For the first one, I would like to invite Angela Ennett to the podium and any family members that you would like to have come forward as well, Ms. Ennett. So for those in attendance and those that are watching, as September the 15th through October the 15th [00:12:44] celebrates Hispanic Heritage Month and many diverse Hispano-Latino communities, we recognize the contributions of individuals from Henrico County, elected officials and employees to community members and businesses that are integral to the way we govern, live, work, and play. [00:13:05] Inclusion, courage, communication, leading self, leading others, and leading the organization are integral to how everyone at the county can ensure everyone in the county can thrive. This is demonstrated through internal collaboration and input as well as partnerships and education to meet today's needs while prioritizing tomorrow's future. [00:13:30] The ongoing celebration of Hispanic-Latino communities includes programming, events, and information available for everyone. Visit Henrico.gov to learn more from Henrico Area Mental Health and Developmental Services, libraries, recreation and parks, and multicultural engagement. [00:13:49] To bring remarks on behalf of Hispanic Heritage Month, Angela Ennett is a co-founder of the Panamanian Traditional Dance Group RVA, which leads dance education, engagement, and celebrations welcoming everyone to experience Panamanian heritage and culture. [00:14:11] Angela, the floor is yours. Thank you so much. And yes, thank you, Mr. Manager John Witokas. Good evening, Mr. Chairman, Mr. Smith, members of the board, guests, and attendees. My name is Angela Enet. [00:14:27] I was invited to bring remark in a recognition of Hispanic Heritage Month as a Panamanian community leader. My organization, the Panamanian Traditional Dance Group, RBA, was created to share significance of our cultural traditions. [00:14:45] Through dance, we are passing down histories and visual stories everyone can enjoy. Henrico is an inviting place for the Panamanian community, where I feel we are welcome and belong. [00:15:02] This summer, we host our second annual Panamanian Picnic International at the Chrome Park, where people come from all over to dance along with us and eat meals we prepare for them. [00:15:18] Some of my families have joined me here today as my husband, my son, the other co-founder, Ms. Jackie, from the group, and the dancer, Ms. Xiomara. We value our relationship with the county and look forward to many ways to be part of our county's office. [00:15:39] Thank you the Board of Supervisors and County Managers for your leadership that create a welcoming place that celebrate and recognize all Hispanic Latino community. Thank you so much. [00:15:56] Chair, my second comment this evening, I'm going to ask Dennis Bickmeyer to come forward. So for those of you in attendance, Dennis has a, goes by a nickname, a moniker, if you will, Showtime All the Time. [00:16:21] He is the first director of a sports authority in the Commonwealth of Virginia. He is internally, we refer to him as the real deal, often copied but never replicated. And so I am pleased to share that Dennis Bickmeyer is the recipient of the Charlie Busser Award for Attraction Employee of the Year. [00:16:45] This was presented by the Virginia Restaurant Lodging and Travel Association, and he received the award last night. This award recognizes individuals for their extraordinary contributions and commitments to their communities. Dennis and his team are leading our mission of bringing sports and entertainment facilities and events to the county. [00:17:08] Under his leadership, the Henrico Sports and Events Center has hosted graduations for nine high schools and 2A centers, as well as welcoming the localities of Hanover County, Caroline County, and King William County for their high school graduations. [00:17:24] The center will be adding New Kent County in 2026, bringing the total to 18 graduations next year. In addition to high school graduations, our center has hosted an incredible array of events, including the fantastic A-10 Women's Basketball Championship, the National Wheelchair Basketball Association, Next Pro Puma Boys Basketball Tournament, and Big Shots Basketball Showcase, and many, many more. [00:17:54] We had a work session earlier with the board where we were noting just the revenue impact that sports tourism has had on our county specifically from this new venue but dennis bickmeyer i remember when we first had a conversation about what if you were at the racetrack and you have been a blessing for our county and everything that we have done in sports and entertainment so congratulations my friend thank you thank you mr manager [00:18:30] members of the board deeply honored and humbled by the recognition I've got to keep repeating this, though. It's a team award. It's not a me award. We're blessed with some great professionals at the Sports and Entertainment Authority and some great partners that are department heads around this room and their staffs. [00:18:50] And we can't do what we do without the great relationships we have, and certainly with Rec and Parks and a lot of our other regional partners like Richmond Region Tourism. But certainly as we look at the Sports and Events Center and everything that we have going on in sports tourism, The vision starts here, so we're very appreciative of this board, those on the board now and those that came before you to see the vision and what sports and entertainment tourism can do here for our county. [00:19:16] I'm also breaking news here really quickly. Virginia Tourism Corporation released their economic impact numbers for the localities. Henrico is once again the fifth largest in visitor spending in the Commonwealth of Virginia. [00:19:33] in 2024, $1.9 billion in visitor spending. And that information will be released tomorrow. Obviously, it's released now, but more information will come out tomorrow. How's that? But again, just we're making an amazing impact here in our county, here in our region, and throughout the Commonwealth of Virginia. [00:19:53] And again, thank you for the recognition. I appreciate it. Thank you. Chair, I have no other comments this evening. Thank you, sir. Any comments from my colleagues? Seeing none, we will move on. [00:20:13] I want to thank Ms. Leanna Hardy again. I see you, ma'am, from the Henrico Citizen is here. I do not see any other members of the media, but if you are tuned in online, thank you very much, ma'am, for your time, and thank you for the coverage. Mr. Manager. Mr. Chair, we would move into appointment. [00:20:30] Agenda Item 225-25 is a resolution for appointment a member to the Economic Development Authority Board of Directors. I do have for your consideration a substitute resolution for this appointment. The substitute clarifies that the term of the appointment begins on October 1, 2025, and ends on December 31, 2028. [00:20:52] I've labeled the substitute resolution item 225A-25. Thank you, sir. I'll entertain a motion on the substitute. 