Next, Mr. Chair and members of the board, 242-25 is the resolution, In this case, declaration of surplus property. [00:28:51] Property is 424 Piedmont Avenue, which is in the Verona District. Mr. Anthony. Once again, Mr. Manager, Mr. Chair, honorable members of the board, this would declare 424 Piedmont Avenue in the Seven Pines Villa Site Subdivision as surplus to the needs to the county. [00:29:07] This paper would further authorize the sale of the property to Baptiste Development LLC for $700. The assessed value of the property when the interested buyer first offered to purchase it the county the interested buyer owns the adjacent properties real property division has processed this request through departments of planning public utilities and public works without objection the director of real property recommends approval of the board paper county manager concurs I'll be happy to answer any questions thank you sir any questions on this item it's a public [00:29:38] hearings anyone in the room wishes to speak to this surplus item just curious It's why I looked up the corresponding addresses near there, and it looks like at least two addresses have been sold within the past eight months. [00:30:17] My questions are, why is it that we do, I'm going to presume that fees that are there as of right now will be demolished. Why do we need to demolish these in favor of building single-family homes? [00:30:36] I mean, I've ranted about single-family homes, how it is not the efficient way of building housing. You need to go into the ideas of building multifamily housing, say duplexes or triplexes, purchasing unit, I mean, apartment buildings in the county, turning them into complexes that are managed by the county, and then turning those units into rent-to-own or purchasable. [00:31:06] My question is, why does the LLC need to purchase this and then turn likely property to single-family housing? Or is there something else that does? [00:31:22] Thank you. I'm sorry, sir. My response would be, we receive these requests and process these pretty often. A lot of times, a certain LLC, a developer, private entity, would have an interest in assembling these lots for, I don't know, future development of whatever their interest is. [00:31:42] And if the county has no need to retain it for whatever reason, we provide them with the opportunity to purchase it. And to address your question with regard to the $700 assessment, that's what the real estate section has assessed the value to be based upon how it exists currently. [00:31:58] But, again, my question is, you know, from the ecological, you know, again, it's trees, probably hundreds. A lot of animals live in there, whether it be microbes from and environmental, so that has come in, not more. [00:32:35] Well, I'm not in a position to argue that statement. That's not really a question, Mr. Chair, for a real property agent. Yeah, the county can't assume, ma'am, what developers will or won't do with the land. [00:32:52] What the county can do is take an assessed value of a piece of property that this county no longer needs on behalf of its taxpayers and surplus it for the value of the land. In this particular case, I am looking at the overhead picture of it, And more than likely, I think the answer that you got a minute ago was either for assemblage, if you look at this parcel and you look at it, which clearly you say you did, or it's for a neighboring parcel on the back to acquire land that they – a nearby parcel that they want to maintain and actually, quite frankly, not use. [00:33:24] But again, intentions for the developer would be unknown to this group. It's just the operation of the surplus of land. Thank you, though. Just one point of clarification, even though this is an LLC, please don't assume this is a developer. [00:33:40] This is an adjoining property owner. That is correct. It may just be buying the property to have woods that he owns, he or she. Yeah, there are homes on Virginia Avenue, which back up to that property, I would say. Thank you. Anybody else in the room wish to speak to this public item? [00:34:01] Anyone on WebEx? There's no one to speak to this item. All right, thank you. Mr. Nelson. So moved. Motion made by Mr. Nelson, seconded by Ms. Roundtree. Those in favor say aye. Any opposed. Motion carries. Mr. Manager, I think that's it on public hearing items. Yes, sir. [00:34:16] Mr. Chair, members of the board, you would move into public comments. I do have three individuals that have signed up to speak. The board does ask that you make your comments from the lectern at the back of the room and that you limit those comments to a five-minute time period and you begin them by stating your name and address for the record. [00:34:32] So, Teresa DiServio? Ms. DiServio, are you here? Ms. DiServio, are you on WebEx? She is not, sir. Okay. I have Mr. Jay West. Mr. West, are you here? Okay. [00:34:49] If you would. Good evening, Chair, Mr. Manager, members of the board. [00:35:09] My name is Jay West. I'm a 20-year resident of Henrico County. I've currently lived in the