Before we begin our agenda tonight, we do have a request of the board for Mr. Nelson to participate in this meeting remotely as Mr. Nelson is currently traveling to attend a family event. [00:06:06] The board's policy allows Mr. Nelson to participate electronically if approved by the majority of the quorum physically present at the meeting. Is there a motion to approve electronic participation for Mr. Nelson? Second. Motion made by Mr. Cooper, seconded by Mr. Rogish. Those in favor say aye. [00:06:22] Aye. Any opposed? Aye. All right. Second. Second by Mr. Rogan. Those in favor say aye. Aye. Any opposed. Thank you, sir. Mr. Chair, moving into manager comments this evening, I do have one comment, and I'm going to ask Kristen Owen to come forward with a number of individuals that are here, Bill Bradfield and Emily Schmidt, if you all would come to the podium. [00:10:15] And after these comments, I think the board would like for you all to come up and take a picture to commemorate this moment. So this is familiar territory for the board. There was actually an event that we held earlier to commemorate what I'm about to note. [00:10:35] But Bill is our FEMA regional flood insurance liaison, and Emily is our CRS coordinator. And they are here today to recognize our county's entry into the community rating system, or CRS, program. [00:10:52] Now, for the residents in attendance and the Weeblos that are in attendance, the CRS program provides our residents with discounts on flood insurance premiums, some pretty significant ones, and this went into effect on October the 1st. [00:11:07] As we announced at our press conference in April, that was at Echo Lake Park, the county joined the program as a Class 5 with an asterisk. Is that right? Yes. You've pounded that into me. That's right. [00:11:24] making us the first in the nation to join at such a high rating. This achievement highlights our ongoing commitment to flood safety and resilience while offering financial savings to our residents. And I'm proud to say that Henrico residents will receive, ladies and gentlemen, a 25% discount. [00:11:43] So, and that's on homeowners insurance. So I want to thank our floodplain management team, ISO and FEMA, for their support in helping us reach this important milestone. We look forward to continuing our work to protect and strengthen our community. [00:11:59] So, Bill and Emily, welcome. The floor is yours. And that 25% discount is on flood insurance. So, if you have flood insurance with your homeowner's insurance, that's what this savings is about. So, you all, the floor is yours to address the board. [00:12:17] No, I just, yeah, thank you very much. I just have some brief comments real quick. Thank you for the introduction. i'm going to try this in the 21st century on my phone so here we go let's save some trees but yes good evening everyone um welcome to the community rating system plaque presentation for henrico county as uh previously stated my name is bill bradfield i'm a regional flood insurance liaison for fema region three out of philadelphia of which the commonwealth of virginia is part of and i'd like to thank the board of supervisors for having me tonight and especially [00:12:52] a huge thank you to Kristen for inviting me, all the work. I've actually known Kristen for a long time. We were previously NFIP coordinators for respective commonwealths, Pennsylvania and Virginia. So we've known each other for a bunch of years. So it's good to see her again. [00:13:10] Throughout the United States, there are well over 20,000 communities participating in FEMA's National Flood Insurance Program, or the NFIP. There are 292 of them located here in the Commonwealth. Each participating community must meet certain minimum criteria in order to gain and maintain basic NFIP status. That's just the basic minimum to participate that flood insurance be made available. Nationally, a relative handful, which is about 6% of the total of these communities choose to go above and beyond the minimum requirements of the NFIP and join the community [00:13:46] rating system. And these additional efforts result in a community that is both safer and better prepared for future flooding events. Henrico County is being recognized today because effective October 1st, 2024, the county entered CRS as a class five, as you mentioned, and is now one of only 30 participating NFIP communities across the Commonwealth of Virginia that qualifies for the CRS participation. I'd also like to point out that the county is one of five Virginia CRS [00:14:18] communities that is a class five which is the lowest you know there are no communities in virginia that are lower than a class five so you're actually coming in already at the gold standard for the commonwealth and we can talk about the asterisks because i think there are bigger things to come from what i understand so kudos there but i do want to mention like what a huge undertaking that is many communities when they come into this program they they start at a 10 that's usually that's zero you know they everyone comes in at a 10 they may come in at a [00:14:56] nine or an eight maybe a seven to come in at your first time at a five is truly remarkable and really a testament to all the hard work that the staff and the county and the leadership has put towards this program and the kind of program that you run it really is a model and we are very excited to work with the county and to use that as kind of like a gold standard and a beacon for what other communities can strive to do. [00:15:25] And as you mentioned, perhaps more tangible to the residents of the county, this Class 5 rating qualifies each NFIP policyholder for a discount of up to 25% on their