[00:09:37] I know it just makes it even worse. Good evening, everyone. We're calling to order our Board of Supervisors meeting, June 25th. We are thankful that you are with us. [00:09:53] For those of you who are going to give public comments tonight, we're going to ask that you use the speakers, I'm sorry, that you use the lectern in the back of the room. For those of you who are watching online, you can remotely comment and go to henrico.us forward slash supervisors, click on the guidance for the Board of Supervisors meeting, scroll down and click on WebEx event. [00:10:25] I'm going to ask that you stand, and we're going to be led. After the Pledge of Allegiance, we'll be led in prayer by Stephen Boots, who is chaplain for Henrico County Police Division. Pledge allegiance to the flag of the United States of America, to the republic for which it stands, one nation. [00:10:48] You've given to us. I thank you for all of those that are here tonight to be recognized and for their accomplishments. [00:11:05] And then for also for all of those that are going to be put into new positions. I pray that you just help them as they do their jobs and as they volunteer in a lot of those positions as well. Thank you for the board and their willingness to serve our county manager. I pray that you give them wisdom with the decisions that they make as well. [00:11:20] I pray that you would just protect those that are in the military and those that are first responders here in this county. I pray that you keep them safe. I pray that you'd bless the meeting this evening. In Jesus' name, amen. Mr. Mandel. [00:11:51] Mr. Chair, we have a request for approval of minutes from both regular and special meetings of June 11, 2024. All right, motion made by Ms. Whitehead, seconded by Reverend Cooper. All in favor, say aye. Aye. Any opposed? Thank you. Mr. Mandel. Mr. Chairman, I have two comments this evening. [00:12:08] For the first time, I'm going to ask our sheriff, Alisa Gregory, to come forward to the podium. Now, I know the board knows this, but members of the audience may not. Our sheriff, this is not a 9-to-5 job. [00:12:26] She is here nights, weekends, whatever it takes. So it is with great pride that I recognize our sheriff, Alisa Gregory, and her incredible staff on reaccreditation. Both Jail East and West were audited by the American Correctional Association. [00:12:44] This was last week. Each facility is required to comply with 62 mandatory standards and 322 non-mandatory standards. These standards were developed to evaluate performance, promote uniformity, and best practice guidelines for all local, state, and federal jails, prisons, and parole agencies throughout the country. [00:13:11] All staff and even inmate workers came together and worked very hard to maintain the level of excellence required by this organization. The audit team consisted of three auditors from various parts of the country. They conducted a vigorous examination of file documents, inspection of both facilities, and interviews with both staff members and inmates. [00:13:37] The auditors were impressed by our continued effort to provide high-quality conditions and services. Now this is where, this is the score. So both jails passed with flying colors, Jail West with a score of 100% on all of those standards and Jail East with a score of 98.3%. [00:13:59] Sheriff Gregory, congratulations to you and the staff, not just for the accreditation, but for everything that you do, not just for all of the employees, but the inmates and just how you do it. It's been absolutely remarkable watching you. [00:14:15] So thank you, Sheriff. Thank you. Sure. Yeah. Thank you is not enough for the staff that we have. [00:14:39] And to include the inmates that are inside the facility. It is totally a team effort. We all spend just as much time together in both facilities as we do with our own family. And so that spirit of family coming together to do what we do and take care of each other just rained throughout both facilities. [00:15:04] So it was amazing to watch, and even as short-staffed as we currently are, to watch everybody work together to do what we need to do to make sure that we have a decent, clean, humane facility and that we are working to help connect folks to resources to ensure that we return them to the community in the best shape possible. [00:15:32] And so it is no way that we could do what we do without the support of all of you and to include just about every other county agency. You would be surprised. General Services, all of the other agencies that tap in to help us maintain and do what we do day to day so a big thank you to everybody and we plan to keep on going and bigger and better things are to come so thank you thank you chairman members of board [00:16:10] my second comment involves my henrico academy which is a free program that celebrates the county's cultural diversity and promotes engagement with immigrants and descendants So it began the 2024 session in April. We've had previous presentations, but we have individuals that have attended the academy that would like to come forward and continue to express their gratitude. [00:16:37] 18 participants who represent 13 countries, 9 ethnicities, and 19 languages met weekly in six sessions to interact with county officials, board members, and tour facilities to learn how the county serves with the community. With the class of 2024, graduates now equal 100 individuals. [00:16:59] So I'm going to ask Jyotsenu Mucherla to come forward. And I know how close did I come to pronouncing your name? Because my last name is not the easiest either. [00:17:15] Unfortunately, yes. It's Jyotsenu Mucherla. Okay. Yes, sir. Perfect. Good evening, Mr. Chair, members of the board, Mr. Manager, and attendees. Thank you for giving me the opportunity to bring remarks on behalf of the class of 2024. [00:17:33] My name is Jyotsna Macharla. Most people call me Betty. I am an Asian Indian, born and raised in India, and I speak three languages. Telugu, my regional language, Hindi, India's national language, and English, which I learned as a second language in school. [00:17:52] My husband, Arun Macharla, and I are both software engineers, and we both have two beautiful girls together who are 13 and 6 years old named Faith and Hope. We live in the Sadler Road community in the West End part of the county. [00:18:12] I am very involved in my children's school PTA, and being the chairperson for National PTA Arts Reflections Art Contest, I'm fortunate to be able to encourage students to showcase their innate talents through various forms of art. [00:18:31] I'm also very active in our church and in various other South Asian regional community events and programs that bring families together, thus creating a sense of unity and diversity. Sixteen years ago, I moved to America from India for my work. [00:18:50] Little