25A-25 for item 225-25. [00:21:10] Is there a second? Second. Motion made by Mr. Roundtree, seconded by Mr. Cooper. Those in favor? Aye. Any opposed? All right. The ayes have it. now unless there's any discussion i'll entertain a motion to approve the resolution 225a-25 mr chair i move we approve resolution 225a-25 second motion made by mr roundtree seconded by mr roguish those in favor say aye aye any opposed motion cares so um mr chair members of board that resolution appointed from the three chop districts of own sampson to the economic development uh [00:21:45] authority board of directors for a term again that commenced october 1st 2025 are you here [00:21:53] if you would come forward ma'am mr chair members of board you move into public hearings rezoning [00:22:51] cases you have three items for your consideration this evening the first item agenda item 195-25 out of the verona district is harsh thacker this is a case where the applicant proposes a single family subdivision this was deferred from the august 12 2025 meeting for decision only mr emerson thank you mr manager mr chair members of the board as noted by the manager this case was deferred by the board on august 12th to this evening for decision only in summary the request is to [00:23:24] conditionally rezone a 36.118 acre site from a1 agricultural district and c1 conservation district to R5AC General Residence District and C1C Conservation District. Proposed changes involve the development of 17.21 acres for residential purposes, and an increase in C1 zoning from approximately 15.5 acres to 18.9 acres. [00:23:51] The surrounding area consists of primarily A1 and C1 zoning, with residential uses located to the west and south. Proposed development aligns with the comprehensive plan, which recommends suburban residential one zoning with a maximum density of 2.4 units per acre. [00:24:07] The development density of 1.35 units per acre is consistent with this designation, and the Planning Commission has recommended approval of the request. The only change to the case since the board deferral is the applicant's submittal of a preliminary jurisdictional determination by the Corps of Engineers confirming the wetlands consistency as shown in the conceptual plan. [00:24:30] If you have any questions, I'll be happy to try and answer them. Thank you, sir. Are there any questions for Mr. Emerson at this point? All right, seeing none, this is a public hearing. Mr. Newby, since we deferred this for decision only, do we go back for public comment? [00:24:47] No, sir, there's no public comment this evening, sir. I just want to make sure. Thank you very much. Nelson. Yes, sir. I just wanted to just review a couple things from the case. Ms. Emerson already said 49 homes, 36 acres. [00:25:05] I think previously it was 14, I'm sorry, 15 acres of, well, I can't remember what it was, no, whatever. The rezoning was 17R519C1, so added three acres of C1 to this particular rezoning, 1.36 homes per acre, which is slightly over what that right is, A1 is one home per acre. [00:25:40] But this is more of a clustered piece, 36, I'm sorry, 49 homes on 17 acres. The case has been worked by both staff and the developer commission recommended it. Some of the concerns, well, previous proposals, it started off being 103 units, 42 single-family, 61 townhomes. [00:26:06] Then it was reduced to 81 single-family. Then we got it down to 49 homes. Some of the issues that we heard from the citizens, traffic complaints, being close to the floodplain initially, just neighbors not wanted it. [00:26:35] I don't want to say not in my backyard, but just neighbors wanting to keep the community the way it is. One entrance was brought up even though the community didn't want two entrances, so some of them did not want a second entrance coming through their neighborhood. [00:26:53] That's the reason that it was one entrance. But after the Texas flooding, the one entrance was brought up as a potential challenge. We have many communities that are one way in, one way out. [00:27:15] My current residence is one way in, one way out. And so there are many of those in the county. That's not anything that's novel that we've not allowed before. There was support. [00:27:34] There was opposition. And the petitions that I got were really for both projects. And I'll speak to that in a minute. More people signed the Jim Capitol, which is not this case, but one that is upcoming. [00:27:54] But there is opposition to this case as well, as well as support. And I've gotten in more support letters over the past couple of weeks. The floodplain was a challenge for some of the community. [00:28:13] But you heard, Joe, again, if you don't mind, Mr. Emerson, tell me what, explain to the citizens what came in from the, you say, the Army Corps of Engineers? Yes, sir. Yes, sir. The Army Corps of Engineers, if we go back to the conceptual, has confirmed the wetlands delineation as being correct on the plat in front of you. [00:28:38] All right. Thank you. As it relates to schools, the elementary school and middle school capacity, as it relates to the impact of this project, was good. [00:28:55] We're getting close to, we have functional capacity right now in Highland Springs, but anything that we do near and around Highland Springs, where I think we're about 175 students away from being at capacity, so need to be conscious of that over the next couple of years. [00:29:14] This has just been a hard case, you know, for me, because I cannot just look at these cases, you know, individually. I've got to look at it over the total construct of what we're doing, not just in Highland Springs, but in the district and in the county. [00:29:40] So it is weighing. and I want to just clear this up to be fair somebody somebody and I can't remember who said that the developer was a DC developer the developer did prove that you know they the developer moved his family immigrated