annual flood insurance premium. We recognize that flood insurance is challenging right now with affordability. [00:15:40] There's been a lot of news. It's an interesting, challenging time to be wearing this crest, but anything we can do to make flood insurance more affordable, and this is a very good first step. So I would like to formally recognize in Ricoh County for its leadership, hard work, and accomplishments on behalf of the National Flood Insurance Program, FEMA Region 3. [00:16:03] I'd like to congratulate and thank everyone here. Thank you, sir. [00:16:07] Thank you very much. [00:16:53] I have no other comments this evening, Mr. Chair. [00:17:12] Thank you, Mr. Manager. For those of you tuned in or those in the room or many of you who perused the minutes, we have one of the best in the flood industry. Kristen has helped us each out significantly with residential areas in our community, so thank you, ma'am, for all the great work you do. [00:17:30] Mr. Manager, my colleagues, we move into Board of Supervisors' comments. Anyone have any comments to my left, Mr. Cooper? I have a brief one. I was looking. I don't see Mr. Yob in here. Thank you, Mr. Yop. So I sit on the Capital Region Airport Commission along with Reverend Cooper and Reverend Nelson this morning. [00:17:51] And part of the presentation was about how the airport handled the infamous water crisis and heard a lot of information. And at the end, the president, Dr. Perry Miller, made a point to thank the members of his staff that he found instrumental in getting him through. [00:18:09] And then after that, he isolated one non-airport employee, and that was you, and was careful to highlight. And mind you, we're a commission of all kinds of localities, so it certainly wasn't just for us. But he emphatically stated that you were key and instrumental to helping the airport maintain operations, keep everybody safe, keep everything going. [00:18:33] So on behalf of Henrico County, the board, you made us really proud in there today. Thank you, ma'am. Any other comments? Mr. Chair, I just want to briefly pause to acknowledge the passing of State Senator Henry Marsh, who passed on January 23rd. [00:18:56] Senator Marsh was the first African-American mayor of the city of Richmond. He was a stalwart of public service whose life and work left an indelible mark on his community in the political landscape, who had a deep commitment for civil rights, equality, and justice. Senator Marsh's legacy is one of advocating for the underserved and speaking truth to power. [00:19:16] As the first African-American to serve as the mayor of Richmond, He broke barriers and worked tirelessly to bridge divides in his city and in the state. His career was also distinguished by his leadership in the Virginia State Legislature, where he championed causes ranging from education reform to health care access. [00:19:33] His passing is a significant loss, not just for his family and close friends, but all who valued him as a visionary leader more than just the society. So I just want to acknowledge his passing and offer prayers and condolences to his family. Thank you, sir. Any other comments? [00:19:52] I'd like to use my comments to allow our guests to introduce themselves. It's the time to shine here, gang. You ready? All right. Come on up to this podium up here, and if you don't mind, tell us your name, what school you go to, anything about your badge that you're working on, which we just talked about for a little bit. [00:20:10] As you're coming up, for those who are just joining us, I had an opportunity to meet with this group of young men and women a minute ago, and they're working on a badge, which you'll hear in a minute, about really deals with the community, community service and elections and how to be good citizens within your community. [00:20:25] So come on down one by one and have at it. Name, school, PAC, and your badge. Anything else you want to share? There you go. [00:20:43] My name is Trevor. I go to Echo Lake Elementary School. I'm in PAC 736, and we are working on a My Community badge. Great job. Thanks, Trevor. [00:21:02] My name is Benjamin, and I go to Echo Lake, and I'm working on my community badge. My name is Blake, and my badge is Debbie. [00:21:19] My name is Eric, and I go to Springfield Park, and I'm working on my community badge, and I'm HAC 736. My name is Nathan, and I'm working, I go to Springfield Park, and I'm working on my community badge. [00:21:45] My school is Echo Lake, and I'm working on my community badge. My name is Andre. I go to Springfield Park Elementary School, and I'm working on my community badge. [00:22:02] My name is Wendy, and I go to Acton Academy West End, and my favorite badge was my family. That's awesome. Thank you all for being here. It is a pleasure for all of us when you all spend time here and come on out. [00:22:26] It's fantastic, number one, for the young men and women to hear and see what goes on in their local government, but it's also a pleasure for us to see you out here and engaging in your community, so thank you all very much. Moving on, I believe I do not see any media present. If you're tuned in on Webex, thank you for tuning in. [00:22:45] Mr. Mayor. Mr. Chair, members of the board, we would move on to presentation. We have one item this evening, and that is 33-25. This is a resolution expressing appreciation to Eldon Todd Yor. This resolution expresses heartfelt appreciation to Mr. Yor for his extraordinary service, invaluable contributions, and unwavering commitment to our county and its residents. [00:23:13] Mr. Chair, a motion would be in order. Yes, sir. Is there a motion to approve the resolution? So moved. Motion made by Mr. Cooper, seconded