did I know that our family would eventually settle in Henrico County for life. I have been living in Henrico County for the last seven years, but it felt like life was just happening until I had a turning point. [00:19:07] And that was the accidental find of the My Henrico Academy program on the Henrico Citizen website. This providential stumble opened me to a whole new world and perspective of the county I live in. [00:19:23] My Henrico Academy Program for Immigrants is the best or perfect program for us to learn more about the Henrico County. Each one of the six well-structured sessions were insightful, enabling us to learn more about the various functions of the county, like various departments, like public safety, judicial systems, and public works, and much more. [00:19:52] We had the privilege of meeting with our county manager and board of supervisors, the department of leaders, who not only gave us their time, but very evidently also gave us their hearts and efforts to help us and other citizens to quickly take action on some of the concerns that were raised during these sessions. [00:20:18] For example, our deputy county manager for community affairs, Ms. Monica Smith-Callaghan, immediately acted, when I mentioned a blind older adult residing in our county for more than 45 years, was trying to find a job without having to relocate. [00:20:38] And on the other hand, Mr. Terrell Hughes and his team acted very swiftly when a request for additional traffic lights was raised for Opaka Lane and Knuckles Road signal, and they've actually completed the project. [00:20:56] when I informed them about the danger it posed in some scenarios that I, myself, and the others encountered. I appreciate and applaud the quick action taken. Because of this program, I, who was going about my life without much knowledge and thought to my surroundings, am now able to put a face to the work being done, and I appreciate my surroundings that you help make easily accessible and beautiful. [00:21:27] Special thanks to Ms. Raina Van for thoughtfully coordinating this informative program. I wish and hope this program is adopted by every other county in the nation as a best practice, and I'm certain my fellow program members will fully agree with me. [00:21:46] I want to thank the Board of Supervisors and County Manager for providing my Henrico Academy to welcome individuals from diverse backgrounds to learn about the county operations, services, and programs, and build lasting relationships that support all communities. [00:22:04] In conclusion, respected Mr. Chair, Mr. Manager, Board of Supervisors, and county officials, we, the class of, we graduates from the class of 2024, have learned a great deal from you and the county staff. [00:22:23] We are with you in all your efforts, and we have no doubt that under your ABLE leadership, our Henrico County will be the number one county in America. Thank you. Betty, I think you all wanted to come forward and take a picture with the board. [00:22:47] This would be a perfect time to do it, Ben. [00:22:50] Chairman, I have no other comments this evening. [00:24:45] Thank you, Mr. Chair. I mean, Mr. Manager, colleagues, I know Reverend Cooper has a comment. Anyone else have comments? [00:25:05] Chairman, I'm going to ask Senator Lamont Bagby to come join me at the podium, please. With the board's indulgence, I would like to recognize the Henrico County Connect program, [00:25:45] which is doing great work to develop and nurture our young people. In short, Connect helps our young people and our youth avoid problem behaviors that can rob them of their future success. Connect offers support services including after-school care, mentorship groups, community engagement, support systems, and educational resources. [00:26:07] Tomorrow, we have the privilege of celebrating our youth and the Connect program with a community day at St. Luke Apartments. Connect success is a testament to many individuals throughout the county. However, I'd like to recognize the contribution of one individual in particular, Senator Lamont Bagby of Virginia's 14th District. [00:26:28] Senator Bagby, who is standing beside me, has secured $1.2 million. Can we clap for that? He has secured $1.2 million from the General Assembly to fund and expand the Connect program over the next two years. [00:26:48] Senator Bagby will help us because these funds will allow the program and the youth it serves to realize their full potential. Connect is helping our youth navigate challenges including mental health, substance abuse, domestic violence. They're learning to be advocates for themselves and to have a positive impact on the community. [00:27:06] In short, Connect and elected leaders like Senator Bagby are helping to make Henrico a better place to live, work, play, and also to grow up. Senator Bagby, it's clear that you understand the needs of our youth and the importance of investing in their future. You have shown Henrico and the board what leadership looks like, leadership that listens, understands, and acts on issues that are the heart of our community. [00:27:29] Because of you, Connect program, the Connect program, is positioned to change families and lives in really great ways. In recognition of that achievement and the dedication you have shown to Enrico in securing these funds and resources and on behalf of the Board of Supervisors, our educators, the program staff, and most importantly, the children and families who will benefit from the Connect program, I thank you. [00:27:55] The board and I hope we can continue working together to make this program even more impactful so that all of our youth have an opportunity to succeed. Thank you, Senator Bagby. When I came in, this is the first Board of Supervisors meeting I've been to in quite some time. [00:28:20] But immediately, I hope you all let me take a point of personal privilege. When I saw you two out there, it was pretty cool. Because I remember in 2007 when I ran for school board the first time, I won, y'all lost. But it's a thing I want these young people here to see, and that is perseverance. [00:28:41] And so 16 years later, Sweet 16, you all are standing here where you should be and where Henrico County needs you. So thank you for the work that you're doing. And I say Sweet 16, but I also want to say happy 50th to Supervisor Cooper, who is celebrating that monumental birthday. [00:29:06] I know you didn't want me to tell people how old you are, but if you all would give him some love right now. But the work that we did with the money and securing the money was an idea that was developed over last summer. [00:29:24] And we had some initial conversations last summer. I talked to some of your folk, and then I approached you at, I can't remember who retirement it was, but at a retirement party, and you was like, oh, yeah, that falls right in