Hey, welcome to the Tuesday, October 14th meeting of the Henrico County Board of Supervisors. Before we begin today, in addition to welcoming you all here, I want to remind folks that public comments, for those in person, will be given from the lectern in the rear of the room. [00:00:25] And for those of you that are watching on live stream for tonight's meeting on the county website, you're encouraged and able to participate remotely. Go to Board of Supervisors webpage at henrico.gov backslash supervisors. Click on guidance for Board of Supervisors meetings. Scroll down and click on WebEx event, and a moderator will help you out. [00:00:44] We'll begin, as we always do, with a pledge of allegiance and an invocation today. Our invocation will be brought to us by Bobby Mead. Bobby, great to see you today. And I'm going to turn it over to Supervisor Roundtree to introduce the individual who will be leading our pledge tonight. The individual who will be leading the pledge tonight is young Mr. Lennox Whitehead, who is joining us. [00:01:06] Please stand, face the flag, and if you would like to pledge allegiance to the nation. [00:01:29] We come together just getting to gather, Lord, under the government of Henrico. We thank you for the leadership who provide, who protect, and all they do for us. We pray for those first responders out taking care of our county tonight, and pray over this meeting today that peace and, Lord, just unity be through it all. [00:01:50] Thank you for your great grace and mercy, we know. Through Lord our Savior, in your name we pray. Amen. [00:02:10] Let me thank you, Lennox. [00:02:27] Colleagues, I will accept a motion to approve the minutes from our September 23rd meeting. There's been a motion made by Mr. Cooper, seconded by Ms. Roundtree. Those in favor say aye. Any opposed? Motion carries, Mr. Manager. Mr. Chair, members of the board, I have no comments this evening. [00:02:44] Any comments from my colleagues? Seeing none, I just want to take a moment for those that are in attendance today and those that are dialed in virtually and for the official record that at 2 o'clock this afternoon we had an announcement out at our water treatment plant that Henrico County has just become the first jurisdiction in the country to receive a water and sewer quadruple AAA bond rating, first in the country. [00:03:14] So huge, huge news. This Quazahilla 2.0 comes right on the heels of Henrico County being just the third jurisdiction, the third county in the United States to receive the four AAA bond rating with regard to our government. So, you know, those two things combined, Mr. Manager, colleagues, those in the audience. I mentioned it in the airport during my comments for the first one, and I mentioned it to a few people today. The fourth bond rate, fourth AAA bond rating for water and sewer bonds may not [00:03:51] be a sexy headline, like building a new school or opening a new park. But I will tell you for the for the taxpayers benefit in this county it proves decades of fiscal prudence and it really really really allows this county to do the people's business at the very best possible financial picture rates as possible so i want to commend my colleagues on this board the my colleagues that have come before us mr manager you your guidance the finance team and quite frankly for today's announcements the dpu team you know bentley's team was out there in force today and the great [00:04:26] work that they're doing out there every day is now rewarded and publicly known so sometimes i mention to those those folks at the dpu folks that they operate behind the scenes while today they were front and center rightfully so any other comments all right seeing none um there is uh i think leanna hardy is i think i saw i swear i saw you m sure oh how are you from the citizen thank you for being here uh today mr manager uh mr chair um moving to public hearing rezoning cases and provisional use permits first agenda item 249-25 in the varina district is [00:05:01] elder homes corporation with a conditional rezoning request and that would propose single-family detached homes mr emerson this case has been deferred to request has been for deferral to november the 12th is that yes sir that is correct all right thank you mr emerson this is a public hearing any questions for mr emerson on the deferral seeing none this is a public hearing does anyone in the room wish to speak to this deferred item anyone on webex wish to speak to this deferred item there's no one to speak to this item all right thank you ma'am uh mr nelson [00:05:42] what do i need to just accept it then yeah this is a defer request is this defer request by the applicant yes sir this is a deferral request by the applicant in order to address some outstanding concerns raised by staff and the planning commission i get it i move that the elder homes corp raz 2025 10177 10172 to be deferred to the november 12th meeting at the request of that second motion made by mr nelson seconded by mr cooper those in favor say aye any post motion carries [00:06:18] mr mr chair um agenda item 250-25 case out of orion of wagner urban logistics with a request for provisional use permit that would allow data centers on a parcel has been withdrawn mr emerson uh any other information other than that no sir that is it we received a letter late yesterday evening withdrawing the case from consideration thank you sir mr newby no action required that is correct mr chair thank you sir any comments on the item uh i'm going to hold my comments in the hand yes sir mr manager so mr chair you would move [00:06:53] on to agenda item 251-25 before you in the three chop district is imperial health services lp with a conditional rezoning request from o2c to osc office service district parcel containing 11.7 acres located on the north line of mailing drive near its intersection with north with param road this case the applicant is proposing an office warehouse use and uh neha shinde is a new presenter before the board neha this is your first time presenting a case that is correct well welcome [00:07:31] thank you floor is yours thank you mr manager mr chair members of the board as mentioned this is a request to rezone a conditionally rezone 11.73 acres from o2c office district conditional to osc office district conditional to allow for an office warehouse use. The site is located on the north line of Malin Drive approximately 315 feet south of its intersection with North Parham Road. Before you is the concept plan which features an existing office building that is currently underutilized. The applicant is requesting modifications to the facade facing the interior parking [00:08:09] lot to accommodate the installation of overhead doors to create flexible office and warehouse spaces. The applicant has submitted proffers that include right-of-way dedication as needed for a turn lane and sidewalk on North Palm Road. Other profits submitted will include additional landscaping, use restrictions, and hours of construction. [00:08:31] All of these are comparable to and generally consistent with those provided with similar recently approved rezoning requests. The 2026 Comprehensive Plan recommends office with a small portion along the eastern boundary designated as environmental protection area. [00:08:49] Staff believes this request offers an opportunity for redevelopment and provides a suitable use for the area. And that the submitted concept plan and proffers outline a reasonable approach to the redevelopment of this underutilized parcel within a developed section of the county. [00:09:06] For these reasons, staff supports this request. This concludes my presentation. I'm happy to answer any questions you may have. Thank you, ma'am. Any questions from my colleagues? The one community meeting that I attended, I think one person came. [00:09:24] Was there any other comment or emails that were you received from the public about this case? I did receive general inquiries about the case once people saw the sign posted. All right. And did they, after having their questions answered, were there any concerns? They were comfortable with the use. Okay. And the back part of this is mostly business, but there is a line of homes towards the back of there, and everybody that lives there. [00:09:46] Yes, they were notified, and I did not receive any. Absolutely. I don't have any other questions. I think this is a great opportunity to kind of spruce up an office park that has not had much use of late. So I'm excited about what's going to be done with it. [00:10:02] Thank you, ma'am. Any other questions for us? All right, this is a public hearing. Is there anyone in the room who wishes to speak to this case? Is there anyone on WebEx for this case? There's no one to speak to this item. Thank you, ma'am. Ms. Rauncher. Mr. Chair, I move that REZ 2025-101192 Imperial Health Services LP be approved with the proffers dated August 25, 2025. [00:10:26] Motion made by Mr. Rountree. Seconded by Mr. Nelson. Those in favor say aye. Any opposed? Motion carries, Mr. Manager. Mr. Chair, members of the board, the next two cases are companion cases, 252-25 and 253-25 with Wilton Commercial 2 LLC with a conditional rezoning request from B1C to B2C and R6C, a parcel that contains nearly 2.7 acres located on the south line of Patterson Avenue near its intersection with Pump Road. [00:10:58] in this case the applicant is proposing a master plan development with multi-family apartments and office uses 253-25 is a request for a provisional use permit under chapter 24 to allow those zoning modifications uh miss shinde thank you mr manager mr chair members of the board as mentioned this is a request to conditionally rezone 2.66 acres from b1c business district conditional and b2c this district conditional to r60 general residence district conditional to allow for a master plan [00:11:35] development with multi-family apartments and office uses surrounding uses include the canterbury shopping center to the north across patterson avenue business uses to the east and west and a multi-family development to the south the applicant has also filed a companion provisional use permit case PUP 2025-101724 to allow zoning modification and commercial uses on the site. While these cases are being heard concurrently, the rezoning and the provisional use permit request will require separate actions. As seen here, the site will be developed in two phases. There [00:12:13] will be three points of access, two from Patterson Avenue and one from Pump Road. One of these access points will feature an L-shaped internal road that connects the western edge of the site to the pump road access allowing for users to the east to have cross access phase one will be constructed along partisan avenue and will consist of a five-story building and will feature offices on the first floor along with structured parking to the rear structured parking will also be available on levels two and three while residential units will be on levels four and five the roof [00:12:51] will also is proposed to include amenities for the building residents. Access to the parking garage will be provided from both the internal road as well as Patterson Avenue. Phase two will be situated to the south of the internal road and will also consist of a five-story building planned for residential users. A portion of this building will include covered parking on the first floor. [00:13:14] Profits submitted, address, setbacks, sidewalks and other topics similar to other recently approved rezoning requests the applicant has also provided elevations and materials seen here that illustrate the building treatment for both phases and would be consistent with the surrounding community the 2026 comprehensive plan recommends commercial concentration for the area although the proposed development does not entirely align with its designation its location along a major roadway and its proximity to office retail and multi-family users present an opportunity for a more intensive [00:13:53] use of the property, thus making it a