by Ms. Roundtree. Those in favor say aye. Any opposed. The ayes have it, sadly, Mr. Yor. I will say, as Mr. Rogas gets prepared, it was very, very tough to accept this one. [00:23:33] Yeah, well, a couple things, Mr. Chair, members of the board. You know, we learned earlier tonight how valuable of a resource this man has been for our county, and we honored you earlier tonight. But a little something that I did not know, as I was drinking through the fire hose last year of everything, I did not know your name was Eldon. [00:23:55] So we're expressing our appreciation tonight to Mr. Todd, to Mr. Eldon Todd Yer. Whereas Eldon Todd Yer has enjoyed a distinguished career with Henrico County, dedicating over 34 years of service to the Department of Public Works, beginning in May of 1990 as a traffic engineer. [00:24:15] And whereas Mr. Yure has made significant contributions to the county's traffic operations, including overseeing signs and signals, reviewing development design plans, serving on snow and NASCAR race duty, and initiating the standardization of lighting at all signalized intersections in Henrico County. [00:24:34] And whereas Mr. Yer was promoted to lead the Mass Transit Division, where he spearheaded the expansion of Greater Richmond Transit Company, GRTC, bus service into Henrico County. And whereas in 2012, Mr. Yer became the director of the Transportation Development Division, where he oversaw a dramatic increase in public works transportation capital projects from four to over 100 active projects and successfully secured state and federal funding, including completing Henrico County's first VDOT revenue sharing project. [00:25:08] And whereas, in 2019, Mr. Year was promoted to Assistant Director of Public Works, where he oversaw the transportation development, construction, and design divisions and continued his work securing funding and advocating for regional projects. And whereas Mr. Yer has played a vital role in regional transportation initiatives, serving on Plan RVA's Richmond Transportation Planning Organization, advocating for federal funding and playing a key role in the future of the region's transportation infrastructure, advancing critical infrastructure projects. [00:25:40] and whereas Mr. Yer was instrumental in bringing to life major trail projects such as the Virginia Capital Trail and the Fall Line Trail. Mr. Yer was also instrumental in the success of the 2015 UCI Road World Championship. [00:25:58] And whereas Mr. Yer played a major role in the establishment of the Central Virginia Transportation Authority, CVTA, serving as the first technical advisory chair and creating the framework for funding policies and project scoring. And whereas Mr. Yer's leadership has greatly enhanced transit services in Henrico County, including expanded routes and increased service frequency along major corridors. [00:26:23] And his recent appointment to the GRTC Board of Directors reflects his ongoing dedication to public transportation. And whereas Mr. Yer leaves an extraordinary legacy of over 120 active transportation projects with funding exceeding $900 million, [00:26:40] representing transfer transformative progress for henrico county's infrastructure and transportation systems now therefore be it resolved that the board of supervisors of henrico county virginia hereby expresses its heartfelt appreciation to eldon todd yur for his extraordinary service invaluable contributions and unwavering commitment to the county and its residents be it further resolved that this resolution shall be spread among the minutes of this meeting and a copy publicly presented to mr yur as a token of the board's deepest gratitude and best wishes for his future endeavors. [00:27:15] Signed, Daniel Schmidt, Chair, Board of Supervisors, Tanya Brackett, Clerk. Thank you, Mr. Yeram. [00:27:30] Mr. Rogish, Mr. Chair, members of the board, Mr. Manager, I'm honored and humbled for this recognition. [00:27:47] On behalf of my family and former co-workers that are here, I appreciate y'all putting this on the front of the agenda as opposed to the end of the agenda where public works usually reside. Sorry, Corral. But yeah, I'd personally like to thank you, Mr. Manager, Mr. Yob, Carrie Tertina, Mr. Hinton, and this particular board. [00:28:10] You make the work much more fulfilling knowing that we don't have to justify the need to extend the sidewalk, build a trail, do a roadway safety improvement, or extend a bus route. The only question we ever get is how quickly can you do it? [00:28:26] So I leave behind a very strong team that's going to keep the good work going and help deliver these projects. It's been an honor to have worked here and served the citizens for the last almost 35 years. Steve said I could round up to 35. [00:28:43] And even though there is a particular member of the board that likes to point out on more than one occasion that I'm not a resident of Henrico County, that hasn't, yes, yes, sir, wasn't going to single you out, sir. But I can promise that I will still visit here frequently. [00:29:00] And at least for the foreseeable future, you have a know that you are in the county payrolls teaching at Laburnum Elementary. So, so again, I thank you. I appreciate the recognition. [00:29:16] I'm humbled. Thanks, Todd. Mr. Mayor. Chair, we do have two appointment papers, both from the Fairfield District. [00:29:34] We begin with 34-25, which is a resolution for appointment a member, this in this case to the Board of Real Estate Review and Equalization. This board paper would appoint Marion Martin to that board for a one-year term that would expire December 31, 2025. [00:29:52] Mr. Chair. Thank you, sir. Is there a motion? Motion made by