line with Connect. But I had already been talking to Jackie Smith and Laura Toddy and Adrian Cole Johnson over in Henrico. [00:29:49] And so it all worked and fell in place. And so I want to thank Monica Smith Callahan for leading the way and making sure we all came together on this awesome opportunity for the community. I thought a lot about it when we were experiencing a little trouble in that community and the police chief and others came out and walked the community, knocked on doors. [00:30:18] But I grew up in that community. And it's extremely important to me that we wrap our arms around them, not just wrap around services, but go in that community and find out what they stand in need of and then meet that need. [00:30:36] And so when we talk about perseverance, Mike can tell you we put that budget amendment in and it didn't pass. It wasn't in the first budget. But I said, Mike, calm now. I'm going to go talk to Louise Lucas and Luke Torian. [00:30:54] And the fact that we couldn't get a budget done the first time that the governor consigned was a blessing because when we came back, we got more money than what we expected. And so I also want to thank Mike for helping us secure the money. [00:31:11] So Mike, Laura, Jackie, Monica, Adrian, Ms. Stephen, all those individuals helped put this together. [00:31:29] And that's true commitment from your team as well as the school system. And I think it's going to prove to be a model. And when I told you about the project, I think you were the one that said it's just not a regular Connect program. [00:31:46] This is going to be Connect Plus. And it's going to be a model that we can use in other communities once we've proved that it can work. So thank you all. Thank you, Reverend Cooper. [00:32:07] Anyone else? Any other comments? All right. So I do have a couple. I do want to respond to the senator. I had some really kind words until he threw that little shout in at us. [00:32:25] No, we are excited. We'll be at St. Luke tomorrow, you know, in Fairfield. And I think it's 1230 or 1245 start. What time? 130, community day, et cetera. [00:32:43] And so all the people that are connected to that, we are excited. Senator Bagby was a school board rep for, I think, seven years before he was elected to the House of Delegates and then in the Senate, so out of the St. Luke community. [00:33:03] And it just shows you, you know, if you ride through St. Luke right now, the community and the owners thought enough to name the community center after him, and he's still relatively young. So it just shows how significant. Yeah, it just shows. [00:33:21] Still going? Still, he won't stop. He like to energize a bunny. He just won't cut it out. And so, again, thanks for being here with us today, sir. A couple things. First, let me see where I want to start. I'm going to ask the fire chief to come up. [00:33:38] We did acknowledge this in a work session on yesterday. Some of you may have seen in the news, if you live in the East End, in the Verona District in particular, we had a pretty major fire yesterday, covered 75 acres of land, and our fire chief and his team were all on top of it. [00:34:00] So if you don't mind, chief, just kind of brief us again. Yes, sir. Mr. Chairman, members of the board, Mr. Manager, I appreciate this opportunity to share the great work that our firefighters and other public safety partners did yesterday. I also appreciate the chairman, the time you spent out there with our folks. [00:34:21] It meant a lot to them as they were tired, worn out, and hot after this. But around 5.16 yesterday afternoon, we got a 911 call for a brush fire that was moving fast, threatening structures. Our first units arrived on scene at 5.18 within two minutes of dispatch. [00:34:38] It encountered significant flames and smoke conditions when they arrived, with four to five houses being threatened at that time. Due to their quick actions, forward thinking, an aggressive call for resources and actions and tactics, they were able to protect those homes. [00:34:55] We did have a shed that was damaged and lost and part of a garage that received damage. But seconds made a difference for this response as one of the engine companies, if they were delayed by more than probably 30 or 45 seconds, that garage would have spread because of the vinyl siding into the house structure and would have been a lot more damage. [00:35:18] The heat conditions out there, the dryness, always present environmental challenges for our firefighters, but they overcome it. We appreciate the Air One, the police plane was up in there providing eyes in the sky for them. In addition, our drone team responded out also to help make sure the fire line was controlled as well as any hot spots were contained. [00:35:40] Our crews, after they got there at 518, the last crew finally cleared at 10 p.m. last night to make it back to their quarters. In total, sir, we had nine engine companies respond to this incident as far as Lakeside. So pretty much the initial response included companies all east of Lakeside Firehouse. [00:35:59] So a lot of other companies were moved around throughout the county to make sure there was still coverage throughout the entire county. We had seven brush trucks or tankers respond. We had two EMS transport units, two rescue companies, five command officers, drone response team, the fire marshal's office, six police officers, Air One, Department of Forestry, Dominion Power, and I'd be remiss if I didn't mention two exceptional farmers in that community that got to work with their equipment helping with FireLine. [00:36:27] In addition, the Metro Richmond Flying Squad made sure that our personnel were rehabbed and provided with water, Gatorade, and cooling stations so they could continue the work for those numerous hours. Also, emergency management was providing information to VDEM and getting us resources if we made requests. [00:36:43] At the peak response, sir, we had 72 personnel on scene for this, and they did an exceptional job. Really appreciate your recognition earlier at the work session for our firefighters for this event. I'd be happy to answer any questions, sir. Questions? Again, phenomenal job. Thank you. [00:37:03] Just another reminder of, I know sometimes it's the small stuff, but, you know, when these catastrophic events happen, you know, it just shows why we are glad that we live in Henrico County. So, thank you, Chief. Thank you, sir. [00:37:22] Today, I want to, I would like to highlight Verona's own, very own Ronnie's Barbecue. Ronnie was in, Ronnie's was invited to Six in the City, which took place in Chicago on June 18th. [00:37:40] Six in the City is a barbecue-inspired three-hour networking reception that allows six southern cities of similar sizes and amenities to build relationships with meeting planners through food. Ronnie's Barbecue was able to