[00:09:37] We are having our meeting both in person and those who are online, so we welcome those of you who are online. When we get to the public comments section, we're going to ask that you give your comments from the lectern in the back. [00:09:55] For those of you who are watching the live stream of tonight's meeting on the county website, you can participate remotely in the public hearings and public comment portion of the meeting. So you can go to the Board of Supervisors webpage at enrico.us forward slash supervisors. [00:10:11] You can click on guidance for Board of Supervisors meeting and scroll down and click on WebX event. And the moderator will let you know when it is time to speak. I'm going to ask that you stand with me as we recite the Pledge of Allegiance and then be led in our invocation prayer by our chaplain, Janetta Lee, for the Henrico County Police Division. [00:10:41] Let us pray. [00:10:57] Gracious Lord, before we ask you for anything, we give you thanks for everything. Bless our community. Bless our leaders and their families. Bless the agenda and the meeting to follow. [00:11:13] May we be extravagant and generous in our love of others. Inspire each of us to work more faithfully for justice and dignity of life everywhere. May you raise our vision above our barriers and give us wisdom and courage to make this a better world. [00:11:34] Keep us forever in your path, we pray. Amen. [00:11:52] I imagine we move to approval of the minutes. [00:12:16] We do, Mr. Chairman. We have before you minutes from the regular and special meetings of January 23rd. On January 17th, a special meeting. Motion would be in order, sir. Two moves. [00:12:32] All right, motion made by Mr. Smith, second by Mr. Rogus. All in favor say aye. Aye. Any opposed? Thank you. Mr. Manager. Mr. Chairman, members of the board, members of the community, I have several comments this evening. First, recognizes incredible service within our county. [00:12:50] I'm going to ask Mrs. Denise Ducing to come forward with. She's got some, her son is here, and we've got some folks from the police department. If you all would come forward. So I know the board is aware, members of the public may not be, but the county does a lot to recognize long-term service within our ranks. [00:13:19] This Mrs. Dusing actually is going to be part of what is known as the Legacy Circle in our county, which recognizes those who have served Henrico County for 45-plus years. She's recovering from a recent ailment but is expected to be right back at work very shortly. [00:13:43] So there's a history here. She was born in France just before World War II. The small town she was born in was bombed by Germany in June 1940, which forced Mrs. Dusing and her family to evacuate. [00:14:00] She and her family were later able to return to their hometown despite many dangerous obstacles. In 1962, Mrs. Dusing married Billy Dusing, an Army sergeant from West Virginia. The couple returned to the United States and went on to have six boys and one girl. [00:14:19] On February 6, 1979, Mrs. Ducing started what would be a 45-year career as a Henrico County crossing guard. She credits her second oldest son, John, with helping her get the job, stating that he found the advertisement in the newspaper. [00:14:39] In 1994, Denise worked diligently to ensure the success of the Officer Ollie Puppet Program. Her talents are limited in this area as she is both a puppet maker and a puppeteer. [00:14:56] Ms. Dusing has spent her entire career dedicated to serving the community surrounding Chamberlain Elementary School. She has been honored both nationally and internationally by organizations such as New York Magazine, The Times-Dispatch, and was even featured in a cartoon in France. [00:15:16] Ladies and gentlemen, can you recognize 45 years of service with a round of applause. Introducing the microphone is yours if you would like to make some comments. [00:15:40] Good to be here and thank you everybody for inviting me. I have loved my job and I can't wait to get back to it. There's many, many things have happened, but it was all good and I can't wait to get back to work. [00:16:02] We can't wait to see you again. All right, thank you so much. Congratulations again. [00:16:11] Mr. Chairman, members of the board, in recognition of Black History Month, we have invited our partners from the Woodland Restoration Foundation to share how the historic Black Cemetery has made great progress in bringing dignity and respect to the nearly 30,000, 30,000 people who are interred there. [00:16:50] Ms. Cousins, it's my pleasure, members of the board, members of the audience, to introduce to you Kimberly Cousins, Woodland Restoration Foundation board member to the podium. And actually, can we get all of the folks from Woodland Cemetery to come forward? [00:17:09] And I understand Mr. Marvin Harris is online. Mr. Harris, are you online? Do we have Mr. Harris online? Ms. Cousins, why don't you go ahead and start, and we'll see what we can do to bring Mr. [00:17:32] Harris on. Sounds good. Good evening, everyone. One balmy Sunday morning, Kathleen Harrell and I stood atop a hill near the rundown chapel at Woodland and looked out. The grass in most of the sections was still waist high. The roads were barely marked and there was