Thank you. Let us pray. Gracious God, before we begin our county's [00:09:41] meeting, we pause to say thank you. We thank you not just for the day, but for all your many blessings. As we observe Women's History Month, we give thanks for the courageous women who have paved the way for progress. We remember their stories, both celebrated and unheard, and their immense contributions to society. We thank you for those represented in our leadership here as well as throughout our county and our nation and around the globe we ask you to continue to be [00:10:17] with us guide us and direct us bless the agenda and all that will be discussed here today we ask you to continue to lead our leaders in a pathway pleasing to you in your son jesus name we pray [00:10:34] amen thank you miss lee i'll accept a motion to approve the minutes of our february 25th meeting [00:11:14] Second. Motion made by Mr. Cooper, seconded by Mr. Nelson. Those in favor say aye. Any opposed? Motion carries. Mr. Manager. Mr. Chair, members of the board and those in attendance, I think Reverend Lee noted that March is International Women's Month. [00:11:34] And we do have some exceptional women that are leading Henrico County. But as background, March is Women's History Month, and since 1987, the United States Congress has authorized the President to proclaim each March, Women's History Month. [00:11:55] Every year sees a different theme for the celebration, and this year's theme is Moving Forward Together, Women Educating and Inspiring Generations. This is meant to highlight women who have dedicated their lives to leadership at all levels to lift up and encourage women of all ages and backgrounds. At Henrico County, we're incredibly fortunate to have thousands of women who exemplify this theme every single day. But I want to highlight just several, one of whom is actually my boss. So this past Saturday, Misty [00:12:34] Roundtree was recognized as a trailblazer in leadership representing Henrico County at the Atlantic A-10 Conference Women's Basketball Championship International Women's Day Panel and Networking Breakfast. Last year, she was recognized as a woman who drives Richmond by the Richmond Times-Dispatch and the Richmond Raceway. And here, I need to pause and also note that Deputy County Manager for Community Affairs Monica Smith-Callaghan and our own [00:13:09] Superintendent, Dr. Amy Cashwell, were part of the 2025 women who drive Richmond class. And they were celebrated last week as well. You know, these honors, among so many others, are why the women that Miss Roundtree, Monica, Smith Callahan, and our Superintendent, Dr. Amy Cashwell, the very meaning of moving forward together. [00:13:39] We're lucky to have them here. And, you know, I do want to take a moment, and this is at great, probably professional peril, and note some of the accomplishments of our supervisor, Misty Roundtree. [00:13:56] You know, in 2023, she was elected to serve as a three-chop magisterial district supervisor. In addition to serving the people in her district, she also serves on the Capital Region Airport Commission, Plan RVA Commission, Planning Commission, Board of Social Services, Local Emergency Planning Committee, and the Parks and Recreation Advisory Commission. She also still works as an attorney at the law firm she co-founded, Just Law PLCC, and serves as a guardian ad litem for children and incapacitated adults. If that wasn't enough, she is passionate about fighting for our environment [00:14:34] as she is for our civil and human rights and for all residents of Henrico County. Her experience in the U.S. Army has prepared her to lead at a moment's notice, and her commitment to acting as a guardian ad litem for our most vulnerable residents confirms that her capacity to care is overgrowing. [00:14:54] Notably, she's also a mom and stepmom to six wonderful children. I don't know how you can fit that into an actual day, but you managed to. Monica, you were recognized prior, and I just want to continue to thank you for your efforts that you continue to do on behalf of our county. [00:15:15] You and I have had many private conversations along the way, and I have confided in you that you are really on the staff, the heart of our leadership team. Mr. Chairman, I thought I wanted to take a moment to just express those sentiments. [00:15:33] Thank you, sir. The opportunity, Mr. Antri, I was there, and what a phenomenal job you did representing not only us, your calls, your interests, your desires, your passions. [00:15:56] So thank you very much for what you did on Saturday, and congrats on the recognition. As we move on in the agenda, I believe we move to Board of Supervisor comments. Any comments to my left? I have. We've got a couple Boy Scouts, a few Boy Scouts in the audience today, two of whom I think will be called upon by Supervisor Rogish. [00:16:16] But I have, from the Three Chop District, Adrish Benarge, I don't want to say it wrong, Benarge, with his father here today. And you guys, please come up. Adrish has been in the Boy Scouts, or a version consistent with age, for many, many years, and is aspiring to be an Eagle Scout like his older brother. [00:16:40] Come on up to this podium right here. So really glad to have them here today. And would you please share your name, what school you're in, your troop number, and what badge you're working on. Hello, everyone. My name is Audrey Banerjee. I am in 7th grade at Short Pump Middle School, and I am part of Troop 715. [00:16:59] I'm here to work on the citizenship and the community merit badge and to learn about how these meetings go. Wonderful public speaking skills already. Very nice. Thank you. And with the two individuals from Tuckahoe, please come on up. [00:17:19] Thank you, guys. Come on up and introduce yourselves. Tell us what troop number you are from and where you go to school and all that good stuff, what you're working on. So I am Owen, and I am from Troop 776 out at Gaten Baptist, and I am currently working on the citizenship in the community merit badge. [00:17:41] I'm Eli, and I'm in sixth grade, and I'm currently working on the community and citizenship merit badge with my brother, and I am at Gaten Baptist Church as well. Very good. Thank you, boys, for coming out tonight. I'm glad that, like Audrish, I am also still trying to figure out how these meetings work. [00:18:06] And how long they go. Anything else? I will only add, before we move on, that this county just completed another week of national television exposure. So we've seen it with the golf tournament that we've been fortunate enough to host for nearly a decade now. [00:18:24] And our sports and events center just came off a run of national television exposure with ESPN2, televised in the championship game for the A-10 Women's Basketball Tournament. And I think it just signifies to the folks in this room, to the folks that are dialed in, to anybody covering it, what this county can do and how well we showcase what our region and our county has to offer. [00:18:45] So I want to thank everybody that was involved in that because it's not a single department. It's our Sports and Event Authority. It's our Rec and Parks folks. It's our utilities folks. It's our works folks. It's everyone that's part of this county. It's our IT folks. Everybody has a piece of what goes on up there, including all of our public safety partners and our education division, because the arena was packed on either Friday morning, Friday morning, the arena was packed with school kids there experiencing a really heck of a game, actually, that they saw. [00:19:13] So, again, much thanks to this county, much thanks to this leadership, this board, for their vision to continue to put amenities like that here in our hometown. On that note, I don't see any media in the room right now to recognize if they were dialed in online today. Thank you for joining us. [00:19:29] Mr. Manager. Chair, members of the board, move into appointments. 