Heavenly Father, we come before you this evening with gratitude for the opportunity to gather and serve our community, Lord. [00:01:43] We acknowledge that you're sovereign over all things, and we ask for your presence to guide this meeting, Lord. We pray that you would grant your wisdom to each supervisor. We pray that you would help everyone to approach each issue tonight with humility, integrity, and respect for one another. May all discussions be productive, intentions pure, and our outcomes beneficial for all. [00:02:02] Lord, we pray that you'd bless our community with unity, progress, and peace. May everything we do reflect the values of justice, compassion, and stewardship that you've entrusted us to. In Jesus' name, amen. Mr. Manager. [00:02:34] Chair, we have a request for approval of minutes from October 22, 2024, both the regular and special meetings, And March 18th through the 21st, 2024, special meeting minutes. These were the legislative budget reviews that the board undertook this prior year. [00:02:56] Motion would be in order. All right. Thank you, Mr. Manager. A motion to accept the minutes. All right. All in favor, say aye. Aye. Any opposed? Thank you. Mr. Manager. Next, Mr. Chair, members of the board, I do have three comments this evening. I'm going to ask Greg Rebels to come forward. [00:03:14] So earlier this afternoon, the board had a work session. The work session was in Cumberland County, where the state's largest reservoir was actually went into service as of Friday. And at this work session, the board recognized my predecessor, Mr. Virgil Hazlitt, for his 22 years of service as county manager. [00:03:40] By naming that reservoir after him, Mr. Hazlett was the one that found the location of the reservoir. And ultimately, we surprised him with having members of his family there. [00:03:56] So it was a little, it was emotional for the board, many of us on staff who worked with Mr. Hazlett. But here we are again, recognizing service with Greg Revels, who has been part of our Henrico family for over 32 years. [00:04:15] He served five years as the deputy building official and over 27 years as our building official. Greg has announced his retirement, which is well-earned. Prior to joining our county, who worked for the State Department of Housing and Community Development as a program manager in the co-development office, Greg received his Bachelor of Science in Fire Protection Engineering from Oklahoma State University. [00:04:46] And I believe they're the Cowboys, Greg. Go Cowboys. Not doing so well this year, but that seems to be a universal thing with Cowboys. That's awesome. Yes, sir. Greg is certified as a building official by the state of Virginia and is a member of the 2003 class of Leadership Metro Richmond. [00:05:13] He has served in various leadership roles at the state and national level, including president of the Virginia Building Code Officials Association in 2000. He was also a member of the State Technical Review Board for over 10 years, serving as the chairman for many of those years. [00:05:31] Greg and his wife, Linda, reside in Powhatan County. His son, Jarrett, and daughter-in-law, Gabby, reside in Boston, where Jarrett co-founded Beacon Biosignals, and Gabby practices as a doctor. In retirement, Greg plans on enjoying the back road scenery on one of his two high-performance KTM motorcycles. [00:05:53] Greg, we wish you the best, and I'm hopeful that you do get to enjoy some riding, visiting with family and relaxing in your retirement years. But I do want to say this to you, my friend, this evening, and that is in all of these years, any time there was a request or a question that came to your office, Greg, you absolutely outperformed. [00:06:18] And I want to thank you for that long record of service. Ladies and gentlemen, Mr. Greg Rebels. I wanted to say something. [00:06:44] So it's really been an honor and a privilege to be a member of the Henrico family for 32 years in serving in this role Really advanced me professionally and personally and gave me the opportunity to see that Materialize in there with my family with my son his wife Of whom I'm tremendously proud and you know that [00:07:19] And the successes that you mentioned I will say in large part are attributed to back two rows of this room as well as all the other staff and what they bring to the table knowing that we always want to do the right thing but more importantly is we want to do the right thing the right way and they embrace that through their their empathy and respect for our residents and our businesses it means means everything so [00:07:55] thank you mr. manager for your support for the folks that are back behind you for their support, and for the previous administration, Mr. Hazlett, and what he did for me as well. So, thanks. Next, Ms. Chair, we're pleased to have with us this evening the 2024 Henrico Christmas Mother, Ms. Linda R. Melton. Ms. Melton, if you and everyone that is here for the Christmas Mother presentation would come forward, and we have with us our county government [00:08:34] Christmas Mother chairs Ms. Tanya Brackett and Ms. Rebecca Slough. Also, we have Ms. Melton is the Community Outreach Office Vice President for Fulton Bank. She's a member of the Richmond Alumni Chapter of Delta Sigma Theta sorority, the Richmond chapter of the Lynx, and the Hanover chapter of Virginia State University [00:09:09] alumni. Ms. Melton holds a Master of Education, a Bachelor of Science from Virginia State. She's been a member of the Christmas Mother program since 2021, following in her mother's footsteps a beloved Charlotte W. Melton, who was the 2000 Christmas Mother. Ms. Melton. [00:09:28] Good evening. So good evening, Mr. Chairman, Mr. Manager, and members of the board. I'm honored to serve as the 2024 Henrico Christmas mother and the first legacy Henrico Christmas mother. As Mr. Manager said, my mother, Charlotte Melton, was the 2000 Christmas mother. So Henrico Christmas mother would, that's a mouthful to say by the way, would like to give you a big thank you and a big thank you to all of the departments within the Henrico County government who are so [00:10:06] graciously contributing their time their talents and their money to make the holiday season better for our neighbors in need a special shout out to these two behind me who are just masters of coordination could not do it without you guys thanks a bunch so applications were taken in October, and the need has increased since 2023. We took 1,517 approved applications. 