an old trailer from the former caretaker with vines and brush growing all around it. At that moment, I'm not sure how many gravestones were still buried deep but we routinely came out uh john shuck bill slavin willie montague and my late aunt marie cousins and whoever else we could convince at the time [00:18:10] to come out um and we did what we could uh we called this place our church uh we were she remarked that day how she must have how it must have been um you must have been able to see i'm sorry the river from the very spot that we stood and i agreed the city sprawl obstructed our view but I'm not sure either of us imagined fully the beauty that is historic Woodland Cemetery as it is today. In 1917, a little history about Woodland, in 1917 John Mitchell Jr. opened the gates of Woodland Cemetery for the African-American citizens of the greater Richmond area. Woodland, as he [00:18:47] imagined, was to be a resting place for people who contributed so much to the rich history of the River City. People like Dr. Zenobia Gilpin, a champion of public health and women's health, Elizabeth Gators was the first black nurse of the Richmond TB Association and who also became the first black nurse in the Richmond Health Department. [00:19:08] Along with contributors to the health of the community, notable athletes like Arthur Ashe and Arthur Stretch Gardner and other community builders like Henry J. Moore, who was a contractor and who actually helped build buildings around the Richmond area. [00:19:28] Also, Charles T. Russell, who was an architect and a designer of the St. Luke's Penny Savings Bank, which was founded by Maggie Walker. Chose Woodland, all these people chose Woodland as their final resting place. Also, people like my great-grandfather and grandmother, Emmett and Marie Cousins, who participated in several social organizations and were also founding members of Six Mount Zion Baptist Church and Historic Jackson Ward. [00:19:55] Faith leaders like Reverend John Jasper also are interred in Woodland. He was the founder of Six Mount Zion and a prominent Virginia preacher. All of these people, I imagine, came to Woodland, stood at that hill where Kathleen and I stood by the chapel and decided to lay their body down so their soul could rest in such a beautiful place. [00:20:17] Today, after years of hard work and dedication, Historic Woodland has been given a new lease on life with partnerships from Henrico County and Henrico County Park Services. We have been able to remove tons of brush, weeds, and other miscellaneous items from the sacred ground. [00:20:38] Woodlands present hold students from local high schools, service organizations, and even a few of the board members' children, like mine, dedicating their time and youthful energy to clearing sections of Woodland. Students participating in clubs and athletic teams from Virginia Union University, Virginia Commonwealth University, and the University of Richmond have dedicated countless hours to clearing brush, unearthing headstones, cutting grass, and clearing roads. [00:21:09] Countless community members, service organizations, businesses, and armed service members have dedicated their time and skills to Woodland to improve the grounds. Right now, I would actually like to recognize my board members. So Woodland Restoration, you guys just wave your hands. [00:21:28] Any members of the Foundation's Advisory Committee that may be here? Could you stand now? Be recognized? Okay. And any of our committed volunteers that made the trek out with us today, could you also stand if you're still here? [00:21:48] Okay, thank you. And then the foundation would also like to give a special thanks to Monica Smith Callahan from the County of Henrico for being our champion and working alongside us so diligently. So with all that being said, you may be asking, what does the future hold for Woodland? [00:22:06] So we are currently working to continue renovating the chapel to become the historic hub of Woodland. We are working on funding to improve road conditions so that tours can be hosted safely on our grounds, and that's a big thing. We are working on partnerships with local school systems to be included in the curriculum when the history of our great city is the subject. [00:22:29] And we are working on various improvements to the grounds, and we welcome you all to help. We hope for all things that are good, peaceful, and prosperous for Historic Woodland Cemetery. Again, my name is Kimberly Cousins. I'm a board member and descendant of an interred family at Woodland, and I would love to have you all come out and join us in restoring this beautiful and sacred resting place. [00:22:55] That's it. Does anybody have any questions? Thank you. I just want to check. Is Mr. Harris on WebEx? Mr. Harris, were you able to walk? Yes, I'm trying. Can you hear me? [00:23:12] Yes, sir, we can. Okay, great. First of all, let me say thanks to Ms. Cousins. What a wonderful speech. I think you told our story. Also, what I wanted to do is reach out and say, Mr. Patokas, County Manager, thank you so much for what you have been able to do for us, and hopefully within the future, continue that's wonderful. [00:23:42] And I mean wonderful public-private partnership. Thanks a lot for everything here, Ryko, has been able to