76-25 is a resolution for appointment of member, in this case, to the Historic Preservation Advisory Committee. This board paper would appoint Patricia M. Eichenberger from the Tuckahoe District to that body for a three-year term that expires December 31, 2027. [00:19:50] Thank you, sir. Is there a motion? So moved. Motion made by Mr. Rogus, seconded by Ms. Roundtree. Those in favor say aye. Aye. Any opposed? Motion carries. And is Ms. Eichenberger here? She is not. She is not? Okay. She'll receive her oath later. [00:20:07] Mr. Chair, 77-25 is a resolution for appointment of member, in this case, the Parks and Recreation Advisory Commission. This board paper would appoint Marcus Jones from the Tuckahoe District to that body for a three-year term that expires December 31st, 2027. Thank you, sir. [00:20:23] Is there a motion? So moved. Second. Motion made by Mr. Ruger, seconded by Mr. Nelson. Those in favor say aye. Aye. Any opposed. Motion carried. Mr. Jones, if you are here, if you would come forward, sir, to receive your oath. [00:20:47] I will. [00:21:23] That is tradition. I love that. Thanks for bringing that out of our audience today. [00:21:39] Thank you very much. Mr. Manager. Mr. Chair, members of the board, we move into public hearing rezoning cases and provisional use permit. The first two items on the agenda are companion cases, and a deferral is requested to the April 8th meeting. Just as a point of information, this is Pandev LLC with a proffer amendment request and a conditional zoning request that ultimately would result in a convenience store with fuel pumps that are proposed. The second item is a request for a provisional use permit that would [00:22:15] allow for 24 operation of a convenience store at that location. Mr. Chair. Thank you, sir. Mr. i have nothing further to add other than the again the deferral is requested to april 8th for both the rezoning and the provisional use permit as the county manager stated thank you mr emerson is the applicant here branches representative of the applicant here all right well um i'm going to hope that the applicant is tuned in i'm going to go ahead and move on this deferral request mr emerson [00:22:49] this request came in today uh yes sir this request not today but we've had it for a couple of weeks my understanding is they're they're doing some title work on the properties and they need some additional time gotcha um before i move on this case this case was brought um past the planning commission in november if i recall mr emerson yes sir that's correct i offer them a deferral in december for a little bit more time is that right yes sir and then there's been a deferral request in february and a deferral request here in march i'm really looking forward to having the public have a chance to hear this case in april 8th so i would encourage the applicant if you dialed in [00:23:27] right now to please make sure this comes to a head in April. On that note, Mr. Emerson, I'm sorry, this is a public hearing. Is there anyone in the room who wishes to speak to this deferral? Anyone on WebEx? Yes, sir. I have one individual on WebEx who would still like to speak to the case. Awesome. Thank you. Go ahead. Mr. Michael Claiborne. Is there any way you can turn the volume up for us a little bit? Can you hear me? Yes. It's low. Thank you. This is actually [00:24:03] Alejandra Chavez his wife. I'm at 2602 Hollybrook Avenue. I understand that there's a request to defer this. I just want to state for the record my opposition to this development. My neighbors and I have been pretty outspoken about it in all the meetings how we view this as a danger to our community. I would also like to mention how we have shared with our friends about the county's pushed for this development. They have all responded how that is crazy and how that is dangerous because anyone who is familiar with our neighborhood is aware of just how much [00:24:41] of a traffic issue we have. So I just want that to be in the record. I don't agree with this. I oppose to it. And the last time that this was discussed, there was a comment about how the area was already zoned for a convenience store and a gas station. And I acknowledge that but i would like to mention that even if something is already approved even if something is lawful it does not mean that it is advantageous and in this case i strongly believe that this convenience store would not be of service to our community thank you ma'am anybody else on webex [00:25:19] no sir that's all i have on webex all right thank you i move that uh first of all thank you for the for the member of the public comment and it's part of why i i'd like to bring this case to an end we've been talking about this case for quite some time uh i'll move that rezoning case 2024-101-247-pandev-lc be deferred to the april 8th meeting of 2025 at the request of the applicant second motion made by myself seconded by mr roguish those in favor say aye aye any opposed all right motion carries mr emerson is the pup up next yes sir the pup would be the next action [00:25:57] all right thank you is there any uh any anybody in the room that wishes to speak to the defer a request on the provisional use permit anyone on webex there's no one to speak to this item all right thank you ma'am in similar fashion i'll move the pub 20 uh 2024 101250 pandev lc be deferred to the april 8th meeting at the request of the applicant second motion made by myself seconded by mr roguish those in favor say aye aye any post motion carries mr manager next mr chair agenda item 230-24 joseph b mccutcheon with a request to amend proffers the applicant [00:26:33] is proposing to amend a profit related to recreational space to allow for the development of a new single-family home. In this case, a deferral is requested for to April the 8th. Mr. Chair? Thank you, sir. Questions for Mr. Emerson on this case? Mr. Emerson? I have nothing further to add. The request is to April 8th, unless you have questions for me. [00:26:59] Yes, sir. Mr. Cooper? I move, Mr. Chairman, I move that. Oh, sorry. Thank you. I'm sorry, Mr. Cooper. This is a public hearing. Is there anyone in the room who