Ms. Cooper, seconded by Mr. Rogish. Those in favor say aye. Any opposed? Is Ms. Martin here? No? Okay. So then we would move on to the Library Advisory Board 35-25, resolution appointment of member to the Library Advisory Board. [00:30:14] This board paper would appoint Valerie McBee, again, from the Fairfield District to that board for a one-year term that expires December 31, 2025. Mr. Chair. Thank you, sir. Is there a motion? So moved. Second. Motion made by Ms. Cooper. Second by Mr. Rogas. Those in favor say aye. Aye. [00:30:29] Any post? The motion carries. He is here. Okay. [00:31:09] For your service, ma'am. [00:31:59] Mr. Manager. Mr. Chair, members of the board, We would move into the public hearing, rezoning case, and provisional use permit component of the agenda. First agenda item 230-24, Joseph McCutcheon, with a proffer amendment request related to recreational space to allow for the development of new single-family homes. [00:32:18] Ms. Moore, I understand there's a deferral that's been requested on this item to March the 11th? That's correct, yes. Mr. Chair? Thank you, Mr. Manager. This is a public hearing, so we'll address the audience and WebEx in a second. Any questions from my colleagues before we do that? [00:32:35] All right. This is a public hearing. Is there anyone in the room that wishes to speak regarding this deferral? Anyone on WebEx? No, sir. No one to speak on this item. All right. Mr. Cooper, is there a motion? Yes, sir, Mr. Chair. [00:32:51] Mr. Chairman, I move that REZ-2024-100950 Joseph B. McCutcheon, Jr. be deferred to the March 11, 2025 meeting at the request of the applicant. Thank you, sir. [00:33:06] Motion made by Mr. Cooper. Is there a second? Seconded by Mr. Rogus. Those in favor say aye. Aye. Any opposed? All right. The motion carries. Thank you. Mr. Mayor. Next, Mr. Chair, 345-24 is a conditional rezoning request coming from Main Street Homes of Virginia. [00:33:24] The request is to rezone from A1 and B3 Business District to RTH Residential Townhouse District. Several parcels that contain 6.5 acres. They're located on the north line of Church Road, near its intersection with John Rolfe Parkway, and here the applicant proposes a townhouse community. [00:33:46] Ms. Moore. Thank you, Mr. Manager and members of the board. As you recall, this item was presented to you and heard public comments at your December 3rd meeting. Then it was deferred to consider changes to proffers related to sodden irrigation and also to give the applicant time to consider opportunities for future connectivity to the properties to the west. [00:34:09] The applicant has revised their proffers and submitted them, and those are included with your staff report as well as a revised concept plan. And both of these revisions do now address staff comments. [00:34:25] Specifically, the concept plan has been revised. The row of townhomes were reoriented on the northwest corner to allow for the stub road to allow potential future connectivity should those properties to the west ever consider to develop further. [00:34:43] In addition, Proffer 15 was revised to state that all the front and side yards would have sod and irrigation. There were two speakers representing Keswick and Covey Run at your last meeting who did voice concerns about traffic in general on Church Road as well as the existing and potential for increased cut-through traffic on Blandfield Road to the south of the property across Church Road. [00:35:10] I will note that representatives from Henrico County's Traffic Engineering Division held a meeting with the Keswick residents last night and they're exploring opportunities to mitigate and remedy those issues. Based on the changes the applicant submitted, staff supports this request. [00:35:28] As noted, the Planning Commission recommended approval of this request at their November 14th meeting. This concludes my presentation. I'd be happy to answer any questions you may have. Thank you, ma'am. Any questions from my colleagues? Seeing none, this is a public hearing, is it? [00:35:44] I just have a couple of questions, and maybe you can answer it or the applicant. One of the things, when we were at the public hearing last night at Godwin High School, I talked about a possible roundabout would be a possible solution coming out of that entrance. [00:36:02] Is that something that this would accommodate in our proffers? It wouldn't have to be the proffers. It could be addressed at the time of they do have addressed proffers relating to any traffic improvements. Right now, they proffer to left-hand learn, but it does give the latitude to do something different at the time of land and development. [00:36:20] So if we needed some right away, we could get that for that if that was the ultimate solution. Yes, sir. I want to thank the applicant for making the stub, you know, going to the west there. So thank you guys on that. So I don't have any other questions. [00:36:36] Thanks. I'll just note by way of explanation that although this is a three-chop project, the impact was generally being felt by residents of Tuckahoe just because of the nature of where the line fell. So I do thank my colleague, Mr. Rogish, for doing a lot of the heavy lifting on the concerns of the residents who do reside in Tuckahoe, notwithstanding that this is a three-chopped project. [00:37:03] This is a public hearing. Is there anyone in the room that wishes to speak to this case? Anyone on Webex? No, sir. No one to speak to this item. Thank you very much. Mr. Roundtree. Mr. Chair, I move that we follow the recommendation of the Planning Commission and approve REZ 2024-102035 Main Street Homes of Virginia, Inc., with the proffers dated December 26, 2024. [00:37:29] It's