do. And I'll tell you, I'm just about ready to tee up. And the reason for that is that, Kimberly, I really enjoyed what you said. [00:23:58] We got a ways to go. But with this partnership, we'll be able to get there, I'm sure. Thank you all so much. Thank you, everyone. Mr. Chairman, with your indulgence, I do have one final comment. [00:24:21] During the board retreat in December 2022, Board of Supervisors directed staff to appoint outside stakeholders to our environmental committee, which is now called HART. Our Chief of Staff, Carrie Tretina, is going to introduce the newest additions to this team. [00:24:40] If you all would all come forward. Thank you, Mr. Manager, Mr. Chairman, honorable members of the board. It is my great pleasure to welcome the inaugural Youth HART Council. So almost all of the membership is behind me. [00:24:57] I think we're missing about two. I'm also joined by Jeff Wydell, who works in our public relations office. And he's also the Heart Outreach Subcommittee Chair. So Jeff, if you want to stand. He is the man behind Stewie. So you can thank him for Stewie being quite literally everywhere. [00:25:15] Also is Eric Byers, who is an environmental science specialist with Henrico County Public Schools. Without these two gentlemen, we would not be here today. They have worked tirelessly after hours on weekends to onboard these students, so I really want to thank them from the bottom of my heart. [00:25:30] So the Youth Council will be working directly with HEART in planning and implementing community projects along with serving as the liaisons from their schools and their representative magisterial districts. We do have representation from all magisterial districts, but not all high schools, so that's just a little nuance to make sure you guys understand. [00:25:50] You know, uplifting the younger generation's voice was a directive from the board during the board retreat, but we've also heard about the environment being so important through other avenues where we engage our students, like the Teen Summit, like we just learned about. [00:26:07] So through this new partnership with Henrico County Public Schools, the students will also receive an externship and volunteer credit hours, as well as they'll be serving on our heart committee making a positive impact for our community and just maybe they'll gain valuable job skills and be future interns with us so I'll stop talking at this point and I will like to ask each of the youth council members to introduce yourselves first name your grade and what high school you go to hello my name is Sean I go to Glen Island High School and I'm in 11th grade hello I'm Lily I'm a [00:26:43] 10th grader and I go to Verona High School hi I'm Annabelle and I'm a junior in the medical science Center at Goblin. Hi, I'm Augustina and I'm a senior at Deep Run High School. Hi, I'm Sasa and I'm a senior at Freeman. My name is Anjali. I'm a junior at Deep Run High School. Thank you all for taking the opportunity with us. You will be seeing more of them and as you all know as well we're working to appoint adults as well to the HART committee so we'll be bringing them forward at [00:27:19] a future board meeting as well. Thank you very much. Thank you Mr. Chair. I think we have comments from two of my colleagues, Ms. Whitehead. I'm going to go first, and then Mr. Rogish. Primacy, recency, so just first comment that I'm so pleased to see the folks from Green Teens here. [00:27:42] Mr. Rogish and I had the pleasure of meeting with some of you guys yesterday, and I can just say we were thoroughly impressed with their commitment to issues that were not of their creating, but are for their fixing, their generation, so really excited. Thank you for being here. [00:27:59] My second comment is, as we are now 13 days into Black History Month, just wanted to put a bug in everybody's ear that there was some really great programming that Henrico County folks have put together for that, and a lot of work has gone into it. Today, Reverend Cooper and I participated in events at a couple of the schools organized by Henrico NAACP. [00:28:22] That was a really great opportunity to speak with some student leaders. And also, if you go on to the Henrico Rexon Park page, as well as the Henrico Library pages, we'll actually go to the Henrico Government webpage and it'll give you a listing. But there are a ton of events, movie screenings, live performances, readings, just a plethora of activities. [00:28:43] And I would encourage you guys to take advantage of them because we want to show that there is an audience for these type of important activities. So please come out and take part in the hard work that so many county employees have done to celebrate this month. [00:29:00] Thank you. Thank you, Ms. Whitehead. Mr. Brokers. Mr. Chairman, we have two special guests here from Tuckahoe this evening. I'd like to recognize Ms. Reese Lash, a senior at Douglas Freeman High School, is from the Student Government Association. So she's helping out with us. [00:29:16] And I also have Emmett LaRue here from a local Boy Scout troop and wanted to welcome him as well. Glad that the high school students have chosen to spend that Tuesday night with us. Thank you for being here. Thank you, sir. [00:29:32] I do want to take a second