here when he was two and went to Echo Lake Moody Middle School and Rico High School and the company is registered in Richmond it's hard because on [00:30:18] one hand you have the community the community doesn't want it um they feel it's unsafe there's going to be a lot of traffic and they some of them want to keep their quiet neighborhood now i did meet with a small group of citizens after the last meeting and um you know dug a little deeper into some of that you know i did uh chuckle at one of the comments i don't know trying to see if my guys here he he he was uh saying he didn't want to live beside a hoa um because those hoa people can be [00:30:53] kind of difficult sometimes and i was like jeez i live in three hoa so far so i didn't know that i didn't know we were we were difficult um you know and so you have this case but on the back of it is another case where there's also a rezoning literally right next door to this particular property so it is hard to look at this one case in isolation that you really got to look at both [00:31:25] of them and and and both have reduced the again the dorado case from 103 to 49 that's pretty much cutting it in half the jim cap case at this point started off at 130 now it's down to 95 you add them up though you still have 150 units so you gotta kind of look at them together still thinking about you know affordable housing though quality affordable housing thinking about rights [00:31:59] of the property owner you know family we received a letter this week from the family um and they they want to sell their property and i wrestle with this in varana you know because property owners have some rights, too, and they also have dreams and aspirations for their families, and some have kept the land and their family for decades. [00:32:28] There is a piece that was approved last year, the Y, Maggie Walker Land Trust, Children's Home Society of Virginia, they have a mixed-use piece, which has some townhouses for homes Homeownership, 22, but it also has apartments, has an early education facility on the Sprout School, and some commercial. [00:33:00] So I was looking at that when maybe that could be a balance for some homeownership in the moment. Again, hard case that I have wrestled with and going back and forward about it. [00:33:19] And, you know, it's been tough, honestly. I feel like either way, there's a case that has been made. But, Mr. Chair, I'm going to move that RAZ 2024-101-760, Dorado Capital, LLC, be denied. [00:33:46] Thank you, sir. Is there a second? The motion has been made by Mr. Nelson, seconded by Ms. Roundtree. Those in favor, say aye. Any opposed? Thank you very much, Mr. Manager. Next, Mr. Chair, members of the board, out of Fairfield, agenda item 226-25. [00:34:05] RJM Land LLC with a conditional rezoning request from A1 Agricultural District to R5BC General Residence District parcel containing 7.7 acres located on the east line of North Wilburnham Avenue near its intersection with Creighton Road. Single family development is proposed. [00:34:28] Ms. Moore, I understand that a deferral has been requested in this case to October the 14th. That is correct, sir. Mr. Chair. Thank you, sir. Knowing that there's been a deferral request, did you say October 14? Yes, sir. [00:34:44] All right. Thank you. Any questions at this time? All right. This is a public hearing. Before we move this item, is there anyone in the room that wishes to speak to this deferral? Is there anyone on WebEx? There's no one to speak to this item. [00:34:59] All right. Thank you very much, Mr. Cooper. Mr. Chairman, I move that REZ 2025-100597 RJM Land LLC be deferred to October 14, 2025 meeting at the request of the applicant. [00:35:17] Thank you, sir. It's been a motion made by Mr. Cooper. Is there a second by Mr. Nelson? Those in favor, say aye. Aye. Any opposed? Deferral carries. Mr. Mayor. Thanks, Mr. Chair, members of the board. We move into the three-chop district with 227-25. Before you is North Atlantic Holding Incorporated and PNF LLC with a proffer amendment request. [00:35:39] The proffer amendment request would be related to access. Ms. Moore. Thank you, Mr. Manager, members of the board. The subject property has been used as an auto dealership since 1990 and was expanded to include the rear portion here along Skipwith Road, and it was rezoned to B3 in 2016 with case REZ 2016-00044. [00:36:04] The proffers of that case allow the use toward the rear to be only used for inventory for the auto dealership and also limits the access to a gated access from Skipwith Road only, and that's particularly with Proffer 15. [00:36:24] This request is to amend only Proffer 15 to allow full vehicle access to the site from Skipfoot Road. The property would still be used as an auto dealership, and all the other proffers accepted with the previous case would remain unchanged. [00:36:39] And that includes a prohibition of loading and unloading inventory cars on Skipfoot Road, and also requires to maintain or build a 25-foot buffer plant to a transitional buffer 25 with a wrought iron fence. [00:36:58] The surrounding uses, one of the reasons that was put in place is this has transitioned over time from primary to residential to commercial. This last remaining piece, when the 2016 case was approved, was still a portion of that was residential, which has since been rezoned in 2018. [00:37:17] with the remaining proffers in place staff believes that proposed amendment would not adversely impact the surrounding area and would allow full use and improvements along this portion of skip with road staff supports this request and the planning commission recommended approval at their august 14th meeting and that concludes my presentation thank you ma'am any questions for miss moore there's more i know i haven't received any opposition to this planning has not as well that's correct no other questions this is a public hearing is there anyone in the room that wishes to [00:37:52] speak to this case is there anyone on webex for this case there's no one to speak to this item thank you ma'am mr. chair i move that rez 2025-101462 north atlantic holding inc and pnf llc be approved with the proffers dated june 13 2025. second a motion made by ms roundtree seconded by mr roguers those in favor say aye aye opposed motion carries next mr chair members of the board you move into public hearings other items 228-25 is an ordinance this is for a vacation of building [00:38:28] line in the westview subdivision which is in the