492 of those [00:10:42] were newly approved applications. In other words, people who had not applied in the past. This represents 4,703 individuals, of which 2,513 are children, 833 are senior and disabled persons, and the remainder are other household members. [00:11:05] Our distribution dates are December 6th, 9th, 10th, 12th, and 13th. And I invite each of you to come down to the warehouse, as Mr. Schmidt has done in the past, and witness firsthand how your support is, along with Henrico County Public Schools and the community, is helping those in need. [00:11:30] So since 1942, we have been neighbors helping neighbors, and we want to continue to do that. Thank you so much. [00:11:47] We, oh, I was going to make a comment, but you come on, shake hands, and come shake hands, and then we'll, I'll have a comment real quick. [00:12:18] We, each year, I think we try to get the Board of Supervisors right, Tanya, to try to visit. And so, and we have three new Board of Supervisors members this year. So which we all usually try to get back to the warehouse and we also we've been doing good we also had a We had a stipulation this year miss Miss roundtree formerly whitehead Actually got married recently. And so if any of us called her whitehead, we had to give you fifty dollars [00:12:55] So we've all been doing well. I messed up today. I did a major mess up today day so I actually have to write you a check for $100 I won't see I won't say what I did but uh but I make sure that we'll send it and we'll be over to visit you okay yes ma'am yes ma'am mr. chair members of board I do have one other comment and I'm gonna ask Terrell Hughes Paul Smith Jeff Sadler and Mario Sims [00:13:25] to come forward so we are tonight we're here to recognize a recent recognition for Public Works from the Asphalt Recycling and Reclaiming Association or ARA. So why is this important? So ARA has awarded Henrico County the 2025 Award for Excellence in Full-Depth Reclamation, a national honor that celebrates outstanding efforts in road reclamation. This [00:14:05] prestigious award is a testament to the county's commitment in advancing sustainable infrastructure improvements in our county. We've used this innovative process to improve over 50 lane miles of roadway, including Meadow Road, Kingsland Road, Turner Road, and most recently, Kane Road. [00:14:26] All of these roads were very narrow and have been widened through this process, which mixes in existing asphalt and stone on site with cement to build a strong road that is wider. The recycling and reclaiming method not only widens our roadways to improve safety, but also aligns with Henrico's HART, or Environmental Action Resource Team initiatives, by reusing the existing materials on site, significantly reducing the environmental impacts of material production and transport. [00:15:03] Compared to traditional road improvement costs, this method has saved our county tens of millions of dollars and is notably faster than conventional methods reducing the duration of resident impacts by months this sustainable practice allows us to continue expanding infrastructure efficiently with upcoming projects on creighton road dabs house road and east richmond road congratulations terrell mario and jeff this award is well deserved and we're excited to see the continued [00:15:38] benefits of your work in our community and terrell i want to publicly recognize you know this is an idea that you came forward with and you continue this team continues to make improvements on our roadways that we've never seen before so thank you terrell and group congratulations deal thank you mr manager mr chair members of the board uh without you this wouldn't be possible so thank Thank y'all for your support. You know, this, this process is different, you know, most recently Kane road. [00:16:14] But we've been doing this for the last year and it's new and it takes a lot of patients from residents. So thanks to the residents for allowing us to try this out. Thanks for the funding and the opportunity. And then, you know, want to thank our staff for really putting this out there. So I may have an idea, but it's really these guys that have to work with the contractors and work with the public to make these projects happen. So I really want to thank the team, But once again, just thank you all for your support in this. [00:16:42] And without you, it wouldn't be possible. So thanks. Thank you, Mr. Manager. Colleagues, are there any board of supervisors comments? Yes, sir, Mr. Chair. [00:16:57] Just a quick one. I want to spread some love tonight for two teams at Glen Island High School that are competing for championships right this very second. Our girls volleyball team is competing right now against Grassfield in a regional championship. And for the first time ever, our girls field hockey team won a regional championship, is competing in the quarterfinals for states tonight at home as the number one seed hosting cg woodson so quick shout out to the ladies both in the gym and on the field right down the street from us tonight we are watching and hoping for two successful wins tonight thank you sir thank you anybody else all right hopefully we'll see those girls in this