to speak to this deferral anyone on webex there's no one to speak to this item thank you ma'am my apologies mr cooper sir ms shaman i move that rez-2024-100950 joseph b mccutcheon jr be deferred to the april 8th 2025 meeting at west of the applicant there a second second motion made by mr cooper seconded by mr nelson those in favor say aye aye any post motion carries next [00:27:39] mr. chair 346-24 aim transportation llc with a conditional rezoning request 14.03 acres located at the northwest line of mechanicsville turnpike at its intersection with st claire lane here the applicant is proposing a truck rental and maintenance facility point of information this item was deferred from the february 11th meeting mr chair thank you sir any questions um thank you mr manager members of the board this case was presented to you at your december 3rd meeting [00:28:15] and was deferred by the board to allow the applicant time to consider other and additional uses for the property in summary the applicant proposes to relocate their truck rental and maintenance facility from where they're currently operating just south of the site here to the current property and thus requesting to rezone it from b3 to m1c the applicant has revised proffer 4 to retain the allowance of several commercial uses on the site such as general retail restaurants grocery stores and pharmacies and these are listed under proper 4i in addition proper 4 [00:28:51] has been revised was before you tonight to state that any use such as a data center which is allowed today would be restricted to office and business zoning districts and all equipment would have to be within an enclosed building just a quick recap any such commercial uses that are now proffered back in would probably be located here where it says future development area the concept plan also notes a 100 foot buffer to screen the industrial buildings here and here as well as a 200 foot [00:29:24] setback for those industrial buildings from mechanicsville turnpike the 2026 conferencing plan recommends commercial arterial the site is also within the enterprise zone the proposed use are consistent with the zoning and pattern of development in the area and supports the goals of the enterprise zone program with the submitted proffers staff supports this request and the planning commission recommended approval at their november 14th meeting this concludes my presentation i'd be happy to answer any questions you may have this is a public hearing anyone in [00:30:01] the room wish to speak to this case mr chairman members of the board mr manager my name is andy conlin on behalf of aim transportation have with me dan fleming of of aim transportation i'll just just take a second just to describe a little bit. AIM Transportation, which is a Henrico business literally next door to this site, proposes the commercial vehicle leasing and service. And you quite frankly see a lot of the businesses that are customers that have a label of these commercial trucks that would be, I think, box trucks, delivery trucks, commercial vans that have the label of the [00:30:41] James River Petroleum, Feedmore, Goodwill Industries, Riverside Brick, for example, that provide for leasing of these vehicles from AIM Transportation, but also maintenance of those vehicles. So that's not their core business and they allow for AIM transportation to provide that service for them. They're currently using that property that's just south of this site. It's a 20,000 square foot building that's been repurposed for their use. It has four bays but it's very tight and does not allow for efficient use by driving through and quite frankly to provide for a safer work environment. They're asking to be able to build the same size building but more efficient [00:31:17] next door. This property is particularly challenging because it used to be a borrow pit, has a power line running through the middle of it, and is trying to be able to configure the use of this property that's been on the market for quite some time. But really, we're talking about two phases of development, being able to move an existing Henrico business for the first building, again, about a 20,000 square foot building. And the second phase would be to be able to provide for out parcels along Mechanicsville Turnpike to be able to provide the uses that are consistent with what the community would like with respect to restaurants and retail that would be permitted in today's zoning, but limited to 10,000 square foot building spaces [00:31:55] so that we can actually provide for local and small businesses that, again, to serve the community. So we'd ask that you follow the Planning Commission recommendation, the staff recommendation, and I would just note that this is, we believe, the best of all worlds by allowing a Henrico business to stay in Henrico, update a building, but also to provide for community service and support the community desires to allow for retail and restaurant uses in this area. [00:32:19] With that, I'd ask that you support this case, and I'll be happy to answer any questions that you have at this time. Thank you, sir. Questions at this time? Matt, can I ask a question, Mr. Chair? Sure. So the business, these trucks would be on this property as well as some commercial as well? [00:32:39] Yeah, so what the idea would be that the, thank you, Ms. Moore, you can see that where the two proposed buildings, There's one that would be replacing the existing one, and as they continue to expand their business, they would have a second one. Those would be secured areas where there would be a gate to be able to get into there. [00:32:55] That would only be allowed by their employees and customers specifically to come in there. And whereas, as Ms. Moore pointed to the left, there's a future development area that would also use this access, as well as potentially the out parcels in the front that would be able to access in front of the gate, per se. [00:33:12] That would be decided at the time of POD and how that would be designed. But that would be the intent, to be able to have those uses. These are all zoned industrial. It's a consistent use, literally next door, that's consistent with commercial, industrial, and its surrounding uses. And they work well together because we have proffered out a lot of the uses that otherwise would go into M1 that would be incompatible with those type of uses. [00:33:34] Thank you, sir. This is a public area. Anybody else in the room wish to speak to this case? Anyone on WebEx? There's no one to speak to this item. Thank you, ma'am. Mr. Cooper. Mr. Chairman, I move that RZ2024-102032 AIM Transitation LLC deferred to April 8th, 2025 meeting at the request of the board. [00:33:57] Thank you, sir. Is there a second? Motion made by Mr. Cooper to defer the case. Is there a date? Do we need to state the date for that? April 8th. Is it April 8th, sir? April 8th. April 8th. At the request of the board member, it's been seconded by Ms. Rountree. Those in favor say aye. [00:34:12] Aye. Any opposed? Motion