to acknowledge the passing of our EDA director, Mr. Anthony Romanello, who has been with us for many years now. His dad passed last week, and the home-going service is Friday, Friday, February 16th at 2.30. [00:29:56] I'm certain he's not watching, probably with his family, but know, Romanello, that we are with you and your family during this tough time. Mr. Manchin. Mr. Chairman, we move into appointments. We have two papers here. 58-24 is a resolution for appointment of member to the Plan RVA Commission. [00:30:17] This paper would appoint Chris Bass, citizen at large, to that commission for a three-year term that would expire December 31, 2026. Mr. Chairman. Say a motion. second all right motion made by Ms. Whitehead second by Mr. Rogus all in favor say aye aye any opposed thank you Mr. Baster are you here you would come forward to receive your oath sir [00:30:45] chairman next item 59-24 is a resolution for appointment of persons eligible to serve as a [00:31:50] third member of the employee grievance panel in the Fairfield district this paper would appoint Samantha Thompson to serve on that panel for a one-year term that expires December 31st 2024 for. Mr. Chairman. Is there a motion? Second. A motion made by Reverend Cooper, second by Mr. Smith. All in favor say aye. Aye. Any opposed? Thank you. Mr. Chairman, members of the board, there is no oath for this position. Mr. Manager, I forgot to recognize any news media, though I don't think we have any tonight. But for those of you who are watching online, [00:32:29] thank you for covering Henrico County local government. Mr. Chairman, members of the board, Members of the audience, as we move into this next portion of the agenda, public hearing rezoning cases and provisional use permit, we have a little bit of an unusual situation in that we have seven cases that are put forward and there are six deferrals that have been requested. [00:32:54] So I'm going to ask Mr. Emerson, Mr. Newby to help guide us through this portion of the agenda, but we begin with 115-22 N3 CHOP Markel Eagle LLC with a conditional rezoning where the applicant proposes a single-family residential development. [00:33:16] Mr. Emerson, the request is put forward that this item be deferred until March the 12th? Yes, sir, that's correct. Okay, Mr. Chairman, do you want to see if there's anyone here? First of all, colleagues, anyone have anything to say? All right, this is a public hearing. [00:33:32] anyone here in the audience who would like to speak to this case seeing no one is there anyone on webex there's no one to speak to this item all right is there a motion 022-00002 markel eagle advisors llc be deferred deferred into the march 12th 2024 meeting at the request of the applicant second all right motion made by ms whitehead second by mr rogers all in favor say aye any opposed thank you mr manager mr emerson is there anything you want to say about the next [00:34:06] series of cases before we get in before individual deferral requester yes sir these are five cases that are they're under different llcs but they're brought forward by linger felt development they are companion cases and i believe there's some ongoing research regarding title and different things that are taking place that need to be completed prior to the board completing their actions on the cases. And the deferrals have been requested on each of these cases until April the [00:34:38] 9th. And they are all along Williamsburg and Charles City Roads. I'm just quickly going through the different aerials of them. So, Mr. Chairman, the first agenda item is 319-23 with Lingerfield Development, LLC, where the proposal was for an office in industrial use, conditional rezoning, deferral requested to april the night all right any comments from my colleagues anyone in the [00:35:13] audience to speak to this case and mr chairman i hate to interject here but you could for the sake of efficiency ask if anyone is here to speak to any of the five cases we would have to still take five motions but you could call for one public hearing on all five thank you mr newby that's very helpful anyone here to speak to any of these five cases anyone um on webex to speak to any of these five cases? [00:35:38] There's no one to speak on WebEx. All right, thank you. I move that REZ 2023-00033 Lingerfeld Development LLC be deferred to April 9th, 2024, meeting at the request of the applicant. [00:35:55] Is there a second? Second. All right, motion made by myself, second by Reverend Kubal. In favor, say aye. Aye. Any opposed? Thank you. Next one, I move that REZ, first of all, I'm sorry, colleagues, Any questions about any of these? [00:36:10] If not, I'm just going to make motions. All right. I move that REZ 2023-00034 VOZ 724 Park City LLC be deferred to the April 9th, 2024 meeting at the request of the applicant. [00:36:26] Is there a second? Second. All right. Motion made by myself. Second by Mr. Rogish. All in favor say aye. Aye. Any opposed? I move that REZ 2023-00035 VOZ724, Part City LLC, be deferred to April 9th, 2024, meeting at the request of the applicant. [00:36:49] Is there a second? Second. All right. I'll give this one to Ms. Whitehead. Moved by myself. Second by Ms. Whitehead. All in favor, say aye. Aye. Any opposed? I move that REZ 2023-00037 VOZ 724 Park