room celebrating the state [00:17:36] champions or something soon i'm gonna ask mr mark coakley to come up to the ds if he doesn't mind Sir, on behalf of the Henrico County Board of Supervisors, I'd like to take a moment to recognize you and extend our deepest gratitude to you and your team. [00:17:57] But tonight you stand and represent as our general registrar. You and your staff provided great leadership and dedication throughout the 2024 election. Under your leadership, Henrico achieved an outstanding voter turnout in the 2024 election. [00:18:17] Of the nearly 250,000 registered voters, more than 182,000 participated, which was a 73% turnout. A total of 91,000 cast their ballots on election day, while 65,000 voted early in person. [00:18:35] Additionally, nearly 22,000 voters submitted absentee ballots by mail and almost 4,000 utilized provisional ballots. It's an outstanding achievement that speaks to both the trust that our residents place in our election process and the hard work of our election staff. [00:18:54] From early voting to election day, you and your staff ensure that our elections ran smoothly with the professionalism and efficiency that Henrico voters have come to expect. In addition to managing the election process itself, you also stood up to defend the integrity of our election and our county residents. [00:19:15] When misinformation about the election process spread, in particular through social media, you stayed calm, composed, and unwavering in telling the truth. Your prompt responses to the media helped to dispel false claims and reinforce the credibility of the way that we run elections here in Henrico. [00:19:35] Mark, your leadership is a vital part of what makes Enrico an example of election integrity and public service. We are proud of the work that you and your team have done, and we thank them for their efforts in ensuring that every voter had the opportunity to participate in a fair and secure election. [00:19:55] So, colleagues, audience, please join me in expressing our sincere appreciation to Mark Coakley and his staff for their continued service to Enrico County. Thank you, Mr. Chair, members of the board, Mr. Manager, team in the back, and everybody out here in the audience. [00:20:26] After 20 years in Henrico County, I felt the most confident about this election, this election that we just did, the enthusiasm of the voters, the security of the ballots, and the support we received from every department available, through the EOC and through tabletop exercises, and the manager and his staff and team. [00:20:48] So it's been a great experience. We're still counting the provisional ballots. We're running the tape now. It takes two and a half hours to run that tape. But we did have over 3,000 provisional ballots, and these are voters that would have been turned away if it wasn't for the teams out there in the polling places. [00:21:08] So I want to thank you all very much, and thank you for your support. Thank you, sir. Do we have any news media with us tonight? [00:21:25] I don't think we have any. All right, for those of you who are watching online or will watch the replay of this meeting tonight, thank you for covering Henrico County. Presentations, Mr. Manager. Mr. Chair, members of the board, I'm going to be honest, I cannot recall another resolution like the one you're about to see come before the Board of Supervisors. [00:21:53] This is a highlight. This resolution recognizes Carlea Swanson, commends her well-deserved accolades, and offers her the best of luck in the Miss America competition. Mr. Chair, I believe you have a presentation. [00:22:09] Yes, sir. Carlea, if you would come forward, please. Oh, sorry. [00:22:25] We need a motion to accept this resolution. All right, motion made by Reverend Cooper, second by Mr. Smith. All in favor say aye. Aye. Any opposed? All right, motion passed. All right, now I can read it. Come on, you come stand, White. Commending Carlea Swanson, whereas Carlea Swanson is a graduate of Highland Springs High School. [00:22:49] Carlyra Swanson is a graduate of Highland Springs High School. She is a graduate of Highland Springs High School. I just want to make sure y'all heard that. She is a graduate of the Highland Springs High School. Ms. Swanson developed a love of music at the young age of six, and her journey as a performer began in the church choir, learning to play classical piano at age seven and playing drums in the Highland Springs High School drum line. [00:23:16] And whereas, Ms. Swanson was crowned Miss Virginia 2024 at the Berglund Center in Roanoke on June 29, 2024. And whereas, she has won $50,000 in scholarships during her participation in the Miss America and Miss America's Teen Competition. [00:23:36] And whereas, as an accomplished musician, Ms. Swanson performed a piano and vocal rendition of a popular ballad in the Miss Virginia pageant. And whereas, Ms. Swanson is a fourth-year Ph.D. student at the University of Virginia. Specializing in critical and comparative studies in music, she holds a master's degree in critical and comparative studies in music, a master's degree in jazz vocal performance from the Frost School of Music at the University of Miami, and a bachelor's degree in jazz studies from George Mason University. [00:24:13] She also is a graduate of Highland Springs High School. She is a member of Rise Among Zion? I didn't know that. Verify that. You're a member of Rise Among Zion. Dang. Messed me up. That's good. [00:24:30] All right. Whereas, as Ms. Virginia, Ms. Swanson has supported education, advocacy, and community service and provided young women the opportunity to express their talents. And whereas, Ms. Swanson is also a spokesperson for the Virginia ABC Authority Ms. Virginia School Tour where she promotes healthy choices and substance abuse prevention to elementary school students across