carries. Mr. Mayor. Next, Mr. Chair, 78-25 is in the Brooklyn District Primrose School Franchising Company, LLC, with a proffer amendment request. Property is located at Staples Mill Road and Hungry Road, and the applicant is proposing to amend proffers regarding the conceptual plan, use restrictions, hours of operation, and architecture, all to allow a daycare. [00:34:40] Ms. Moore. Thank you again. As mentioned, this is a request to amend proffers accepted with C38C89 in order to convert a former pharmacy building for a child care facility at the southeast intersection, Staples Mill, and Hungry Roads. [00:34:55] The applicant is requesting to amend proffer 15, which currently prohibits child care centers, and amend proffers regarding the conceptual plan, elevations, and landscaping, and add new proffers addressing child care operations and screening. The original concept plan shown here shows two buildings, but only the northern portion was ever constructed. [00:35:18] This remains vacant and wooded. The concept plan has now been updated to show the outdoor play areas around here. The existing footprint of the building would remain substantially the same. The only other difference was there's three entrances now to the site. [00:35:38] This access here on Hungry Springs is proposed to be temporarily blocked up until a time that this area would develop and it would open back up. Landscaping would also remain the same with substantial buffers along all street frontages, but the proffers would be updated to list specific quantity of plantings required by transitional buffers 35 and transitional buffer 50. [00:36:06] Changes to the building elevations would include new windows and awnings along the sides and the rear. And the site, just for reference, is primarily surrounded by residential uses to the northwest and east, And two buildings are zoned 02 to the south across Anderson Road. [00:36:27] The applicant did hold a community meeting on February 6th, but no residents attended. But two people did attend the Planning Commission and voiced concerns about refuse pickup hours, as well as just general traffic. To address those concerned with the hours, in addition to supplementing the buffers with supplementing planters with transitional buffers, as just mentioned, The applicant also revised the hours for trash pickup from 8 a.m. to 6 p.m. [00:37:01] It was 7 to 7. And also proffers regulating the child care would be from 6 a.m. to 7.30 p.m. All other proffers accepted with the original 89 cases would remain. The 2026 comprehensive plan recommends commercial concentration for the site. [00:37:19] The proposed use is consistent with this designation, and the proposed amendments would not significantly alter the intent of the original proffers. Therefore, staff supports this request, and the Planning Commission recommended approval after February 13th meeting. This concludes my presentation. [00:37:36] Thank you, ma'am. This is a public hearing. Does anyone in the room wish to speak to this case? Is there anyone on WebEx? There's no one to speak to this item. All right. Thank you, ma'am. Ms. Moore, just really quickly, the hours of operation for the daycare is 6 to 7.30, but the parcel is 7 to 11. [00:37:55] Is that because of the back property, I'm guessing? That's correct, yes. And they met the trash collection hours of 8 to 6. Is that money through Friday, or is it seven days a week, 8 to 6? That is money through Friday. Awesome. And thank you for mentioning the community meeting. I appreciate this applicant having the meeting. I know no residents attended. [00:38:11] There's been some questions that we've fielded on my own, but I think we're in great shape. One last question, ma'am. turn lane off of Staples Mill into the property that's existing off of Staples Mill Road? Yes, yes, sir. So no improvements to the road or turn lane or have to be necessary here? No, sir. All right. Thank you, man. Appreciate it. Seeing no one in the room or on Webex to speak to this case, I appreciate the work of the Planning Commission and the Planning Department on this one. I move we follow the recommendation of the Planning Commission and approve the rezoning 2024-102740 [00:38:47] Primrose School Franchising Company, LLC, with the proffer state of February 26, 2025. Motion made myself seconded by mr nelson those in favor say i i don't know any post motion carries next mr chair 79-25 out of the three chop district is fayhead mahasis with a request a conditional rezoning request from a1 to r5ac general residence district this is a one acre parcel on the south line of cane road near its intersection with fry landing drive the applicant is proposing detached dwellings with zero lot lines miss moore thank you this [00:39:25] This request would allow up to five zero-lot line detached dwellings as an extension of the Short Pump Manor neighborhood directly to the east and further south, which is also zoned R5AC. The site is located at the western terminus of Manor Crossing Court with access through Manor Crossing neighborhoods, ultimately to Pouncey Track Road and Lees Field Farm Drive. [00:39:49] The applicant has proffered this conceptual plan before you, which was recently revised and it's included in the packet just handed out, to remove a notation that was previously shown to about a road extension toward Woodson Hills. And Proffer 1 now reflects the date of this new exhibit. [00:40:09] The other proffers would continue the streetscape improvements along Kane Road. That includes vegetation and a 5-foot sidewalk, 25-foot buffer and fencing. [00:40:25] and then also noting that this concept plan even though it notes temporary round it would be built to the same standards as the one to the eastern and have the exact same design standards from public works elevations have also been proffered showing a variety of home styles consistent with the surrounding area and the propers provide details regarding sidewalks garages front yard trees and building material similar to those accepted with the developments [00:41:00] throughout Bacova. The applicant held a community meeting on January 29th and five nearby residents attended. The main topic was the status of the cul-de-sac and ensuring that the roads would not be connected with this development. The 2026 Conferencing Plan recommends suburban mixed use with a density of up to four units per acre. The proposed development and overall density of 3.3 units per acre are consistent with the SMX designation and would be in keeping with the the character of the overall BCOVA development. Therefore, staff recommends approval of this [00:41:37] request, and the Planning Commission recommended approval at their February 13th meeting. This concludes my presentation. Thank you, ma'am. Questions from Ms. Moore? This is a public hearing. Anyone in the room wish to speak to this case? Anyone on WebEx want to speak? Yes, I have two individuals on WebEx. All right. One, Ms. Calaris, can now unmute. As well. Can you hear me? Yes, we can. [00:42:17] Okay, perfect. It sounds like the road extension