been a motion made by Ms. Roundtree. Second. Seconded by Mr. Cooper. Those in favor say aye. Any post. Motion carries, Mr. Mayor. Next, Mr. Chair, members of board 36-25 is a request for provisional use permit in the Tuckahoe District. [00:37:45] The applicant is John Javos, and this would allow outdoor seating at a location that is at the southwest intersection of Huguenot Road and Kanawha Drive. And in this case, Planning Commission voted to recommend approval. [00:38:01] Ms. Moore. Thank you again. The applicant is requesting a provisional use permit to allow an outdoor dining area for Stella's Groceries located at River Road Shopping Center 2 on the south side of Huguenot Road. Stella's occupies the westernmost tenant space where the 357 square foot outdoor dining area is proposed on the side of the building. [00:38:24] The area would accommodate approximately 11 seats and a service station. The shopping center is MB1 and the surrounding uses are predominantly commercial. Outdoor dining isn't allowed use in the B-1 with the approval of a provisional use permit, provided that certain standards set forth in the zoning ordinance are met. [00:38:45] This includes minimum distances with any residential districts, and this proposal does meet those requirements and others. In addition, staff is also recommending 13 conditions to further regulate the use. The 2026 comprehensive plan recommends areas for environmental protection area, And this is due to floodplains associated with the James River and Kennewick Canal. [00:39:15] However, based on revised FEMA maps that were accepted in April, I believe, of 2024, the placement of the outdoor dining area would be located outside of the 100-year floodplain. And this, again, is based on the recent revisions to the floodplain map. [00:39:34] Therefore, a staff believes that the use would meet the intent of the EPA designation and would be compatible with the commercial uses on the site and surrounding area. Staff supports this request with the recommended conditions in the staff report. And that concludes my presentation. Thank you. [00:39:52] Thank you, ma'am. Any questions about my colleagues? Just one, well, two questions. One, well, you answered the one question on the floodplain. Thank you. And the 13 conditions, those are outside of the normal B1 business district zoning requirements, or some of those are in there. [00:40:13] the specific one i'm asking about is access to the outdoor dining areas must be accessed through the interior right that's a good condition in my opinion so i just is that something that's in all b1 outdoor dining um actually that is not specified in the zoning ordinance but we do specify it pretty regularly in all of our conditions and they do meet that requirement as well yeah i don't have any further questions mr chair thank you sir this is a public hearing is there anyone in the room that wishes to speak to this case seeing none is there anyone on webex no sir no one to speak to this item. Thank you, sir. Mr. Ruggish. Mr. Chairman, I move that we approve PUP 2024-10-22-62 [00:40:52] Johnny Javos with the recommended conditions listed in the staff report. Motion made by Mr. Ruggish. Is there a second? Second by Ms. Roundtree. Those in favor say aye. Aye. Any opposed? Aye. Motion's carries. Next, Mr. Chair. Members of the board, public hearing other items. The first item is 37-25. This is an ordinance that would allow the Director of Finance to retain copies in lieu of original tax returns. Ms. Minor has the details. Sheila. Thank you, Mr. Manager. Good [00:41:28] evening, Mr. Chairman, members of the board. This item would allow the Director of Finance to utilize copies, specifically electronic copies, of various property tax returns for processing. state code currently requires the commissioner of the revenue or the person acting in in the capacity of the commissioner of the revenue to seek the approval from the governing body in order to use copies in lieu of original tax returns. The director of finance recommends approval and the county manager concurs. Thank you, ma'am. Any questions for Ms. Miner? [00:42:03] Just a random question. Are there others that we can approve this for? Other returns or documents? Currently, I think the state code is specific to these types of returns, if I'm not mistaken, Mr. Attorney. Mr. Chair, I would agree with Ms. Miner. [00:42:23] This seems to be an anachronism in the state's tax code that would date back to a time when mimeographs and copies were an uncommon and rare and unreliable source of information. Well, then, thank you for bringing this. And to the extent that you find any other anachronism or, you know, ways to minimize paper, I think you will find us a friendly board to that. [00:51:43] I guess those in favor say aye. Any opposed. Motion carries, Mr. Manager. Next, Mr. Chair and members of the board, we move into public comments. If there's any individual that wishes to address the board of supervisors here this evening, we ask that you do so from the back of the lectern and ask that you state your name and address as you begin your comments, which the board asks that you limit to five minutes. [00:52:08] Mr. Martin, if you would come up. is there anyone else in the audience that wishes to address the board this evening? Okay. Two. And is there anyone on Webex? No, sir. No one is signed up for public comments. Okay. So Mr. Martin, if you would start and then ma'am, you could, you would follow Mr. Martin. Okay. Mr. Owen, I apologize. [00:52:32] It's been a while since you've been here. Hi, good evening. Mr. County manager, chair of the board and board members. I'm John Owens of 6315 Millhiser Avenue in the Brooklyn district. I want to