Virginia, and whereas in January, Ms. Swanson will represent Virginia at the Miss America competition at the Walt Disney Theater in Orlando, Florida. Now, therefore, be it resolved that the [00:25:07] Henrico County Board of Supervisors celebrates and honors Carlea Swanson for her remarkable achievements and contributions to the community. Be it further resolved that the Clerk of the Board of supervisors shall prepare a copy of this resolution for presentation to Carlyle Swanson commemorating her well-deserved accolades and offers her the best of luck in the Miss America competition. Signed by my self-chair, Tonya Brackett-Clerk. Again, let us show some love [00:25:38] for Miss Swanson. Thank you so much to the board and to Mr. Chair for this prestigious honor. You know, as Miss Virginia, everywhere I go, people ask, where are you from in Virginia? And always proudly say the east end of henrico and i went to highland springs high school and i feel so special [00:26:14] about going to holland springs high school because it was there almost 10 years ago that i decided i wanted to be miss virginia in that environment the east end of henrico truly cultivated that moment i'd like to thank god for this wonderful honor for preparing a time like this for me to my parents for encouraging my friend kaya the miss virginia opportunity for all the ways they encourage me and support me and I like to thank my grandma Gladys she isn't here with me but my grandma prayed for moments like this for me and I always say my grandma taught me how to be Miss Virginia because of the ways that she treated people the ways that she cared for the community and ultimately encourage my community service [00:26:51] initiative music is unity where I take music into schools and nursing homes helping people feel more connected again thank you so much for this honor I'm so grateful this manager turn it back over to you mr. chair members of board we move into public hearing rezoning cases. First case 316-24 BWS Enterprises LLC with a proposal [00:27:23] for data center office and light manufacturing use has been withdrawn by the applicant. Mr. Chair, this is a public hearing. This is a public hearing. Is there anyone here to speak to this case for or against? All right. Seeing no one. Reverend Cooper. Mr. Chair, thank you. There was an article on the newspaper today about this case, and I'm concerned it may leave the wrong impression with the community. [00:27:55] Before we move on, I'd like to ask Mr. Emerson some questions, which I hope will bring clarity for the public. Mr. Emerson, the applicant in the case wanted to rezone the property from agricultural to industrial to build a data center, correct? That is correct, yes, sir. And the Planning Commission recommended denial of rezoning, correct? [00:28:13] Yes, sir, that is correct. There was considerable citizen opposition to the case. The applicant cannot build a data center on that property without rezoning, correct? That is correct, yes, sir. But the surrounding properties are already zoned for business and industrial uses. Is that correct? Yes, sir, that is correct. [00:28:30] And you'll recall in all the community meetings that you and I attended on this, we made sure that we informed the public that the M1 and the B3 and the M2 all allowed data centers as uses if they met the design criteria of the zoning code for those particular zoning categories. [00:28:53] And so do they have the right to build that on this property? Yes, sir. They can build those on those properties as long as they meet the design criteria specified in the code. I appreciate that because, again, I want to bring clarity to an article. Did the Times Dispatch even reach out to us? [00:29:09] Yes, sir. They reached out yesterday, I believe. I received an inquiry from media services that had come through the Times Dispatch this morning inquiring as to whether or not we had had any contact or any new information, I think is the way it was stated from the applicant. And that answer is no. We don't have anything submitted on the properties at this point. Thank you, Mr. Minister. I think that's important because I want the public just to know that I oppose this rezoning application and glad that it's being withdrawn. At the same time, it's important and clear to the community that the surrounding [00:29:45] properties have the buy right for the potential possibility for future development. It's important for me that they can still see something such of that nature. I don't think the newspaper article was clear on that point, and I want everyone in the community to have the full picture. That said, I'm glad to see the rezoning case withdrawn tonight for the agricultural property, and I want to thank community for its involvement its engagement i know that i and my planning commissioner heard a lot of community feedback about the case so mr chairman thank you um quick question so i don't [00:30:20] know reverend cooper if you just said this but how so there's a front page article in the rtd yes sir how does it get so how how did this happen the article in the paper yeah i mean it because the way it read it's it's the way the reporter wrote it and the way the editor after their review presented it in the paper yeah but but but didn't it had no input from us didn't reach out to the board of supervisors rep not planning staff or anything they did make an attempt but we [00:30:56] were closed yesterday okay and it was just an email all right that's just that's a big screw up and so it's unfortunate for reverend cooper and fanfield to that article was very misleading so yes sir i i do believe it's important that everyone understands as reverend cooper has stated that the un the unconditioned b3 the unconditioned m1 and the m2c located in that area all allow the development of data centers and many many other uses that are