City LLC be deferred to the April 9th, 2024 meeting at the request of the applicant. [00:37:12] Is there a second? Second. All right, second by Mr. Smith. All in favor say aye. Aye. Any opposed? Finally, I move that REZ 2023-100203 Lingerfeld Development LLC be deferred to the April 9th, 2024 meeting at the request of the applicant. [00:37:32] Is there a second? All right, second by a motion made by myself, second by Reverend Cooper. All in favor say aye. Aye. Any opposed? Thank you. Mr. Manager. Next, Mr. Chairman, agenda item 61-24 in the Verona District. Before you is Cappy and John Montgomery with a request for provisional use permit under Chapter 24 of the County Code to allow a bed and breakfast and an event venue on a parcel located on Kingsland Road. [00:38:00] this case, the Planning Commission voted to recommend that the Board of Supervisors grant the request. Mr. Emerson? Yes, sir. Thank you, Mr. Manager, Mr. Chairman, and members of the Board. The subject parcel is a 16.7-acre A1 zone parcel on Kingsland Road, across from its intersection with Deep Bottom Road. The 2026 comprehensive plan recommends the site for Suburban Residential 1, which corresponds to single-family development and related accessory uses. Surrounding properties consist of other large-lot single-family residential to the east, west, and north, [00:38:38] as well as the county's water reclamation facility to the south. The applicants wish to offer one room of their home for bed and breakfast accommodations and make the surrounding farm setting available to host private outdoor events, such as weddings, birthday parties, reunions, and similar gatherings. [00:39:00] Bed and breakfast is a principal use allowed in each single-family zoning district from A1 through R4A, and by extension, any customary accessory uses. Hosting weddings and other events has, for many years, been considered accessory to bed and breakfast operations in the county, and the two notable ones, of course, are Mancomanch on Oakley's Lane and the Virginia Cliff Inn on Mountain Road, Old Washington Highway. [00:39:28] However, in order to evaluate the unique circumstances of each B&B and event site, the scale of proposed operation, and its relationship with surrounding properties, approval of a provisional use permit is required. [00:39:44] This process allows the Planning Commission and the Board of Supervisors to consider all potential impacts and apply mitigation measures as necessary. As shown on this basic layout exhibit, the farmhouse is near the center of the property at the end of a long gravel drive. [00:40:02] Areas labeled 1 and 2 adjacent to the house are where event activities would be concentrated, other than parking which would be in a marked field at the front of the property. Temporary tent structures may be used for guests, but these and all other event setups would still be limited to the two designated areas. [00:40:20] It is also important to note this request would not involve constructing any new permanent structures or expanding any existing structures. Events would occur only between 12 noon and 11 p.m. and could be held throughout the year, although most would likely be during the warmer months. [00:40:40] There is no maximum for the total number of events, but the maximum attendance at any event would be 150 guests. The applicant is also committed to having no more than 15 events annually, with over 50 people attending. In addition to these parameters, the applicant has agreed to abide by numerous other conditions, which are listed in your staff report. [00:41:03] These recommended conditions include limiting the use of amplified music to only Friday through Saturday with reduced hours, preservation of perimeter tree buffers to help dampen noise and ensure visual screening, Maintenance of the field parking area, provision of lighting for guest safety in a manner that minimizes glare on adjacent properties, post-event removal of tent structures, provisions for portable toilets, solid waste removal, and recycling, and submission of a scaled layout for review of all relevant operational features, setbacks, and other measurements. [00:41:39] At the request of the Planning Commission, a previous condition regarding emergency access improvements to the driveway was removed to allow the fire code to apply as necessary. Since then, conversations between the applicant, building inspections, fire, and planning have clarified the processes required to approve the driveway surface and any temporary event structures. [00:42:03] For temporary event structures, the applicant would submit a single permit for blanket approval by the building inspections at the start of each year. This is similar to the process used with recreation and parks for events throughout the county. As for the driveway, the applicant would either provide the standard width and surface materials as described in the fire code or obtain fire's approval of an alternative that can reliably support the necessary vehicles. [00:42:32] This flexibility is allowed by code but may require the applicant to provide additional surface testing and related documentation to assure those code requirements are being met. Two other minor changes to the conditions have been made since the Planning Commission action. [00:42:49] Condition 