Thank you for joining us for our Board of Supervisors meeting April the 9th, 2024. We are glad that you have decided to join us either in person or online. If you are giving public comments at any portion, at any point, we're asking that you give your comments from the lectern in the back. [00:00:24] For everyone who is watching the live stream of tonight's meeting on the county website, you can also participate remotely in the public hearings and public comment portion of the meeting. We ask that you go to the Board of Supervisors webpage at henrico.us forward slash supervisors, click on Guidance for the Board of Supervisors meeting, scroll down, and click on WebEx event there. [00:00:52] A moderator will let you know when it is your time to speak. Before we begin our agenda, we have a request from our colleague, Mr. Dan Smith, to participate in this meeting from his home because he is ill. [00:01:10] He did participate in our work session just a couple of hours ago with us. The board's policy allows Mr. Smith to participate electronically if approved by a majority of the quorum physically present at the meeting. [00:01:27] Colleagues, you'll have a motion to approve electronic participation by Mr. Smith. So moved. Second. All right, moved by Mr. Rogish, second by Reverend Cooper. All in favor, say aye. Aye. Any opposed? [00:01:43] As have it, electronic participation is approved. Join me as we stand for opening prayer and the reciting of the Pledge of Allegiance. Let us recite the Pledge of Allegiance first, then have the invocation prayer. [00:02:07] We will have our invocation led by a chaplain for the Henrico County Police Division, Will Clements. Let's pray. [00:02:24] Lord God, we thank you for this evening. Thank you for another day. Thank you, Lord, for the Board of Supervisors. We thank you for all of the volunteers that are here this evening, Lord, all of the topics that are being discussed and voted all, and we pray for your guidance and your direction. I pray, Lord, that you would just have your way in this meeting tonight, Lord, and we give you praise and glory for it, and it's in your name we pray it, Jesus. [00:02:42] Amen. Mr. Manager. [00:03:07] Mr. Chairman, we have an approval of minutes for March 26, 2024, both the regular and special meetings. A motion would be in order. Motion to accept the approval of minutes. [00:03:23] So moved. All right, need a second. Second. All right, motion made by Ms. Whitehead, second by Mr. Rogas. Y'all in favor say aye? Aye. Any opposed? Mr. Mandel. Mr. Chairman, members of the board, members of the community, I have two comments this evening. Last Friday, the chairman of the board, Ms. Whitehead, and I attended two local mosques and were able to observe the end of or what was the beginning of the end of the month, the holy month of Ramadan, and tomorrow is the actual end. [00:03:58] It is eat-out-fitter, holiday marking the end, and it is worth noting that we have a large population in our county that recognizes and celebrates this holiday. So for the first time, our county is offering employees the ability to take flexible leave, any kind of leave, floating holiday. [00:04:24] For that holiday, you have seen us observe more and more religious holidays and observances throughout the years, and this is just in addition to that. Mr. Chairman, Ms. Whitehead, I don't know if you have any comments as far as the participation on Friday prayers. [00:04:45] It was my first time being in a mosque and celebrating with that community, and it was extremely eye-opening. As a woman in that environment and honoring and respecting their traditions and their rules that may be different from what I'm accustomed to, I'll be honest, that made an impact on me. [00:05:13] But what I was struck by was, and I made these comments at the ladder of the mosque, is their dedication, you know, the sacrifices that are required, that fasting, and many of us celebrate different religions that require a level of sacrificing with varying degrees. [00:05:30] But even when we have our differences, the fact that we find commonality and unity in a belief in a higher power, a belief that there is something that has greater control, a belief in something that gives us hope, and that is worth our sacrifice and dedication is moving, even if we don't call the higher power the same name. [00:05:50] So it was my privilege and my honor to be amongst that, to be accepted and welcomed, and I was grateful for that opportunity. Mr. Chairman, I also have a second comment. Thank you, Ms. Whitehead, for that. [00:06:07] And that is a more somber one for our employees and residents. Many of you knew my predecessor, know my predecessor, Mr. Virgil Hazlitt, who served our county with distinction for over 40 years. Last Thursday, his wife of many, many years, Shardell Hazlitt, who many of you also knew passed after a long illness. [00:06:36] She was a devoted wife and mother. She was all about her family. She graduated with a master's degree from UVA and worked for our school system, helping children through the PRIME program. She loved to be outside, many, many plants, azaleas, rhododendron, at the Hazlett household that she was instrumental in planting. [00:07:05] She was a member of Second Baptist Church, active in the Tuckahoe Women's Club. And for those that knew Mr. Hazlett, the family will receive friends at Bliley's on Augusta from 2 to 5 on Saturday, and there will be a celebration of life at the Second Baptist Church on River Road Monday at 1 o'clock with a reception to follow. [00:07:31] Mr. Chairman, may her memory be everlasting. I have no other comments. Thank you, Mr. Manager. Colleagues, do you have any comments? I'll add a comment and a thank you to Mr. Vitoulkas, county manager, and this was something. [00:07:47] I hope you don't mind me saying this. I had reached out to Mr. Vitoulkas yesterday in a conversation that I had had with a deputy in one of the courtrooms that I work in, and some of you may know I'm a trial attorney, so I'm in the courtrooms day in and day out, and there was a discussion about the the raises that you guys may know occurred or that we've approved for certain staff the 7.2 for critical staffing and that included sheriff's deputies a very integral part of our public safety and the deputy that i was speaking to as a member of the encore program which is a very important program that we bring retirees in to fill some critical [00:08:22] staffing shortages and they're valuable members that come back and are willing to work on at an hourly rate and um he inquired as to whether or not the bump for the 7.2 percent would include encore folks who had come back and i reached out to the county manager and and he informed me that that was not how it had been envisioned um we discussed a little bit more and this morning mr vitolkis reported back to me and said that that we've changed that and we are now including all of the encore employees will get that 7.2 percent increase on their hourly rate [00:08:58] and i was just so pleased one for the for the folks that that will benefit but also just the responsiveness and and i give that as an example of of the power that your voices have when you reach out and let us know what your concerns are and the confidence that we feel as board members in reaching out to all staff and including uh the county manager to be able to get things done for the most valuable members of of of our teams here so uh thank you mr county manager for making that happen so quickly um i've already received so many um expressions of gratitude from the folks that [00:09:33] that will affect and um just just kudos thank you miss whitehead any other colleagues all right uh let's continue to move forward there are no no members of the news media here with us i'm sure they are watching online or will watch so we're always appreciative of the coverage of our meetings we move to our presentations we do mr chairman we begin with the proclamation for public safety telecommunicators week april 14th to the 20th i'm going to ask you mr chairman to the podium to present the proclamation to the following individuals rebecca taylor director for [00:10:12] emergency communications and linda kidd communications supervisor and rebecca if you've got anyone else you all please come forward we have a proclamation of the board of supervisors of henrico county virginia public safety telecommunicators week april 14th through the 20th whereas the communications office of the henrico county department of emergency communications serve the local community by answering telephone calls for fire police and [00:10:49] emergency medical services assistance and by ensuring that the appropriate response is dispatched as efficiently as possible, and whereas communications officers perform