impactful as long as they're developed [00:31:36] underneath the the guidance of the zoning code they are allowed uses right but if the case would have came come forward it probably that case would have been denied if it were a zoning yeah i mean yes sir we would have denied it um and so i think it's good that the public know that part too so um you want to make a motion um i move um that the advocate be approved that we were drawn second all right motion made by reverend cooper second by uh mr roguish all in favor say aye aye any opposed. Thank you. Mr. Manchin. Next. Mr. Chair, 230-24 is Joseph B. McCutcheon Jr., [00:32:14] also in Fairfield. In this case, the applicant proposes to amend a proffer related to recreational space to allow for the development of new single-family homes. This case was deferred from October the 8th, and a deferral is requested to the 2nd January 2025 meeting. Mr. Emerson, Do you have anything to add? [00:32:36] No, sir. That sums it up. They have requested deferral to the 2nd January meeting. Do you have any questions or anything? No, sir. This is a public hearing. Is there anyone here to speak to this particular public hearing item? I'm sorry. [00:32:51] I didn't ask this for the last case. Is there anyone on WebEx? There's no one to speak to either item. Thank you. All right. Reverend Cooper. Mr. Chairman, I move that REZ-2024-100950 Joseph B. McCutcheon, Jr. be deferred the 2nd January 2025 meeting at the request of the applicant. [00:33:13] All right, is there a second? Second. All right, motion made by Reverend Cooper, seconded by Ms. Roundtree. All in favor? Aye. Aye. Any opposed? Thank you. Mr. Manchin. Next, Mr. Chair, 288-24 in the 3CHOP District, Complete Automotive of Richmond Incorporated, in this case the applicant proposes to amend proffers regarding permitted uses to allow for an automotive repair facility. [00:33:42] Mr. Emerson, I understand a deferral has been put forward. Yes, sir. With this rezoning request as well? Yes, sir, Mr. Manager. It was late breaking. I received it as I came in this evening. It is a request to defer to the December 3rd meeting, the first December meeting, which I believe I've got that date right. [00:34:02] Clerk's nodding her head yes, so it's to December 3rd. All right. It's a public hearing case. Ms. Roundtree, is there anything you want to share before we move forward. All right, this is a public hearing. [00:34:18] Anyone here to speak to this particular case? Anyone on Webex? There's no one to speak to this item. All right, Ms. Roundtree. Mr. Chairman, I move that REZ 2024-101-509 Complete Automotive of Richmond, Inc. [00:34:34] be deferred to the December 3rd, 2024 meeting at the request of the applicant. All right, motion made by Ms. Roundtree, seconded by Mr. Smith. All in favor say aye. Aye. Any opposed? Thank you. Mr. Manager. Next, Mr. Chair, we move into public hearings. Other items, you have nine items for your consideration this evening. [00:34:52] We begin with 317-24, which is an ordinance to amend and reordain certain sections of the county code to establish the greater Henrico Technology Zone and provide incentives for businesses and redevelopment in the zone. [00:35:08] Mr. Romanello. Thank you, Mr. Manager, Mr. Chairman, members of the board. Good evening. Just Lake Hazlett, Miss America. It's a great day to be in Henrico. I'll tell you what. This board paper introduces four of your public hearing tonight is the proposed ordinance to establish the greater Henrico technology zone and replace what was established two years ago for the greater Innsbruck area. [00:35:37] This would cover every office building in Henrico. Qualifications for buy-right incentives include a million dollars of capital investment and the creation of at least 10 new jobs paying on average the local prevailing wage in the county. The establishment of the greater Henrico Technology Zone was presented to the board at its retreat in September and is part of our comprehensive office strategy, which we call Henrico Tomorrow. [00:36:04] A companion paper will be presented by Ms. Miner here in just a minute, and we recommend your approval. All right. Thank you. Public hearing. Colleagues, any questions? first. All right, this is a public hearing. Is there anyone here to speak to this particular public hearing item? Is there anyone on WebEx for this hearing item? There's no one to speak to this item. All right. Is there a motion? So moved, sir. Second. All right, motion made by Mr. Smith, seconded by Mr. Rogish. All in favor say aye. Aye. Any opposed? Thank you. Mr. Mitchell. [00:36:41] Next, Mr. Chair, 318-24 is an ordinance that would amend and reordain section 20-81 titled partial exemption for rehabilitated renovated or replacement commercial and industrial structures of the code of the county to expand the partial tax exemption miss minor thank you mr manager and good evening mr chair members of the board mr romanello is a tough act to follow but i will do my best this ordinance would expand the current commercial tax rehabilitation credit program providing additional benefits for eligible office buildings to be eligible office buildings would [00:37:16] have to exceed 60,000 square feet in size, be 15 years old or older, and must increase their assessed value by a minimum of 30 percent. If participating in the program, these office buildings would receive a 15-year real estate tax credit on the differential in their tax assessments. [00:37:36] The executive director of the EDA and the director of finance recommend approval. The county manager concurs, and I'd be happy to answer any questions in advance of the public hearing. questions colleagues okay this is a public hearing is there anyone here to speak to this particular item is there anyone on webex there's no one to speak to this item there's that motion a motion made by ms roundtree