has been removed from the request, so we have nothing else to add. All right, thank you very much. Thank you. The next individual is Bahayana, Mr. or Ms. Bahayana. [00:42:39] Yeah, hi, good evening. My name is Dixit Bahayana, and I am the resident of 12341 Menor Crossing Court. It is basically the home that is on the current cul-de-sac, and I moved to this home like six months back, And the reason I bought the home was primarily because it was on cul-de-sac as it was advertised. [00:43:01] And it is for the safety of my daughter, who is five years old. And obviously the community and neighborhood is wonderful as well. But that was one of the major reasons we bought the home for the safety of our daughter. And now if the cul-de-sac is moving, you know, ahead, you know, or it's getting extended, that would impact the safety plus the premium that I paid to get this home, you know, also goes away, right? [00:43:30] So I did raise this concern in one of the previous meetings when we did, when I actually kind of proposed from my end that we don't get that temporary extension to the other community later, plus don't, you know, extend this road, rather just, you know, extend this cul-de-sac so that the homes can actually be just around the same cul-de-sac, which is more extended, you know, or probably just expanded as such. [00:43:55] The circle could be expanded to have all those five homes instead of having this road extended and reducing the value of the home as well as again leading me to live in a home where I feel that my daughter may not be safe while the cars are coming through because there will be more homes. [00:44:12] Of course, the cars will be coming through more. So I did raise that concern, and I thought that the advanced engineering, who is a developer, and the other people who were there were going to make a change around it. [00:44:27] But I don't see that change when I just saw the presentation. So I want to raise that concern again. Thank you. Thank you, sir. Anyone else on WebEx? No, sir. That concludes the WebEx participants. Thank you, ma'am. [00:44:43] Any questions? I just have one question, Mr. Chair. Sure. On the picture, there is a home there. Is that being taken down? this one here yes ma'am on that well on the undeveloped property it looks like there's a house there 12-1-2-1 but then lot three kind of goes in between it so i was just curious correct so it's actually utilizing some reserved area from this section and then the rezoning is here so they would incorporate what's existing on that section along with this rezoning and i [00:45:20] imagine that would be taken down gotcha thank you guarding the um so the two issues that were primarily of concern at the community meetings. One, the question about the road extension cutting across those two cul-de-sacs there. The other one just mentioned by the gentleman speaking was the actual size of the cul-de-sac itself. The concern being he was hopeful to still be able to consider his property a cul-de-sac house, as it were. And there was some discussion [00:45:56] about, I guess, trying to enlarge the cul-de-sac a little bit so that more homes, I guess, could qualify or be considered to be a cul-de-sac home. Is there, so this, I know this is not necessarily to scale as far as the cul-de-sac is, but I'll get to the road in a second, but as far as the cul-de-sac piece itself, is that the same size as the community meetings or is that enlarged? [00:46:21] Was that enlarged? I don't have the answer to that. I just know that it's the same as the eastern and that's built here and to the requirements of public works has to have the easement and radius of about 41.5 radius. That's a requirement. Now, if it goes in larger, I think that would be up to the applicant to address because it would alter the number of lots. Does the applicant want to [00:46:44] address that, Bob? Good evening, Mr. Manager, members of the board. My name is Robert J. Babcock and i'm the developer of the bukova master plan community and so uh misty i i'm sorry i didn't [00:47:21] catch the question so this is the conversation that was had at the community meeting about the the cul-de-sac itself yes and whether um it was whether you guys looked into trying to enlarge that so that more homes could be considered on that cul-de-sac jeff um yeah basically this is just a preliminary rezoning plan our intention is to try to increase the size of the cul-de-sac to to achieve that that's our plan when we get into the development part okay so what's reflected on the schematic which from the schematic looks like I guess technically the cul-de-sac encompasses [00:48:01] lot one and lot five you're saying that that's not the actual that's not what that is actually going to be reflecting necessarily with us removing that future road extension um we didn't have time to get into the design part we're probably going to shift that cul-de-sac closer to the existing cul-de-sac location so that that's what our intent is with this okay um and then this non-cul-de-sac related so the um the road extension or the concern being that folks on [00:48:36] Woodson Hills Way did not want to have a road connecting those two cul-de-sacs across that parcel, which is represented by 12133. And that parcel is not subject to this case today, correct? That's correct. And the original schematics had a road drawn in, again, not as part of this case, but just demonstrating that that was potentially a connection that could be made at some point in a future case? [00:49:03] That's correct. And as I understand it, the applicant hearing that concern presented this new schematic, this new exhibit, which removes that delineation in the schematic. Is that right? That's correct. Now, to be clear, because I don't want anybody to be misled, at some point, as part of the case involved, any potential case involving 12133, the applicant in that case could request for that road to be included. [00:49:30] Is that right? They could incorporate part of the design. They would have to work with Woodson Hills and both of those. But it would have to come back with the same process you're going through tonight with a public hearing and with public input. And as it stands right now, are we aware of any potential? [00:49:46] I don't want people thinking there's something waiting around the corner to come and address that. Are we aware of any potential cases that are upcoming with that particular parcel? No, ma'am. Okay. And there's nothing required that would say that that road has to be there at some point? [00:50:02] No, it does not require it. Now, it may impact the amount of lots for Woodson Hills because you're only allowed to have 49 lots on one entrance, so it could restrict them in the future. But there's nothing that says it's mandatory or there's nothing that says they can't. [00:50:19] Thank you, gentlemen. Thank you. I don't have any other. Thank you, ma'am. We just had an opportunity to speak. This is a public hearing. No more questions, Mr. Andre. So I recognize the concerns. [00:50:37] I do think