Tuckhoe District, where I own a home with my daughter and I for the last three and a half years. During my adult life, I have found Henrico County to be a pleasant place to call home. You know, moderate taxes, low crime, good schools, fair law enforcement, sensible governance. [00:35:28] A few things are perfect in life, but in my experiences, I found Horiko to be a great place to live and raise my family. I wish I were here this evening to discuss something of great social significance, you know, about how we could work together, you know, to help with our homeless population or something else. But unfortunately, I'm here to discuss something very much in my own self-interest. [00:35:46] It's not something I really sought out to bring here, but it's a matter that I was confronted by county government and threatened with having my property seized. And I wanted to bring that to you all's attention and discuss it further. The Community Maintenance Division within the Department of the Community Revitalization is one of the most common points of interaction between citizens and that department. [00:36:06] What I'm specifically here to discuss this evening is the procedures under which they operate something called the Tag and Tow Program, which is what they call a program to remove vehicles they consider abandoned or inoperable from public right-of-ways. Using their own words, this is done to promote a healthier and safer environment. [00:36:22] At present, the Tag and Tow Program operates under Henrico Code Section 22-252, which references Virginia Code 46.2-100 to define an operable vehicle by the following criteria, that it is not an operating condition, which no further definition is provided, it does not display valid license plates, it does not display an inspection decal that is valid, or displays an inspection decal that has been expired for more than 60 days. [00:36:48] I believe using the above definition alone and without further definition is a highly flawed method of identifying vehicles that are truly inoperable, that present safety issues to motorists or pedestrians, or that are serving to diminish property values. Recently, in my own neighborhood, a neighbor had an automobile parked on the street, the public right-of-way, for six to eight weeks. [00:37:09] This vehicle had current Virginia safety inspection, two license plates that displayed current Virginia registration decals. Unfortunately, the vehicle had also been in a serious accident. Passenger side front suspension was collapsed, the wheel was folded back into the fender well. The airbags had been deployed, and the windshield was shattered. [00:37:25] To any person with knowledge of how automobiles operate, this was clearly a vehicle that was not in operation. Yet using the inspection processes and the criteria that the community maintenance division has chosen to use for its tag and tow program, this vehicle was not cited as an inoperable vehicle during their normal neighborhood inspections. [00:37:43] At the same time, I had a high-end sports car sitting in front of my home. But because it does not have a front license plate installed, it was considered an inoperable vehicle by the department. And I was given notice that my vehicle would be towed within 48 hours if it was not removed. Simply put, I think this methodology that they are using is flawed. [00:38:02] Please understand now, I don't question the authority by which the department operates or anything of that nature. As a homeowner and a parent, I understand having minimum standards for appearance to ensure safe roads and neighborhoods for motorists and pedestrians and to discourage conditions in residential neighborhoods that would impact neighborhood property values. [00:38:19] What I seek is a more comprehensive set of criteria used beyond the state definition of an inoperable vehicle to be used in establishing if a vehicle should be removed from the public right-of-way. In my research, I've noted that many other localities around Virginia have expanded upon the state-provided definition for their community beautification initiatives. [00:38:40] Now, I was taught at a young age not to complain about something without also offering a solution. My personal ideas would be to expand upon the inspection process used by the department to use factors such as flat tires, broken or key components being missing or broken, that allow a vehicle to operate to help determine what is truly a vehicle that's in operating condition. [00:38:59] I believe that a matrix could be developed, including legal definition and observations from the inspection to help better determine what is an operative vehicle. But these are my own ideas, and such proposals should come from more than a single individual. I note that there are presently over 40 standing boards and committees that are used for advising the county government. [00:39:18] I recommend that this, or I request rather, that this board stand up a temporary committee to help liaison with the Department of Community Revitalization to help develop a