suitable use for the area. For these reasons, staff supports this request. This concludes my presentation. I'm happy to answer any questions you may have. Any questions for Nehi on this case? I just have a couple. Sidewalks are on the frontage? That is correct. Five foot along Patterson Avenue. Along the entire length of Patterson Avenue. And I think this case, we've actually, we had a community meeting. That is [00:14:29] correct have we had any opposition or letters that came in we just had one inquiry about the site again you know seeing sign posted and resolved that is correct my biggest headache on this project is schools as everyone knows this particular piece of property is currently zoned Mayberry Tuckahoe Freeman that's correct and I have worked with my colleague Miche in the Tuckahoe district to ask that this be included in the redistricting so this is [00:15:07] one of the pieces this is the piece that I support on the redistricting I think it's I don't think we have anybody from schools here thank you this this piece would move this particular location to Harvard Elementary School this would move this location to the new Cuiacuson middle school and this would move to the high school of Godwin that's correct right and so we can't proffer that in this because the the applicant has no control over that that is [00:15:38] correct yeah I am the other question in the document shows the yield that this may produce, and I just want to make sure that I'm, we're looking at 150 units, and the estimate is 23 students on the yield, on elementary school students, and the Rise apartment, that's the only other apartment complex that's in Tuckahoe that's recently built, I think the [00:16:17] yield is way less, the actual actuals, even though there are more units, so I'm thinking that that yield will not be that high but again we cannot afford to send that many new kids to Mayberry, Tuxahum Middle or to Freeman frankly so asking the school board that that particular scenario which is Carver section one and Freeman section three be still included in the register thing so I don't have any other questions on this particular case at this time so any other [00:16:51] questions all right this is a public hearing is there any in the room that wishes to speak to this case. I had one person sign up in advance. Is there Adrian Avram here? Thank you, sir. You can go ahead and go first since you signed up. Good evening. My name is Adrian Avram and I'm the property owner of the commercial building located at 1006 Pump Road. Thank you for the [00:17:29] opportunity to speak today and I'm here to respectfully oppose the proposed rezoning of the property parcel number 741-741-1794 known as Wilton properties. [00:17:50] I propose to oppose the rezoning from the commercial to residential use. My opposition is based on two major concerns that will directly and negatively impact the existing community one is the increase traffic volume and the other one is the [00:18:22] significant damage of the private road currently used for access and I'm sharing that private road I'm at the corner at the pump I'm at the corner at the pump road behind the 7-Eleven. So I'm south of Wilton properties. First, traffic volume and safety. [00:18:54] Our area experiences already considerable traffic during peak hours. Converting this property to residential use will substantially increase the number of vehicles, estimated at 700 more vehicles entering and exiting the area throughout the given day. [00:19:23] Unlike commercial use, which tends to have more predictable traffic and limited evening activities, residential developments will generate more traffic around the clock, early mornings, evenings, weekends or holidays. [00:19:44] This will increase not only the risk of congestion but also raise safety concerns for the pedestrians, cyclists and residents who already rely on this road for daily use. [00:20:02] Emergency vehicle access could be affected as well, causing additional safety threats. Second, the damage to the existing private road. The current access road which is privately maintained, it was never designed or built to accommodate heavier or more frequent traffic that residential development will bring. [00:20:35] As more vehicles will use the road, it will deteriorate much faster which is already in desperate need for repairs and that will lead to more expensive maintenance and repairs. [00:20:53] Those costs will be unfairly fall under the existing property owners, even though the new development would be the primary cause for the increased wear and tear of the road. [00:21:10] For these reasons, I respectfully asked the board to deny the rezoning request from residential from commercial to residential use. Thank you. Thank you, sir. Hi, my name is Jennifer Lieberman. Y'all know who I am. [00:21:34] Decades ago, things like grocery stores and shops to meet everyday needs were closer to neighborhoods. You likely knew someone who grew some of the food that you consumed. You had a genuine connection with your neighbors, as that is all that was for communication. [00:21:56] Nowadays, there's nothing lockable, which you all pronounce with building sidewalks going to nowhere. With all these housing developments, I don't see any substantial ideas to figure out how to get people more community-oriented with any of these proposals, save for the Dry Bridge Road development. [00:22:15] Even that is a stretch. You are approving developments in ways that necessitate people use 4,000 or 5,000-pound vehicles just to get around. Instead of using ideas that were either proposed at those lakeside meetings, which, let's be honest now, were a waste of money, waste of taxpayer dollars, as you all knew that all of that area was owned by one couple. [00:22:46] You could have communicated with the community to figure out ideas. All I'm really asking is that when you develop things, or when we develop things, I think that we really need to maintain the mentality that we need more community-oriented things, not necessarily just to build just because we can. [00:23:15] That's all I really have to say. Thank you. Anyone else in the room wish to speak to this case? Is there anyone on WebEx to speak to this case? There's no one to speak to this item. Thank you, ma'am. [00:23:33] Yeah, we're going to take this in two sections, Mr. Rogish. Can I ask the applicant to just come up for a second and just talk about a couple things real quick, Mr. Chair. Yes, sir. I did hear something. [00:23:50] I'm assuming the private road that's being talked about is Canterbury Green, and maybe it's for staff, but is that the road that we're talking about that's private? There's a road that comes off Patterson Pump Road, and right behind the 7-Eleven, there's a private road that divides. [00:24:10] The 7-Eleven from the dentist off. It advises 7-Eleven, and it enters into Canterbury Green Shopping Center. That road is a shared road between us and Dennis. That road was actually a heavy-duty asphalt road. [00:24:30] It was designed for shopping center traffic. There was, unfortunately, fire, but there was significant shopping center traffic there. Matter of fact, in the evening, one of the tenants in the back, the recovery full circle brief, has about 50, 60 people who come there in the evenings. [00:24:57] I don't know where the gentleman's property right next door got his traffic statistics, but we do not think there will be a huge increase in traffic. [00:25:13] It will probably be spread out about the day. As people know, they go to work. So it will be just the sidewalk issue. This is proposed a five-foot sidewalk along this property. [00:25:33] I don't own the property, Pump Road. However, I've been in touch with the owner of that site. He has not called me back yet. He's out of town to see if he would like to continue the sidewalk all the way to Pump, which will then allow the community, not only this community, but the community behind us, To walk on Patterson Avenue, hit the pump, cross, and enjoy the Dunkin' Donuts, the Shade Max, the brewery there across the street. [00:26:11] That's all I've got. Okay, yeah, and I've also spoken to a number of the businesses across Patterson that are super supportive of having some additional residents in this location. Having it walkable is a priority. [00:26:28] And I do feel like from a commercial concentration, that would be more in the daytime, that having residential and office, I think it would be more after-hours traffic and on weekends than it would be commercial concentration. So to the businesses that are open 9 to 5 or 8 to 6 even, I think it would be less traffic. [00:26:48] I would also like to offer to the gentleman who owns the dentist's office, I'd be happy to talk to him about the shared road and the shared expenses through that road. Sounds like you just got yourself a free road potential. I'll share it. [00:27:04] I'm sorry. Okay. I didn't say that. Oh, I'm sorry. That's how I heard it, sir. Thank you. Thank you, sir. Any other questions? There was no one else. We already asked for public comment. Mr. Rogish, we're on the rezoning case, and then we'll take the PUP separately. [00:27:22] No further presentation, I would imagine, is needed, but a few separate votes. Okay. So, Mr. Chairman, I move that REZ 2025-10-1725, Wilton Commercial 2, LLC, be approved with The proffers date is September 10, 2025. [00:27:38] Second. Motion made by Mr. Rogish, seconded by Mr. Cooper. Those in favor say aye. Aye. Any opposed? Motion carries. The provisional use companion case, Mr. Rogish, this is a public hearing. Does anyone in the room wish to speak to the provisional use case? [00:27:55] Anyone on WebEx? There's no one to speak to this item. All right. Thank you, ma'am. Mr. Rogish? So, Mr. Chair, I move that we approve PUP 2025, 10, 17, 24. wilson commercial 2 llc the recommended conditions listed in the staff report second motion made by mr roguish seconded by mr nelson those in favor of that uh any vote motion carries mr manager congratulations nayam thank you sir great job that was our second case all right next uh 254-25 [00:28:31] in the tuckahoe district is mohammed ahmed with a request for provisional use permit under chapter 24 the county code that would allow an indoor recreation facility a snooker hall on a parcel that is located at the southwest southeast intersection of old parham road and blankenship road for you is livingston lewis with his first presentation before the board livingston welcome thank you sir mr manager members of the board uh as mentioned this is a request for a snooker hall in one of the tenant spaces in the old parham center retail building near the intersection of [00:29:07] north parham road and west broad street the site is zoned b1c business district conditional which requires a provisional use permit for indoor recreation when there are three or more pool or billiard tables the proposed business champion snooker would be laid out as shown on this exhibit with eight snooker tables and two billiard tables both are queue and ball games but with different dimensions the space would be primarily for game play as suggested conditions number four and five prohibits service of alcohol smoking and vaping and proffer number 10 of the underlying [00:29:44] zoning case prohibits a full service restaurant however the applicant has stated they may provide pre-packaged snacks via vending machine other proposed conditions limit the number of game tables and stipulate typical security measures for this type of use the zoning ordinance also requires the applicant work with police to create a septed plan the 2026 comprehensive plan recommends commercial arterial for the subject site a designation which is consistent with the indoor recreational use subject to the suggested conditions staff believes this request would [00:30:21] be compatible with adjacent uses staff supports the request and the planning commission recommended approval at their september 11th meeting this concludes my presentation i'm happy to answer any questions thank you sir