that the applicant, we're talking about an acre here, so there's only so much wiggle room that we can do to try to get some of these homes in this neighborhood. I do think good faith effort is being made and has been made to address the concerns. I'm all about transparency, so I wanted to make sure that folks understood that that middle parcel, you know, may be revisited at some point, but it is not going to be included in this particular case tonight. Thank you for all of the residents that came out and have made their voices heard either at the community meeting or through email or calls. [00:51:11] We received them all. With that being said, I do move that we follow the recommendation of the Planning Commission and approve REZ 2024-101-278 Fahed Mahasis with the revised proffers dated March 11, 2025. Thank you, ma'am. [00:51:27] Is there a second? Second. Motion made by Ms. Rountree, seconded by Mr. Cooper. Those in favor say aye. Aye. Any opposed? Motion carries. Mr. Manager. Next, Mr. Chair. public hearings other items agenda item 80-25 is a resolution this is for condemnation for an easement for countywide pedestrian signals the property in question is at pump road and old prescott road 10,700 old prescott road which is in the tuckahoe district miss bowen thank you mr manager mr chair members of the board this board paper authorizes condemnation proceedings for [00:52:04] property needed for construction of the countywide pedestrian signal pump road and old prescott road project the county needs to acquire a permanent sidewalk and traffic control easement containing 1,307 square feet across the property located at 10700 old prescott road identified as tax-backed parcel 741-750-6451 and owned by Richard J. Cannon. Based on the independent appraisal, the county made an offer of $7,890 for the required easement, but the parties have [00:52:44] not reached an agreement. This board paper authorizes the county attorney to institute and conduct condemnation proceedings in accordance with the Code of Virginia. This board paper further authorizes and directs the county manager to continue to seek a voluntary acquisition of the easement to take all steps necessary to acquire the easement and to enter on and take possession of the acquired easement's importance with the Code of Virginia. I will be happy to try and answer any questions you might have. Thank you, ma'am. This is a public hearing. [00:53:17] Anyone in the room wish to speak to this resolution? Anyone on WebEx? There's no one to speak to this item thank you very much mr rogers yeah we had a student uh hit across the street um from godwin last year at this location so i'm looking forward to a crosswalk solution here so uh some of the resolution mr chair motion made by mr rogers second and by miss roundtree those in favor say aye aye any opposed resolution cares mr manager next ms chair 81-25 is a resolution for signatory authority this is for conveyance of approximately 12.5 acres off urop road this is in the varina [00:53:57] district miss bowen thank you mr manager mr chair members of the board this board paper would declare a surplus approximately 12.5 acres of unimproved real property a pure road near the county's border with charles city county the board paper author authorizes the sale of the property to bottoms bridge environmental reclamation llc which will pay 156 250 for the property and sell wetlands credits to the county at a reduced rate the county can use the wetlands credits for various [00:54:32] county road projects the deputy county manager for community operations and the director of public works recommended approval of the board paper and the county manager concurs we'd be happy to try and answer any questions thank you ma'am this is also a public hearing anyone in the room wish to speak to this resolution anyone on webex there's no one to speak to this item all right thank you you ma'am motion made by mr nelson second by mr cooper those in favor say aye any post resolution carries mr manager mr chair members of the board uh we've moved into public comments those of you [00:55:08] in attendance this evening anyone that wishes to speak may do so from the back uh lector and the board does ask that you begin your comments by stating your name and address for the record and that you limit those comments to a five minute time period the first person i have signed up To speak is Ms. Sarah Ramsey. Ms. Ramsey, if you would come forward. [00:55:44] County Manager, Honorable Board of Supervisors, I am here to talk to you about consent. Last weekend, I was outside talking to a neighbor about the fluoride in the community drinking water. I told her that fluoride is not used to treat the water, but rather the person, for the purpose of making one's teeth harder. [00:56:06] I went on to explain that the FDA considers fluoride a drug when it's added to the water supply, which means that we are all being drugged without our consent. Turns out that this neighbor was very familiar with fluoride because she used to be a dental hygienist. [00:56:25] She told me that she was against fluoride treatments in her practice. Then she went on to say that she doesn't think the county's fluoridated water, she doesn't drink the county's fluoridated water because there is no such thing as a fluoride deficiency. I asked her if she was for or against community water fluoridation and to my surprise she said she was for the fluoride despite not ingesting it herself. I asked her why she was for the county mass medicating the public with fluoride against their will. She explained to me [00:57:05] that we must drug everyone in the community in order to target the poor people who don't know to brush their teeth. I responded by saying that I grew up fairly poor in the city of Richmond where we didn't have running water, electricity, or even food at times. And then when I was in my 20s, I lived in a tent and I lived in a tent on and off for two years. So I know a thing or two about being poor. My poor family didn't want fluoride in the water, and neither did my poor [00:57:39] neighbors, my poor friends, or the poor homeless that I've known throughout my life. In fact, we hated the local government for making it harder for us poor people to have to go out and buy fluoride-free water. But despite my rebuttal, my neighbor kept insisting that the county of Henrico must target poor people, particularly poor black people. It was at this moment in the conversation that I realized that she thought poor people were stupid people and stupid people [00:58:16] must be targeted with fluoridated water because they don't know that they need to brush their teeth every day. What's ironic is that fluoride lowers your IQ. So all those stupid people that she wanted to target with fluorinated water, we'll just keep getting dumber with every glass of water they drink. Even so, my neighbor insisted we must target poor people with fluoride. I thought she doesn't care what poor people want. So let me come, let me come at this from a [00:58:49] different angle. I said to