brooklyn magisterial district mr anthony yes sir thank you mr manager mr chair honorable members of the board ladies and gentlemen this is a request to vacate a 25-foot building line located at 914 sabbath street the owners have requested this action in order to make improvements to their front porch. [00:44:25] Thank you for giving us the opportunity to speak. Today, we are over here with the behalf of 550 community members who have signed a petition requesting badminton facilities in Henrico. [00:44:43] Badminton, as most of you may be knowing, is an Olympic sport popular across the world and growing rapidly in our community. last five to ten years. Right now we only have access to a couple of facilities of Henrico County such as Deep Run Recreation, Eastern Henrico Recreation Park for a couple of hours in a week. And these spaces are overcrowded and sometimes unavailable due to the other commitments of the Recreation Center and other programs. Today we have almost 500 players [00:45:21] within the Henrico County area who want to play on a weekly basis. We have discovered that Henrico County went ahead and invested a lot in sports, as Mr. David was articulating earlier, with $4.4 million allocated to pickleball in 2024, $1.1 million to the other sports. [00:45:45] It's a great investment, great achievement that the county made. So we are requesting if we can have more equity and inclusion for badminton as a sport, too. Badminton is a professional sport and not a recreational one. [00:46:01] The players are not able to spend enough time to sharpen their skill, just like the tennis, pickleball, basketball. It acts as a launching pad for the next generation with the multiple university ecosystem in and around Henrico County whose graduates come in and play. [00:46:19] there are people who actually go to Washington DC or to Charlotte area or the Asheville area to go ahead and play because they don't have anything available or even if it is for a couple of hours during the week it is overcrowded. So I'm sorry I apologize we are requesting the Henrique County to look at some option that can be dedicated for badminton as a sport or a facility. [00:46:50] And our community over here, whom I'm representing right now, they are ready to co-invest in this revenue-generating opportunity for the community and Henrico County. I'll be more than happy to answer any question that the chair or the board members may have. [00:47:10] Thank you, sir. Next, Mr. Chair, Sean Welsh. Sean, are you here? Are you on WebEx? He is not, sir. Okay. We move on to Tyrell Felder. [00:47:29] You here, sir? Ma'am? If you would go to the podium in the rear of the room. Good evening. I stand before you no longer as just a concerned member of our community, but as a terrified husband, father, and neighbor. [00:49:44] To start out, this is touching base on a dangerous situation growing in our neighborhood Hill and Dale community, a recovery business, not business, house, they say. My wife and I have lived at 903 Turnbull Avenue across the street from 904 Turnbull since 2020. [00:50:00] We loved the safety and security of our quiet home in the cul-de-sac, the seven-house cul-de-sac, I'll add, enough to start our family welcoming our twin boys in May of 2024. In March of 2025, 904 Turnbull Avenue sold. By May, there were packages arriving on the front porch by the hundreds. [00:50:19] At this point, we had our suspicions but had no idea what was actually going on. In early June, the first of the vans labeled So Bright Recovery came speeding down our once-quiet cul-de-sac, pulling into the front yard, yes, the front yard, not the driveway, of 904 Turnbull. [00:50:35] When we looked them up online, we found a picture posted to their Instagram page taken from their living room with our house and my truck in the background. Under the post, it states, the men So Bright Sober Living House has opened. To this day, neither myself nor any of my neighbors have heard anything from this company that claims to provide a safe recovery environment for those struggling with substance abuse. [00:50:59] They gave no notice they'd be joining our neighborhood. They have not introduced themselves or tried to fit in with our community at all. They have, however, let us know they are here in other ways. There are eight individuals living in this property at any given time. Every single one of them appears to come and go whenever they please. [00:51:16] None of them have their own car. So our cul-de-sac has become a highway of taxis, Ubers, Uber Eats, DoorDash, medical transportation vans, friends and family, and last but not least, their Sobrite recovery van that lays on the horn every single morning, letting them know they've arrived. [00:51:32] That's not very fun with twins at home. Let's see. I'm not talking once or twice a day. This is upwards of 30 to 50 times a day these cars are flying down our cul-de-sac. My children no longer have a cul-de-sac to play in. [00:51:50] Instead, they get to collect the hundreds of cigarette butts flicked into our front yard in my truck bed. They get to watch the police show up and block off the entrance to our street while EMS loads one of the residents into the back on a stretcher. And now, instead of my wife and children getting to go on walks around the neighborhood during the day, they get to watch these individuals walk shirtless throughout our neighborhood, arguing on FaceTime as they cut through our yards to get to the store. [00:52:13] all while they hide inside afraid of the new violent tier three sex offender who just moved in with them. A sex offender who was sentenced to 20 years in prison for taking indecent liberties with children but all but two years suspended under a plea agreement. I'd like to state that I myself am a recovering alcoholic. I'm four and a half years without a sip of alcohol and I fully sympathize with these individuals and I understand the need for a facility like this. Huge emphasis on facility. This is no longer a home in our neighborhood. This is a business. These guys get to come live in our neighborhood for a couple of weeks to a year at a time and then move on, [00:52:51] which means while they get to come here and hopefully recover, we are left with a continuous cycle of recovering addicts and violent sex offenders constantly in and out. All it takes is for one of these individuals who we know nothing about to slip up and do something regrettable. My wife and I no longer feel safe in a home and county