come tonight to congratulate you on a sort of recent plan to build a parking lot and a bus transfer station of sorts there at Parham Road and Broad Street for the Pulse bus line that might extend out that far. [00:53:04] So I think that's a great idea. I'm glad you're doing it. Reading in the paper, though, it sounds like you're adding three stations, one at Forest Avenue, one at Glenside, and one at Worcester. Well, I guess one in Parham, too, so four stations. [00:53:22] I would ask you that you consider adding an eastbound station at Morningside Drive as well, because that's, if you kind of look at the lay of the land, that's at the bottom of the slope. [00:53:37] You know, you have to walk uphill to go to the ones at Forest Avenue. And I think it would see a lot of use in that area, and it would be equitable with, you know, the stores and such in that area. [00:53:54] And so, yeah, you might also consider a westbound station at the Wawa there at Bremo Road, too. I know they're sort of trying to space them apart, but I think they would be useful and people would see a lot of use. [00:54:13] Thank you. Thank you, Mr. Allen. Yes, ma'am. As you now know, the Virginia Department of Health quietly went from requiring fluoride to recommending fluoride. [00:54:33] No one is required to follow a recommendation. Virginia Department of Health has said that Bentley Chan is making the decision to choose water fluoridation for Henrico. But the problem is that Bentley Chan did not know that he was allegedly choosing fluoride. [00:54:54] It would seem to me that the guys in the Henrico Public Utility Water Works have been bamboozled into thinking that VDH was requiring the waterworks to add fluoride chemicals into the water as a condition of the waterworks permit. [00:55:13] It would seem that no one but VDH knew that you could opt out of the water fluoridation program using the Virginia Administrative Code 12VAC 5-590-510 section E. It appears that the waterworks did not know that they could discontinue fluoride and still get a permit from VDH for they were allegedly misled by VDH into thinking that they were required to follow everything in the [00:55:53] permit. If fluoride was already written into the permit, then they thought they were required to add fluoride. How was the waterworks supposed to know that you can opt out of fluoride when fluoride language is already written into the permit? The only way one could possibly know this information is if VDH told them or if they regularly read the Virginia Administrative Code, including the [00:56:26] history. How is the waterworks supposed to know that Henrico should have had an ordinance in place long before adding fluoride chemicals into the community drinking water when language about fluoride is already included into VDH's waterworks permit. VDH is supposed to be the watchdog for the waterworks, making sure that everyone knows what they are doing and making sure that they are [00:56:59] following the rules and regulations. But instead, VDH is being a little bit of a trickster, in my opinion. In my opinion, VDH has done the waterworks dirty by not letting them know that water fluoridation for Henrico is optional. Furthermore, it would seem that Bentley Chan has been put in a bad position because he knows that he alone shouldn't have been making the decision to add [00:57:34] fluoride chemicals into the community drinking water. But Mr. Chan also recognizes that he alone should not be making the decision to discontinue water fluoridation. This is a problem that needs to be addressed immediately, for one man alone should not be making the decision to add fluoride chemicals into the entire community drinking water what's currently happening is wrong and [00:58:08] it's unethical henrico board of supervisors and the county manager please give bentley chan and the others at the waterworks the support that they deserve to fix this debacle as soon as possible Please help end this unethical practice of community water fluoridation in Henrico. [00:58:33] For one person, three people, or five people should not be making the decision to mass medicate Henrico residents with a neurotoxicant such as fluoride. It's simply unethical. [00:58:49] I'd like to say one more thing. There's an organization that, it's a nonprofit, that seems to follow me wherever I go. Virginia Department of Health is letting them know when I speak at the quarterly meeting, when I speak at the water advisory committee meeting, when I speak to people in the county. [00:59:10] They're running behind, acting like, in my opinion, that they're just an ordinary citizen that just loves fluoride in the drinking water. This is a very slimy move, in my opinion. One of the arguments that they make is that fluoride is natural, and because it's natural, it must be good. [00:59:32] This is a fallacy. Poison ivy is natural. Tobacco is natural. Lead is natural. Arsenic is natural. Mercury is natural, okay? So anyone who claims, well, we should be adding fluoride to the drinking water because fluoride is natural, Either they are idiots or they are bad, they're misleading you, in my opinion. [00:59:58] And I don't think this particular organization are idiots. I think they're doing it in order to deceive. The type of fluoride that goes into Henrico's drinking water, it is not quote-unquote naturally occurring fluoride, such as calcium fluoride, that you would find naturally in the ground. [01:00:15] The fluorine is toxic. Calcium is the buffer. When you have naturally occurring fluoride that's in the water, they are bound together. The calcium protects you from the fluorine, okay? Ma'am, I hate to do this, but you're a little over six minutes. [01:00:32] If you