with distinction a vital duty to the citizens of Enrico County in protecting their health and safety, and whereas Enrico County residents and visitors depend on the skill, expertise, and commitment of these professionals who provide unselfish service on a daily basis in very stressful situations. Signed by our Chairman Tyrone Nelson and Ms. Tanya Brackett, our Clerk. Mr. Chairman, members of the board, Mr. Manager, it's an honor for me to stand and accept this proclamation on behalf of our volunteers. [00:15:37] The volunteer program has served as a vital resource for many of our residents and our workforce for 40 years. In 2023, volunteers donated 104,928 hours of their time to the county in numerous ways, including assisting recreational programs, planting trees in our parks, helping stranded motorists with disabled vehicles, supporting our library staff with library programs, serving at the new sports and event center for events, and aiding our children as special advocates in the court system. [00:16:12] The value of these hours amounts to a total nearly $3 million. And in the last year, the county has implemented eight hours of volunteer leave for our county employees. Since then, our employees have utilized over 2,135 hours of volunteer leave. [00:16:30] They have served various organizations such as the Henrico Community Food Bank, Woodland Cemetery, Feed More, Meals on Wheels, YMCA Greater Richmond, Mission Tomorrow, Henrico Christmas Mother, and many, many more. As you can see, volunteers are the heartbeat strengthening our organization, and we're thankful for their commitment, time, and passion to our county and community. [00:16:54] The national theme for National Volunteer Week is celebrating service. So I would like to take a moment to acknowledge all of our Henrico County volunteers. If you're a staff or a volunteer and here tonight, please stand to be recognized. I also want to express my gratitude to the Board of Supervisors for proclaiming April 21st through the 27th as Volunteer Week and for your support of the county's volunteer initiatives. [00:17:32] Tonight, I want to introduce very quickly Mr. Bob Ramsey, an 18-year motorist assistant who has had a positive impact on our residents. Mr. Ramsey, your remarks. Thank you. It's an honor to represent the group. [00:17:49] I want to thank the chief. I want to thank the police officers that are here. When I started, Bill Lavecchia was the county manager, and it's grown to a program that just gets better and better. [00:18:05] It's been fun to represent you. I'm tickled to death to be a resident of the county. I'm proud to be a resident of the county. I think it's run very, very well. The police that we are basically helping by, if it's a stranded car, they have to stay behind the car until a record comes, and we'll come, and we're professional waiters. [00:18:28] We can wait. The other thing we do is we'll allow the police officers to work crashes while we keep them safe. just the day before yesterday, a former county assistant manager had a little crash at an intersection, and we protected him and worked with him. And I said, I think I know you. And anyway, it was very interesting. So thank you. And Catherine, Mallory is our volunteer person who does a great job. I asked what I should talk about. She said about two minutes. So I'll be finished. But thank you so much. It's an honor to represent you. And I think our program is [00:19:07] just getting better and we all the way from the chief down every time we have an event you honor us and you feed us and it's a great thing so thank you so mr. ramsey and group don't go far i think the uh chairman and the board would like for all of the volunteers to come up here to the dais we'd like to take a minute and take a picture with all of you it's too late [00:19:37] I'm doing well. I'm doing well. Have you guys met Ms. Whitehead? You know Mr. Cooper? [00:19:57] Congratulations, sir. Thank you for the service. Thank you for the service. [00:20:03] Thank you. [00:20:47] Thank you, dude. Thank you. I'll be with you one day. I'll stay safe on the other side. I'll stay safe on the other side. Thank you, sir. [00:21:06] Yep. I'm trying to get out. Stuff on the side. [00:21:23] That's wrong. Not the right case. Anyway, all right, now we're good. Now we're good. All right, as we prepare, as we are clearing out the room, we're going to continue with our meeting. [00:21:42] We move to the appointment section. Mr. Manager. Mr. Chairman, agenda item 116-24 is an appointment of member to the Henrico Area Mental Health and Developmental Services Board. This board paper would appoint Ann Cox to that board for a term that would end December 31st, 2025 as a family consumer representative. [00:22:05] I think it is poignant to know that Ann's husband, Jay, served in this capacity for many, many years for the county and served admirably before passing earlier this year. So, Mr. Chairman, motion would be in order. [00:22:22] Colleagues, need a motion. So moved. Second. Moved by Mr. Rogan. Second by Reverend Cooper. All in favor, say aye. Aye. Any opposed? Thank you. Ms. Cox, if you would come forward to receive your oath. [00:22:35] I would faithfully and partially discharge and perform all duties and come and employ me as a member of Henrico Area Mental Health and Development Services Board, according to the best of my ability, so help me God. [00:23:04] I do. [00:23:14] Mr. Chairman, members of the board, we move into public hearings, rezoning cases, and provisional use permits. [00:23:54] For the members of the audience, there's a rather beefy agenda in this area this evening. but we begin the first two cases out of the fairfield district general land company with a conditional rezoning request and an associated provisional use permit agenda items 316 23 and 317-23 request has been put forward by the applicant to withdraw both items do we need to um we need to vote on withdrawals no sir mr chairman no action is necessary the cases are [00:24:26] withdrawn okay mr. Emerson that takes us to 115 - 22 this is Markel Eagle where the applicant proposes a single-family residential development in the three chop district here request it has been put forward for deferral to June the 11th is that correct yes sir that is correct first of all you have any comments before we move forward okay is there anyone here to speak to this particular case even though it's being deferred if you're here we'll offer you [00:25:01] opportunity to speak seeing no one here is anyone on webex to speak to this particular case there's no one to speak to this item all right i need a motion mr chairman i move that rez 2022-00002 markel eagle advisors llc be deferred to the june 11 2024 meeting at the request of the applicant second a motion has been made by ms whitehead second by mr roguish all in favor say aye [00:25:34] any opposed thank you mr manager next mr chairman 117-24 out of tuckahoe district gateway associates of richmond with a provisional use permit that would allow commercial uses and zoning modifications as part of a master plan development this evening i was notified that this case is also there's a request for a deferral to is that may 14th mr emerson may 14th yes sir mr manager all right mr rogers and the comments no sir all right this is a public uh even though it's deferred it is [00:26:09] still a public hearing so is anybody here to speak to this case in the room yes thank you just for a moment i'd just like to briefly reiterate comments on this project uh that i made to the planning commission and i'll emphasize one particular point since the project has been deferred uh it's the consideration of myself i'm jeremy ross 1610 renmark road in the rich haven neighborhood, which is directly across Parham Road from this proposed development. [00:26:38] No consideration was given when this was evaluated by the staff of the impacts on the surrounding community and the surrounding roadways. This project will have detrimental traffic effects, it will reduce walkability in the area, it will increase safety problems on Parham Road, and it will actually damage the view shed and the noise effects in the Ridgehaven neighborhood by reflecting sound directly back at us from Parham Road. [00:27:03] The project is ill-situated and needs to be considered carefully in its context, not just in relation to what's happening on the parcel itself. So I'd love for you to take advantage of the deferral to send this back to staff to do a proper technical evaluation of the impacts on the surrounding community. [00:27:21] Thank you. Thank you. Any other comments from inside the room on this particular case? Anybody on WebEx? There's no one to speak to this item. All right, is there a motion? [00:27:38] Mr. Chairman, I move that PUP 2023-00018 Gateway