we once loved. My neighbors, many of whom are here with me tonight are rightfully outraged on paper this might be a recovery house but the reality is this is a dangerous poorly managed business playing roulette with our safety thank [00:53:22] you thank you sir mr i'd like to make uh just a quick comment um on it and i think as most of you know i think you notified us i want to say last week or within the last no more than sort of two weeks ago about this i had no idea what was going on over there um i think our deputy county manager Mr. Finemail has, if you've sent an email in or if you've called, hopefully he's gotten back to you. There is a new code section that went into effect, and I have it here, 372-431.1 [00:54:02] that went into effect this year to make it a class one misdemeanor to advertise as a recovery home and not have a conditional or an actual license. So we do have some new tools, I think, in the toolbox to potentially address some of this. Obviously, people have a right to live and as you said recovering addicts is a very important piece of it is is to be in a home sounds like what they're doing may not be that way and um i can assure you that this county myself and i know our deputy county manager mr feimel will take action what we can do thank you [00:54:36] guys for coming out thank you sir thank you sir next mr chair members of the board uh jonathan ward mr ward are you here good evening members of the board my name is jonathan ward and i live at 6021 Glen Abbey Drive, Glen Ellyn, Virginia 23059 in the Wyndham community and a proud Henrico resident. [00:55:15] I want to share my initial concerns about the H.H. Hunt data center that's proposed just over the Chickahominy River in Hanover County and a property that is, for all intents and purposes, adjacent to the Wyndham community. I speak on behalf of only myself, my wife, and my three-and-a-half-year-old son and do not represent the Wyndham Community Foundation. [00:55:36] I want to begin by acknowledging Henrico's leadership. Your leadership on data center regulation, I think, should be the standard for other localities to emulate. You seem to have balanced economic growth with health and environmental and quality of life protections. [00:55:52] And you've been transparent as to how you will use the economic benefits to offset the cost of housing for the people who need it the most. I sincerely hope that Henrico County officials follow your leadership in that manner. The HH Hunt project, adjacent to Wyndham, as reported, would place a 400-acre, 10-building data center campus and fleets of diesel generators directly against our community and within one mile of Shady Grove Elementary School. [00:56:23] This raises three concerns for my family. One is health, and the science is clear that the exhaust from emergency diesel generators increases and directly contributes to higher rates of asthma, harms children's lungs, and otherwise worsens and prolongs hospitalizations should they occur. [00:56:42] I am a veteran who served in Afghanistan, and I am on the burn print registry, just as many of my other service members are who served in Afghanistan and other conflicts abroad. So I know firsthand, and we all know firsthand, what long-term exposure to ambient air pollution does to children and to populations and to service members. [00:57:06] Our children should not be collateral damage in this situation against the ambient air pollution from a data center across the Chickahominy. Two is fairness. Hopefully, we do not end up like this. Hanover collects the tax revenue, and RICO absorbs the pollution, the traffic, and property value decline. [00:57:27] Another instance, one county profits while another county's family members pay. And finally, Hanover gets the benefits from the data centers, while Henrico's kids get the asthma. Three is process. [00:57:44] There should absolutely be an open, multi-jurisdictional consultation on the broader project across the river. I understand that this is very early in the process. I'm not ignorant of the administrative process that Hanover has established and fully intend on participating in it, should it be open to residents of my community. [00:58:05] But they are making decisions or have the potential to make decisions that have profound impact, not just for my community, but for the entire northern part of Henrico and every other county that is downriver from the Shikahominy. I fear that there will be zero concern that your constituents, not from you, but from the Henrico side, that your constituents are not invited to talk about and discuss the scale of this project. [00:58:30] This project, again, is at the head of the Chickahominy, and as you know, it flows downstream, contributing to the water work system of Newport News, the city of Newport News, and larger Hampton Roads residents. Tens of thousands of people rely on the Chickahominy for their drinking water. [00:58:47] And so decisions made by Hanover will both ripple and permeate far beyond their own borders. And if they do not invite our community members to the table, that would be absolutely unacceptable. I am not against data centers. [00:59:03] They are a necessary part of our economy. And they're the only way that we're going to achieve dominance over other nation states' competitors. But even what I am against is a surge of even tier four emergency diesel generators so close to our community and our elementary school. [00:59:22] I ask you to take some type of action to urge Hanover to at least bare minimum adopt a very thorough open consultation with the immediately impacted communities that are downwind and down river from the project, especially the neighbors that are less than zero feet from the border of that particular project. This is about protecting children's health. It's paramount and ensuring fairness between counties and respecting Henrico's residents. Thank you for your time. Thank you, [00:59:51] I'm sorry. Mr. Ward, thank you for coming out and for speaking. I know that while you acknowledge that you don't speak on behalf of anybody but your family, you probably also recognize that there are many people that have contacted our office, my office in particular, about this issue. [01:00:12] I learned about this project Friday, I believe it was, by receiving a voicemail from Jonathan Spires of BizSense asking me for my thoughts on it, and that's how I learned about it. So this is, as you noted, all very new information. [01:00:28] We