second by reverend cooper all in favor say aye aye any opposed thank you mr manager mr chair 319-24 is an ordinance that would add article 12 to chapter 6 of the [00:38:14] code of the county to waive building permit fees and other local fees for approved affordable housing developments. Mr. Leva. Thank you, Mr. Manager, Mr. Chair, members of the board. This board paper establishes a program to incentivize the development of affordable housing. Qualified developments will be eligible to receive waivers of fees for building permits and planning applications. To qualify, among other criteria, development must consist of single-family detached or attached dwellings and serve households with incomes between 60% and 120% of the area median income and also provide continued affordability beyond the initial purchaser. [00:38:54] The program was, as mentioned before, discussed with the board at the retreat during September 4th, and the directors of finance and community revitalization recommend approval. The board paper and the county manager concurs. With that, I'm happy to answer any questions you may have. Thank you, Mr. Lebo. [00:39:10] Any questions? Colleagues, this is a public hearing. Is there anyone here to speak to this particular item? I ain't the one on WebEx. There's no one to speak to this item. All right. [00:39:26] I do have a quick question, Mr. Lee, but I think I asked you this last time we were here. There was, I don't want to call it misinformation, but there was some, I had heard publicly that the county was spending up to $250,000 per home. [00:39:48] And we had a meeting on Friday, and the presentation talked about, it could be somewhere between maybe $80,000, $100,000, maybe even up to $120,000 to buy down the price. to make homes more affordable and you said then that the building permit waiving the building permit fees and other fees would roughly run to us approximately around what 12 12 to 15 000 12 to 15 000 regardless of size of the house where the house is etc so um so at a maximum we probably [00:40:28] be one somewhere between probably 115 or 130 yes if you add everything in absolutely 250 is like double that amount so no word it's 120 130 somewhere all right total okay max but the average we saw about 80 for one and about 100 yes sir yep yep thank you i just wanted to go on record so that we can go back and pull from that if ever need be absolutely all right um anybody want to make the motion second all right motion by reverend cooper second by mr roger all in favor say aye aye any opposed thank you mr manager next mr chair 320-24 is an ordinance mr newby will cover [00:41:07] from the DS, but this would allow us to comply with changes in state law regarding short-term rental registries by amending and reordaining the county code so that short-term rental registries are established, annual registration is required, and a fee is noted in the code. [00:41:29] Mr. Newby? That's correct, Mr. Manager, Mr. Chair, members of the board. This is your last state law update ordinance for the year. It's a companion to the zoning ordinance update that you'll be receiving two items from now. In short, the new state law allows people who lease a house to operate a short-term rental as long as they provide proof that the property owner has granted permission for the lessee to use the home as a short-term rental. [00:41:53] I'd be happy to answer any questions. Any questions for Mr. Newby? All right, this is a public hearing. Is there anyone here to speak to this particular case? All right, anyone on WebEx? There's no one to speak to this item. [00:42:10] Colleagues, is there a motion? Second. All right. Motion made by Ms. Roundtree. Second by Mr. Rougas. All in favor say aye. Any opposed? Thank you. Mr. Manager. Next, Mr. Chair. 321-24 is an ordinance that would amend and reordain certain sections of the county code to clarify, correct, and update provisions of the subdivision ordinance and to conform to changes in state law. Mr. Blankenship. [00:42:40] Mr. Manager, did you want to call both these papers together or something? So, Mr. Blankenship, I know you have a presentation that covers both. So with the chair's indulgence, let me just introduce the second one as well. Thank you. 322-24 is an ordinance that would amend and reordain sections of the zoning ordinance and to allow that to conform to changes in state law. [00:43:06] So thank you, Ben. Thank you, Mr. Manager, Mr. Chair, members of the board. This is a package of amendments that you have seen at your retreat in September. There are a few changes to the subdivision ordinance that I'll go over in one slide, and then a few changes to the zoning ordinance that I'll break down in a little bit more detail. [00:43:26] The subdivision ordinance, there are some changes to the state code regarding timelines of approval, and we just need to conform with those. We also want to add a faster and less expensive process to join two lots together. if a property owner buys two lots and wants to build one house on both of them that is somewhat cumbersome now and we want to simplify it there are some changes procedurally to the way double frontage lots are reviewed and approved and you'll see that again under the zoning ordinance some of those prop regulations are being moved from the one code to the other there are some changes to entrance requirements similarly that we're moving to the zoning ordinance our requirements for [00:44:04] property line markers are somewhat out of date the department of public works has updated their design manual to require a more modern kind of property line marker and so we want to conform the ordinance to that and finally there is a mention of the future land use map under the cluster housing subdivision that we think should with the comp plan update we think that should be removed and rely only on the zoning then