18 was added to reiterate the Board's authority to revoke a provisional use permit under certain circumstances. That change was reflected in your staff report. The other more recent change, which was distributed this evening and is at each of your seats, It reflects condition number eight, revised so that right-of-way dedication is triggered by site plan approval rather than a 90-day window. [00:43:14] This allows better coordination with the actual start of the business. In lieu of a formal community meeting, the applicant twice mailed letters to surrounding property owners, inviting them to visit the farm, hear about the proposal, and share any concerns. One household attended these open house opportunities and sent an email in support. [00:43:35] Several other adjacent property owners have voiced concerns to staff and the Planning Commission about the introduction of commercial impacts in a rural setting. Considering the separation distances from adjacent uses and the requirements contained in the recommended conditions, the proposed uses would be compatible with adjacent properties and would be consistent with the SR1 land use designation. [00:44:00] For these reasons and with permitting processes having been clarified, staff supports this request. The Planning Commission at the January 11th meeting concurred and recommended approval to the board as well. If you have any questions, I'll be happy to try and answer them. [00:44:15] I don't have any questions at this point, Ms. Amoson. Thank you for the detailed explanation, questions from my colleagues. All right, is there anyone here to speak to this public hearing item? [00:44:41] All right, seeing no one, I'm sure that the applicant is not going to come up and speak. being that there's no one speaking to opposition, right? All right. I want to thank planning staff and planning commissioner, Mr. Mackey, who's here and worked this case. [00:44:58] I think anything that would have been considered an issue has been remedied and resolved. So I move that we approve the PUP 2023-00020. Cappy and John Montgomery, with the revised conditions dated February 9th, 2024, distributed this evening. Is there a second? All right, motion made by myself, second by Reverend Cooper. All in favor, say aye. Aye. Any opposed? Thank you. Mr. Manager. Mr. Chairman, members of board, public hearing, other items, you have five items for your consideration. Mr. Anthony will [00:45:35] take us through this portion of the agenda, 62-24, resolution for signatory authority. This is a quit claim for drainage easements in the Brooklyn District. Yes, sir. Thank you, Mr. Manager. Good evening, Mr. Chairman, honorable members of the board, ladies and gentlemen. [00:45:53] This board paper would authorize the chairman to execute a quick claim deed releasing any interest the county may have in portions of a drainage easement. This is located at 2015 and 2103 Staples Mill Road and 2000 Maywell Street. [00:46:11] The owners of the property encumbered by the drainage easements have requested this action. The county does not have any need for this area to be quit claim, and there's no county facilities in those areas. The Real Property Division has processed this request through the Departments of Planning and Public Works without objection. Mr. Chairman, members of the board, this brings us to public comments. [00:52:25] I do have one individual that has signed up to speak this evening, and that is Bridget Charles. Yes, ma'am, if you would come forward, please. [00:52:35] Greetings. Hi, my name is Bridget Charles. I'm a retired veteran and I'm the founder of the House of Humanity. We provide shelter to homeless families and domestic violence victims. My company is fairly new. I've done a lot of extensive research. I've been on the streets to try to see how I can serve my community like I serve my country. [00:53:17] And it's a big need for housing for homeless families and especially domestic violence victims. I have some brochures that I would like to give out to everyone to bring the attention to the matter. [00:53:40] I'm trying to make a difference, do a little bit better than what we have out there. We can always do better, right? So my thing is we're in the process of trying to purchase a big building to house these families. I've learned a lot by just going out here looking like if I buy a house, a four-bedroom house, I can only house two families, right? [00:54:00] So, therefore, we're just out here. We're raising money, raising attention to the need in the Richmond area just for the homeless families and domestic violence victims. So, I'm just here to be recognized, hopefully could get some support, direction on how to make this happen to where we can house more. [00:54:22] We have a lot of programs. have life skill programs we do transportation and so far this is just you know me doing the work with a few others but i i'm really trying to you know make a difference in the community basically so if you have any any direction that can be pointed into how i can make this happen uh how i can purchase a big building to uh like i said i am a veteran so i'm trying to use my veterans preferences on trying to buy buildings like the vfw you know so forth and so on so i [00:54:59] just you know i just need the