Associates of Richmond to LLC be deferred to the May 14, 2024 meeting at the request of the board. All right, motion made. [00:27:55] Second. Needless second. Second. All right, motion made by Mr. Rogers, seconded by Reverend Cooper. All in favor, say aye. Aye. Any opposed? Thank you. Mr. Manchin. next mr chairman out of the brooklyn district 118-24 is brian moss with a request to amend proffers the applicant proposes to amend proffers regarding building materials and building height in this case mr emerson thank you mr manager mr chairman members of the board this is a request to amend the proffers accepted with rezoning case c18c90 regarding building materials and building height on property located at the intersection of Staples Mill Road and East Parham Road. [00:28:35] The existing building was developed as a Burger King drive-thru restaurant in 1993 but is now unoccupied. The applicant has indicated they have no plans to alter the building's footprint with this request. Adjacent uses are predominantly commercial with a restaurant located to the east on property zoned M1. A retail center is located to the west and a bank to the south, both Zone B2C. To the north is an office, Zone B1, Business District, and M1. The applicant proposes to amend proffers related to exterior building materials and building height to allow [00:29:13] for flexibility in attracting a new tenant and renovating the existing building. Specifically, the applicant proposes removing language regarding the use of red brick and mansard-style roofs with slate-like appearance. In its place, exterior walls of any building on the property would be constructed of brick, brick veneer, glass stone, stone veneer, or a combination of such materials. [00:29:39] The applicant is also proposing to increase the maximum building height from 20 to 25 feet. The 2026 comprehensive plan recommends commercial concentration for the subject site, and the proposed amendments would not significantly change the intent of the proffers. Staff supports this request and the planning commission at their March 14th meeting recommended approval. If you have any questions, I'll be happy to try and answer them. Thank you, Ms. Emerson. Questions, colleagues. All right. No questions or comments. This is a public hearing. [00:30:15] Is there anyone here to speak to this particular case? All right. Seeing, are you here to speak to this case? Seeing no one. Is there anyone on Webex? There's no one to speak to this item. All right. Mr. Smith. Thank you, Mr. Chair. I had an opportunity to visit the site visit the site and spoke with the applicant. [00:30:38] I think these improvements will be an uplift, a facelift for this corner. Mr. Emerson, please thank your staff for your work on this. Mr. Chairman, I move that we follow the recommendation of the Planning Commission and approve REZ 2024-100126, Brian Moss, with proffers dated February 22, 2024. [00:30:58] Motion made by Mr. Smith. Second. Second by Mr. Rogish. All in favor, say aye. Aye. Any opposed? Thank you. [00:35:29] Therefore, staff recommends approval of this request, and the Planning Commission recommended approval, as mentioned, after March 14th public hearing. Thank you, Ms. Moore. Are there any questions, colleagues? Is there anyone here, as this is a public hearing, to speak to this particular case? [00:35:48] Is there anyone on WebEx? There's no one to speak to this item. There's their motion. Mr. Chairman, I move that we follow the recommendation of the Planning Commission and approve RZ-2024-1000604801, Hermitage Associations, Associates, LLC. [00:36:09] Motion made by Reverend Cooper, seconded by Ms. Whitehead. All in favor, say aye. Aye. Any opposed? Thank you. Mr. Manager. Next, Mr. Chairman, 121-24 out of the Fairfield District is RJM Land, LLC, where the applicant is proposing a conservation district. [00:36:25] Ms. Moore. Thank you. The property includes 1.6 acres within a 100-year floodplain that runs along the eastern border of the Greenhouse Subdivision, which is a single-family community that was approved in 2022 with rezoning case REZ 2021-00065 and is currently under development. [00:36:45] The proffers that were accepted with that original case requires that areas located within a 100-year floodplain be rezoned to C1 Conservation District. This request fulfills that requirement and also supports the 2026 Comprehensive Plans designation for the site as an environmental protection area. [00:37:04] This concludes my presentation. I'd be happy to answer any questions you may have. Thank you, Ms. Moore. Colleagues, any questions? All right, hearing no questions. This is a public hearing. Anyone here to speak to it? Seeing no one. Is anyone on WebEx? [00:37:21] There's no one to speak to this item. All right. Reverend Cooper. Mr. Chairman, I move that we follow the recommendation of the Planning Commission and approve REZ 2024-100107, RJM Land, LLC, with the proffers dated February 21st, 2024. [00:37:40] Second. All right, motion made by Reverend Cooper, seconded by Mr. Roker. All in favor, say aye. Any opposed? Thank you. Mr. Manager. Next, Mr. Chairman, out of the Verona District is 122-24, Arcola Towers, with a request for a provisional use permit that would allow for telecommunications, tower located near the intersection of duran and mccallan parkway miss moore thank you again the applicant is seeking approval of a provisional use permit to allow a 199 foot tall telecommunication tower on a 28 acre parcel located on the east line of duran road and just southeast of dory park [00:38:18] access would be provided by a 10 foot wide gravel drive from duran road to a 60 by 60 leased area The ground equipment and tower would be sited approximately 300 feet off of Durand Road and enclosed by a 7-foot high chain link fence. [00:38:37] The site, as you notice, on the aerial is heavily wooded, and the dense standard trees would remain to help obscure the views of the ground equipment and portions of the tower. The closest residential lot is approximately, as shown here, 500 feet away, and that's the rear property line of their lot in the Castleton subdivision. [00:38:58] As you can see here, the tower would be a monopole style with the potential of five attendant arrays for co-location. The applicant held a community meeting on February 28th, followed by a second balloon float on February 29th. [00:39:17] Based on that balloon float, they did provide a location map depicting renderings of the proposed tower at different viewpoints. The most visible, as they noted in red, being along Hasberg Lane and Castleton to the east and a couple of cleared areas along Duran Road and then along Danrett Drive. [00:39:41] Can you show us the ones in red, please? So this is the one from Castleton. That's view one, and that is right here. Going back to Duran Road, let's see. [00:39:57] That would be two and four. It's a little bit obscured. There's the one off of Duran. This one is also on Duran. and then view three is the one to the south and Doran Forest subdivision off of Danrett Lane. [00:40:18] Okay, thank you. So due to the size of the parcel, we do feel, let me go back to the aerial. Due to the size of the parcel and the presence of the extensive trees and vegetation, staff believes the proposed tower would be acceptable on the A1 zone property. [00:40:41] In addition, the height, while minimal visibility, would provide co-location opportunities for users and expand the services in the area consistent with the goals and objectives of the comprehensive plan. Therefore, staff does support this request with the 12 recommended conditions in the staff report. [00:40:57] And the Planning Commission recommended approval at their March 14th public hearing. This concludes my presentation. I'd be happy to answer any questions. Thanks, Jane. Just one question. These towers are located, not Arcola in particular, but just towers in general are located all over the county. [00:41:14] Yes, sir. For different purposes, different reasons, both on public and private property? Yes, sir. And this one is a little bit higher because it does allow that co-location, and it's appropriate on this large acreage of land to allow that vegetation and some distance from other areas. Plus, you do have a large flood plan in EPA here with Dory Park. [00:41:33] And you said, so I think there's Dory to the west and to the east, 500 feet to the residential, and that's Castleton, right? That's correct. So about 500 feet is about right here. Okay. All right. Thank you. I don't have any questions. Who is the applicant? I'm just curious. [00:41:54] Is the applicant here? We have three representatives here, I believe. Yeah, I'm good. I think it's Mr. Fletcher. Yeah, just hold on. Might be some opposition. If it's some opposition, then I'll get you to