better system for identifying and remediating when vehicles are truly inoperable. I shall volunteer my own time to help work on this effort. [00:39:35] I've spoken with Eric Lebo, the director of that department, and I have found him to both be very patient and open-minded regarding the issues I'm discussing with you all this evening. I hope that together, citizens and government, can come together to help develop a more comprehensive process that meets the objectives of the Community Maintenance Department without needlessly bothering or burdening the citizens of Verico. [00:39:56] Thank you. Thank you, sir. I'm glad you were here tonight, and I'm also glad to hear that you've had a conversation with Mr. Lebo. Yes, sir. Your points raised tonight are well presented. Thank you very much. Thank you, sir. Next, Mr. Chair, members of the board, Kenneth Harvey. [00:40:12] Appreciate your time to update the county manager, W.M.A. [00:41:19] Brian, the board, on what the American Legion is doing. But I'll start with my name, Kenneth Harvey. I'm at 7817 King Ider in Reichel County. With that said, I am the commander for American Legion 233. [00:41:39] And I want to start by saying that I came here earlier, and I wanted folks to kind of understand what the American Legion is all about first. We're supposed to look at the community and make sure that there's pockets out there that need to be resolved, youth, seniors, programs that we can help with. [00:42:05] We bring those programs, and I want to say that I want to thank the community for allowing me to be a part of what we've got going on. And what we have going on is positiveness in the community and a great vacancy that was permitted by the American League. [00:42:24] So, I don't want anybody here to think that Verona is not an important place. It is. And one of those reasons is I'm a veteran, but about enough disabilities, I'm not even sure why I'm standing. But I'll say this. [00:42:42] On Friday, September 26th, we'll be at the Eastern Henrico Recreation Facility for a job fair. We did a job fair July 11th. It was a lesson. It's still a lesson. We're learning. We want to grow the community within that pocket. [00:43:01] And what we fail to do as the American Legion is keep that pocket growing. We've got a lot of kids out there. And I'm going to make a statement here. Some would say, wow, when the American Legion gives back $39,000 in scholarships and grants one year and $49,000 another year, and then we turn around and watch the scouts because we're adopting them, give back $5,000, what's going on with the community? [00:43:32] We want to make sure those kids are taken care of. That is what the American Legion is supposed to do. We're supposed to figure out what's going on out there and get there and fix it as best we can. So I want to thank the county manager for giving me an opportunity to bring in folks that are helping us. [00:43:50] And I want to start with saying that Mrs. Montgomery has done a wonderful job of assisting us with this upcoming job fair and a lot of the other staff. What we've got on track right now is about 40 employers that are coming in and offering jobs. [00:44:08] So if you're looking for a job, stop by the rec facility. We have a stellar group of people who taught me some lessons. I'll say this, that the Marana board member, Mr. Nelson, has helped me grow. [00:44:26] I think when you grow, you have to be out there in the community to figure out how to grow. You're going to make some mistakes. So I made a few, and I got some lessons. And I know about lessons because I made enough of them to be standing here today. [00:44:44] So when we look at all that's taking place, we've got volunteers such as the Scouts, Mindvetchers, CNF Bank, New York Life, and Meineke that are on board with what we're doing. So let me just say, without the community, we're much of nothing because you folks make the community up. [00:45:05] American Legion, for some time, or more, about 15 years over there where we're at, in the Verona location, lost its way. And I'm here to say that I'm not here to change anything in Verona. [00:45:21] I'm here to help Verona, the county, as much as they allow me to repair those things that need to be repaired. So what am I saying? I met with Mrs. Atkinson and talked about how we can make sure money that we come into gets to the kids, get to the family, sit down and talk to them. [00:45:41] There's no reason for us to be giving money back. So with that said, on October 4th, Dory Park, we will be fundamentally doing a fair. And that fair is free to all those who come by. Those things that we worked on is to make sure we don't burden the county. [00:46:01] When you burden the county, we're not helping the county. We find ways to get things done. I got a lot of support with that within the county and communication system. And it takes a lot of talking to getting folks to help me get that done. [00:46:21] So I'm going to sort of narrow this down to one starting thing. When you bring a team together, a team can get a lot done. And so what I see