could wrap up, please. Yes, thank you for being graceful. So the type of fluoride that is in Henrico's drinking water, it's hydrofluorosilic acid. This is a waste product from the aluminum industry and from the fertilizer industry. [01:00:51] Every year, you get a water quality report from the waterworks. It is written there, black and white. They are not hiding this from the public. Okay, thank you. Is there anyone else that wishes to address the board this evening? Sir, yes, if you would go to the podium. [01:01:09] Good evening, county manager and the rest of the board. My name is Richard Flanagan, and my address is 7809 Kalua Drive, 23227. [01:01:33] And I'm here tonight to speak on behalf of my community, Three Fountains North Community and Three Fountains North Civic Association. We have a project hand-in-hand with the county doing water quality. [01:01:54] We have a lake in our community that surrounds our community. Well, our community surrounds the lake. And we have been trying to get this improvement done for quite some time. And the board, I'm sure, is familiar. [01:02:11] Well, in April, we did a groundbreaking ceremony in April of 2023, 2024. And we were all excited and happy that things were getting on the way. [01:02:28] Then started April, from April till August, there was no work being done. But since August, yes, they've done tremendous work. And we've seen a lot of things that has transpired, and they seem to be on schedule. [01:02:49] There's a couple of things that did come up, and one of them, without excuses, They say that the project will be delayed completion until maybe July. This is back, well, they told us it would be in May. [01:03:05] But now all of a sudden it's in July. Well, it is a consumption that oil and water does not mix. However, in reality, oil and water is always trying to mix. [01:03:22] So we're trying to mix with the county and the public utilities to get this project completed. and we don't want it to be pushed back any longer. We have a very large amount of seniors in our community, and they've been waiting and waiting and use a lot of patience. [01:03:42] So I just would like for the board to have some consideration and revisit this project so we can get it completed on time with any further delay. But I want to also say that Michael Outts has been tremendous. [01:04:01] He was put in a position to get this project done on the fly, and he's done a great job of that. And Mr. Terrell Hughes has been with him on that. So that's all I wanted to bring this back up to the county so that it can be done and completed for our neighborhood. [01:04:21] Thank you very much. Thank you, Mr. Flanagan and Terrell. I'm assuming you all have talked. Okay. Thank you. [01:04:37] We'll go as fast as we can. there anyone else that wishes to address the board this evening yes ma'am hello my name is Emily Waterbury and two years ago I came here for the for this for the [01:05:09] scout requirement can you help her with put that mic as close to her as you can thank you so two years ago I came here and working on a scout badge and after [01:05:33] After the meeting was over, I talked to Mr. Schmidt and we talked about a sidewalk so that I could walk to my library. [01:05:55] And he told me that I had to bring it up again. And so here I am. Great job. Great job. And I believe we talked about you were going to be there when we cut the ribbon on that sidewalk. Is that right? [01:06:12] Mr. Hughes, not to put a date on the spot, but the sidewalk that's being referenced, you were in this conversation as well outside. This is the one that connects that area of Glen Allen High School and the library and the Mormon Church. Do we have an update on timetables for those connection projects, or are we able to get that information to this young lady? [01:06:32] That would be great. So, one, I love that you remember that, and two, I don't want you to let us forget that because that conversation, that sidewalk's coming. You can see the crosswalk. [01:06:48] I think you see the crosswalk that's just gone in now across from Glen Island High School. Thank you very much to Mr. Hughes and the staff for that. And that's just a piece of it. It's hard enough to get it across a VDOT road, but the sidewalk connectivity is critically important. And if you would, again, accept my invitation that when we get that sidewalk piece in there, if you cut that ribbon, that'd be great. [01:07:07] Don't let me forget about that. I think you have my cell number. You're not going to let me forget about that. Thank you very much. Is there anyone else that wishes to address the board this evening? Mr. Chair, seeing no one, we move into the general agenda. [01:07:24] The first item is 45-25, which is a resolution. This is an award of contract for planning department renovation. This is a project in the Brooklyn District. I believe this renovation, Mr. Gresko, renovates an area that was original to the building, which was built in 78, I believe? [01:07:48] Yes, sir. Okay. Thank you, Mr. Manager, Mr. Chair, members of the board. This board paper awards a fixed-price contract for $1,348,028 to Woodland Construction Incorporated for the Planning Department renovation project. [01:08:04] The county received three bids on November 5, 2024 in response to ITB number 24-2762-10JL and addendum number 1. Based upon a review of the bids, Woodland Construction Incorporated is the lowest responsive and responsible bidder. [01:08:24] The directors of general services, planning, and purchasing recommend approval of the board paper, and the county manager concurs. I'd be happy to answer any questions. Thank you, sir. Any questions from my colleagues? I move the resolution. Is there a