actually had meetings earlier today to discuss kind of a briefing about the project and what potential options are. So it is very early in the process. we do intend to engage in conversations to see as you noted you know this we can't tell Hanover what to do but we can certainly have a robust discussions and call upon good faith discussions about how this does impact Henrico residents as well as Hanover residents as well so I I'm looking forward to having those discussions I know some of those folks across the the county line and trust [01:01:03] that they will operate in good faith and hopefully as you said look to some of the actions that we have taken in henrico to try to protect against some of the problems that data centers can bring and hopefully absorb some of those on their side of the county as well so thank you for coming out again i've heard a lot from a lot of different folks about this particular development and we We're all over it, so thank you. [01:01:33] Next, Mr. Chair, members of the board, Sarah Ramsey. Ms. Ramsey, I believe you're on WebEx. Yes, can you hear me? Yes. Great. Honorable board members, believe it or not, we are making progress. [01:01:53] A year ago, when I asked you who I should blame for the hydrofluorosilicic acid in Henrico's public drinking water, you responded by saying that it's the Virginia Department of Health. That response was a lie, which you all now recognize. [01:02:13] Then, eight months ago, when I asked you who I should blame for the hydrofluorosilicic acid in Henrico's drinking water, you responded by saying that it is the DPU director, Bentley Chan. That, too, is a lie of which you've recognized. [01:02:31] Then, on April 8, 2025, the county manager, John Vitalkis, jumped on this grenade and said, if it's the devil you seek, then name my name. The county manager does not have the authority to demand that a drug and a well-known neurotoxin be put into the county's drinking water. [01:02:53] But then, last week, to my surprise, one of you board members finally admitted to me that it's the Henrico Board of Supervisor members that is ordering the DPU director and the waterworks operators to put hydrofluorosilicic acid into the drinking water. [01:03:18] Finally, the truth comes out after a year. The Henrico board members are responsible for contaminating our sacred water supply. Now, this particular board member promised me last week that he will publicly take responsibility for the hydrofluorosilicic acid that is being added into the public drinking water. [01:03:45] Let's see tonight if he was lying or telling the truth. Will he hide in the shadows with the rest of the cowards or come out into the light? So, what say you? Who will publicly take responsibility for this barbaric practice of drugging people with a neurotoxin without their consent? [01:04:09] Board members, if you truly feel that adding hydrofluorosilicic acid into the community drinking water is such a wonderful thing to do, then you should have no problem speaking out in defense of your actions and taking the credit for this poison in our drinking water right here, right now, tonight. [01:04:37] if you do not take responsibility for the hydrofluorosilicic acid in the water then i will have no choice but to believe that you that what you are doing is indefensible thank you thank you ma'am all right next miss chair uh we have james bowles mr bowles are you here sir um i would like [01:05:14] to address uh some problems with the reap program which i believe is something like real estate assistance program or something like that which is supposed to help the the indigent and the elderly in henrico county as i understand it there are two qualifications being disabled and being below the federal poverty level and income. [01:05:46] You're not required to qualify under both, but I do qualify under both. And there's erroneous math in the sizing of my real estate assessment, and I can't get it corrected. [01:06:07] The house next door to me has a lower assessment. It's the exact same plan, except it's slightly larger. It has a heat pump. I've got an old furnace. Does not work. [01:06:24] It has whole house air conditioning. I have a window unit that I depend on for every level and every room in my house. They have a cement patio. [01:06:40] I don't have anything like that. They have a large electrified outbuilding. I don't have anything like that. Why is their assessment lower than mine and why won't anybody do anything about it? [01:06:56] When I try to have something done about it, my efforts to have things corrected have remained unaddressed to this day. And I'm only told that it's the wrong time of year to address tax disputes, that they have to be done in the spring or something like that. [01:07:18] And they won't even tell me an exact date. They just say, oh, sometime in the spring. I was told I missed the deadline, and that meant it could no longer be addressed as a REAP qualified abatement. [01:07:41] Rules were set up by the district supervisor, I was told, and that penalties and interest would accrue. Nothing I could do about it, nothing they could do about it, excuse me, not meaning me, myself, personally. [01:07:58] But that's the quotes that they were giving me, that they themselves couldn't do nothing about it because it was the district supervisors. In opposition to the spirit of this law, which is to alleviate the burden on our aging population, it actually makes it worse. [01:08:21] I've got penalties and interest now, and they won't come out and fix it. They won't measure. They won't do the math. Math is an exact science. [01:08:38] Two plus three equals five. The final stages, I'm in the final stages of congestive heart failure. I have a 5 to 15% ejection fraction, and that's on a good day. [01:09:00] They won't measure it when I'm in the hospital and can barely move. My cardiologist said I would not live to see Christmas of 2022 without a heart transplant. [01:09:21] I have numb feet due to disintegration of the myelin sheath on my nerves. I have a disintegrated bone in my spine. And I've got untreated or unsolved type 2 diabetes that nobody seems to be able to fix due to allergies to medications. [01:09:58] I take over a half a dozen medications a day that cause me to be fatigued and to have mental confusion. Mr. Bowles? Yes. [01:10:15] I don't mean to interrupt you, but I think that, you know, based on everything you have described, that young lady right there, she's going to raise her