this is a public hearing any questions for lewis right seeing none is there anyone in the room who wishes to speak to this case anyone on webex there's no one to speak to this item thank you mr rogish mr chairman i move that we approve pup 2025 10 14 23 muhammad [00:30:56] ahmed with the recommended conditions listed in the staff report been a motion made by mr rogish there's been a second by mr cooper those in favor say aye aye any opposed motion carries mr manager next mr chair members of board 255-25 out of the tuckahoe district main street homes of virginia with a conditional rezoning request from a1 to r3ac one family residence district parcels that contain 7.25 acres located at the southwest intersection of church road and covey run drive [00:31:29] in this case the applicant is proposing single family homes mr lewis thank you mr manager members of the board this is a request to rezone two parcels at the southwest intersection of church road and covey run drive to allow for the development of up to 14 single family homes between two existing subdivisions retrievers ridge to the west and covey run to the east the proffer concept plan shows the proposed linear arrangement with all homes being accessed from covey run drive and avoiding a wetland area in the middle r3a zoning is requested to allow a slightly smaller [00:32:06] minimum area for two of the lots most affected by the wetlands those would be lots four and five indicated with the cursor however the proffers include lot width and area minimums that meet or exceed our three standards for consistency with covey run other proffers relate to exterior building design and materials sidewalks tree save areas and landscape buffers among other topics this evening you received revised proffers dated today with revisions to numbers 2 and 18. the change to number two further reduces the allowed hours of exterior construction which are now [00:32:45] proposed as monday through friday 8 a.m to 6 p.m saturday 9 to 5 and no sundays proffer number 18 has been revised to prohibit any vehicular connection between the Browerton Road stub to the west and Covey Run Drive to the east. Staff would prefer to allow this potential connection in the future but this revision was in response to citizen concerns about potential cut through traffic. [00:33:10] Citizens have also reiterated a desire for the applicant to limit driveway materials to aggregate only but there has not yet been a change on that issue. The comprehensive plan designates the site for suburban residential 2 which recommends a maximum of 3.4 dwellings per acre with a proffered limit of 1.93 units per acre and other assurances provided staff believes the proposal would be consistent with the 2026 plan and compatible with adjacent neighborhoods for these reasons and the connection issue notwithstanding staff supports the request and believes it would be a [00:33:48] logical continuation of the residential development in the area planning commission recommended approval at their september 11th meeting and this concludes my presentation happy to answer any questions thank you sir any questions for livingston on this item yeah mr lewis just uh you referenced so covey run to the east that's r3 currently and so covey yeah that's r3c this would be um r3ac because the two lots would be less than 11 000 and that's because of the wetlands you referenced so correct same size homes and we've worked very diligently with the [00:34:27] hoa on making sure the homes were the same size etc that's correct um you did reference the cut through um down below on bow bowerton i know staff has asked for that but the applicant has proffered that there will not be a cut through connection from bowerton correct that's correct in this location here okay um there has been significant and i don't think you mentioned it but there's been On the significant discussion on the BMP on the south side, yeah, right there on Covey. [00:35:05] That's because ideally they would utilize the BMP that's already existing in the east right there, yeah. So there's a BMP there as well, and so they would like to utilize that BMP. [00:35:22] However, there's a, I don't know if it's a title dispute or if it's the developer that built Covey East has not turned that over yet to the HOA, even though the HOA is maintaining it. So because of that, this applicant cannot utilize that BMP. Is that your understanding? [00:35:43] You have that correct. And there's nothing at this point that the county can forcefully do to make that transition occur. We can still try to work with the applicant, well, not this applicant, but the prior developer to try to turn that over. [00:36:00] If that's turned over, then they can utilize one BMP, and they might potentially be able to build one more unit on that lot. Is that correct? That's correct. the text on the layout actually states such and the proffer reiterates that it's hard to read on the plan but that is stated on the on the layout that a lot 14 would go in this location here if [00:36:26] if that were if that scenario played out the only other comment i guess question and again going back to the schools and i just want to make this in in this application we're we're being shown a functional capacity of Gaten Elementary of 614. We're showing membership of 589. We're actually [00:37:00] saying that 14 single-family homes will yield three elementary school students, which I think is a little low personally. I guess when I look at functional capacity of 614, the schools put out last week a functional capacity of 644, and there's a functional capacity that Ms. Roundtree had a case last in December of 2024 where also the functional capacity was 644. So something that again I'm working with my colleagues we're talking with some of our other colleagues but [00:37:36] that functional capacity when presented to us we're not sure exactly what that exactly means sometimes. I don't know if you can answer that or. In the research that we've done since the question was brought up as I understand from schools functional capacity can fluctuate on a year-to-year basis based on usage of the building programming and the like you can think of any number of scenarios in this case schools passed along to us the gate and elementary in that intervening time the change was caused by the fact that there was a pre-k program introduced [00:38:13] taking two classrooms offline so presumably those pre-k attendees would also be removed from the statistics so that's my understanding the very basic understanding of it but that's the explanation of the change 644 614 can I go ahead finish that but in Livingston I don't know if you can answer this Joe Jane whoever what is the school's role in determining these capacity numbers and for every case that [00:38:53] that comes forward the schools um with the department so the impacts with police and libraries and wherever every zoning case um when you guys give your recommendation to plan the commission etc um i've had a question well not a question but it had been implied to me that schools doesn't really have a part in developing these numbers that you that we see [00:39:30] now i've been on board for a decade and a half i thought schools was involved in whatever numbers are given to us is that true yes sir that's absolutely true what we do is we provide schools all the development information number of units generated type of unit and and they from from that information take it and based on their numbers that they see that are that come forward from these types of developments they generate the numbers that they project will be produced by [00:40:06] those units. There have been a number of different people over the years since I've been dealing with it that have done these numbers for the schools. Each one has done it differently. At one point the schools did send home a survey with the elementary school students you some of you may remember it they would stick a piece of paper down the backpack and as you pulled everything out of your child's backpack you'd find that sheet of paper they would say how many siblings do you have at home? What are their ages? Who else is in your household? They discontinued doing that, I believe, sometime around the recession. And again, there have been various different [00:40:45] individuals, all very competent, that have worked with it. But their formulations have also changed over the years. But we always meet with schools. We have traditionally met with them at least two or more times of the year they receive all the development information both both the the entering the pipeline on the rezoning side and both the active side so that's it that's the answer to my question so they are aware of what's in the pipeline what's current what's being heard and what has been approved yes sir absolutely they are okay so you don't know how that information [00:41:24] is disseminated to elected officials on the school side, but what I'm hearing you say is as our staff has that information, schools helps us create the numbers and projections for how potential zoning can impact school population. [00:41:45] Yes, sir. The numbers that you see reflected in your staff reports each month on the zoning cases, those numbers are produced by schools, not by us. Sorry, Mr. Brokers. Thank you, sir. Oh, that's exactly the point. The chart that we get, Mr. Nelson, is effectively cut and paste from the schools. [00:42:03] So when we're looking at this, and just like we did in the case across the street, and that was also a Main Street product, that was 41 townhomes that Ms. Roundtree had in December. That's where in December it showed 644, so there was a lot of capacity there. [00:42:22] I have some concerns, truthfully, from the membership to capacity here. that we're really pushing it but knowing that schools produced a number of 644 again last Thursday for functional capacity I have less of a concern on the actual capacity of getting based on the numbers that the school has has provided to us so with that I think there are some other questions so sorry I yield. Any other questions for Livingston at this time? All right it's uh this [00:42:55] is a public hearing is there anyone in the room that wishes to speak to this case sir? My name is David Hildebrand the president of the Cubby run homeowner Association first I want to thank everyone here since this whole thing got started working with Main Street homes and accounting and Commission has gone well in most cases we've gone back and forth on things and and they've tried and worked to accommodate us on almost that we have requested and I appreciate that the [00:43:31] flying the ointment right now as brought up during the other planning meeting was that we don't have the title we didn't know that these years we have paid to maintain that property and only found out actually through the work of Main Street Homes attorney Jeff Geiger did not when we went back and found the records we found that they had filed that Youngblood properties had filed the paperwork that said they did turn it over but they never did we have been pushing for the county to help us. [00:44:04] We're kind of the innocent party here. We've incurred large legal expenses trying to get this done because it would make sense for both the county and Main Street homes to use that existing BMP storm drain that's already on the street is sized to handle it all with the additional homes. [00:44:20] What I'm asking now is whether or not the county is still going to try and help get that title issue resolved because it's not just a dispute. We got caught in the middle of this one. county dropped the ball by accepting signed documents that said the transfer had in fact occurred. We have copies from your files that didn't happen, all right? And so our attorneys have not gotten any response from Youngblood Properties, and at this point, if it's not going to happen, I need to know that, all right? So my question to you is, I know you can't predict the [00:44:58] outcome. Is the county still planning to help or to