her, shouldn't we have individualized medicine? Meaning if we have 100 people, if we have 100 people but only five people want fluoride, then just give five people the fluoride and leave everyone else alone. She didn't care. She said you must drug everyone in order to save the few. This is extremely disturbing for obvious reasons. This would be like saying let's start adding little blue pills into the public drinking water because 10% of the men who got [00:59:28] the COVID shots now have a floppy disk instead of a hard drive. If this sounds ridiculous, absurd, or slightly offensive, that's because it is. And so is the fact that Henrico is drugging everyone with fluoride for the less than 1% of the so-called stupid poor people who don't know how to brush their teeth. Lastly, the government has never established a safe level of fluoride. So please stop medicating the masses against their will with the hydrofluorosilic acid commonly known [01:00:07] as fluoride. I do not consent, not even a little bit, no matter how rich or poor I may be. Thank you. Chair, next speaker that we have signed up is Faradun Nurstani. Mr. Nurstani, are you here? [01:00:29] Are you on WebEx, sir? He is not, sir. Okay. Is there anyone on WebEx? There's no one to speak on WebEx. Okay. So I'm going to ask the folks that have lined up if the first speaker would come forward ma'am you in the uh woe vest yes ma'am my name is karen hamilton and i've lived in enrico county for every six decades which may be more than most of you supervisors and certainly more than mr vatolkas i just want to make some comments actually kind of goes in line with what [01:01:03] the young lady was saying about water you know the water crisis was really bad but you what you normally do is you pretend these things don't happen and once it does happen then as soon as as you can you you forget about it you but did you know that statistically speaking one in five houses in america is still unwell and septic and actually i think there are places where you don't realize that people might prefer considering what happened especially with the water crisis people might prefer to have their own septic and and and water systems i will say that because you [01:01:38] are most of you are new you probably aren't familiar with what has happened in western estates but western estates is a development that never should have happened and the houses were far too large to be on well and septic had can i just see a show of hands how many of you have ever lived on well and septic ah okay so you know maybe um and certainly mr newby i would hope you'd know as an intelligent man that you're not supposed to do more than one load of laundry a day uh but most people that in west it's actually nobody in western estates did their homework to see what is involved. They didn't call the health department. Nobody did any homework. The real [01:02:15] estate people didn't tell them what's involved. The developers who built the houses didn't tell them. Nobody told them and they didn't do their homework. So within, actually one gentleman who lived in West End States told me within two years his septic system had completely failed. Another lady told me that hers failed and she had to replace her septic system to the tune of $50,000. [01:02:36] So we're talking about a sizable amount of money. But again, I think a lot of people would prefer to remain on well water and something, especially when, again, what happened with the water crisis was horrible. But in line with that, the thing is, cane rica was already overpopulated. [01:02:55] And I can say that because I proudly, intentionally never got pregnant, never got married, because I recognize that. And so I want you to think about the Bible book of Genesis in the very beginning. our creator told adam and eve to fill the earth and subdue it those three little words very few people take that to heart but and subdue it meant cease stop control it that's not happening um we're having some issues that i read in the in the paper yesterday i guess it was or last couple of days we're having some issues with tucker high school having a lot of crowding they don't even have room [01:03:30] to sit down and eat at lunch apparently so there are fights going on um humans really aren't meant to live like this what scares me is that you have put all of these apartment buildings so close together if there's a fire they're all going down um i actually hate living in apartments i have done that um but um nowadays it's even worse because not do not only do we have people have bed bugs but smells people people who smoke marijuana how do they do that it's disgusting it smells like a dead skunk um it's just horrible i don't know how people i get on the bus [01:04:06] and it's just horrible um so i don't know how people do that but i you know when you're when you're in your home you want to have the peaceable enjoyment of your home whether it's an apartment or a house and you don't want to have to smell other people's foods cooking and the smells that comes from their food it can make you sick um perfumes a lot of people are we're living in a society when smells are or you know they can make you ill so having said all that i know that none of you will take that to heart but just i just had three three little words and subdue it thank [01:04:39] you yes sir if you would come forward good evening my name is paul momquist i live at 5406 edgefield street in the fairfield district and open transparency me and mr cooper were at a community watch for glenly back monday may 3rd and an issue came up about road humps road bumps road whatever's being installed in fair on on fenwick avenue now that caught a lot of people [01:05:18] that lived in the area including the relative that lives on lendover by surprise and they said what and i talked to mr hughes no mr johnson about it and he said that sharon snitger was told by a person who claimed to be an elected member of an HOA of Glenley area. I can confirm to you no such organization exists and no such election ever got held. And I request that somebody look [01:05:58] into the matter of someone going to the county buildings and protecting himself as something he's not because I feel those speed humps are not necessary at all and the design of the road is totally flawed. I also understand that their supervisors, Mr. Terrell Hughes, might be here tonight and I would wonder if it is he here. I would like to speak to you about this issue because as I understand it in talking to Mr. Johnson, it's already been approved for spring of 2025 with no input from the people on Fenwick and the person who's proposing it lives three [01:06:38] quarters of a mile or two-thirds of a mile up on North Battery. He is also the person that was responsible for the blockages at Springdale and Ravenscroft where the new apartment complex looks up and I hope anybody is viewing this video because I know this is going online he's my words there are people claiming to be something they're not to your detriment good afternoon folks y'all have