right now, as for the American Legion, I want to be happy to say that I've learned a lot, I've moved a lot, and I appreciate what the board members and the staff here is doing. [00:46:45] And I want to be sure that when I leave here tonight, we'll see folks at the Rec Facility, we'll see folks at the Dory Park location, and we need volunteers. But what volunteers that does not show up, I assure you, as the commander of America Legion 233, we're going to keep pushing because I will not allow any money to go back this year and next year and the year after. [00:47:12] As long as I'm the commander over there, we're going to find a way to make it work. So if anybody in here wants to help me make that way, besides Mrs. Atkinson, who's the board member for the school county, touch bases with us. [00:47:27] Give us a call. Anybody want to volunteer, volunteer. But help me get what I came here to do, not just for myself and all that I've been through. I serve this country proudly, and I'll continue to do it through the county. [00:47:44] With that said, I'm going to close it up and move on. Thank you, sir. Great to see you again this evening. You're welcome. Is there anyone else that wishes to address the board this evening? Anyone on WebEx? There's no one to speak on WebEx. [00:48:00] Okay. Mr. Chair, members of the board, then you would move into your general agenda. First agenda item is 243-25. This is a resolution for amendment to the fiscal year 25-26 annual fiscal plan. This is for the appropriation of funds for the rebuilding of Cuyacuson Middle School. [00:48:19] Mr. Crawford. Thank you again, Mr. Manager, and good evening again, Mr. Chair, members of the board. This resolution, as the manager noted, is an amendment for the Cuyacuson Middle School rebuild project. it was a project approved by the voters in the 2022 bond referendum with a 89 million dollar estimate the construction bids were received for this project on september 11th and after an analysis of the bids the lowest responsive and responsible bidder it was revealed that there [00:48:57] was a 15.1 million dollar shortfall within the project now this amendment here i will note does not require any general fund resources all of the all the entire shortfall is will be covered with unappropriated bond proceeds those being interest earnings on the 2020 and 2024 bond issuances and the premiums generated on the most recent issuance this fall. [00:49:28] With that as an overview, I'll be happy to answer any questions the board may have. Thank you, sir. Any questions for Justin on this item? Mr. Chair, I have a couple questions. Justin, just the $89 million, was that, you said, previously approved when? [00:49:46] Was that in 22? So the plan that was put forward to the voters totaled $89 million. Those appropriations came over the first couple years, I believe, the FY24 and FY25 budgets. So the increase of $15 million didn't increase the scope. [00:50:04] Is this material cost? Is it labor cost? Is it just cost of goods have gone up? Yes, sir. The estimates for this project were put forward in late 21, early 22, and the construction market in that time has shifted. [00:50:28] You mentioned in 2022 the bond pass. Does anybody know that passed well over 80%, right? You said 80%, but it was like 85% or it was well over 80%. Yes, sir. I have a couple questions for maybe that school, and it might be for the schools if that's okay. [00:50:49] That school was built in, do you know, Justin? Yes. I was going to ask Ms. Mansfield to acknowledge the director of facilities for HCPS, Ms. Susan Moore. Thank you, Ms. Moore. How are you? I'm good. Just a couple quick questions. [00:51:05] That school was built in the 70s, right? Yes, sir. Late 60s, early 70s. Late 60s, early 70s. And in this, are we adding capacity to this school? We are adding a little bit of capacity. That is allowing us to put the second center of innovation into the Cuyacuson Middle School. [00:51:28] We also have a FACE family and community engagement hub that will be housed inside the new building as well. So not necessarily adding more students in the community there, but adding at the Center of Innovation will pull some kids from outside because that will be the second Innovation Center? [00:51:44] Some from outside as well as some from within the school itself. Okay. Real quick, Susan, can you also speak to the ADA compliance with that building and the challenges we've had with that building? Yes, sir. So the existing building, it's a one-story footprint, but within that footprint, we have three different levels in the building. [00:52:09] As a matter of fact, we have five different educational wings that the classrooms are on. Every single one of them has about seven to eight stairs to get up to the actual classroom level. So you can go up, you can go down. It is a plethora of stairs throughout the building. [00:52:29] And we added lifts within that building to make it as accessible as we could, but the new building will be fully ADA compliant. Just one follow-up question, and honestly it's a comment