try and get that property transferred? That's question I have for you thank you sir I'll address it after everyone okay yeah absolutely yeah thank you sir the second part of that is if the answer is no that you're really gonna pull back from that and assume it's just a spute between you know young broad properties and our HOA which is not then with the county I assume if there's not going to be any help and no property transfer because we [00:45:35] can't keep carrying all these legal expenses then would the county be acceptable for us to notify them that we're no longer going to maintain a property we don't own that either the county would have to take over the main or turn it back to Youngblood properties it's a substantial piece of change each year to do that that's my two questions gotcha thank you sir all right I'm Alex galukov for current resident at 521 cover and drive and I would like to [00:46:12] comment about the thing that the presenter already mentioned about pro for offer item nine about driveway private material and we would like to request to leave only as the only option to have aggregate material and it's I want to explain why because we want a cohesive and consistent look of our neighborhood [00:46:45] And when we were building our houses like 10 years, 12 years ago, for our developer, the builder, it was very important that all lots would have aggregate driveway. I remember it was very important for them. [00:47:04] And all our current residents, they also have a similar view. we want to have matching appearance for both sides of the street and so that all lots all new lots would have aggregate material currently in the profit it says other materials also like concrete and other materials and we only request to to keep only one option as a aggregate material [00:47:33] that's it thank you sir hello my name is Dari Zimina I am also a resident of Kaviran and I have slightly different issue i think i'll convey our common concern for the whole street uh we've been living there for quite some years by now and all of us witnessed uh how long the lot for uh shy walk uh development with town homes at the corner of uh pump and journal was sustaining deforested barren [00:48:10] barren eroded you know land quite ugly and dusty and that construction project is not complete there is still work on those townhomes uh also from what we see around us mainstream homes acquired two more lots from my understanding it's approved and will the work will be done that would be across the church from us there will be 40 more new homes and behind that there will be another there is another area cleared right now for construction of single [00:48:45] family homes with uh many projects and possibly you know most likely our project on the way it's uh very good from uh for main street i'm glad for them but we're kindly asking to continue this very you know productive uh dialogue and kind of nurturing attitude to this neighborhood and put special you know provision not to deforest this patch of land uh several years before the actual construction will start it's particularly possible to avoid since in our case storm drainage [00:49:24] is already in place so it wouldn't take that long to equip the land for single family home construction after it's deforested thank you so much all the residents would highly appreciate that and thank you again main state homes for talking to us thank you first i just want to say that I don't understand how the county operates without a reputable ecologist on staff that you can consult with before voting for any of these measures. I also, so I'm here for yet another [00:50:02] meeting talking about single-family homes as I don't think you are quite conceptualizing what I have to say as some existential problem. So I suppose that I need to be more blunt and concise as to what I am saying. Let's talk about the basics first. Where does a single-family home development project go. Generally speaking, that land gets built on either land that is occupied by trees or by grass or some other low-level species. Let's talk about trees first, as that [00:50:38] is the bulk of my issue. What do trees give to the earth? We are on the east coast, right? We deal with hurricanes and tornadoes every single year. What do trees do? They protect us from wind. I don't know about you, Jody, but I've been assaulted by the wind while riding. You know, I had a liver injury that I was in the ICU for five days. It hurt just how it is, but that's because we don't [00:51:09] have the infrastructure or the mentality of keeping things the way they are. So what do trees do for the surrounding environment? Directly for humans, it gives shades for building infrastructure like businesses and houses so that when the sunlight is searing, which in turn helps lower electricity bills during the warmer months when the AC is consistently running as it seems that we have such a disconnect with outside that some need the AC running when it is 70 degrees out. [00:51:51] Secondly, trees give so much space for so many species to live their lives. Birds create nests, squirrels eat the masts that help them thrive during the fall and winter seasons. They create so much foliage for so many species that put their offspring in or they live in so that they can stay warm enough to not die. [00:52:15] But for some reason, we maintain this mentality that we need to act as gods and sanitize what it really means to be an animal. We need to get rid of the homes of every single animal so that we can theoretically occupy what we can call home because they're icky or some nonsense and spray poison to ensure that they don't come anywhere close to where we live. [00:52:42] because giving space for them to occupy for places like stocks or dragonflies to watch for their prey is just immoral for some reason. [00:52:58] From what I can tell, most of you have children, right? I find it absolutely important that you are telling your children that it is okay to vote for measures that will lead to ecological terrorism, ecological disaster. [00:53:15] You keep voting to demolish areas that are currently occupied by countless species of plants and animals without thinking. Perhaps we need more wildlife. I don't understand how you can sit there and vote for things that will lead to our planet doing whatever it can to eradicate our species. [00:53:37] Thank you very much. Anyone else in the room wish to speak to this case? Is there anyone on WebEx that wishes to speak to this case? Yes, sir. I have two individuals lined up to speak. All right. Thank you. Ms. Maria F. [00:53:57] Can you hear me? Hello? Can you hear me? Yes, ma'am. Go right ahead. Go right ahead. Yes, yes. Thank you. My name is Maria Francesco. I'm a Coviran resident. I just wanted to confirm that the questions about cohesiveness of our street was always discussed with Main Street Homes and Mr. Rogesh, and I appreciate his involvement. [00:54:21] And we are not picky when we're talking about driveways. We are not picky because we just want left side of the road look the same as the right side of the road. And I think it's absolutely normal because if we decide to sell our homes or if new families are moving to this residential area and they will see and they will see completely two different driveways, they will think there is someone someone had some issues when designing this street. [00:54:46] So we it's not its driveways, it's the homes, it's everything. I don't think there is a single street in Henrico County where left side looks opposite to the right side. It just happened this way that left site was developed several years ago, and only now we have a chance to develop another site. [00:55:03] So I would really appreciate if you will look into this matter and make sure that our both sites look the same. I also wanted to address the issue with the schools, and I addressed it multiple times when we had a planning zone committee. But I don't think that planning zoning department is really into it. [00:55:22] Every time we are talking about new students, we are talking about 14 homes. But the reality is there are no 14 homes. There are 120 townhomes built in by Main Street Homes, Shire Walk, and another community across the street, Church Road. There are our 14 homes, and there are 10 homes on the old Pamp Road. [00:55:40] We're talking about 150 new families moving to this new area. 150 families, and Main Street Homes is constantly advertising this area as the area with good schools. That's the reason why I moved two years ago into this area. [00:55:56] We walk past Shire Walk every single evening with my family and with my kids. And we see who is moving into those townhomes. Families with not at least one kid, but one, two, sometimes three kids. So right now, we are not talking about three or four kids going to all Gaten Elementary. [00:56:13] We are talking about 50, 60, even more, depending on how fast Main Street homes will move with their construction. Right now, we have a replacement principal in Gaten Elementary School. So I don't know who will be the new principal. And I don't know if there are discussions with the new principal will take place. [00:56:32] But as a mom of three, I can tell you that last year my kids had like 24 kids in school. This year my fifth grader has 28 in a very small class. And I don't see any plans for the school to add any more facilities. [00:56:48] And people move into this area, moving for gate and elementary. I don't think that people will move and be happy when in two years school board will decide to move those families to another school. They move specifically for Gaten. So I really hope that when we're talking about new kids for Gaten, we are not talking about 14 homes on Coviran. [00:57:08] We're talking about 150 new families. And I would like also to comment and say that I totally agree with two previous residents that keep talking about deforestation of the area. Main Street Homes does not have enough headcount, as I see it, to start the project and move very fast. [00:57:27] It's been two years, they work on the Shire Walk, and it's not finished yet. So it might last three years, we don't know how many years. But we already see across the street, there is a new construction that is planning to start, and they will start cutting trees there. We're asking, please, make sure we are not looking at the empty land after they cut everything for years to come. [00:57:51] Please convince them, talk to them, do an audit, and make sure the construction is not lasting for five, seven years. We don't know how many years. We are cooperating with you. We understand that it's not up to us to stop this construction, even though we would like to keep the wildlife and nature. [00:58:09] But we are asking you, please, help us to speed up this project so that we don't look at the deserted area for five or I don't know how many years. Because we never received anything in writing as to what is the time frame of this construction. [00:58:26] And please understand that we will be locked in our homes. Our kids will be locked because we're safe for their safety. For many years, we don't want to live in this misery for five years. We are cooperating. If you say, okay, it's one year, there's a certain time frame. [00:58:43] Okay, we will talk to our kids. We will make sure we take care of them. We will make sure they don't go to the construction. site but since there's no fence no proper safety measures i've sent photos before where kids were climbing the sand piles i go to shire walk and i see garages open ladders everywhere on the floor i understand that maybe there it's it's okay but to me it's not okay so i just want you to please watch with the residents and make sure we don't love in this misery for five years thank you [00:59:19] thank you ma'am flip us to the second speaker ma'am yes sir miss lynette c you can now speak can you hear me yes ma'am okay um i just wanted to piggyback on the school when this project started i called gaten elementary myself and i asked um how many more kids they