participate in Chicago thanks to Richmond region tourism. [00:37:59] The other cities that attended Six in the City included Chicago were Birmingham, Columbia, South Carolina, Louisville, Memphis, and Raleigh. There were about 150 meeting planners, and they each got to vote on the city that had the best food and the best booth presentation. [00:38:23] Richmond Reason Tourism had previously won for best booth presentation twice, but never for food. so partnering with ronnie's was the best decision as our destination took first place for best food for the first time ever has anybody here from ronnie's all right well y'all make sure y'all tell ronnie's that we shout them out the the winning piece consisted of brown sugar sriracha deviled eggs virginia virginia smoked brisket mac and cheese and honey butter cornbread [00:39:02] logan's limeade for a mocktail with a sweet tea lemonade pound cake for dessert it was also uncle ronnie's birthday on tuesday and he was able to celebrate his victory with his ronnie's barbecue family and his richmond reason tourism family congratulations again to ronnie's barbecue thank you for bringing home first place and then finally i'm going to request that um we share [00:39:38] uh a video um from juneteenth can't go do this to clear up what's going on juneteenth crowd come on y'all give yourselves a round of applause y'all looking good looking good this is our fourth year hosting juneteenth here in dory park we've got food trucks we've got vendors for the first time [00:40:16] we have two stages going on let's get the party started in a few minutes We started in 2021. Here we are in 2024. I mean, we may end up with 15,000 people here, which I think is an astronomical amount of people. We want to educate, you know, and so talk about the importance of what Juneteenth is, particularly to the African-American community, but it is a countywide event, so we got hundreds of vendors here. We got food trucks. It's an [00:40:51] awesome crowd here tonight with a lot today with a lot of energy. This is incredible and even though I'm a newly elected official these are the types of events that before getting into office I love so much about Henrico and so I'd come out to events like this all of the time. I love the feeling of community. I love the vendors. I love the food trucks. I love everything about it but what I really love is it gives the opportunity for us to talk with our children about things that they might not be learning about in school or elsewhere. This is my first Juneteenth. I'm excited to be out here today all the way from tuckahoe out in verona but you know what what makes me super [00:41:29] excited is the amount of people that are out here and this is what community is all about bringing our community together and i just love being out here and seeing what henryka parks what the county [00:41:37] is doing and this is it's a fantastic event all right so uh we did um so the first time we did [00:42:20] this was 21 and we had I don't know maybe we had 5,000 people I can't remember um but the crowd so I said 15,000 we actually had 17,335 people attend that Juneteenth event um it's an amazing amount of people um we had two stages set up main stage the headliner was all the noise RVA featuring Lonnie B, community stage headliner, was 10-year-old DJ Amari, who you saw. [00:42:54] We had 145 vendors, 22 food trucks, representation from seven county departments, health department, food, DPW, library schools, soil and water conservation, and planning. [00:43:10] And we're looking to add more new elements next year to highlight the 160th anniversary of Juneteenth in our fifth year of Henrico County's celebration. It was amazing. First, I want to say thank you to my colleagues, and I think Mr. Smith was out of town. [00:43:30] That's why he wasn't there. But this is the first time. I have four out of five members from the board of supervisors. Supervisors that be there, several school board members, you know, and I just had to write this one down all the way from Tuckahoe. [00:43:48] jody roguish uh 45 minute drive 45 minute drive sir so we we had we had a ball though he got reimbursed for the mileage i mean and uh and so that was a that was a made that was major work and um now i know um john zanino and the wrecking parks team are amping up for uh 4th of july and We'll be at Crump Park and you know, let's see. Maybe there'll be 17,000 on the Crump Park. It'll be hard, but [00:44:27] But but we'll be out there supporting and being with being with our county residents there as well So those are my comments. Mr. Mancha. Yes Recognition of the news media. Do we have anybody in attendance? We did we did have two persons Here, during our work session today, though, Tom Lapis and RICO Citizen and Sean Jones from the Richmond Times Dispatch. [00:44:59] So, if you guys are watching, do want to acknowledge your presence from being with us earlier. Turn it over to you, Mr. Manager. Mr. Chairman, members of the board, we move into presentations. We have our annual Keep in RICO Beautiful Committee Land Lover and Clean Business Award Program. [00:45:15] This program recognizes one residential property owner from each of the county's five magisterial districts and one county-wide clean business who receive an award for their beautification and sustainability efforts. In this case, I'm going to ask Megan Brown, Executive Coordinator for Keepin' RICO, and Colin Waltall, Tuckahoe District Representative and Chair of the Keepin' RICO Beautiful Committee, to present these awards. [00:45:40] And why don't we get all of the Keepin' RICO Beautiful folks. Are you all coming forward? Colin, I'll let you drive this train. How about that? Thank you, Mr. Manager. Good evening, Mr. Chairman, members of the board, members of the community. My name is Collin Walthall, all the way from the Tuckahoe, and I am the chairman of Keep and Rec a Beautiful program of the Department of Public Utilities. [00:46:07] I'd like to introduce the Keep and Rec a Beautiful committee members here tonight. Blaine Gooden from the Verina District, Teresa Harris from the Brooklyn District, Brian Montgomery for the Fairfield District, Elaine Rivera from the Verina District, and then Lynn Yergek from the Brooklyn District. [00:46:28] We present our Land Lover and Clean Business Awards annually. These properties truly keep Henrico beautiful. The awards from the local Henrico business will be presented in alphabetical order by district. Pictures of the properties will be shown on the screens before you. [00:46:46] At this time, I'd like to ask Mr. Daniel Smith to come forward and present the Land Lover Award for the Brooklyn District. The Land Lover Award for the Brooklyn District is presented to Edward Dale. The front yard of this property is heavily shaded by a large red maple. [00:47:07] Ferns and other native shade-tolerant