on the zoning ordinance there are four categories here under state code amendments some changes to the timelines and not the timelines but the duration [00:44:40] of provisional use permits and conditional use permits also the amount of time that an applicant has after approval and before they begin construction of certain projects so that their permits don't expire those are now addressed in state code we don't have any difficulty with them but we do want to conform the ordinances pod's and subdivisions as i mentioned there were some timeline issues that the the state adopted that we want to conform with again we we move faster than the required timelines anyway it's not a problem and the short-term rental change mr newbie just touched on having to do with the ownership of property there are some new uses [00:45:18] that have been proposed new in the sense that they're not listed in our zoning ordinance and we would like to have them listed so in the future covered it'll be clear we've had two proposals for industrial training facilities one was an electrician's apprenticeship program the other was for commercial driver's license program training program so we want to spell those out in the ordinance and clearly state where they would be allowed we've had several conversations about residential treatment facilities which again is a term that is not currently used in our zoning ordinance and we think it should be they propose allowing them [00:45:53] in the same locations where a hospital is allowed it's the next closest listed use and also adding small-scale distillery where we already allow breweries this is less than 5 000 gallons per year so it really is a small scale more of a retail level operation but we've had several questions I think it should be addressed clearly moving on to our form-based overlay district as you know this was new to Henrico County in 2021 the regulations were developed for us by a consultant who has a great deal of experience in this field but we had very little experience and now as we've [00:46:32] seen the Virginia Center Commons project come up out of the ground we've been able to see some areas where we think we can improve on the work that was done three years ago so we want to require a mixture of uses in some of those areas increase the requirement for screening of alleys add some flexibility to the facade transparency requirements and just clarify and improve the consistency of the whole overlay standard finally there are some updated standards that i won't spend a lot of time on the board brought up the vaping shops issue and the boarding house issue at the retreat in september and so we have rolled the quests of the board into this package of amendments [00:47:11] There were some comments about townhouse parking, just clarifying regulations that have been in the code for quite some time. But the difference between houses that face public streets versus private streets and parking area, make sure that that's clear. Some questions about radio and TV stations that don't need to go through the provisional use process if they don't include large antennas. [00:47:33] Electrical substations, we just want to differentiate between large regional kind of facilities and smaller substations that only serve one or two uses. some changes to double frontage lots most of that is procedural as well and then finally just clarification and correction on some of the requirements for fences on corner lots fences in front yards are regulated more strictly than fences inside and rear yards on a corner lot you have kind of a conflict where one person's front yard is next to another person's rear yard so we just wanted to clarify how those are handled the planning commission has held two work sessions and a public hearing on these amendments and at october 10th public hearing [00:48:13] the planning commission recommended approval the board has seen these of course at your retreat on september 5th and the public hearing would be tonight that i'd be happy to answer your question mr blingenship thank you thank you for all the time that you guys have been putting into this i know planning i feel like planning commission has had a couple of different conversations about this and um has recommended and all of our planning commissioners have asked a lot of questions so I think they've been very helpful in getting us to this point. [00:48:48] Colleagues, do you have any questions about 22 or 23, the ordinances, before we? I know we have to approve them one at a time, but we can at least take questions. You guys have any questions? [00:49:04] Questions? All right, this is a public hearing. Is there anyone here to speak to items 322-24 or 323-24? Is there anyone on WebEx? [00:49:22] Mr. Chairman, it's 321-24 and 322-24. Okay, I'm sorry. 321-24, 322-24. Anyone on WebEx to speak to these particular cases? There's no one to speak to these items. So do the property owners have any recourse once this process is initiated and instituted? [00:51:30] Well, the conversation is still open for negotiation and hopefully settlement going through the COT process. But once we've entered into court, then it'll just be up to the courts to decide. In your history, how long does these processes normally take? [00:51:46] to get to court or to uh it depends on the judge's docket normally it's a year out half somewhere around there depending on the length of cases thank you you're welcome sir any other questions so we heard today when we were out at the um at the reservoir that the county does everything it can before it gets to condemnation yes sir we within reason try to do all we can to avoid the clot process one it's expensive uh and two it just requires [00:52:20] a lot of time resource time so we try to all we can to reach an agreement with property owners again still having the conversation as we move towards a