had to capacity and they said well at this point um and we haven't finished registration for the year we have like three kids left to our capacity the number that you guys are giving is from last year it's not [00:59:56] from this year. So I don't think anybody is doing their due diligence because nobody has actually called Gaten and said, hey, where are you at on your capacity as of right now, 2025? And you have all of these new townhomes that are not, they're not filled up yet. They haven't been bought. I think last time we checked, they were like half percent or something. And then you have the other approved neighborhood and then the one that's going to go behind BP or whatever. Approving this neighborhood is another 14 homes so like piggyback off what Maria was saying it's a lot more than 14 homes that are into consideration right now for Gaten Elementary and the school size for the [01:00:35] classes I have a daughter in third grade they have significantly increased this year which is making it pretty difficult for teachers who are used to teaching in a smaller classroom size so that's just one thing and then the other thing is the protected tree line that they are talking about that only covers half of the area, I don't see why it's not common sense to make that tree line protected all the way down to the end of the street so that that wildlife area can continue on into the other wildlife area, which is like the Tuckahoe Little League ball field where there's a whole bunch of trees and things like that where it can continue on. I feel like stopping it if [01:01:13] these new homes end up putting fences and stop some, you know, animal life from being able to go through you're going to have a lot of dead animals on church road seems very um inconsiderate of you know maintaining the wildlife that henrico talks about taking pride in and for some reason when it was proposed um originally it got nixed i don't know why i just 10 feet of a you know a tree line a buffer if you will makes total sense to me that's all i have to say thank you ma'am is there anyone else on webex ma'am there's no one else speak to this item all right thank you very much [01:01:51] mr roguish before i'm gonna have the applicant come up i just want to make a couple of quick comments just to make sure everybody's on the same page there have been four rezoning cases in basically this intersection over the past five years um and i'll get to you in one second mr geiger but i believe that the shire walk when we talk about that one has about 82 townhomes and i think about 50% are built out and again you can clarify that in a second but so when schools gives us operational capacity or I'm sorry functional [01:02:28] capacity and actual enrollment I'm assuming that they're including the build out if a product has been built that those kids are in the operational capacity or operational numbers the single-family homes that is currently not owned by this applicant it's owned by another developer that are being bill there are 28 homes that's actually zoned to short pump elementary school so i don't want um the confusion at gate and then again this is all in the current boundary lines that exist but those kids the boundary line does does cut right through there so it's and it also cuts between [01:03:05] miss roundtree and i's district so north of church road is in miss roundtree's district south is in my district so that piece the 28 homes single family homes is designated currently to short pump not to Gaten okay and this is what I was asking earlier when we got the case from Ms. Roundtree in 24 in December the functional capacity was showing us as 644 building 41 townhomes north and that would be to the west of the Waffle House that piece of property where the gap is is that's [01:03:41] not included in the documents that we have currently those those those are not they're clearly not built so they're not in the enrollment numbers I know that that one said nine the yield was going to be nine so I'm adding that nine to my three from what schools is saying and that's how I'm saying that there's room at Gaten Elementary School based on what I'm getting I agree with look there are there are operational things that the school does classrooms may be crowded and overcrowded I don't know the answer that I don't have that information I'm making a decision on what they've given us functional capacity and the last thing [01:04:17] And I'll say on that is the schools did, and it's on their website, but they did produce through the redistricting membership for this year. And I'm looking at it, and Gaten is showing K-5, 599, functional capacity 644. So they're showing to us that there are 45. [01:04:35] Again, that's what I'm seeing, 45 availability. So that's why when I look at 14 single-family homes with a 45, and again, even with the project that Ms. Roundtree has. that's just one to clarify that if you could the applicant if you could potentially touch on the title transfer the trees and the tree line what you've done on that as well as anything you can do to talk about the driveway concerns that folks have and any kind of thing on the construction timeline or any other questions mr geiger thank you mr chairman mr rogers thank you for the [01:05:13] introduction my name is jeff geiger here on behalf of the applicant um i would uh just um right if we just go to the next slide if you're able i would like to thank uh before i get into the points that mr roguish asked me to address would like to thank mr hildebrandt for his engagement in this process his advocacy on behalf of the members of his homeowners association we have achieved a better request before you as a result of their input since the planning [01:05:49] commission saw the request we have added that tree save that was mentioned we are just taking it to 13 lot 13 at this point because right now we have to assume that the area that we're showing as a stormwater basin will be a stormwater basin so animals will be able to move freely through the stormwater basin whatever trees don't have to be removed as a result of the requirements to meet tpw's requirements they will be preserved but at this point because of the title issue on the [01:06:22] existing stormwater pond where title reflects that a previous developer or the developer of heavy run does continue to own that property we do not have the ability to come in and modify that pond the HOA documents do not give the homeowners association the right to transfer to us the ability to modify the right they have as mr. Hildebrandt indicated is for maintenance only we have communicated to Hildebrandt and at [01:06:59] our community meetings that we are ready willing and able to engage in the discussion about joining the HOA and using that pond if they are able to get us the legal right to do so mr. roguish asked me to touch on these driveways i know that was a topic of many comments i would like to let you know that the proffer includes many high quality driveway materials we view aggregate as the base homeowners could then decide to use different other types of [01:07:33] material for the driveway also at the end of the day main street could make the decision when they build the homes to say everybody will use aggregate this is zoning it's just trying to provide a variety of high quality materials that raises the bar for the community for those driveways there was a question about whether we would deforest the land mr emerson correct me can correct me if i'm wrong but once this land is rezoned to residential we are not allowed to [01:08:09] remove a tree until we get a land disturbance permit once we get a land disturbance permit we will then do the work and at our community meetings we did show a timeline for how long we believe the construction will take we really think 13 homes will go will be sold in about a year's time frame but we were honest with them and said it could take up to three years just depending on what the economy is doing at that time i believe i touched on the topics that mr roguish asked me to touch on on behalf of the applicant i ask that the board approve the request [01:08:46] before them thank you sir yeah thank you one last comment you know on the driveway um i live in a neighborhood where the it's it's aggregate or stamped concrete or asphalt and we have multiple homes of different variety in there some people like to play basketball and they don't like the aggregate for example so i can certainly understand you know the neighbors wanting to it to look good um they're saying the same so in the plan of development let's make sure we work with the neighbors um on that if that's if that's truly what they really want um then in the plan of [01:09:25] development we can we can maybe work on that um the only other many colleagues have questions I do want to say that, you know, I was at both community meetings that we had. [01:09:43] I was here at the Planning Commission. I've spoken with both the folks that called in tonight personally. So I hope that the community knows that we're trying to do everything we can. The one issue that I know the HOA would love to get resolved is the BMP, And I know that actually the applicant would love it if they could utilize the existing BMP because they can then build another home on that property. [01:10:11] So my colleagues totally understand what's going on on this. There's a BMP at the end of that covey run that was built by the original developer that was supposed to convey to the HOA. They never actually did that. And before I ask Mr. Newby if there's anything, you know, I would like to see if there's any pressure we can put from the county to actually make sure that we've done what we're supposed to do. [01:10:35] And so they made a comment that maybe we didn't. And so I think it's still between the HOA and the former developer, but we would love for that property, for the BMP, that this HOA of only 14 homes has been paying for. [01:10:53] They, unfortunately, do not own the property that they've been paying for. They thought they did. And so I guess, Mr. Newby, if there's anything you can do to talk with the attorney, et cetera, on that, Or if there's any pressure we can put on that previous developer, I don't know. So is there anything we can do? [01:11:10] Mr. Chair, Mr. Rogish, I have been in touch with the HOA's attorney, Mr. Bean, as of last Friday, to offer any assistance the county may have in helping with this conveyance. One of the challenges we face is that the ask is for the government to convince Party A to transfer property to Party B. [01:11:28] It's not the government's property. We have no interest in the property. So I don't know that a court would allow us, for instance, to sue to force a transfer in this case. Nevertheless, I'm hearing this evening from Mr. Hildebrandt that he may have another angle, that the documents have been filed where the previous developer suggested they had completed the transfer, and maybe that was a requirement of some regulatory process of the counties. [01:11:49] I'd be happy to look into that further with the HOA's attorney to see if there's an angle there by which pressure could be put to complete a transfer that appears to be contemplated by the covenants. And then my final comment would be the actual maintenance of the BMPs is covered by the covenants as well. [01:12:06] which is mr. Geiger points out places a short-term maintenance like cutting the grass on the HOA and long-term maintenance was a department of public works with the county so the county does have at least some right if not obligation to do long-term maintenance of the BMP already so I'm gonna do something that I'm gonna follow my elder statesman on on this case yes mr. [01:12:33] Nelson I appreciate you looking over whenever I said elder statesman thank you sir he knows I'm gonna defer this for decision only Um, Mr. Emerson, can you clarify one thing for me or, or, uh, Mr. Lewis, if, if we do that, can the proffers change between now and if it's for a decision only, you don't know the answer to that question. [01:12:57] Mr. Attorney, would we have to reopen the public hearing to be able to change the proffers or would it just have to occur prior to the decision in between those actions? Believe it or not, I anticipated this question. The law says the governing body may also accept amended proffers once the public hearing has begun if the amended proffers do not materially affect the overall proposal. [01:13:18] So it will depend on the nature of the proffer amendment, as I'm sure Mr. Geiger is aware. So that is fantastic that you anticipated that question, Mr. Newby. I appreciate that. Mr. Chairman, without further ado, I move that REZ 2025-101470 Main Street Homes of Virginia Incorporated be deferred for decision only with the proffers dated October 14, 2025. [01:13:46] There's been a motion made to defer to when? We'll do that for the next meeting, correct? 