plants are putting down their roots. Grass has been replaced with mulch and stripped of pollinator plants are beckoning towards the sun. In the backyard, there is a raised vegetable garden surrounded by large native azaleas. [00:47:25] Mr. Deal is here to accept his award. [00:47:49] I asked Mr. Cooper to come forward and present the Land Lover Award for the Fairfield District. The Land Lover Award for the Fairfield District is presented to Laura George. Having only been in her house for a few years, Ms. George has transformed this yard into a blustering native wonderland. [00:48:09] In the backyard, a large area of non-native turf grass has been solarized and replaced by a pine needle bed with pathways lined with unused wood. The rain barrel sits proudly next to her awning, and the compost bin are just a few more of a sustainable practice too numerous to list. [00:48:28] Ms. George is here to accept her award. I asked Ms. Whitehead to come forward and present the Land Lover Award for the Three-Chop District. [00:48:59] The Land Lover Award for the Three-Chop District is presented to Chris and Marty Maialasio. In their yard, mulch beds have been replaced with turf grass in front of the native perennials of all shapes and sizes and blimps. [00:49:14] You can wander all you want in front of the yard, but don't forget the shaded winterland in the backyard. A vermouth composting bin and a native nursery are just some of the surprises to behold. Mr. and Ms. Malasio are here to accept their award. [00:49:44] I'd like to ask Mr. Jerry Rogish to come forward and present the Landliver Award for the Tuckahoe District. [00:50:14] The Landliver Award for the Tuckahoe District is presented to the Schreiber family. The Schreiber's have put their hearts and souls into making this a wildlife sanctuary. In fact, if we were a bumblebee, butterfly, rabbit, or a black snake, this yard would be the one we would stop in and likely stay. [00:50:35] The milkweed nursery on their deck is fed by a rain barrel below with a small fountain pump. Their yard is a Monarch Way station. The Shriver family are here to accept their award. [00:50:50] I asked Mr. Nelson to come forward and present the Land Lover Award for the Verona District and to please remain for the Clean Business Award. [00:51:29] The Land Lover Award for the Verona District is presented to Morgan Halverson. Having acquired this property with nearly a blank slate, Morgan has replaced 30 to 40 percent of the front lawn with native perennials. Focusing on plants that will reseed themselves, she has even nurtured volunteer oaks that will bring canopy space back to her yard. [00:51:56] As if the front yard wasn't enough, there are attractive raised vegetable beds in the back. Ms. Halverson is here to accept her award. [00:52:20] The Clean Business Award for the county is presented to Short Pump Animal Hospital. The first thing that comes to mind when thinking about a veterinary hospital is cats and dogs. [00:52:37] not necessarily birds and bees, but this business takes care of them as well. Instead of mowing a large swath of land behind the hospital, owners have created a meadow of pollinators. In green business fashion, they also protect the watershed with their doggy waste station and recycle inside. [00:52:57] Dr. Milano and Mr. Milano are here to accept the award. [00:53:19] These awards present a commitment to keeping Henrico beautiful in their dedication to sustainability that this committee commends. [00:53:39] We recognize all their hard work and thank them for them being an example of our homes and businesses in the county. We deserve our recognition, and they deserve our recognition and applause. I thank you for your time. Thank you, Colin. That was really well done. Includes the appointments [01:08:11] this evening. Mr. Chairman with your indulgence before we move into public hearing items Agenda item 201-24 is the resolution for appropriation of funds for fiscal year 24-25. This is the actual appropriation for the budget that you considered March and April time frame. [01:08:33] We do have a budget amendment on the public hearing item list, and the suggestion is that you adopt the budget before you amend the budget. So, Mr. Crawford, if you would, with 201-24. Yes, sir. Thank you, Mr. Manager, and good evening, Mr. Chairman, members of the board. [01:08:51] As the manager noted, this board paper would appropriate the budget for fiscal year 2024-2025 that the board adopted, or as the board adopted, on April 9th. The total appropriations would be $1.8 billion for the operating budget and $327 million for the capital budget. [01:09:15] This board paper also, if approved, would allow for the carry forward or a select number of carry forwards, which include funds for ongoing capital projects, the long-term disability benefit program, grants, and donations within the special revenue funds. [01:09:41] And I would note that this would also allow for the carry forward of the Virginia All-In initiative funding that the board approved in december of 2023 or just the remainder of that with that as a an overview i'll be happy to answer any questions the board has on the site this is the board this is the uh budget that we spent the whole week talking about right yes sir the week of march 18th through the 21st a whole month talking about etc so i'm sure [01:10:15] we we know it well um motion from someone you got a question go ahead reverend cooper all right motion made by reverend cooper second by miss whitehead all in favor say hi any opposed thank you thanks mr chairman members of board we move into public hearing items 199-24 is a resolution amendments to the fiscal year 24-25 annual fiscal plan in this case this appropriation of funds is to establish an affordable housing trust fund mr crawford thank you again mr [01:10:54] manager as a note as the manager noted this resolution if adopted would amend the fiscal year 25 annual fiscal plan to create an affordable housing trust in the amount of 60 million dollars that is a life-to-date appropriation this was introduced at last meeting on June 11th and was duly advertised with that as a you know if approved the funding would be used for to expand affordable housing housing opportunities within the county, particularly with affordable home ownership and workforce [01:11:33] housing. If that is an overview, I'll be happy to answer any questions. Thank you. Questions from my colleagues. This is a public hearing. Is there anyone here to speak to this particular resolution? Anyone on WebEx for this resolution? There's no one to speak to this item. All right, thank you. [01:11:52] Is there a motion? All right, motion made by Ms. Whitehead, second by Reverend Cooper. All in favor, say aye any opposed thank you mr manager next mr chairman agenda item 200-24 is an ordinance this has a long title but this board