to Mr. Cooper, but that is kind of the idea when we look at rebuilding a school versus rehabilitating something. [00:52:51] Because I know in that same bond we had, Longham and Jackson Davis, they increased capacity, but we didn't rebuild them completely. But to Reverend Cooper's point, sometimes you have to completely rebuild a school because the ADA compliance, that's a great point, though. Yes, sir. They were also very small schools. [00:53:08] So by nature, that small campus school is not how we would design a typical elementary school today. Thank you. Thank you. Sir, good. [00:53:24] All right, thank you. Any other questions for Justin on this item? All right, seeing now, is there a motion? So moved. Motion made by Mr. Cooper. Seconded by Mr. Nelson. those in favor say aye aye any post motion carries mr. manager next i'm sorry can you do that again in the books no i resent my motion oh mr roguish one that is noted it was usually how we keep in the file hey it was school so you know that's what it was excited over here he was pushing the button still on the school board oh man don't do that to me i miss the man's kind of kind of rescind my [00:54:04] motion please sir it is it's in the books one is in mr rogers category as an iou for you sir mr manager next uh mr chair 244-25 an item that has been worked on by mr yob who's coming up to the podium for several years this is a resolution for the acquisition of real property from csx this is the actual canal canal that traverses the tuckahoe magisterial district and goes into to the City of Richmond. Mr. Yard. Thank you, Mr. Manager. Good evening. Members of the Board, [00:54:39] Mr. Chair. First of all, let me introduce Randy Marcus, Vice President of CSX, who is with us tonight. Randy and I have been talking about this for quite a long time now, and if you have any really hard questions, that's I'm sure why he's here. But as the Manager said, this would authorize the county manager for signatory authority for a five mile stretch of the canal, a canal containing approximately 65 acres. The county would use this property for both potential future utility [00:55:16] improvements, recreation, as well as public safety. And public safety is important as there are a number of residents who live on the river, have no way to access their homes other than crossing the canal. The bridges that exist for those properties are in disrepair, and we would take over maintenance and repair of those, in fact replacing them one by one over the course of the next several years. So with that, a very historic resource. It's been around the Commonwealth since [00:55:49] 1835, if our numbers are correct, and George Washington was in fact originally involved with us back in his time. With that, I'll be happy to answer any questions that you may have. Thanks, Steve. Any questions for Mr. Yalb? All right. Seeing none and seeing that this item is in the Tuckahoe District, is there a motion, Mr. Ruggish? [00:56:13] Reverend Cooper, so move the resolution. The motion may have Mr. Ruggish. Second by Mr. Roundtree. Those in favor say aye. Aye. Any opposed? Motion carries. Mr. Manager. Thank you, Steve. Thank you. Next, 245-25 is the resolution. This is approval of Virgin Med Transportation, Inc. [00:56:34] to operate a medical transport service in henrico county miss dixon good evening mr chairman members of the board mr manager this board paper approves virgin med transportation inc to provide medical transportation services within the entire geographical area of the county the fire chief recommends approval of this board paper and the county manager concurs i will be happy to answer any questions? Thank you, ma'am. Any questions on this item? Is this part of our free ambulance [00:57:07] service that the county provides? No, ma'am. This will be a private ambulance service. It will do home to hospital transports or hospital, I'm sorry, hospital to home, hospital or home to dialysis patients. So it will help support the private ambulance services that are already existing within the county which we are glad for this expansion any other questions on this item all right seeing none is there a motion so moved second motion made by mr roundtree second by mr [00:57:42] cooper those in favor say aye aye any post motion carries mr manager 46-25 is a resolution this resolution would initiate the east end water transmission main project that was discussed in work session earlier mr. [00:58:58] I know I say this to all of us because we all care about our entire county. I know this was a little different for Reverend Nelson and myself and constituents in the Fairfield-Variner districts who lost, who weren't able to get water during our water tragic situation. [00:59:17] And we asked you, Ms. Manager, fix this problem for us. And you all came up with a $300 million solution. And today is the genesis of that project. along with what Ms. Miner proposed as well. You know, so this is a great day in Heracle. It just shows that when we are faced with complex issues and problems, we find solutions and we work together