30 or 60 days, I think. 30 days. Next time, 30 days? [01:14:03] Mr. Chair, Mr. Rogish, I believe the next meeting for zoning cases would be November 12th. Wednesday, November 12th. Wednesday is what I got. Wednesday, November 12th. So there's been a motion made by Mr. Rogish to defer this case at his request to Wednesday, November 12th. [01:14:19] And I believe it's been seconded by Ms. Roundtree. for decision only for decision only so no public hearing correct those in favor say aye aye any opposed all right the motion carries mr mr next mr chair uh 256-25 staples mill road properties llc with a conditional rezoning request to c1c conservation district a parcel that contains 2.7 acres this is the conservation area of the cases in brooklyn mr lewis thank you mr manager members board in december 2023 this site along with the adjacent property was rezoned to b2c for a sheets [01:14:58] convenience store and gas station as well as r5c for a small townhome development to the south proffer number seven of that rezoning request required the tree preservation buffer to be rezoned to c1 conservation district prior to filing a second plan of development on the b2c portion of the property the same number i'm sorry the same proffer also specified that the c1 rezoning application must also carry forward the language in proffer number six of the original case which further describes the preservation area this case would fulfill those obligations the 2026 comprehensive plans recommendation recommended future land use for the subject [01:15:35] properties office although it has been approved as a tree preservation area this request is consistent with the surrounding development and would provide impact mitigation for the adjacent townhome community therefore staff supports the request planning commission also recommend recommended approval on september 11th and this concludes my presentation thank you sir any questions for livingston on this one all right seeing none this is a public hearing is there anyone in the room that wishes to speak to this case yes ma'am uh i'm brenda hayes and i'm not this is the first time i've ever been to one of these meetings and um if we're discussing [01:16:14] the staples mill road partners and the conservation area um i just got this memo and i had sent something to the email to the county and hadn't received a reply about it but i owned the property that backs up ai basically i was looking on my phone about the property 403 bremner boulevard and it said a it was included in the sale per ai i didn't know i sold it but the bottom line is something is wrong and there used to be alley I've owned it almost 20 years now [01:16:50] and I had access to my property and since the it has been sold and it's being built on and now I'm dealing with being able to get what I need in and out of the back from it and so this is the first time that I've had to be able to speak to the county about it and we have some difference of opinions There is a proposed had always been a proposed road also through to Bremner Boulevard Through the back way that never came about also [01:17:27] but I'm one of the few lots that goes all the way back to the Property that's being built now. I'm not sure some of the other lots have been sold, but mine has not. Yes, ma'am. Miss Hayes I've researched your Your question, and I think I can help out, ma'am. [01:17:48] I don't know if you can see it. Yeah, you can see it on that map. The right-of-way, but yeah, you go. If the hand moves right to left there, that right-of-way behind your home, the county has researched that, and that's been owned by a trust for years. [01:18:05] Tatum trustee has owned that and sold it on March 5th, 2024, to the local development group. So the ownership of that lot you're looking at, and I can send you a more detailed map tomorrow, ma'am, if you'd like, for what you're discussing. [01:18:22] Listen, do we have the other, do we have the map that shows the... I have a paper copy. I don't have it available. Tomorrow, can we send that to Ms. Hayes? I don't think we sent the definition. Ms. Hayes, what you're looking at is behind your home to the one side was part of the transaction. [01:18:43] Behind your home, literally behind your home, going to Staples Mill Road was owned by Tatum Trustees, Tatum Trustee, And it was sold to the Rebke Group on March 5th. So the ownership of that easement tract that you're talking about was owned by a different estate. And we can show you that. [01:19:00] We'll send that to you tomorrow. But if you can get information for Brenda, we'll – I have your email. You're on September 15th, man. We have your – you called in and you asked about it. And then I believe Mr. Conlon left you a voicemail around October 5th. [01:19:17] Yeah, it says here that you didn't return, so I'm guessing you didn't get it. But we'll get you the information and we'll show you that that easement was not owned by the county, not owned by the EDA, it was owned by an estate who sold it, legally sold it on March 5th. Who sold it? [01:19:32] The estate that owned it. So if you can leave your information, we'll get you that information and we'll show you all the data. Well, my concern is how am I going to get in and out of my property? Well, you have front access, what you're talking about is rear access. Say it again? What you're talking about is rear access. You have front access to your property, you have those front to back properties. [01:19:49] Say it again? You're talking about your properties, they're front to back. have frontal access but you're asking for rear access is that you're asking for and you're using an easement that got you out behind that CVS correct correct yeah that property was owned by an estate and it was sold legally on March 5th 2024 and we'll send you all that again if you leave your information tonight we'll get you all that information tomorrow well I was hoping that the county would be looking out also at for the homeowners like you were saying yeah looking out after the homeowners because that's been it been problematic also for a while yeah and it was it was [01:20:28] as you see also there the street goes bubble cell i think it's called bubble cell goes back it does from there and it goes to staples mill and that was never done but access has been always been back and forth there the county can act on action is that the count of land the county owns but the eda we researched it for you the eda has never owned the county nor the eda has ever owned that land it's owned by a private trustee and it was sold private to private but we we have that info we'll send it to you if you leave your information with us tonight i think we have it we don't i don't think i have your email address though so if you leave that tonight i would suggest that the county does closed caption because it's been very difficult to hear not only you but for people [01:21:06] speaking uh i'm a little hard of hearing now i have so the bottom line is that's my feedback to the county uh because it's no sense people being here and they can't hear gotcha understood there it is an issue understood thank you but i would like for somebody to call me and also make sure they get in touch with me i have an email i never got an email yeah could you leave your email address with us this evening i think he's got it all right do we have it do it before she leaves do we have our email address yes i'll just speak with her again and make sure that's the one that i have somebody get her before she leaves thank you sir all right is anyone else in the room wish [01:21:44] to speak to this case anyone on webex there's no one to speak to this item all right any other questions on this item all right i'll make a motion that we uh approve rez 2025 101721 stables mill road partners llc approved with the proffers that are dated august 27th 2025. but a motion made by myself seconded by mr roguis those in favor say aye any opposed motion carries mr manager chair members of the board next three cases out of the fairfield district 226-25 is rjm land llc with a [01:22:21] conditional rezoning request from a1 and rthc to r5bc general residence district several parcels containing 7.7 acres located on the east line of north laburnum avenue near its intersection with creighton road and he the applicant is proposing a single family development miss moore thank you mr managers members of the board as mentioned this is a request to conditionally rezone almost eight acres to R5B General Residence District conditional to develop 32 single-family homes. [01:22:57] The R5B District, as you recall, is a new zoning district that was created and became part of the zoning ordinance this past February. It does allow lot sizes as small as 3,000 square feet and lot widths as small as 30 feet in width and a maximum density of 10 units per acre. [01:23:17] There are other standards that's required by the zoning ordinance and that includes with each of these developments the installation of five foot wide sidewalks, street trees, and curb and gutter along street frontages. And any garages available has to be accessed from rear alleys if the lots are less than 50 feet in width, in this case it is. [01:23:40] There are some provisions where the director of planning can waive that on certain circumstances. The board also adopted design guidelines for small lot single family developments as an amendment to the 2026 Comprehensive Plan. [01:23:55] These guidelines encourage other design elements such as community open space, articulated building designs, and lighting. So proposed are 32 single family lots with a single point of public access from Laburnum Avenue. [01:24:13] The lots along here would actually face Laburnum Avenue, which would be supplemented with a 25 foot wide landscape buffer and the 5 foot wide sidewalk. The remaining lots would be accessible from 24 foot wide alleys to the rear garages as required by the R5B standards. 