court date of open conversation trying to reach agreement especially if they're they retained legal representation mr chair members of the board if i just may add pardon me for interrupting but you'll see on your agenda there's a couple of cases where we've done exactly that that the board has instituted condemnation proceedings we're in court we've continued to talk and staffs continue to work with the property owners to reach a resolution and you'll see a couple of those resolutions on your agenda today [00:52:59] we're notwithstanding having filed condemnation papers we've been able to settle and resolve it for a price that's agreeable to everybody okay all right uh this is a public hearing anyone here to speak to this particular resolution all right what about anyone on webex there's no one to speak to this item. Anthony yes sir thanks again mr. manager mr. chair honorable members of the board this would authorize the acquisition of permanent sidewalk easement across property located at 3300 Church Road [01:01:10] which is owned by by ZP number 14 LLC for the church road sidewalk project on [01:01:38] On January 24th, 23, the board authorized condemnation proceedings for 769 square feet of permanent sidewalk easement and 1,000 1,416 square feet of temporary construction easement following negotiations between the two parties. The owner is willing to accept 25,000 as just compensation for the easements. The deputy county manager for community operations and the director of real property recommended proof of the board paper. County manager. I'll be happy to answer any questions. Thank you. Questions, colleagues. [01:02:09] I'll just comment that I get a lot of questions about the sidewalk project on Church Road and the timeline of it and it just jumps out at me how the condemnation discussion we just had that this was started in January of 2023 and now here we are in November of 2024 and part of the delay was going through this condemnation process. [01:02:34] And so I just think it's worth pointing out that when folks, you know, express frustration about how long it takes to do something like sidewalks, it's because of these very granular issues that we don't have a whole lot of control over, but you guys continue to work diligently through. So, so thank you for that. [01:02:50] Just wanted to point that out, but move to adopt the resolution. Second. All right. Motion made by Ms. Roundtree, seconded by Reverend Cooper. All in favor say aye. Any opposed? Thank you. Next, Mr. Chair, 330-24 is also a resolution, also for approval of acquisition, also for the Church Road Sidewalk Project. This would authorize the acquisition of permanent sidewalk easement at 11100 Glen Hollow Court on January 24th of 2023. [01:03:30] the board authorized condemnation for shooting for 396 square feet of permanent sidewalk easement and 1950 square feet of temporary construction easement following negotiations between the parties the owners are willing to accept 36,000 as just compensation for the easements as additional consideration the county will replace the owner's existing fence abutting the sidewalk along church road the deputy county manager for community operations and the director of real property recommended approval of the board paper earned i'll be happy to answer any questions thank you Sir, any questions? [01:04:04] All right, is there a motion for the resolution? So moved. All right, motion by Ms. Roundtree, second by Mr. Smith. All in favor say aye. Aye. And they're opposed. Thank you. Next, Mr. Chair, 331-24 is the resolution award of annual contract. [01:04:20] This is for drainage and maintenance projects. Mr. Zanino. Thank you, Mr. Manager, Mr. Chair, members of the board. This board paper awards a unit price contract to Talion Armstrong, Inc. for labor, supervision, materials, supplies, and equipment for drainage and maintenance projects throughout the county as needed and requested by the county. [01:04:41] The contract will be for a period of one year with option for the county to renew the contract for two additional one-year terms. The county received two bids on October 10, 2024. Based upon a review of the bids, Tyleen Armstrong, Inc. is the lowest responsive and responsible bidder. [01:04:59] First-year expenditures are estimated at approximately $350,000, which may increase or decrease depending on the actual needs of the county. The cost of each project assigned under the contract will be determined upon completion of the project by multiplying the unit quantities authorized by the county by the unit prices in the contractor's bid. [01:05:19] Funding to support the contract is available within the Division of Recreation and Parks budget. The Director of Recreation and Parks and the Purchasing Director recommend approval of the board paper. And the County Manager concurs. I'd be happy to answer any questions. Any questions, colleagues? Just got one, Mr. Chairman. [01:05:36] Mr. Zinno, since you're up here presenting a Drainage and Maintenance Project Award, I'm assuming this is just for parks? I believe it could be used by others. This is mainly for trails. So Echo Lake restoration would be an example. East Direct Track would be another example. [01:05:54] So it's drainage, concrete work, mostly related to trails. Yeah, I was just reading the resolution, and I mean, drainage and maintenance, not always we see the director of Rec and Parks up here talking about drainage and maintenance. Just a quick question. Thank you, sir. Any other questions? Mr. Smith, you want to make the motion? [01:06:11] Yes, sir. Move the resolution. Second. All right. Motion made by Mr. Smith, second by Mr. Rogich. All in favor say aye. Aye. Any opposed? Thank you. Mr. Manchin. [01:08:15] All right, motion made by Reverend Cooper, seconded by Mr. Rogan. So all in favor say aye. Aye. Any opposed? Thank you. Mr. Manchin.