come up and speak. It is a public hearing. I'm sorry. Colleagues, any questions? There's a public hearing. Is there anyone here to speak to this case? [00:42:13] All right. Anyone on WebEx? There's no one to speak to this item. All right, colleagues, I move that we approve PUP 2023-100-204-Ecola Towers with the recommended conditions listed in the staff report. All right, moved by myself, seconded by Mr. Rogan. [00:42:32] All in favor, say aye. Any opposed? Thank you. Mr. Mantra. Next, Mr. Chairman, members of the board, the next five cases Mr. Seal is going to cover, all in the Verona district 319 320 321 322 and 60-24 all affiliated or associated developments if you will these are five public hearings mr. seal is going to have one presentation and mr. newbie just to be clear one one public [00:43:09] hearing for all five items and then five separate votes by the board that's That's correct, Mr. Manager, Mr. Chairman, members of the board. One presentation, the chair could call for public hearing on all five items at once and then take action on each case individually. Thank you, Mr. Manager, Mr. Chairman, members of the board. [00:43:28] As mentioned, these are five separate requests to develop four office warehouses along Williamsburg Road and Charles City Road. Surrounding uses to the subject properties include a mix of non-residential uses, including a landfill to the south, existing businesses along Williamsburg Road, industrial uses to the east along Klockner Drive, as well as some remaining single-family homes on property zone day one. As the manager noted, the five separate cases include four separate development areas. The first two cases are more companion cases with the conceptual plan shown [00:44:04] here. These are RAZ 2023-33 and RAZ 2023-100203. This is a conceptual plan for the two companion requests fronting on Williamsburg Road, which is to the top of your screen here. This shows a 176,000-square-foot office warehouse with one entrance located on the western side of the property, a 20-foot fire lane leading to access 38 loading docks in the rear. The proffers submitted with these requests provide assurances regarding the property's frontage along Williamsburg Road, including a landscape buffer with decorative fencing, sidewalk, and additional right-of-way dedication as required by the Department of Public Works and VDOT. Other proffers address [00:44:43] building materials, permitted uses, and lighting. The other conceptual plans show similar offices warehouses that would be located to the south along Charles City Road. First, 2023-34, includes a 70,500 square foot office warehouse with 30 loading docks to the rear with one point of access on Charles City Road as shown here. Next would be a 3,600 square foot phase one office warehouse building with possible expansion of an additional 9,600 square feet. The conceptual plan also shows additional future expansion of a storage lot located to the rear of the building. And then [00:45:22] the final request, it does extend to Williamsburg Road as shown kind of here, and then it's this long parcel located in the middle as shown on that screen. However, the proposed development would be concentrated on the southern portion of the site facing Charles City Road. The conceptual plan shows a 24,000 square foot office warehouse with a storage yard to the rear. The entrance would be located on charles city road but i would note that the commitments regarding right away dedication sidewalk and fencing would carry along the portion of the site facing williamsburg [00:45:55] road as shown on its conceptual plan at this time none of the properties are proposed to interconnect due to the existing power line easement that runs through the middle of the site as you can see in the middle here the proffers for the three companion cases outside of those two facing williamsburg road are very similar in nature and address sidewalks and right away landscape buffers along Charles City Road permitted uses and building materials. [00:46:23] The 2026 comprehensive plan designates all of these parcels for office service, planned industry, and commercial concentration. In addition to these designations, three of the subject sites are located within the county's enterprise zone. These requests are generally consistent with the planned industry and office service designations and the pattern of office warehouse development in the surrounding area, especially to the east and west. [00:46:43] Although not fully consistent with commercial concentration designation, the office warehouse use on the site of rez 2023-100203 is consistent with the site's location in the enterprise zone as well as the pattern of development with the mini storage is just directly to the east the proffer submitted with all five requests provide assurances regarding the quality of proposed developments and design appearances including enhancements along the frontages along of charles city road and williamsburg road the proffers also restrict uses in a manner that would be compatible with the surrounding area and for these reasons staff is recommending approval of all 5 requests. [00:47:20] The planning commission did recommend approval of these requests at different public hearings. As the manager noted, comment can be taken together for all 5 of these requests, but separate motions would be required on each item. That concludes my presentation. I'd be happy to try and answer any questions you might have at this time. [00:47:36] Colleagues, do you have any questions? I do have comments, but I'm going to hold them. Let me ask you one question. You said the uses are, again, what? And the frontage is Williamsburg Road and Charles City Road. [00:47:57] So the concentration of frontage looks to be in close proximity of each other on Charles City and right beside each other on Williamsburg, correct? Yes, sir. And what did you say the uses were again? So the applicant has limited the uses to essentially light manufacturing and warehousing uses, along with some ancillary accessory uses. [00:48:19] the light industrial uses or manufacturing uses permitted in the industrial or M1 district, which is being requested here, include artisan manufacturing, which is a new definition in the recently updated zoning ordinance, so small-scale manufacturing, as well as manufacturing, light manufacturing, which is in an enclosed building in something that can't produce smoke or dust or anything like that. [00:48:39] So you can or can't? You cannot, sir, by the definition of those uses in the zoning ordinance. All right. That's it? Yes, sir. Mr. Emerson, I asked you about this because I received an email that made mention of infrastructure costs for the county. [00:49:01] What's the infrastructure costs for the county for this project? It would be zero. That will be borne by the developer here. Any road improvements, any water sewer extensions, anything of that nature would be solely the responsibility of the developer. Sidewalks, all that? Yes, sir. So everything they proffered, they pay for? [00:49:17] Yes, sir. Okay. All right. I may have more questions. This is a public hearing. Is there anyone here to speak in opposition? Board members, my name is Gray Montrose, and I live here. [00:49:47] I live about three-quarters of a mile away. What you can't see on that map is the elementary school that is really just across the street. We have been told over and over again that Williamsburg Road, which desperately needs improvements, is narrow. [00:50:02] There are no shoulders. There is no way that it can accommodate more trucking and more traffic, that improvements are coming. And those are the improvements in the infrastructure costs that we're talking about. We're not necessarily talking about the cost to install sewer and water on this property or make a turn lane for these properties. [00:50:23] We're talking about the stormwater improvements that have to go on Charles City Road. There's standing water on Charles City Road every day, sunny days, standing water. There are no shoulders on Charles City Road. There are trucks bombing up and down Charles City Road every day. [00:50:39] No shoulders, narrow roads. We can't accommodate increased traffic and manufacturing. But that's not the most important thing. The most important thing here is that Montrose is a textbook environmental justice community. This board has received the EJ report for this community run by EJ Screen, which is the EPA tool to identify environmental justice communities. [00:51:05] Environmental justice is the policy of the Commonwealth per the 2020 Environmental Justice Act. And at some point, we have to recognize that permitting decisions that in this case would destroy the last green space in this entire community, a community that has six