second? Motion made by myself, seconded by Mr. Cooper. [01:08:41] Those in favor say aye. Aye. Any opposed? Motion carries, Mr. Mayor. Next, Mr. Chair, 46-25 is the resolution for award of contract. This is for a main switch. in ats replacement at jail west which is in the brooklyn district mr gresco thank you again this board paper awards a fixed price contract for 493 581 thousand dollars to ebenezer electric llc for the main switch and ats replacement at jail west the county received two bids on january 9th [01:09:14] 2025 in response to itb24-2784-11jl and addendum number one based upon a review of the bids ebenezer electric llc is the lowest responsive and responsible bidder the directors of general services and purchasing recommend approval of the board paper the county manager concurs be happy to answer any questions on this one also thank you sir any questions from our colleagues seeing none i will move the resolution seconded by mr rogius does in favor say aye any post motion carries mr [01:09:52] measure next is 47-25 this is a resolution for award contract this is for electrical renovations at liby mill library which is in the brooklyn district mr gresco all right thank you again this board paper awards a fixed price contract for 274 750 to ace electric company incorporated for the electrical renovations at libby mill library the county received one bid on november 14th 2024 in response to itb24-2768-10jl and addendum number one based upon a review of the [01:10:30] bid ace electric company is the lowest incorporated is the lowest responsive and responsible bidder the directors of general services and purchasing recommend approval of the board paper and the the county manager concurs be happy to answer any questions on this one sir just one question whether being the single bidder was that in the range of of the budget for what we needed to get done yeah it was estimated at 300,000 um so it came in a little under and we've used ace electric in the past so we feel comfortable with the bid thank you sir any other questions on this item [01:11:04] i'll move the resolution second by mr roguish all in favor say aye any opposed motion carries measure next mr. chair 48-25 is the resolution this is for award of contract this is for an annual contract for concrete and asphalt rehabilitation county-wide and we have our director of recreation and parks mr. zanino i i rarely associate you with concrete and asphalt rehabilitation but floor is yours thank you mr manager mr chair members of the board so this [01:11:38] board paper awards a unit price contract to finley asphalt and ceiling llc for labor supervision materials supplies and equipment for concrete and asphalt rehabilitation projects throughout the county as needed and requested by the county the contract term is one year with the option for two renewals to the contract for two additional one-year terms the county receives six bids on november 12 2024 based upon a review of the bids finley asphalt and ceiling llc is the lowest responsive and responsible bidder first year's expenditures are estimated at approximately two [01:12:17] million dollars which may increase or decrease depending on the actual needs of the county the cost of each project assigned under the contract will be determined upon completion of the project by multiplying the unit quantities authorized by the county by the unit prices in the the contractor's bid. Funding to support the contract is available within the Division of Recreation and Parks budget. The Director of Recreation and Parks and Purchasing recommend approval of the board paper. I'll add this is a lot of trails, trails and parking lots. So with that, any questions? That was my question. You're usually the grass guy, not the concrete guy. [01:12:52] Any questions for John? All right, is there a motion? Moved by Ms. Roundtree. Is there a second? Second. Second by Mr. Cooper. Those in favor say aye. Aye. Any posts? Motion carries, Mr. Mayor. Next, Mr. Chair, members of the board, 49-25 is a resolution, authorization to submit application and signatory authority for a grant through the Virginia Department of Quality. [01:13:17] Mr. Hughes. All right. Thank you, Mr. Manager, Mr. Chair, members of the board. This board paper would authorize the Director of Public Works to submit grant applications to the Virginia Department of Environmental Quality, or DEQ, pay for outcomes, non-point source, pollution reduction pilot program, or the program. [01:13:36] The board paper further authorizes the Director of Public Works to execute agreements to secure grant funds from the program. The program allocates reimbursement funds ranging from $500,000 to $7.5 million per award on the number of pounds of nitrogen and phosphorus pollution removed or prevented. [01:13:56] The county has identified one or more projects that may qualify for the program. The Director of Public Works recommends approval of the board paper, and the county manager concurs. So, yeah, this is something we're looking at doing to, I guess, take some of the existing county funds that we have and do a project and then potentially get reimbursed at a 100% rate on it. [01:14:15] So that helps us multiply the funding that you provided us. Happy to answer any questions. That's great. Any questions for Mr. Hughes? Seeing none, is there a motion? Moved by Mr. Rogge, seconded by Mr. Cooper. Those in favor say aye. Any opposed? [01:14:31] All right. Mr. Manager, anything else? Mr. Chairman, no other business. Any additional comments from my colleagues? All right. Y'all have a wonderful rest of your Tuesday. Thank you. ---------------------------------------------------------------------- Coraggio Consulting ยท aguyonx.com