paper would basically amend the county zoning ordinance to regulate historical horse racing facilities in the county mr emerson this was discussed in work session but please provide the overview uh yes sir thank you mr manager mr chairman members of the board uh to keep this brief as the manager did did note this does have a long title it amends [01:12:30] numerous sections of the zoning code where historical horse racing is currently allowed by right to require a provisional use permit for that that use so it will go through the legislative process both the planning commission and that the board of supervisors anytime one of these facilities as proposed. Under the Administrative Act of the State of Virginia, historical horse racing is allowed up to 175 terminals within a locality that has approved off-track wagering, [01:13:03] which Henrico did in 1992. Anything above that number could be approved based on population up to 700. Henrico qualifies for up to 700, but anything beyond 175 automatically does require board approval so what this does it amends your zoning ordinance to make provisions to allow historical horse racing with a provisional use permit requires the sept head plan which is currently required and and requires a distance setback of 2 000 feet from light facilities [01:13:40] schools religious facilities parks playgrounds so forth and so on planning commission did hold a public hearing on this item earlier this month uh no one spoke to it planning commission recommended approval uh at after their hearing on the 13th the director of planning recommends approval this board paper county manager concurs i certainly will attempt to answer any questions that you have i also have with me mr ben blankenship who also will assist me if if i need to [01:14:12] to phone a friend for some assistance all right this is uh um well colleagues do you have any questions for mr emerson at this point all right this is a public hearing is there anyone here to speak to this particular um ordinance anyone on webex there's no one to speak to this item all right mr smith thank you mr chair i have a few items of concern on this issue that i just want to clarify for the public both those here both those dialed in and who may hopefully read [01:14:51] about it after um mr emerson don't go far mr newby um can you share shed a little light on how horse um betting and when horse betting became a thing in henrico i believe it was 1992 that's correct sir mr chair members of the board mr schmidt to answer your question in august of 1992 five percent of the qualified voters of henrico county virginia petition the circuit court of henrico county to hold a referendum to allow uh betting on horse racing in the county [01:15:22] There were two questions on that ballot, whether you could have betting on live horse racing in Henrico or betting on horse racing shown at a satellite facility. In other words, the race is taking place outside of Henrico County, but you're betting at a location in Henrico County. [01:15:38] In November of 1992, the voters of Henrico County approved both measures. And since that time, we are a qualified locality for parimutuel wagering on horse racing. And in 2018, the General Assembly amended the Code of Virginia to allow historical horse racing betting to occur at any locality such as Henrico that has previously approved a referendum. [01:16:04] The caveat there, you said in 2018, was historical horse betting. Yes, sir, which was a new category of betting created by the General Assembly and regulations thereafter where a bettor places a parimutuel wager not on a live horse race, but on a horse race that's taken place sometime in the past, and this can be done by means of a machine which looks strikingly similar to a slot machine. [01:16:27] Thank you, Mr. Newby. So just to clarify, 32 years ago, 5% of Henrico's voting population, which we estimate to be perhaps 5,000 plus or minus? Correct, yes, sir. Filled out a petition to require this county to place a referendum on the ballot in November of 1992. [01:16:48] There were two questions on that ballot. But it was also a presidential election year. It was Bush Clinton, correct? Yes, sir. I know that because there was a debate here in Richmond at the University of Richmond. I was a freshman at the University of Richmond that year. Couldn't get a ticket, so I stood on the curb and watched the motorcade go by. [01:17:04] So in November of 1992, this county passed a referendum. The results of that election countywide on question one, if you could bet on live horse racing, Mr. Newby, was what percentage? Just about 60-40? [01:17:22] 62 percent voted in favor or excuse me 62 000 voted in favor 40 000 approximately voted against so 60 40 yes 60 40 yeah and on question number two should you be permitted in the county of finrico to wager on horse racing on a horse running around a dirt track on a machine and watch it on tv betting on a california race betting on a new jersey or new york race from virginia on a machine on live horse racing that passed yes sir the results were much closer the yeses were approximately 51,000 and the noes were 49,000 approximately. 51% to 49% 32 years ago on [01:17:58] live horse racing. That's correct. Of note in the Brooklyn district, thank you for the data that was pulled in the Brooklyn district. Question number two passed 50.8% to 49.2% 32 years ago for the right to bet on a live horse running on a live track over a television machine. Yes sir. All track betting yes sir and remember this was just for betting on horses on site or off track so your point number two in 2018 the general assembly took action whereby correct me if I'm wrong they allowed parimutuel wagering via historical horse racing as you mentioned algorithms that are [01:18:36] programmed into a machine that looks like a slot machine that we see in place now in several cities around Virginia that's correct sir in 2018 that occurred yes sir to the user it looks like a slot machine but behind the scenes it's an algorithm based upon a historical horse race yes sir it still qualifies as paramutual wagering per the Virginia Code. Yes, sir. And as a part of that General Assembly action, it permitted somebody who would like to, to put up to 175 of said machines, [01:19:08] 25% of the 700 allowance into this county with zero public input. Precisely so. Yes, sir. Based upon our population, that's where the 175 came from. That's correct. And our prior approved referendum and if they want to put more than 175 up to 700 they would have to do what they would have to ask this body the board of supervisors for approval to exceed 175 but not to exceed 700 would that be a public it would be at a public meeting yes sir so the public would have input [01:19:43] so the public had input 32 years ago in 1992 with their vote public had no input in 2018 to change the concept