landfills, six landfills in the immediate proximity. [00:51:30] One of them is in the city of Richmond. Two of them are capped. Four are active, one of which is under a consent decree right now for repeated violations. Six landfills in one community, numerous junkyards. As you can see on that image, industrial, industrial, industrial, manufacturing, industrial. [00:51:49] And that's what environmental justice needs. In 2020, a case came down on the Fourth Circuit that the judge unequivocally said environmental justice is not a box to be ticked. And in that case, it was a decision as to whether there would be a third compressor station in a community that already had two. [00:52:09] What if we had said no to four of the landfills, five of the landfills in this community? What if we had said no to some of the industrial uses in this community? What if we had said, let's put a park in Montrose to serve the residents that live here and to make sure that the kids across the street have clean air to breathe? [00:52:30] that the stormwater that has to go somewhere can maybe go to green space instead of onto our roads, into our basements, and in our yards. This is our community, and at some point we're asking you, begging you, please stop putting the industrial burdens, the industrial uses, in one spot. [00:52:52] And that's our community. So we thank you for your consideration on this matter. Please, please preserve the last green space in the community of Montrose. Any other comments from persons in the audience? [00:53:10] Is there anyone else here, anybody else in the audience who is in opposition to this case but not speaking? Okay. Okay. [00:53:26] Do you want to go back? I'm just trying to get a sense of people who live in the community. If you want to go back and stand and speak, that's fine. Hello. [00:53:43] My name is Valerie Pegas Johnson. A lot of you, I'm sure, are familiar with me because I'm always sending emails about our community and the rubber stamp being placed on every application that comes through here to destroy our communities and knock down our trees and lands. I came here to speak on another matter, but I want to applaud the men and women, the people of our jurisdictions, outside our jurisdictions, to stand before this leadership to speak on these environmental matters and these applications and this overdevelopment of our community, overdevelopment of our community. [00:54:16] We are destroying trees. We are putting up telecommunication towers. We have smart meter devices putting it on our homes that are causing problems, health problems, health effects. I'm sorry, I'm a little nervous, but this is a passion of mine. [00:54:33] Back in 2021, I came to this board and expressed a concern about a smart meter device put on my home, the home in which I paid for. And I was told that there is anything, there was nothing that this board could do about it. We can't do anything about it. [00:54:49] The word can't to me means certainly am not trying to do anything about it. During the coldest months of the year back in 2021, Dominion Power turned off the power to my home in addition to a lot of homes throughout this state. [00:55:06] Four weeks, my family and I were without power and electricity and heat because I refused a smart meter device because I was concerned about my family and our personal well-being because I did not want to be monitored. I had to get an attorney. [00:55:22] I had to reach out to an organization to help me to get through those four weeks of me and my family. And Dominion finally, finally, after speaking to representatives, governments, politicians, gave me a call and said, we're going to put this analog meter on your home, an opt-out meter, which I originally requested. [00:55:46] Because I wasn't compliant and didn't follow the rules, I had my electricity disconnected. So we come here every day, and the times that we do come here, we turn our attention to our flag, and we pledge our allegiance to a country who does not pledge its allegiance to us. [00:56:05] And that is very difficult. There was a veteran who just came home from chemotherapy who did not want a smart meter, and Dominion told him, "You take this smart meter or we'll disconnect your power." And that man had no choice but to accept that. [00:56:20] So I think we really need to take a hard look at all these applications that come across the desk in the cell towers and really think about what it is doing to the people that are dying every day with all types of cancers. It's very hard to come here to speak on this matter. I'm very compassionate about it. We serve, we come here, we pray to God to help us through these matters, but we can't, we can't, excuse me, we can't serve two gods. You have a God or you have [00:56:57] a county that gives us one choice of any, and then you give us our God, one who I commit my life and my passion to, gives us a freedom of choice to follow him, to make a decision whether or not to be with him. But our leadership doesn't give us the same choice. [00:57:16] And I strongly ask that you consider all that I've said. I say it out of compassion because I'm a person who loves people. I love my country, and I love where I am. And in closing, we did recognize Volunteer Week where we selected a certain group of individuals. [00:57:34] Thank you to our officers who support and volunteer for our county. But we also need to recognize the people who volunteer for the CASA program, Meals on Wheels, the millions of people who volunteer for their homeowners association, who give their time for their communities and serve their communities, who take their net pay and pay assessments and insurance taxes, liability taxes, maintenance taxes. [00:58:01] We need to recognize all volunteers who give their time to make this a great county, jurisdiction, and a country. And I thank you for your time. Thank you. anyone else speak in opposition? Is there anyone on Webex? There's no one to speak to this item. [00:58:21] All right, Mr. Conlon, do you want to come and say a few words? Mr. Chairman, members of the board, my name is Andy Conlon here on behalf of the various applicants that are up before in these five cases. Reality is we're trying to provide for infill development with quality development standards that are expected by Henrico County and following a comprehensive plan to provide for office service and commercial and industrial uses within an industrial area. [00:58:51] And most of those properties are divided, as Mr. Seale has already pointed out, by large Dominion transmission lines and therefore having a development and being able to provide for jobs, job opportunities, and small businesses is a part of the goals of this county, and that's what we're trying to do. We're also providing for not only the quality standards but making road improvements, dedication along Williamsburg Road as well as Charles City Road as required by VDOT and the county. [00:59:15] So with that, we believe we've met all legislative prerequisites. We're going to be in compliance with all local, state, and federal laws, not only through this process but also through the site plan and POD process. And with that, I'll ask you to follow the staff and planning commission recommendations. I'll be happy to answer any questions. [00:59:32] Anyone, any of you guys have any questions for the applicant or for staff? Thank you. I did want to, before we start making the motions, I did have a couple notes that I wanted to make. [00:59:55] First thing I want to do is I want to thank those who spoke. I appreciate your voice to the case and your caring about our community. I definitely want to thank Ms. Montrose for her comments. [01:00:13] And in particular, I want to thank you for not mentioning what you mentioned in the email yesterday, which is what makes up Montrose. And I know the EJ report identifies Montrose as a low-income black community pretty much. [01:00:40] You know, that community is a diverse community, and, you know, it's made up of working families. It's homeowners. It's many of those seniors who live in that community, whatever you call Montrose. [01:00:57] I think in your email you identified it from the city of Richmond to the airport. You know, whatever we identified that urban part of Eastern America as is diverse. [01:01:15] And, you know, I don't know if I would identify it as low income, so thank you for not repeating that today. From the city to the airport, there are multiple landfills. There are junkyards. [01:01:32] There are distribution centers. There are factories. The report says that there's a high air toxic cancer risk and all of that may be true. Community is more than that though and right there in that area if you started Williamsburg and Laburnum I started there today. I too don't live too far