10 foot buffers would be provided along the other perimeters of the boundaries. Sidewalks would also be provided along this internal street here and then pedestrian shared walkways would be in the middle [01:24:49] of the single families home here. The homes include proffered elevations as you see here. Each proffered elevation picks variant designs, different roof lines and styles, and each would be a minimum of 1,250 square feet. All the side, all the yards would be sawed and irrigated. [01:25:16] Other proffers address building materials, foundation plannings, and hours of construction, landscaping and future conservation areas. All the lots would be located on the western portion of the site and the eastern portion would remain undeveloped due to wetlands and flood plans present in these areas. I will note that this will be this is the first R5E district considered by the board. We had the other one earlier that was deferred so we're pretty excited about having a product that offers diverse housing and affordability while having really good standards [01:25:55] that we feel like will benefit the community one of the reasons it was deferred from the last board meeting was to allow the applicant time to explore opportunities for a better common open space this was the concept plan that was before you last month even though it wasn't heard with limited open area around a trailway around a bmp they went back they thought about it revised it and through that they are proposing an alternative i guess for bmp allowing more [01:26:28] expansion of the lots to be moved back to allow this whole gathering spot right here with walking trails other amenities would have to include at least two issues like park benches gazebo and other amenities for outdoor passive space so that is become proffers um that's before you this evening the 2026 comprehensive plan recommends suburban residential two with a recommended maximum density of 3.4 units per acre and [01:27:04] of course environmental protection area the single-family uses are consistent with these designations and although the requested gross density of about 4.5 units per acre slightly exceeds the recommended density as designed it would be compatible with the surrounding communities in the area and would be consistent with the conference of plans design guidelines for small lot single-family residential developments. [01:27:30] For these reasons, staff supports this request and the Planning Commission recommended approval at their August 14th meeting. This concludes my presentation. I'd be happy to answer any questions you have. Thank you, ma'am. Any questions for Ms. Moore? Well, Ms. Moore, thank you so much for pointing out that I asked specifically the applicant to revisit the plan because I felt as though if this is going to be the first R5 in the county and in Fairfield District that we have more amenities for the residents. [01:28:05] And so I want to thank the applicant for taking my request serious and being able to be creative and move the BMP from the back of the property to basically expanding it to give us that that beautiful space and so um i want to make sure and i believe that they will make sure that the amenities that you know we ask for will be provided in the community is that correct yes sir that will be evaluate thomas subdivision the the the front of the property that's the sidewalk is that that's internal that's the ones that go in front of the house is not external laburnum correct well we do have a one along laburnum and then it comes internal along [01:28:42] here and then of course it connects to internal walkways here and here and so the sidewalk is going to go on both sides of the common entrance yes sir thank you all right this is a public hearing anyone in the room wish to speak to this case so i actually i just want to know why do we need more people in in riku county we already stretched thin in terms of emts or first responders [01:29:21] we are already stretched tight in terms of schools we are already struggling to be more of a community and we are already misunderstanding the future prospects of destroying mother nature why do we need to build homes that are four or five hundred thousand dollars that won't be here in 50 100 years because we're using cheap materials why do we need to all of this do y'all have any answers [01:29:57] thank you ma'am anybody else in the room we should speak to this case anyone on webex for this case there's no one to speak to this item all right thank you ma'am mr cooper yeah before i make the motion again for me and fifa it's important to get more single family housing we do know that there is a housing crisis and affordability crisis in our community and so i'm always amazed how house people want to know why others don't need housing and so it's amazing to me um um mr chairman i move [01:30:32] Mr. Chairman, I move that we recommend approval of RZ202-100597, RJM Land, LLC, with the profits date of October 1st, 2025. Thank you, sir. Motion made by Mr. Cooper, seconded by Mr. Nelson. [01:30:48] Those in favor say aye. Any opposed? Motion carries. Mr. Mayor. Next, Mr. Chair. Members of Board, 257-25, H.H. Hunt Land, LLC, with a conditional rezoning request from a1 to rthc residential townhouse district uh two parcels containing 8.6 acres they're located on the southwest intersection of mountain road and woodman road and in this case the applicant is proposing townhomes miss moore thank you again this request would rezone to rthc to develop a [01:31:22] townhouse community with up to 58 units the site is located just north of the towns of woodman and if approved this community will as proffer to join their HOA. Vehicle access though would be separate with a single access on mountain road but a pedestrian trail is proposed to connect the two developments adjacent to a stream in an RPA area on the western portion of the site. The proposed townhomes would be three stories in height and are proffer to be similar to the elevations you see before you. Each unit would be a minimum of 1400 square feet and would [01:32:01] have rear loaded garages access from an alley except for the units along the southern property line here to address adjacent concerns of privacy and height a 25 a 20 foot wide tree save area would be provided along the entire southern boundary line and i believe this is an addition to the 30 foot setback on the rear the tree save area would also be provided here on the corner of of Woodman and Mountain Roads with supplemental plantings along a 25 foot [01:32:37] wide buffer along both roadways. Other amenities include a gathering park on the corner with walking trails and at least two amenities to again include picnic and other passive amenities. As part of the county's improvement to Woodman Road the Department of Public Works plans to install a sidewalk and curb and gutter along the west side of Woodman Road, and the applicant has committed to proffering land dedications for this purpose. There will also be a dedicated left and right turned lane here [01:33:11] to be constructed at the entrance of Mountain Road by the applicant. Other proffers address building materials, foundation and driveways, and future conservation areas. The 2026 comprehensive plan recommends office and environmental protection area, and while the proposed residential community is a departure from the office designation or recommendation it would continue a residential pattern that has evolved in this area over the years and with the quality assurance provided by the proffers staff does support this request and the planning commission recommended approval after [01:33:50] September 11th meeting. This concludes my presentation. Thank you ma'am. Any questions from Ms. Moore? Ms. Moore can you give me a history of that property as far as previously Consider usage if you don't mind. Okay. No, I know I've spoken. No, I will say that the office designation was a wide swath starting in the 1980s. [01:34:12] It was thought to be close to the intersection in 295. But over the years, with this particular piece of property starting in 85, it's been recommended for multifamily. It's been recommended for age-restricted multifamily. And then later for most recently in 2023 or 24, it was actually withdrawn because the citizen concerns for a self-storage facility with a retail. [01:34:39] So many, many attempts for this property to be office, many attempts for it to be commercial. Some of those didn't even come to the Planning Commission. They just were with staff. So this has been a particular evolving with all the developments that's occurring around it. [01:34:57] We do feel like it's an appropriate transition and a quality development. They'll fit well here. Well, to your point, I think I inherited the conversation pertaining to the development of a storage unit facility. And I asked Mr. Emerson to do for me an analysis of all the storage unit facilities in the county. [01:35:19] And unbeknownst to a lot of people, Fairfield has some of the most of the storage unit facilities in the county in the Fairfield district. So that was not something that I wanted to see there on that corner. And I heard from residents abundantly about that usage. And in this case, I haven't heard that type of negativity or that pushback in regards to it. [01:35:39] Ms. Gardner, can you answer some questions real quick? You may or may not be able to answer this question, but I want you at least to try to. In speaking with the developers, they stated to me that when they built the neighborhood behind it, that they actually wanted to purchase that property then to continue as a neighborhood. [01:36:01] Can you verify that? Mr. Chairman, Jeff Geiger here on behalf of the applicant. Mr. Cooper, thank you for the opportunity to answer that question. I can verify that. How have the discussions been with the current residents behind as far as the HOA, the potential of just the symbiotic relationship, if you will, of this new community and their community? [01:36:22] Because I don't have it offhand. How old is that community? He's probably about 15 years, 10 years old. years old HH Hunt the applicant did build it as you mentioned and I really appreciate their willingness they started this process to knock on the door board for that HOA and continue a dialogue with them through planning Commission one of the requests that we got from staff was to make a pedestrian [01:36:56] connection and we use that dialogue to resolve up with a solution that works well for the neighbors and that board that board will then pull the members see if they want the pedestrian connection to communities we appreciate staff flexibility to let us design it in a way that reflects the desires of the existing townhomes and we have given them the materials they need in order to poll their members and so we continue that dialogue and continue to work with them i'm i'm [01:37:35] appreciative of hh hunt for making sure that that tree safe area was was taken care of in the front of the prop as well as the back i think the 20 the tree savior as well as the buffer along woodman is great for insulation as far as the community from the community from the roads uh as well as i'm aware of the potential of joining the hoas together so therefore they'll be combined thank Thank you, sir. [01:38:02] Sir, any other questions? All right, I don't think we've done this part yet. This is a public hearing. So is there anyone in the room who wishes to speak to this case? Is there anyone on WebEx? There's no one to speak to this item. All right, thank you, ma'am. [01:38:18] Mr. Cooper? Ms. Chairman, I move that we recommend approval of REZ 2025-101467 H.H. Hunt Land, LLC to be approved. [01:38:37] Motion made by Mr. Cooper. Second. Second by Mr. Nelson. Those in favor say aye. i heard any post motion carries next mr chair uh 258-25 is ridge homes llc with a conditional rezoning request from b3 r4c several parcels containing less than four tenths of an acre they're located on the northwest intersection of mountain road and north run road and here the applicant is proposing it's more just a single family home yes sir okay all right so this request [01:39:12] is to rezone two parcels to R4C to develop one single-family home. The property is surrounded by a mixture of commercial and residential uses. If rezone this property would be a logical extension of single-family development southward along Mountain Road especially since a building permit was recently issued to construct a single-family home on the R piece property directly to the north. The homes will be built on a crawl foundation and it would face this question arose it would actually front on North Run Road and [01:39:50] also would have that would have requirement of the installation of a five-foot sidewalk along North Run Road it should be noted just for your information that the Longdale segment of the of the fall line fall trail line will go across Mountain Road and cross over I believe about right here and And dedication is already for that right of way been accommodated for that trail line on Mountain Road. [01:40:28] So the 2026 conference plan recommends commercial concentration for the subject parcels as well as parcels to the west. While the existing B3 is consistent with that