our school system. [01:18:38] Thank you. Thank you. We'll make sure that our governing body doesn't deal with curriculum for schools. We fund schools, but we'll make sure we take your comments and advise school staff to watch our video, hear your comments, And hopefully you talked to somebody today so y'all can keep that dialogue going with the school system. [01:19:02] But thanks for coming and speaking tonight. Anybody else, Mr. Mantra? Is there anyone else that wishes to address the Board of Supervisors this evening? Mr. Owen. [01:19:20] Hi, I'm Mr. Chairman, members of the board, and Mr. County Manager. I'm John Martin Owens of 6315 Millhiser Avenue in the Brooklyn District. I'm coming tonight. I just wanted to point out when I was driving down Libby Road near my house and at the intersection of Indigo and Libby I was kind of shocked to see there's a Libby sign that's L-I-B-B-Y whereas all the other signs on the street are L-I-B-B-I-E and I think that's the I-E is the [01:19:57] preferred spelling so I just thought it was not to offend anybody but it's a little sloppy so I was hoping somebody could take a look at that sign at Indigo and Libby try to correct that. Sure Mr. [01:20:16] Smith will take care of that for you, Mr. Owen. 100% look at it myself tomorrow. If I can beat our director of public works there, we'll see who gets there first tomorrow. Thank you. Alright, Mr. Manager, any other public comments? Anyone else wish to address the Board of Supervisors this evening? Do we have anyone on WebEx? [01:20:38] There's no one on WebEx. I do want to take a moment and recognize our planning commission chair, Mr. William Mackey, who is here tonight to my right. [01:36:48] Thanks for being here tonight, sir. Any other comments from my colleagues? Just one, sir. I'd like to take a moment to introduce, embarrass, and thank a local student for coming out today. Jocelyn is here with us today. Jocelyn is a part of the student government program that this county puts on that has amazing history. [01:37:05] So Jocelyn was with us at the board work session today, and she's here with us at the board meeting. So, ma'am, thank you for hanging with us all night. A senior at Tucker High School, participated in the program, interested in public policy, government, law, applying to colleges and doing all those things and spent hours with us today. [01:37:21] So, ma'am, great to see you. See you again soon. Thank you. I just want to make a couple of comments, and I regret that some of the speakers left because I really would have liked for them to have heard some of this. And as I look out at the audience and I see young people here, I think it's especially important to make these comments as well and for those who may be listening. [01:37:46] We heard public comments today raging in scope from spelling on street signs to folks who felt, you know, that perhaps racial discrimination or other very serious violations of their rights were being heard. And it can be heated at times and emotional, but I will take passionate civic involvement over apathy any day. [01:38:08] It saddens me for anybody to leave this forum and feel as though they were slighted or ignored. And I would, you know, just remind some folks that are in the audience that perception is everything. And sometimes reactions or expressions that may be seen up here are not adequately or accurately conveying what might actually be felt. [01:38:28] I know every one of the gentlemen seated beside me on here, and I know that they care. And we may not all agree on what progress or what justice looks like, but we all want that to happen. And so I say that not because I have to make any justifications or excuses or apologies for anybody, but because we are all here because we are properly motivated. [01:38:53] We just go about things in a different way. And so I welcome, and I will say this, that I will be a board member that welcomes folks to come out and speak at these hearings and have their time to say whatever it is that they believe needs to be heard because that is what the civic process involves and that is what we are all entitled to and that is what we got elected to do. I know that many of us, especially those up here who have worked on behalf of the county diligently for much longer than the few weeks or months that a couple of us have, are very passionately and vociferously defensive of those who work for the county and [01:39:33] rightly so in this short period of time that I've been on the board of supervisors, but more so in the length of time, 20 plus years, I've worked with folks in the county, some of whom were mentioned by name today. I can personally attest to the character of those mentioned. And so I understand that it's offensive and it's abrasive to hear very strong words and accusations being leveled that cause folks to want to jump to people's defense. And I applaud that as well, because that is what we should do for people that we care about and respect and esteem. And so for anybody that was perhaps or felt offended or maligned by some of the comments or allegations [01:40:12] that were made, I hope that you don't take that to heart and know that we appreciate the job that you are doing and that we trust and we have confidence. But when we're doing things right, we don't fear accountability. We don't fear questions being asked because we know that the right answers are going to be given and that light does not do anything to diminish what it is that we're trying to do, but it instead helps to amplify it. So I just put that out there to say, And, again, I don't know if these folks will hear any of these words, but for anybody who might be listening, please feel welcome to come out here and speak to us. [01:40:44] That's what we're here for. All right. Any other comments? Thank you, Ms. Smith. Thank you, Ms. Whitehead. Meeting adjourned. ---------------------------------------------------------------------- Coraggio Consulting · aguyonx.com