from there. There's a pharmacy, there are restaurants, there are homes all around. There's some classic places that people travel to [01:02:08] for that area country style donuts bubble's restaurants bnb seafood um there are places that work on your car etc small businesses all up and down that particular corridor um there are big parts of eastern henrico that have manufacturing and um industry the like yeah i wish i was around when um landfills were going in on charles city um charles city road i wasn't the teal landfill [01:02:43] is closed because it was one of the first things that I fought when I got here. We fought it our way to the Supreme Court. Literally today we heard about a landfill that the county owns that was closed in 1980 that is about to be a solar park pretty much. That's a decision that we are making and Dominion people are here tonight as we enter into a lease agreement with them to provide solar um on an old landfill and so i i understand your frustration about the area some of the [01:03:21] frustration i share over the course of decades i wish we could have spread out industry in this particular area um it is not oversaturated in this one or two blocks on williamsburg or on charles city road i think the um state has a beautiful building with green space a library building um that will be a budding i think it's a um a horse stable on that back side some some some people you probably know um and so there is some green space around um it's not the [01:04:01] last green space a lot of homeowners in montrose who have front and backyards um so there's a lot of green space in the communities of montrose but i appreciate your comments um i am going to move that we follow the recommendation of the Planning Commission and approve REZ 2023 dash 00033 Lingerfeld Development LLC with the proffers dated November 22, 2023. Is there a second? [01:04:36] Second. All right, motion made by myself, second by Mr. Rogish. All in favor say aye. That passed. REZ 2023. I move that we follow the recommendation of the Planning Commission and approve REZ 2023 dash 00034 VOC 724 Park City LLC with the proffers dated November 22nd 2023 is that second motion made by myself second by Reverend Cooper all in favor say aye any opposed I move that we follow the recommendation of the Planning Commission and approve [01:05:14] REZ 2023 dash 00035 VOC 724 Park City LLC with the proffers dated November 22nd, 2023. Is there second? Second. Second by Mr. Rogish. All in favor say aye. Any opposed? I move that we follow the recommendation of the Planning Commission and approve RAZ 2023-00037 [01:05:41] VOZ 724 Park City LLC with the proffers dated November 22nd, 2023. Is there second? All in favor say aye. Any opposed? Lastly, I move that we follow the recommendation of the Planning Commission and approve REZ 2023-100-203 Lingerfeld Development with proffers dated December 15th. [01:06:10] All in favor? Oh, I'm sorry, I need a second. Second. All right, second by Mr. Rogus. All in favor say aye. Aye. Any opposed? Thank you. Mr. Manager. Next, Mr. Chairman, members of the board, we move into public hearing other items. First item, as Ms. Miner comes forward, is a resolution for the real estate tax levies for calendar year 2024 later on this agenda within the general agenda you will find the budget adoption paper first as required by state code the board must adopt tax levies for the office for the calendar year so without further ado miss minor thank you [01:06:48] mr manager and good evening mr chairman members of the board this is a public hearing on the real estate tax rates proposed by staff for calendar 2024. The general rate on real property is proposed to remain at 85 cents per hundred of dollars of assessed value. Additionally, the county has six service street light districts. The rates in these existing districts will say the same. [01:07:14] The county has one new service district at Virginia Center Commons, and it is proposed for a rate of $0.03 per $100 assessed value. The director of finance recommends approval of these rates and the county manager concurs. I'd be happy to answer any questions the board may have. [01:07:32] Questions from my colleagues. All right, seeing none, is there anyone here to speak to this particular resolution? Yes. [01:07:50] My name is Valerie Pegas Johnson. I am strongly opposed to this tax increase. Here is a copy of the county's budget. [01:08:08] Make it make sense to me. the highest salary for Henrico County for the 2023 calendar year was over $300,000 annually. Per Henrico County's annual report for fiscal year 2022 and 2023, government employees received 8.2 percent, not 7.2 percent, 8.2 percent raise. That's recorded in this document here. In 2023, taxpayers received $26.3 million in tax relief. This includes $11.2 million in surplus funds that were returned that fall in 2023 through a real estate tax credit of two cents per $100 of [01:08:48] assessed value. I guess my question is, are you all asking for us to give you the money back now because you're imposing higher taxes? In November of 2022, some voters approved the issuance of $511.4 million in general obligation bonds for school, recreation parks, fire stations, et cetera, allowing continued capital improvements. During the public comment period back in March of this year a board of supervisors meeting several residents from the tuckahoe district opposed the expansion of the tuckahoe creek park stating agenda line item 92 24 is not substantially in [01:09:25] accord in addition global park a project that has been in the works for almost a half a decade is expected to begin its second phase after henrico county board of supervisors on january 23 2024 voted at an expense at the expense of taxpayers a 30.3 million dollar fixed price contract the board resolution also appropriates an additional 18.1 million dollar to cover the difference between the initial project budget and the contract amount in may and june of 2023 about [01:10:01] 90 000 single-family homes across henrico received what we were told were free 96 gallon recycling carts. This done part of a $5.7 million initiative to promote recycling. The carts according to Henry Cole County's 2022-2023 annual report were funded with $4.3 million from Henry Cole County and $1.3 million from the Recycling Partnership to replace 24-gallon handheld bins. Homeowners who purchased a 96-gallon cart for $100 before the 2023 distribution of these free carts were [01:10:38] not reimbursed, but they did receive a free additional 96-gallon car. Many homeowners, including me, notify CVWMA and ask that the authority take back the 96-gallon car. No information as to the total number of recycling cars that will return to the authority by homeowners of CVWMA participating programs. This is a little bit off the subject, but I just want to talk about government wasteful spending. This is what is called the front [01:11:11] cover of what is known as the fastivist report for 2023. In this report, it shows $900 billion of wasteful federal money, taxpayers' money, okay? They gave a substantial amount of money to Fauci's wanting to do a report on transgender monkeys, okay? Yeah, I said transgender monkeys. [01:11:40] It's in this report. This is a true report, okay? But I'm talking, I'm referencing wasteful government spending. No, I'm just, I'm asking you a question. I'm sorry. What is that you're holding? That's our... It's a festival, F-E-S-T-I-V-U-S-22 report. Oh, that's a federal report, okay. [01:11:57] Yes, list of $900 billion in wasteful spending. So now we're here today asking our board of supervisors who just gave us a credit not to increase taxes. [01:12:14] There is an overbuild of communities in this jurisdiction, generating thousands, hundreds, billions of dollars of revenue for this county. So I strongly oppose an increase to the taxes for the 2024 calendar year. [01:12:32] The money that I got back, the little $60 checks that I got back, I endorsed it back over to the county because I found it insulting that you would give me that check. So I gave that check back to the county and asked them to apply it to my taxes. [01:12:52] So I'm stating here that I, again, oppose any increase to our real estate taxes as well as our personal property taxes. There are some states in this country that do not impose property taxes for our vehicles that we have to pay for. [01:13:08] Maintenance, upkeep, $40 for a little sticker. The overspending is just too much. We're just trying to get by. You have teachers that make under $50,000 a year, but yet we have people in our leadership position that we vote to put you in this position making over $300,000 a year. [01:13:31] How can you feel good about that? How can you justify what I just reported? Thank you. Is there anyone else here to speak