hand. She's our director of finance. So from everything you've described, I don't see why you couldn't get on the REAP program. [01:10:34] So if you would. I am on the REAP program now. I am told that I cannot get the credit for the time that I was not able to get on the REAP program purely because of them not fixing the assessment problem and me not being able to deal with it. [01:11:01] So, again, I think Ms. Minor is here. Why don't you all step outside and see if you can't, because I think you've been talking to staff members. You did make a comment about a supervisor. [01:11:18] You're not referring to board members, are you? You're referring to staff? Someone in the administration building that has to do with tax collection Yes, sir. told me that the only person who could help me would be the board of supervisors. [01:11:35] They made the rules that they had to abide by. They could not make any kind of variance in the rules or address it because the way the law was written or whatever, that they could not do anything about. [01:11:51] Even though I have been disabled since before the REAP program began, I've been disabled since the 80s or 90s. Yes, sir. So I'm sorry you were told that, but Ms. Minor, if you would just step out and talk to her, she'll get your information. [01:12:10] I think this may be a fruitful conversation for you, okay? Okay, I do have a second problem. At the urging of my brother, who lives in the District of Columbia, and contrary to the law and my wishes, Henrico County has destroyed my mother's garden ostensibly because it contained native species. [01:12:40] I have neighbors who have non-native, aggressive species, and I can't get anything done about that. These plants are destroying my lawn, and I can't deal with my own lawn for trying to kill these invasive species, aggressive invasive species, non-native. [01:13:07] And Henrico has some laws that ought to, or rules, that ought to address this, but no one will enforce them. These things have been growing for years. They have fined me hundreds of dollars for mowing, literally to the dirt, my entire backyard lawn. [01:13:36] I had a fescue lawn, which is preferred for most people because it stays green all winter long. They mowed it to the dirt. The fescue won't grow there anymore because it's supposed to be mowed to around four inches. [01:13:53] And Ryko County Agricultural Extension will tell you that it's supposed to be about four inches because it helps shade the roots and makes the other plants unable to germinate. They have germinated every weed that's ever landed on my lawn that has not rotted. [01:14:15] The seed has not rotted. Mr. Bowles, so I am familiar with that second case. And I apologize, but you're at seven and a half minutes now. Sheila, if you would give Mr. Bowles my office number, he and I will talk about that second case. [01:14:31] Because, again, I am familiar with it. As Mr. Lebo from Community Revitalization has talked to me about your case. so let's see if we can't get that first item resolved okay what about the second item she you you're gonna you and i are going to speak tomorrow okay all right i have i have tried yes sir i know all right um do we have any other speakers that are wish to address the board of [01:15:03] supervisors this evening yes sir if you would go to the podium thank you uh my name is joe hines I am an owner in 3212 Skipwith Road, which is across the street from the North Atlantic Holding Incorporated project that was up tonight for public comment. [01:15:30] I do want to say that I only received, this is the first notice I've received, which was actually today when I got home and checked the mail. I checked it on Saturday. I checked it again today. First notice I received about any type of rezoning for it. [01:15:46] I also realized there's a process involved here, or I guess a special use permit is related to it. But I tried to get online. I picked up a little bit after 6, realized it was too late to come to the board meeting, looked online. Then when I saw the plans, it was the first I'd seen of any of the plans. [01:16:05] We were literally right across the street from the proposed changes, which I believe is going to be a parking lot. I literally apologize for shortness of breath. I literally ran all the way over here from the parking lot to try to get here in time to speak. I know you all have already voted. [01:16:21] I don't know if you all could pull that back and allow us time the adjacent property owners to meet with the actual applicant for that permit and see if that's possible or not. But if not, I want to go on record as saying we were not aware of what was going to be happening across the street. [01:16:40] The Girl Scouts of Virginia just bought the office building next to us, Special Olympics rent-air office building, and we have a child care facility literally right next to us as well, too. So I just wanted to at least bring that up and go on record that, one, we were not informed, and two, we would probably be imposed until we have more information about it. [01:17:02] So I don't know if y'all can rewind that or not. I did try to get on WebEx as well. Couldn't get on it in time to comment at the end of the public hearing, but I at least wanted to let you know I made the effort to come here after I received my first notice tonight. And I do know Mr. Emerson. [01:17:19] He's a good man. I assume if these notices were tagged to go out, I don't know why I didn't get one before, but I just wanted to go on record as saying I had not received one until tonight, and I was trying to get up here to essentially oppose it until more information was had. [01:17:35] I did go online to try to find the actual site planning and all that information, and then previous planning commission meetings where it might have come up, I couldn't find any of that information online either. So sitting here with about 2% of the information for me to be able to comment appropriately, and part of the reason why is I just hadn't seen any of the information before. [01:17:58] So I will respectfully request, and I understand if you can't, that y'all rescind that and allow us time as adjacent property owners to have a conversation with people across the street about what they were planning on doing before it gets approved. And again, I apologize about the delay. [01:18:14] I just got it today. Thank you. Thank you, sir. I'll add, I don't believe we were able to rescind the case, but I do have one question