a nice day thanks sir is there anyone else that wishes to address the board this evening [01:07:10] yes sir if you would that's all right actually why don't you come right on up here to the front It's a longer walk to the back. [01:07:28] My name is Rodney Bailey. I live at 1608 Blindover Road, Lappville District. I'm 87 years old, and I'm proud of myself being able to be here. [01:07:46] And I want to say that I was the head of the neighborhood watch in that area. The gentleman by the name of Buddy that was ahead of me, I don't remember his last name. [01:08:02] I took over as the head of it from him, and for about maybe eight years or so, I ran the meetings and so forth. Officer Alley can testify to that. He knows me very well. [01:08:20] I want to state that a certain person that's now running it is saying that he was elected to run it. That's Noah. When I left, I left it in his hands because he seemed to be the most capable person to do it. [01:08:44] I regret that decision. I have to say, I've lived there since 89. I moved up to Lindova Road. It's a very nice neighborhood, very peaceful, very quiet. [01:09:02] And I just would like to ask the one question. Was this speed hump thing put in the newspapers or on radio or on television so that the residents of the neighborhood, because most of the people out there are older people, people that have lived there since 55 or 54, some of them. [01:09:24] And I think it should have been announced a lot more before the decision was made to do this, allowing people that live on the streets to voice their opinion on it. Thank you very much for listening to me. I apologize for having to hang on to something. [01:09:42] Thank you, sir. Mr. Hughes obviously is here. I think he can help answer your questions with regard to the installation of the traffic calming devices. Thank you, sir. [01:09:58] Mr. Manager. Anyone else this evening? All right. Mr. Chair, seeing no one else, you'd move into the general agenda. The first item, agenda item 82-25. This is the annual receipt of the operating and capital budget estimates for fiscal year 2526 and notices of public hearings on the budget and proposed tax rates. [01:10:21] As a point of information for those in attendance that may not be aware, Board of Supervisors actually received a copy of the budget last week, and that was also put out on the county's website. It is the earliest, Mr. Crawford, that the budget office has ever put out on the budget. [01:10:40] my memory goes back a while so uh do you have anything else for as far as overview uh just real quickly uh as the manager noted this this is the uh receipts of the operating and capital budgets the resolution if adopted by the board does authorize the advertisement of both the budget public hearing which would be held on march 25th and the public hearings for the tax rates that support the budget that public hearing would be held on april 8th and then as then with one final [01:11:17] thing to add is that we will be meeting uh starting monday at 9 a.m to review the budget mine item by department as we do each and every year so with that as a brief overview i'll be happy to entertain any questions the board has at this time thank you sir any questions for justin Before we accept the motion on this resolution, I just want to echo what Justin just said, and I want to encourage the members of the media that might be dialed in to please extend some coverage to this jurisdiction next week [01:11:53] as we go through line by line an 800-page-ish. Including the non-numbered pages, you can round up to 800, sir. All right, that's fine. 700-plus pages. Again, I'll say this, Mr. Nelson has certainly done this longer than I have, but in the time I've been here, this is an endeavor of the people's business line by line. [01:12:14] And I would like to, in advance, thank the members of the media who cover it and tune in, because it will be available to the members of the public? Yes, there are open meetings. Live stream? No, they won't be live streamed, to my knowledge. [01:12:30] But they are public meetings. So I'd like to reiterate to the members of the media how important and thankful we are for that coverage. It is a public meeting, however, and members of the public could attend it? Absolutely. Similar to our work sessions? Yes, sir. All right, well, thank you very much. Again, I'd like to make that plea to members of the media to please follow along with what's going on. [01:12:48] Next week, we've got four-plus days of enthralling, I think, coverage in the budget. So is there a motion for the resolution? Motion made by Mr. Cooper. Second. Second by Mr. Nelson. Those in favor say aye. Any opposed? Mr. Mayor. Next, Mr. Chair, members of the board, 83-25 is an introduction of ordinance. [01:13:07] This is to change utility charges by amending and reordaining Section 23-361. This is all for water and sewer charges for next fiscal year. Mr. Chan. Thank you, Mr. Manager. Mr. Chair, members of the board, good evening. [01:13:23] This is an introduction for advertisement and a public hearing on April 8, 2025, for a proposed ordinance to change utility fees and charges to be effective July 1st. The ordinance would increase bi-monthly service and volume charges for water and sewer. [01:13:40] with the total increase in water and sewer charges for the median residential account holder using 10 ccf of water every two months to be seven dollars and 35 cents or approximately 12 cents per day the changes are recommended to support annual operating debt service capital and capital costs associated with water and sewer projects with that i'll be happy to answer any questions that you may have thank you sir is there a motion so i'm sorry is there any questions still move but a motion made by mr nelson is there a second [01:14:19] a second by ms roundtree to move the introduction of the ordinance those in favor say aye uh any opposed motion carries next mr chair uh 84-25 is a resolution for award of contract this is for employee health services miss george good evening members of the board um mr chair This board paper would award a contract to Bonds Corps Mercy Health Employer Services, LLC, DBA, Bonds Corps Occupational Health, to provide employee health services. On January 24, 2023, the board authorized condemnation proceedings to acquire the right-of-way and easements. On March 1, 2023, the county filed a certificate of take and deposited $6,000 with the clerk of the Henrico Circuit Court to acquire the easement. On August 24, 2023, the county filed [01:16:28] a petition for condemnation to institute proceedings to determine just compensation in accordance with the state law. Following negotiations between the parties, the owner is willing to accept $12,000 as just compensation for the easement. Upon completion of the acquisition, the condemnation proceedings will be dismissed. The deputy county manager for community operations recommends approval of the board paper, and the county manager concurs. I'd be happy to answer any questions if I can. Thank you, ma'am.