support and the help one to how on how to make this happen to where we can clean up a little bit of our our streets and uh more of a safe haven for domestic violence victims do you um thank you first of all thank you for coming sharing about your um your work and we appreciate it do you have any information do you have a card or anything yes sir it's with um okay all right so we're going to take that information and um let us pass that along to staff that may be working in this area and somebody may reach out to you um so okay but [00:55:38] thank you for coming and sharing with us no problem yep good luck to you yes okay is there anyone else that wishes to address the board of supervisors this evening is there anyone on webex that wishes to address the board sorry i thought mr welch was coming up there's no one on webex mr chairman And seeing no one else to speak, we move into the general agenda. [00:56:11] I'm going to ask Mr. Crawford. He covered these budget amendments in work session. So this is an introduction of resolution to budget amendments for the month of February. Mr. Crawford. Thank you, Mr. Manager, and good evening, Mr. Chairman, members of the board. As the manager noted, this is an introductory resolution. [00:56:30] If approved, it sets the public hearing for these budget amendments at the board's next meeting on February 27th and also authorizes the advertisement of these budget amendments in the Richmond Times Dispatch on February 20th. [00:56:46] Just as a quick overview, again for the board, as I did present these in work session, but for the general public, the total requested amendments is $20.8 million, and really there are two items that take up the bulk of that. [00:57:02] 10 million dollars is requested to true up the highway the state highway maintenance payments that our department of public works utilizes for the maintenance of our road networks and then 6.4 million dollars is requested for the renovation of adams elementary school that is the last 2016 schools bond project so with that as a quick overview of the amendments i'll be happy to answer any questions the board has at this time thank you sir any questions from my colleagues mr chairman [00:57:40] move the introduction to the resolution motion made by mr smith second by miss wayhead all in favor say aye any opposed thank you next mr chairman as fire chief comes forward 68-25 is a resolution for approval of commonwealth care ambulance llc to operate a medical transport service in our county yes sir mr chairman members of the board mr manager this board paper approves Commonwealth Care Ambulance LLC to provide medical transport services with the entire geographical area of the county upon receiving an emergency medical services license from the Virginia Department of Health Office of EMS. Fire Chief [00:58:19] recommends approval of this board paper. County Manager concurs. Happy to answer any questions. All right. Any questions for my comment, I mean for my colleagues, about this particular resolution? For the Chief? Need a motion. All right. Motion made by Reverend Cooper, seconded by Mr. Rogish. All in favor say aye. Aye. Any opposed? [00:58:45] Thank you. Next two items, Mr. Chairman, members of the board, 69-24 and 70-24 are both items that would declare portions of the fall-on trail or pieces associated with the fall-on trail substantially in accord with the comprehensive plan. [00:59:04] Mr. Emerson, if you would take the board through both, please. Yes, sir. Thank you, Mr. Manager, Mr. Chairman, members of the board. At the request of the Department of Public Works, the Planning Department conducted a substantially in accord study to determine whether a proposed site for a trailhead for the Fall Line Trail, located at the southeast corner of Francis Road and Greenwood Road, is substantially in accord with the 2026 Comprehensive Plan. [00:59:28] A substantially in accord study is conducted if there is a property whose proposed purpose is for public or government use as provided by the Code of Virginia, Section 15-2-2232A. The proposed site for the Longdale Recreation Trailhead is approximately 1.24 acres and is part of a larger 6.89-acre parcel owned by the Central Virginia Soccer Association. [00:59:55] This property is commonly known as the Longdale Recreation Center. The county will be partnering with CVSA to add fall line trail facilities and amenities to the site by paving and upgrading the existing gravel parking lot and by adding a four-stall restroom, picnic shelters, fitness equipment, and other amenities. [01:00:14] The proposed trailhead is generally consistent with the 2026 comprehensive plan, recommendation of open space recreation for the site. The site under consideration presents no apparent conflict with the intent of the comprehensive plan. [01:00:32] After January 11, 2024 meeting, Planning Commission concurred with staff's recommendation, finding the site substantially in accord with the comprehensive plan, recommending approval to the Board of Supervisors. If you have any questions, I'll be happy to try and answer them. Questions? No questions. Is there a motion? [01:00:55] Mr. Chairman, I make a motion to approve the recommendation presented by the Planning Commission. Second. All right, motion made by Reverend Cooper. Second