to this particular resolution on real estate tax levies? [01:13:50] Ms. Miner, can you, and I apologize, when you were speaking I was making a note I may have missed. What taxes are we increasing again? I'm sorry. Mr. Chairman, the question I'm raising, the proposed real estate tax livy of 0.85% of 100 assessed value evaluation represents no change from last year. [01:14:13] Am I correct? That's correct. There's no change in the rate. It was $0.85 for calendar 2023 as well. It was $0.87 two years prior. The board reduced it in 2022. So basically there's no increase in taxes. There's no increase in the tax rate. [01:14:30] So that's what I was asking. I was just making sure I didn't know that we increased any taxes now on this proposed Agenda item there are no increases. The only change in rates is that that VCC service district Which is just in the Virginia Center Commons area is a new service district and they have It proposes a three cent real estate tax in addition on that area only and then the owners in that property in that area were notified of that increase and given an opportunity to comment. [01:15:01] And that increase goes from $0.27 to $0.30, correct? That increase goes from the $0.85, they would be assessed to $0.88. And that's to pay for the streetlights that are going on that ring road in Virginia Center Commons. All right. Any other questions, colleagues? [01:15:20] And, again, for the record, it's hard for me sometimes when I hear stuff that's not accurate. No elected official in Henrico County makes $300,000. So I'm OK. Just for the for the record, the only elected officials we have in Henrico County are board of supervisor members, school board members, Commonwealth attorney, sheriff, clerk. [01:15:46] Nobody makes anywhere close to three hundred thousand dollars. Not elected officials. Are you to speak to this particular resolution, ma'am? OK. All right. Colleagues have no questions. I already asked was anybody here. Anybody on WebEx? [01:16:02] there's no one to speak to this item all right is there a second all right motion made by reverend cooper second by mr rogers all in favor say aye any opposed thank you mr manager second mr chairman 124-24 is a resolution for personal property and machinery and tool tax levies for 2024 miss minor thank you again mr manager this is a public hearing on the personal property and machinery and tools rates for calendar 2024, the general rate of $3.50, and the rates of the various classes of personal property would remain unchanged from calendar 2023 as proposed. [01:16:41] There are 16 classifications of personal property on this item. Just to point out a few, the most, the largest of which is the vehicle personal property class. You'll recall that the board reduce that rate for 2023 to three dollars and forty cents pending some legislation that was provided by the general assembly and a change in code additionally biotechnology research and development rates are 90 cents other research and development rates are 30 cents and aircraft are 50 cents again there are multiple classes on this item the director of finance recommends approval of this board paper and the county manager concurs i'd be happy to answer any questions [01:17:24] As a public hearing, is there anyone here to speak to this particular resolution? All right, is there anyone on WebEx? There's no one to speak to this item. All right, is there a motion? So moved. Second. [01:17:40] All right, motion made by Ms. Whitehead, second by Mr. Rogers. All in favor, say aye. Aye. Any opposed? Thank you. Mr. Mantle. Next, Mr. Chairman, 125-24. As Mr. Chan comes forward as an ordinance, these are the utility rate charges for next calendar year, both water and sewer. [01:17:59] Mr. Chan. Thank you, Mr. Manager, Mr. Chairman, members of the board, good evening. This is an introduction for the, or this opens the public hearing for the proposed ordinance to change utility fees and charges to be effective July 1st, 2024. [01:18:16] The ordinance would increase bimonthly service and volume charges for water and sewer. The total increase in water and sewer charges for the median residential account holder using 10 ccf or 7,480 gallons of water every two months will be $6.95 or approximately 11 cents per day. The changes would be effective July 1st, 2024 and are recommended to support annual operating, debt service, and capital costs associated with water and sewer projects. [01:18:49] I will note again that we sell water at six-tenths of a cent per gallon delivered to your home. And for us to produce that same gallon and treat it, it does cost us two-tenths of a cent. [01:19:12] but the rest of those costs are spread over the distribution and collection of water and wastewater so with that i'll be happy to answer any questions that you may have questions colleagues all right this is a public hearing is anyone here to speak to this ordinance anyone on webex there's no one to speak to this item motion so moved second motion made by reverend cooper second by mr rogers all in favor say aye aye aye any opposed all right let's imagine next [01:19:49] mr chairman 126-24 this was a resolution this is a resolution for signatory authority lease of county property to dominion uh energy in the verona district this was the lease that was discussed regarding the landfill solar and mr yob thank you mr manager good evening mr chairman members of the board ladies and gentlemen i'd like to acknowledge we do have representatives from dominion energy here with us in case there are questions about their solar facility This lease is similar to another landfill we had closed a while back in the Three Chop District where we again have solar going on that landfill. [01:20:28] But getting to the point, this property, also known as the Closed Nine Mile Road Landfill in the Varina Magisterial District, encompasses approximately 57 acres. The board paper itself would authorize the county manager to execute a lease with Virginia Electric and Power Company, which is doing business as Dominion Energy Virginia, for these two parcels of land. [01:20:54] Again, they're located in Verina off Milburn Avenue, and Dominion would install, own, maintain solar panels and associated equipment on the properties as well as take over the maintenance of the area where the solar farm would be located. The lease would be for 35 years, and for that lease, Dominion will pay the county $30,000 per year in rent, and they will have an annual escalator on that rent. [01:21:21] With that, I'll be happy to answer any questions you may have. Any questions for Mr. Yop? We do want to shout out the Dominion reps who have been here with us for the past three and a half hours. Thank you all for being here and the presentation that you made to our board earlier. [01:21:41] We're excited about this partnership. Since a public hearing, is there anyone here to speak to this particular resolution? All right. Is there anyone on WebEx? There's no one to speak to this item. All right, colleagues. Is there a motion? So moved. [01:21:58] Second. All right, motion made by Mr. Rogus, seconded by Ms. Whitehead. All in favor say aye. Aye. Any opposed? Thank you. Mr. Manchin. Next, Mr. Chairman, we move into public comments. I don't have anyone that has signed up this evening. Is there anyone here this evening that wishes to address the Board of Supervisors? [01:22:16] Is there anyone on Webex that wishes to address the Board of Supervisors? There's no one to speak on Webex. All right. Seeing no speakers, Mr. Chairman, we would move into the general agenda. 