to accomplish them. [00:59:35] So thank you, Mr. Chan, for your work on this. And I know Reverend Nelson has something to say as well. I think you covered it. So we're excited, just ready to hit the fast forward button so we can move as quickly as possible. [00:59:51] Mr. Chair, I was given the privilege and permission by Reverend Nelson, senior statesman on this board to ask Mr. Tuckahoe if he would make the motion for the East End. That's very noble of you both. Mr. Rogish. So move the resolution. Very excited about it. Thank you guys for doing this. It's been a motion made by Mr. Rogish, properly seconded by Mr. Nelson. [01:00:17] Those in favor say aye. Aye. Any opposed. Motion carries and Mr. Cooper your debt has been paid. Thank you. Thank you Bentley. Next is 247-25. This is a resolution for award of contract. This is the proposed bridge rehabilitation project for the parham road bridge this is in the brooklyn district mr hughes all right mr manager mr chair members of the board good evening this board paper would award a 2.8 million dollar construction contract to lanford brothers company for rehabilitation of the param road bridge over csx railroad the work will include removing the old [01:00:52] bridge surface and putting down a new stronger concrete surface replacing seals and bearings that allow the bridge to flex and move safely, repairing damaged steel and concrete parts of the bridge, applying new protective coating to help prevent future water damage, managing traffic and phases so vehicles can continue to use the bridge during work, replacing the concrete median on the bridge and nearby approaches and coordinating with the railroad during the project. The project area runs from 0.15 miles east of Landmark Road to 0.21 miles west of Ackley Avenue. Construction is expected to begin in 2025 and completed in October of 2026. The county received three bids and based upon a review of the bids, Landford Brothers Company is the lowest responsive and [01:01:32] responsible bidder. Funding to support the contract is available within the project budget so which consists of about 2.2 million dollars of state bridge funds that we were able to obtain and about 573,000 in local maintenance funds. The director of public works and purchasing recommend approval of the board paper and the county manager concurs so happy to answer any additional questions there was a couple of my questions were state bridge funding you mentioned that have we worked with this company before previously uh no i don't recognize their name they've they're very well known with vdot though oh gotcha yes we check the references they've worked on a number of emergency bridge repair projects for vdot around the state gotcha any [01:02:09] questions for mr hughes seeing none i'll make a motion to move the resolution it's been seconded by mr cooper those in favor say aye any post motion carries mr manager chair members of board At this time, I'd ask the board to add an item to the agenda. [01:02:25] I've labeled the item 248-25. The item is titled Resolution Settlement of Litigation to Approve a Settlement Recommended by the Self-Insurance Trustees in the case of Carl Green as conservator on behalf of Damien Cousins versus the estate of Trey Marshall Sutton. [01:02:45] Thank you, Mr. Manager. Any discussion from the board on adding this item? Mr. Chair, I would like to note for the record that I am abstaining from any voter discussion on this matter. I was previously appointed to represent Mr. Cousins in my capacity as a private attorney in a matter completely and wholly unrelated to this matter that is before the board and had no previous involvement in any discussions prior to today either. [01:03:10] I no longer represent Mr. Cousins, and the county attorney has advised me that I do not have a conflict of interest that prohibits me from participating in the discussion or vote on this matter as an elected member of the board. However, I am making the choice to abstain from any discussion, participation in the discussion or vote on this matter. [01:03:29] So I would ask the clerk to please note that I am not participating in this item. Thank you. Thank you, ma'am. Any further discussion on adding this item to the agenda? Mr. Chair, I move we add Resolution 248-25 to the agenda. Second. Thank you, Mr. Cooper. [01:03:45] Motion made by Mr. Cooper, seconded by Mr. Rogish. Those in favor, say aye. Aye. Any opposed? And the one abstention noted. Is there any discussion on the item itself? And if so, let's have it now. If not, I'll entertain a motion on the item. [01:04:00] Mr. Chair, I move we approve Resolution 248-25. Motion made by Mr. Nelson, seconded by Mr. Cooper. Those in favor, say aye. Aye. Any opposed? Again, noting the one abstention. Motion carries. [01:04:16] Mr. Manager. Mr. Chair, I have no other business this evening. Thank you, sir. Any closing comments from my colleagues? Seeing none. Y'all have a wonderful Tuesday. Thank you. ---------------------------------------------------------------------- Coraggio Consulting · aguyonx.com