by Ms. Whitehead. All in favor? Any opposed? Thank you. Mr. Emerson, if you would cover 70-24 as well. [01:01:14] Yes, sir. Thank you again, Mr. Manager, Mr. Chairman, and members of the board. This is the second substantially in accord study completed for a fall line trailhead. Similar to my previous presentation, the study was done to determine whether a proposed site for a trailhead located on Mountain Road between New York Avenue and Virginia Avenue is substantially in conformance with the 2026 comprehensive plan. [01:01:39] A .7-acre subject site will be part of the Longdale phase of the Fall Line Trail and will be designated a minor trailhead as it will not have any restroom facilities or parking. The site will function as an access and resting place for users and is also planned to include an obstacle course, a rubber circular track, fitness equipment, and a bench area with landscaping. [01:02:03] The 2026 conference plan recommends commercial concentration for the site. The site in question presents no apparent conflict with the intent of the comprehensive plan. Again, at their January 11, 2024 meeting, the commission concurred with staff's recommendation and found the proposed site substantially in accord with the comprehensive plan, recommending approval to the Board of Supervisors. [01:02:25] Again, if there are any questions, I'll be happy to try and answer them. Any questions? All right, hearing none, is there a motion? Mr. Chairman, again, I make a motion to approve the recommendation presented to us by the planning commission. [01:02:43] Second. Alright, second made by, I mean, motion made by Reverend Cooper, seconded by Mr. Smith. All in favor say aye. Aye. Any opposed? Thank you. Next, Mr. Chairman, 71-24 is a resolution for award of contract. This is for the Lake Overton Wet Pond Retrofit and Dam Safety Improvement Project. This is in the Fairfield District. Mr. Hughes. [01:03:06] Thank you, Mr. Manager. All right, Mr. Chair, members of the board, good evening. This board paper awards a unit price contract for $1.49 million to Doran Landscaping for construction of the Lake Overton Wet Pond Retrofit and Dam Safety Improvements Project. [01:03:23] The project consists of retrofitting Lake Overton to a wet pond with safety improvements made to the earth and dam. The design plan includes dredging, sediment, creation of a four-bay, lake shoreline erosion protection, a new concrete spillway, dam and bank repairs, and forest mitigation plantings, as well as a trail connecting to the nearby park. [01:03:45] The county received three bids, and based upon a review of the bids, Doran Landscaping is the lowest responsive and responsible bidder. Funding to support the contract is available within the project budget. The director of public works and the purchasing director recommend approval of the board paper and the county manager concur. [01:04:01] So, one thing I'll note is we did receive $415,000 in state grant funding to help fund this as well. Happy to answer any other questions. Thank you. Any questions for Mr. Hughes? All right, no questions. [01:04:18] Is there a motion? Mr. Chairman, before I make a motion, I just want to recognize members of the Three Fountains North community who have come out tonight to support this. Mr. Chairman, I make a motion that we approve the recommendation as presented. All right, motion made by Reverend Cooper, seconded by Ms. Whitehead. [01:04:37] All in favor, say aye. Aye. Motion passed. 22? 72-24, 72-24 is a resolution. This is acceptance of road in the Fairfield District. Mr. Hughes. [01:04:53] Thank you, Mr. Manager. Mr. Chair, members of the board, this board paper would accept 0.1 miles of River Mirror Lane into the county road system for maintenance. The Director of Public Works recommends approval of the board paper, and the county manager concurs. Happy to answer your questions on this. Yeah, I've got several questions. [01:05:13] No, I'm not going to mess with you. Any questions for Mr. Hughes? Is there a motion? Again, Mr. Chairman, I make the motion that we accept the recommendation as presented. Motion made by Reverend Cooper, seconded by Mr. Rokish. [01:05:33] All in favor say aye. Aye. See, Mr. Hughes wasn't even expecting to make that. You know, you see how he dragged it out? He was like... He was already down there from the last case. He didn't get the wall. He was like, I don't even get the opportunity to make these resolutions. I think that's all the business we have, right, Mr. Mantra? [01:05:51] No other business, Mr. Chair. All right. Colleagues, anything for the good of the public before we end the meeting? Just very briefly, I forgot to mention we are hosting our very first three-chopped town hall Tuesday evening. I know Mr. Rogish won't steal his thunder. He's got an announcement similarly at the Deep Run Rec Center Tuesday evening. [01:06:10] So come on out if you're a three-chopped resident. And we are hosting, thank you, Ms. Whitehead, we are hosting the Tuckahoe Talk 1 o'clock on the same day, February 20th. It will be at the Regency Mall at the Henrique Adult Education Center. All right. Thank you. Thank you, colleagues. [01:06:26] Meeting adjourned. ---------------------------------------------------------------------- Coraggio Consulting ยท aguyonx.com