from betting on a live horse running around a track to playing on a virtual slot machine with an algorithm behind the scenes that is, I'll say, unknown to the user in front of them based upon a historical horse result. [01:20:05] Correct. No Henrico voter expressly approved betting on historical horse racing in Henrico County. Awesome. Mr. Newby, we're almost there. Has this county recently been considering, in order to put this in front of us tonight for this ordinance, have we been considering a way to include public participation in this process should a business wish to do this? [01:20:27] Correct. The proposed ordinance would require anyone wishing to operate a historic horse racing facility in Henrico County to seek what's called a provisional use permit from the Board of Supervisors, which is a public process. So as a part of governance, that process, in order to bring it here tonight, takes some time, correct? [01:20:47] Yes, sir. This is a public process, right? Yeah, typically several. To get announced, published. How much time does that take to not only do the research, but then to announce it, to hold it in front of the Planning Commission, I believe, in a public hearing? and then announce it we're talking weeks right at a minimum sir you'd have an application uh it would go to the planning commission after notice for a public hearing and then a recommendation to the board of supervisors again advertised for a public hearing so two public hearings two rounds of advertisement mr emerson did i get that right you did yes mr newbie but it's approximately four [01:21:21] months four months with based on advertising deadlines and in scheduling it it would take if you hit it perfectly you could do it in as little as three to get to normal rule of thumb is about four months to get to today and that is a that is public when we when this government when this when this just jurisdiction states the fact that we're going to look into this and enact an ordinance that would require the public to have the ability that would allow the public to have the ability to weigh in that is a publicly known entity and it's out there that we're that's that's what we're working on yes for weeks or months yes sir all right thank you mr newbie mr emerson [01:21:55] In that time that we've been working on this, in those last few weeks or months, has anyone filed to beat tonight's deadline in order to produce such an establishment with up to 175 machines in this county? Yes, sir, they have. They have. And in order to circumvent the ordinance that we're working on tonight, I would surmise. [01:22:15] You don't have to answer that, Mr. Emerson. So can you tell me that the individuals or the corporation that have filed, what have they filed for? What have they filed a building permit, zoning confirmation? What has happened in that process? Yes, sir. What they've requested thus far, they filed their building permit, they filed their CEPTED plan, which is required under the current ordinance. [01:22:39] Along with the building permit, of course, they filed their facade upgrades, their tenant outfit, which comes in with that, and also received a zoning confirmation letter. So by doing so, when it was known to the public that we were having this discussion tonight and putting it up for public opinion, they have done what to their ability to do so? [01:22:59] Well, I would defer to the county attorney for that opinion, but I believe they've secured their interest in that use prior to action by this board. Mr. Newby, you'd concur that that is the assumption? Yes, I concur. [01:23:17] All right. So for public knowledge, for public information for those dialed in and hopefully those reporting on this this evening, several years ago, a similar organization, the organization, quite frankly, in all fairness, under different ownership, but with the same exact brand the same exact storefront the same exact concept uh came to me came to this county regarding a different location at that time we went down to their location met in the conference room mr manager i think it was you and me yes sir um and maybe some county staff that were with us i believe and they shared their vision for such an establishment in the [01:23:55] county shared with us that um where they wanted to put it what they wanted to do at that time i shared, we shared our reservations about the location, about the concept, and that it wasn't very supportive of it in that location at that time. The comments that we heard back from them as it went away were, we're not going to go anywhere, we're not wanted. Not wishing to jam anything in this county where we're not wanted. So fast forward to here we are today and keep that note in mind that we now have a filing while we've been under public responsiveness on this issue [01:24:31] to try to jam this business into the location prior to an ordinance being enacted. So in closing, as I come to a conclusion of these questions and thought concept is, I certainly invite that applicant, if he or she or they are listening this evening, to participate in this newly, hopefully created, if it were to pass tonight, this newly created process of public engagement by withdrawing your filing and refiling it. [01:25:03] Why? Because the same people that this group intends to quote-unquote serve deserve it. These folks of this county weigh in during the PUP process on far less intrusive items, including hours a store can operate. [01:25:21] And the residents that at least I represent, certainly my colleagues can weigh in, deserve the right to weigh in if there is going to be a gambling establishment in their neighborhood. So, again, I invite the applicant to do what's right by the citizens, and I invite them to participate, if this ordinance is enacted this evening, in the process of public engagement by withdrawing or filing and refiling within the ordinance period. [01:25:51] There's been PUPs, again, as I mentioned, to change hours of operation of businesses. No PUP until tonight, hopefully, that enacts a process for gambling. I think the applicant has an opportunity here to show their awareness of what it takes to be a trusted community partner and participate in the public process for those they wish to serve. [01:26:14] I'll repeat myself, they have an opportunity to show their awareness of what it takes to be a trusted community partner and allow the constituents of this county to participate in such a public process. That is why I support this ordinance this evening. So again, several years ago, we had our meeting. Here we are today. And I will state that from my perspective, without the opportunity for my residents to weigh in and without public participation, the actions of an applicant to circumvent an ordinance that this county has been publicly working on for weeks and or months is unwelcome. [01:26:51] That is my