96-24 is a resolution. This is the approval of the annual operating and capital budget for fiscal year 24-25. [01:22:37] A lot of work, a lot of effort by the staff, and then the Board of Supervisors went into this. Mr. Chairman, there were several changes that were made by the Board of Supervisors during the legislative budget hearings, and I have for you a consideration of a substitute paper that would approve the annual budget, which I have labeled 96A-24. [01:23:05] The substitute resolution adds $89,500 within the health and welfare portion of the general fund to hire and additional health workers discussed. During the public hearing number of adjustments within the non-departmental realm were made The substitute also contains the other items requested by the board. I just referenced non-departmental But also including a four million five hundred and thirty seven thousand dollar reserve for the Henrico County public schools to expand [01:23:41] Elementary school planning time. All right. Thank you. Mr. Chair. Mr. Manager. Ms. Crawford, Mr. Hayes, Mr. Hinton, thank you for all your work. Thank you to all the agency heads and to the Board of Supervisors for the time and effort put under this budget. [01:24:47] Which brings us to Agenda Item 127-24. This is a resolution for a substantial accord determination for the Spring Park Trailhead for the Fall Line Trail. Mr. Emerson. Thank you, Mr. Manager, Mr. Chairman, members of the board. [01:25:07] I can get the computer to cooperate here. There we go. The Department of Public Works requested the Planning Department to conduct a substantially an accord study to determine whether a proposed site for a trailhead for the Fall Line Trail located at the corner of Lakeside Avenue and Park Street is substantially in accord with the 2026 Comprehensive Plan. [01:25:35] Fall Line Trail is a proposed 43-mile north-south shared-use regional trail that will span seven localities from Ashland to Petersburg. At this location, the trailhead will be the point of entry in Henrico County from the City of Richmond. [01:25:52] The proposed site for the Spring Park Trailhead includes the location of the former Bank of America building, which the county will be leasing to sports backers for their headquarters. Opposed site is approximately 1.6 acres and is Zone B2 Business District, R6C General Residence District, and R41 Family Residence District. [01:26:16] The existing zoning is reflected in the 2026 Comprehensive Plan recommendations of Suburban Residential 2, Environmental Protection Area, and Commercial Arterial. A park facility, such as a trailhead, is permitted in the identified zoning districts and will help increase access to both the trail and businesses along the trail. [01:26:38] The subject property is planned to be part of the lakeside phase of the trail. Preliminary designs indicate the site would include a two-stall restroom facility, paved parking lot, wayfinding, picnic tables, and benches. After March 14th meeting, the Planning Commission concurred with staff's recommendation and found the proposed site substantially in accord with the 2026 comprehensive plan. [01:27:02] If you have any questions, I'll be happy to try and answer them. Thank you, Mr. Emerson. Any questions for Mr. Emerson? All right. Is there a motion? Mr. Chairman, I move that we follow the recommendation. The Planning Commission approve the resolution for SIA-2024-100163, Spring Park Trailhead, the Fall Line Trail, Finding the proposed trailhead to be substantially in accord with the county's comprehensive plan second All right motion made by Reverend Cooper second by mr. Mr. Manager. Mr. Chairman members of the board This is an award of a fixed price contract for $1,783,738 to JL Kent & Sons Incorporated for the Francis Road and Greenwood Road Sewer and Water Extension Project. [01:28:12] The project consists of providing approximately 1,860 linear feet of 8-inch sanitary sewer main and approximately 110 linear feet of 4-inch water main along Francis Road and Greenwood Road. Work on the project is anticipated to begin in June of this year and be completed within 240 calendar days. [01:28:36] This is an American Rescue Plan ARPA project, and we will be providing 23 properties with county sewer and 11 properties with county water. So something to note about this award, the lowest bid, as you'll see, was from Shield Contracting, LLC. [01:28:59] It was deemed non-responsive due to Shield Contracting not signing their bid bond, making that invalid. Therefore, the second lowest bidder, J.L. Kent & Sons, is the lowest responsive and responsible bidder. [01:29:17] With that, I'll be happy to answer any questions that you may have. Thank you, mr. Bentley as they are there any questions? Next, Mr. Chairman, is signatory authority award of contract. This is an annual contract for stormwater management facility maintenance. [01:32:36] Mr. Hughes. Thank you, Mr. Manager, Chair, members of the board. Good evening. This board paper awards a contract to Blakemore Construction Corporation for stormwater management facility maintenance. The contract consists of furnishing all tools, labor, materials, equipment, fees, and supervision necessary to provide maintenance and repair of both publicly and privately owned stormwater management facilities located within Henrico County when needed and requested by the county. [01:33:01] The county received four bids, and based upon a review, Blakemore Construction was the lowest responsive and responsible bidder. The contract will be for a period of one year with the option for the county to renew the contract for two additional one-year terms. Funding to support the contract is available within the Department of Public Works budget. [01:33:21] The Director of Public Works and the Purchasing Director recommend approval of the board paper, and the county manager concurs. I'd be happy to answer any questions on this one. Questions. All right, is that a motion? So moved. All right, I'm going to give this one to Mr. Rogus. [01:33:37] You want to second it, Ms. Whitehead? Second. Second by Ms. Whitehead. All in favor, say aye. Aye. And then opposed. All right, last one. Last, Mr. Chairman, 132-24, acceptance of roads in the Verona District. Mr. Hughes. What road is it? [01:33:54] It's Castleton. So it's in the Castleton division. And we're accepting it. Why? It's a new part of Castleton? Yeah, they're done building the houses, and the roads are good to go. All right, so I move to resolution. Second. Oh, you had a quick? [01:34:10] Come on. Cora Cooper. Go ahead. You got a quick reference. Second. All right, thank you, sir. Motion made by myself. Second by Reverend Cooper. Second. All in favor, say aye. Aye. Any opposed? Mr. Manager, we were moving so quickly earlier. [01:34:29] You gave us a handout before we close out that focused on historical salary increases. There was some information that had gone out in an article recently. And just for the sake of public record, can you let us know some of these statistical increases so we can speak them into public record? [01:34:52] Yes, sir. mr chairman members of board there was an article in a local newspaper that referenced some classes of employees perhaps not getting pay increases and so we have run some numbers going back to january of 2021 so if you were an employee in the county january of 2021 and are still with the county your salary will have gone up by 40 percent between then and july 1st public safety actually increasing by nearly 45%. We have full-time instructional assistants that have seen [01:35:31] a 41%. If you're actually in the exceptional education area and are an instructional assistant, your pay would have gone up by 42%. We have custodial services, 33%. Teachers have gone up nearly 32% and full-time bus drivers by nearly 53% if you were here January of 2021 that is the difference between that and then and July 1 does that answer your question mr. chairman it does [01:36:05] and we 17 million for critical shortage adjustments and so that critical shortage adjustment really focuses on those jobs that are critically short clearly so part of the focus in this budget was we were experiencing vacancies in public safety and education we had over 300 teacher vacancies in the school system bus drivers were down a third as the board was going into the budget [01:36:38] discussion the sheriff has over 100 vacancies police has nearly 70 and so the decision was made to offer a bifurcated pay increase where 4.8 percent would go to all employees and then an additional step would go as an inducement for other employees uh in for the employees in the areas that i mentioned so the outcome of all of those efforts i heard someone say that a henrico county teacher is paid less than fifty thousand dollars there is no henrico county teacher that is paid less than fifty thousand dollars starting if you have zero experience you're going to come in [01:37:16] at nearly fifty six thousand dollars if you have a year of experience you'll be at fifty eight if you look at our police fire starting salaries that was those will eclipse sixty one thousand dollars or 9-1-1 operators who we recognized earlier at the beginning of the meeting or actually as a group police fire 9-1-1 in every rank right now exceed every locality in the region in the in the sheriff's office we do have [01:37:51] some differentials because some Hanover County actually those are actually have police duties also so um in most ranks we exceed and then in the uh in the k-12 area we clearly exceed uh all of the counties at the earlier steps and then after step 15-16 um we bounce back and forth between other other counties the city of richmond always is kind of a wild card because they wait till late to make adjustments so uh does that answer your question sir that's helpful [01:38:29] colleagues any questions or comments before we adjourn the meeting all right meeting adjourned ---------------------------------------------------------------------- Coraggio Consulting ยท aguyonx.com