for you, if you don't mind. What's the date of that letter you have in your hand? There is no date on it. [01:18:32] It was a standard mailing. [01:18:42] Yeah, it looks like it was a late August postage date on it. But literally, I just checked my mail on Saturday. It was not my mail on Saturday. I got home tonight right around 6 o'clock and checked it, and it was in the mail tonight. Well, thank you. Your comments are certainly on the record, as always, tonight with public comment. [01:19:00] Thank you, sir. If the applicant is still here, can they at least be willing to meet with me afterwards as well, too? Sir, I think Joe Emerson probably has the information that you're looking for. [01:19:23] Do we have any other individuals that are present that wish to address the board this evening? Okay, anyone on Webex? There's no one to speak on Webex. All right, Mr. Chair, members of the board, then you would move into your general agenda. [01:19:39] As Mr. Crawford comes up, agenda item 232-25 is an introduction of resolution. This is for receipt of requests for amendments to the fiscal year 2526 annual fiscal plan for the month of September 2025. Justin? [01:19:55] Thank you, Mr. Manager, and good evening, Mr. Chairman, members of the board. This is, as the manager noted, an introduction of the September amendments. If approved, this would set the public hearing for these requests for September 23rd and authorize the advertisements of these amendment requests. [01:20:18] As an overview, the total is $30.5 million. Being that these are the September amendments, there's two parts. The first that I'll note is the request for reappropriations for continuing programs, so funds that were appropriated in fiscal year 25 that are requested to come forward. [01:20:43] That total is just under $10.3 million. Of that total, $9.7 million is state highway maintenance funding for public works. you'll and that funding will be there's actually on the last page of the proposed list the proposal will transfer those funds from the general fund over to capital projects for paving paving efforts the bulk of the amend the new amendments is within a special revenue fund 11.9 million dollars here [01:21:19] a number of highlights here including the annual appropriation of cdbg and hud home funds from the department of housing and urban development which is utilized by the department of community revitalization as noted during work session 1.5 million dollars is requested for the operating operating funds for the henrico sports and events center there are 2.2 million dollars of requests coming forward from the department of mental health and developmental [01:21:52] services in addition to that 2.2 million dollars there's also 1.6 million of opioid abatement authority funding that is coming forward for a number of different efforts with those resources and then 1.9 million dollars for eda agreement payments 900 000 of that is for demolition uh effort uh or phase one demolition of uh glenn of the glenwood farm subdivision uh per the agreement uh reached with the eda and then uh another million dollars for uh sports grants [01:22:30] through the sports and event through the sports and entertainment authority um moving on to the general fund request 2.1 million dollars here uh staffing for a new medic unit that was approved last fiscal that the physical unit was approved last fiscal year new behavioral health staffing within the jail along with a new primary care and substance use treatment contract for the sheriff's office and i would note that this is partial funding there's some salary savings that have [01:23:05] been identified along with us one of the opioid abatement requests will help assist with that funding on the capital side 6.2 million dollars worth of requests of that 1.5 million dollars is the first half of a of a payment for the wastewater treatment plant upgrades in new kent that helped serve the jail jail east this is per the jail east agreement that was entered into [01:23:41] there's also 1.6 million dollars for the uh for the as a partial funding for the regrading of the hungry road railroad crossing and then 2.6 million dollars uh for the uh division of fires apparatus replacement program uh i understand that was a lengthy overview but if there are any questions i'd be happy to uh entertain those at this time thank you sir any questions for just all right seeing none is there a motion on the introduction so moved been a motion by mr cooper seconded by [01:24:16] mr nelson on the introduction of the resolutions um those in favor say aye any post motion carries Next, Mr. Chair, members of the board, 233-25 is the resolution for signatory authority. This is for acquisition of real property for floodplain mitigation, 2127 Park Lane, which is in the Brooklyn District. [01:24:36] Mr. Anthony. Thank you once again, Mr. Manager, Mr. Chair, honorable members of the board. This paper would authorize the acquisition of 2127 Park Lane for the floodplain mitigation program. The owner, Richmond Group, has agreed to sell the property to Henrico for a total of $1,900, which is the current assessed value. [01:24:57] Directors of Public Works will property recommend approval of the board paper. County Manager concurs. I'll be happy to address any questions. Thank you, sir. Any questions for Mr. Anthony? All right, I'll move the resolution. Second. Motion made by myself. Seconded by Mr. Cooper. Those in favor say aye. [01:25:12] Aye. Any post? Motion carries. Mr. Mayor. Next, Mr. Chair, 234-25 is a resolution for award of contract. This is for the Virginia Center Commons Sewer and Water Replacement Project, which is in the Fairfield District. Mr. Chan. Thank you, Mr. Manager, Mr. Chair, members of the Board. [01:25:29] Good evening. This is an award of a fixed-price contract for $8,385,000 to Sogress Construction Corporation for the Virginia Center Commons Sewer and Water Replacement Project, consisting of providing approximately 2,110 linear feet of gravity sanitary sewer main and manholes and approximately 2,630 linear feet of water main associated interconnections and hydrants. [01:25:56] The purpose of this project is to replace existing water and sewer to increase the capacity of the system for redevelopment in the Virginia Center Commons area. Work on the project is anticipated to begin in December and be completed within 510 calendar days. [01:26:12] With that, I'll be happy to answer any questions that you may have. Thank you, sir.