perspective on the issue at hand, as well as the filings that have been recently placed within the system. Mr. Chair, I thank you for the time, and I certainly invite my colleagues to offer their perspective on the issue. Mr. Chair, thank you. Thank you, Ms. Smith. [01:27:08] Colleagues, I'd rather willing to chime in before we go to a motion. Mr. Chairman, I will chime in. I have been kept abreast of this development, was disappointed and chagrined to hear about the filing that i would agree has to be viewed as something trying to squeeze in under ahead of the ordinance before the board today i am always one advocating for the voice of our residents to be heard and to circumvent the process that will i am anticipating be passed tonight to allow our [01:27:42] citizens to have our residents to have that voice i think is um is quite disappointing and um although Not in my district, per se. We are one Henrico County, and certainly the residents of Three Chop go throughout the county. And I would echo my colleague in imploring the applicant to reconsider what they have done thus far. [01:28:05] Anyone else? I concur with my colleague, Mr. Smith. I think that the process was tried to be circumvented. And I just don't think that that location that they're trying to put this facility in, it's in the Brooklyn District, but it's close to my district, the Fairfield District. [01:28:21] I believe that we all are very familiar with the predatorial business that preys on a certain segment of our population, low-income workers, retirees, minorities, and the disabled. And so potential for addiction, impact on health security concerns, I just don't feel that it fits the character of the community. [01:28:38] So I'm not in support of it. Mr. Chairman, I fully concur with my colleagues as well. For something that was a referendum 32 years ago, that's a long time ago. Things have changed a lot. [01:28:55] for it to have changed in 2018 by not our voters, but by the Commonwealth of Virginia. And the timing of this application that we've already provided notice on this ordinance is very troubling to me. [01:29:10] So I fully concur with my colleagues. All right. I guess I'll chime in last, and I agree. You know, we started this process, and then all of a sudden we get the notice after the process starts. [01:29:26] All of us, I think if this was going to a, if this was a hearing, this would be a 0-5 vote down, I'm certain. So, you know, hopefully if the applicant is watching, do the right thing, especially if you ever want to have to, you know, you got to deal with us again if you want to have other stuff happen. [01:29:47] So you could try to shove it down our throat. That's up to you for this case. But I know I will remember. Mr. Chairman, colleagues, thank you for your input. I appreciate the time offered to share my concerns with this filing that will directly affect the folks in my district. [01:30:09] And on that note, if there are no other comments, I certainly move. Did I ask for comments? Yeah, I did. You did, yeah, okay. I move to pass the ordinance. Second. All right, motion made by Mr. Smith, second by Reverend Cooper. All in favor, say aye. Aye. Any opposed? Thank you. Mr. Manager, I think general agenda. [01:30:27] Well, prior to that, Mr. Chairman, we do have public comments. is there anyone here that wishes to address the board of supervisors this evening is there anyone on webex that wishes to address the board of supervisors there's no one to speak on webex all right so moving into the general agenda the first action was approved by the board earlier 202-24 is a resolution for signatory authority this is the commonwealth's development opportunity fund performance agreement for berkeley insurance company which is in the three chop district mr Romanello. Thank you, Mr. Manager. Good evening, Mr. Chairman, members of the board. This paper [01:31:06] authorizes the county manager to execute a performance agreement among the county, the EDA, the VEDP, Virginia Economic Development Partnership, and Berkeley Insurance Group. Pursuant to the agreement, the state will pay a grant of $217,500 from the Commonwealth Development Opportunity Fund to the county. The agreement requires a one-to-one match that the EDA will achieve through incentives described in an economic development agreement between the eda and berkeley berkeley will make a capital investment of 6.1 million dollars and create and maintain at least 72 new jobs at an [01:31:42] average salary of 99 000 a year and i would mention this is our eighth project since the board of supervisors approved the technology zone just two years ago the eda heard this matter thursday night and recommends your approval questions i have not is there a motion move to [01:32:05] accept the resolution? Second. All right, moved by Ms. Whitehead, seconded by Reverend Cooper. All in favor say aye. Aye. Any opposed? Thank you. Next, Mr. Chairman, agenda item 203-24 is a resolution for signatory authority. This is a memorandum of understanding with the Partnership for Housing Affordability to administer the Affordable Housing Trust Fund program that you approved the amendment for earlier. Mr. Lebo. Thank you, Mr. Manager, Mr. Chair, members of the board. This board paper authorizes the county manager to negotiate sign, and administer an MOU with the Partnership for Housing Affordability. [01:32:42] Pursuant to the MOU, PHA will administer programs to provide affordable housing opportunities in the county, and the county will make donations to PHA from the Affordable Housing Trust Fund to support the programs. The Director of Community Revitalization recommends approval of the board paper, and the county manager concurs. [01:32:59] With that, I'm happy to answer any questions you all may have. Questions, colleagues. Is there a motion? So moved. All right. Motion made by Reverend Cooper, seconded by Mr. Smith. All in favor, say aye. Aye. Any opposed? [01:33:14] Thank you. Next, Mr. Chairman, 204-24 is a resolution for award of contracts. This is for professional, architectural, engineering, planning, urban design, and management services. Mr. Emerson. Thank you, Mr. Manager, Mr. Chairman, members of the board. [01:33:30] This, in essence, creates a short list of consulting firms that have been cleared through procurement that we can use to assist us with planning projects. throughout the year, and this board paper would award contracts to Baskerville and Sun PC, EPR PC, and Glavin Homes Architecture PC to provide annual professional architectural engineering, planning, urban design, and management services as needed by the county. [01:33:57] The county received seven proposals in response to RFP number 23, 26, 24, 12, JOK. Based upon review of the proposals, the selection committee interviewed the following firms, Baskerville & Sun, EPR, Berkeley Group, Glaives & Holmes.