designation, use for the property for single family would be more compatible with the adjacent zoning and residential uses. [01:40:46] staff does support this request and the planning commission recommended approval at their september 11th meeting this concludes my presentation i'll be happy to answer any questions thank you ma'am any questions on this case for ms moore by my colleagues seeing none this is a public hearing is anyone in the room wish to speak to this case there's no one to speak to this item thank you [01:41:08] Thank you ma'am. Mr. Cooper. Mr. Sherman, I move the recommend approval of RZ-2025-101469 Ridge Homes LLC for approval. Motion made by Mr. Cooper, seconded by Mr. Nelson. Those in favor say aye. Aye. Any opposed? Motion carries Mr. Manager. [01:41:26] next mr. chair members of board we move into public hearings other item agenda item 259-25 is an ordinance this is a vacation of a drainage and utility easement for 7709 dartmoor road this is in the west ham subdivision which is in the tuckahoe district mr anthony yes sir thank you mr manager good evening mr chair honorable members of the board uh this would vacate a 10 foot drainage and utility easement located at 7709 Dartmoor Road and Weston subdivision David and Laura Hodge the owners of the residential lot have requested the vacation to construct a detached garage real property division [01:42:05] process this request this vacation request through the departments of planning public works and public utilities without objection director real property recommends approval the board paper County manager concurs I'll be happy to address any questions thank you sir any questions for mr. Anthony this is a public hearing anyone in the room wish to speak to this item anyone on webex for this item there's no one to speak to this item thank you ma'am mr roger mr chair some move uh ordinance 259-25 motion made by mr roger seconded by mr cooper those in favor say aye motion carries next mr chair you move into public comments we do have a number of individuals that [01:42:44] have signed up to speak uh here today and we've got several on webex now the board does ask that you begin your comments by stating your name and address for the record and that you limit those comments to a maximum of five minutes so we begin with miss sarah ramsey miss ramsey are you here are you on webex no she is sir um miss ramsey yes can you hear me miss miss ramsey hello yes miss [01:43:20] ramsey we can hear you hello miss ramsey we can hear you hello yes ma'am go right ahead we can hear you um let's come back to miss ramsay can you hear us okay there must be some technical issue um keep her on the line and let's go to jennifer lieberman miss lieberman you're up would you like [01:43:52] to speak okay all right uh joseph laundry who is on webex mr landry can you hear me yes sir okay uh i'm just calling to uh complain about the innsbruck after hours rock concerts so i live in wyndham and the last rock concert that that was there i think it was like september [01:44:26] 28th 29th and that concert was really loud i live in the wyndham uh neighborhoods and i could clearly hear that concert from my front lawn and i could clearly hear it all the way out until 10 o'clock at night on a weeknight and i have a number of small kids and all my neighbors have small kids and you know little kids need 10 12 hours of sleep a night and I also have to get up at five in the morning to do my stuff so I think it's outrageous that you guys would permit a rock [01:45:01] concert to go till 10 at night on a weeknight in a residential area so I'm asking that you guys don't do that again during a weeknight it'd be okay for me on the weekends but just not on a weeknight until 10 o'clock at night. Thank you, sir. All right. Next, we have Lafon Cain. Lafon [01:45:31] Cain. Okay. Terrence Smithers. Terrence Smithers. Roland Tolliver. Is Mr. Tolliver here? A number of speakers spoke up on or signed up for school issues, Mr. Chairman. David Magner. Mr. Magner, are you here? Okay, Mr. Magner's issue was speeding in Chamberlain Farms neighborhood. And then we have Doug Clark. I see Mr. Clark, if you [01:46:07] would come forward, please. My name is Lieutenant Colonel Douglas Clark. [01:46:39] Our residence is 5005 Castle Point Court, and I appreciate your time, Chairman, County Manager, Board, and citizens of Norico County. I have provided you with information that I'm going to be speaking about, and the purpose of my speaking here today, I was here roughly a year ago, minus eight days. Speaking about the security of our elections in Enrico County, I'd like to give you an update. We've had a little bit of progress, and I'd like to ask your [01:47:13] assistance in the other areas where we still need some progress. I'm revisiting an area of concern all voters of Virginia, which I presented to you, I said, a year ago, October 22nd. Security and accuracy of Enrico County electronic voting systems. I speak of two areas that have still not been addressed and jeopardized the security and accuracy, voter rolls, and electronic voting systems. Regarding the voter rolls, concerned citizens, including myself, purchased at a cost of over $24,000. Voter registration and historical data and use specialized software also used by the [01:47:51] federal government to query and analyze the state of Virginia electronic databases. The databases were analyzed and over half a million discrepancies were found in Virginia and over 19,000 in Rico County. The data presented in this challenge report came from official certified voter registration data from the Virginia Department of Elections elect. Pursuant to Virginia Code 24.2-429, three qualified voters of Norico County submitted a notarized affidavit challenging all 19,748 voter registration IDs due to incorrect or incomplete registration information in October [01:48:29] of 2024, the first 2,700 of which are provided to you at a board meeting on October 22nd of last year. By law, a registrar was compelled to respond to this affidavit and request for immediate investigation and investigate all 19,748 errors prior to November 5th of 2024 federal election. [01:48:52] He failed to do so. Therefore, these errors have not been corrected, leaving thousands of names on Enrico County voter rolls, which should be removed or at least marked as inactive in the event that they moved. By law, you can't remove them. They have to be marked inactive for a couple years and then removed. Absent immediate corrective action to meet the illegal requirements of federal law, the coming election cannot be legally certified because the election will be inaccurate, unverified, and a violation of the citizen's fundamental civil right to vote in free and fair elections. Invalid names and IDs must be investigated and removed immediately. I provided [01:49:30] each of you with a copy of the Help America Vote Act. This I've done after our meeting last year where I spoke. I submitted complaints with the state of Virginia and delivered them to Henrico County Registrar's Office and the Board of Elections. These documents explain the federal law where we are in violation of and compelled action from Henrico County to come within compliance. Failure to remove invalid voter IDs is a violation of federal and state election law listed in the documents provided. No more than one in 125,000 ballots in error are allowed by law under HAVA. [01:50:08] Data presented suggests in Ricoh County and the state of Virginia far exceed their error limits and it is physically impossible to certify the election under these conditions unless corrected prior to the certification process. Election officials have the duty and responsibility, a sworn oath, to investigate and remove these invalid names and IDs from the voter rolls. [01:50:28] An email from the county attorney, Sarah Maynard, indicated that the registrar had only reviewed 965 of these 19,748 voter IDs as of March 11, 2025. A copy of that email is included in the packet I provided to you. [01:50:46] The second subject that is even more important is the electronic voting systems. The Help America Vote Act, included in your packet, states that all elections must be accurate and secure and that electronic voter registration computer databases updated regularly. [01:51:07] The electronic voting systems manufacturers who contract with Enrico County, and we pay several hundred thousand dollars for, will not allow inspection of hardware or software. Enrico County is denied access to the motherboards and to the database log files, which would allow verification that there are no internal or external modems or internet connections. [01:51:32] Access to Sedaj's software and source code used to tabulate and report vote totals contained in the networked election night reporting computers. This is a violation of federal infrastructure security protocols, testing, as well as HAVA election law requiring all elections to be open and transparent. [01:51:52] Election officials who move forward with inaccurate and unverified voter counts based on the electronic voting systems that we are denied access to without a validated vote count is a violation of the federal election laws. [01:52:11] Would you allow a building to be contracted in Henrico County inspected by Henrico County building inspectors and engineers? I mean, this building right here, I'm sure Henrico County engineers and inspectors looked at the plans before it was built. Mr. Clark, you're at six minutes. If you could summarize, please. [01:52:28] Yeah, I'm almost done. Thank you. Video presentations showing how our election voting systems are not secure have been shared with our registrar and the record board of elections, and I've included them in this packet. I've had them listed here. And I also emailed a copy of this to your recorder online so that you can easily have access to these. [01:52:51] Conclusion recommendations. i'm asking the registrar not certify the elections in 2025 unless and at which time the voter rolls are cleared second i urge in record board of supervisors to secure our vote and require a hand count of official paper ballot to be documented by cctv video for all precinct counts and aggregate to vote totals to be verified countywide i'm requesting that you watch the video presentations that i've provided here to help you understand the problem you can't fix a problem unless you know the problem exists and that's the end of my presentation and I [01:53:30] would thank you for your time and these videos that I've provided you to watch take no longer than watching a football game but they are very informative and we'll explain to you exactly how these electronics voting systems are not secure and if you would like any further information I'd be more than happy to provide it thank you very much thanks sir next is Rachel Hefner miss Hefner [01:53:55] Good evening, Board of Supervisors, and our county manager. [01:54:16] My name is Rachel Hefner. I'm actually a new resident of the Tuckahoe District, living right near one of the zoning properties at the corner of the neighborhood behind Patterson and Gaskins, but I previously lived in Lakeside for four years, and I'm here today as the lead organizer for the transit and housing teams of the Richmond area chapter of New Virginia Majority. [01:54:39] We're a social justice organization in the Richmond area working on a variety of issues, and we just recently launched a transit campaign. And over the past several months, we've been building a strong base of bus riders who are regional at their core. Some live in Henrico and work in the city. [01:54:57] Others live in Richmond and buy groceries at the Brook Road Walmart. Others try their best to get from the far edges of Chesterfield to the rest of the region. At the last GRTC board meeting, we learned that by 2031, GRTC will be in a $40 million deficit. [01:55:13] Fair Free and their expansion projects are only a small percentage of that deficit. The reality is they need more operating funds and specifically need them for local governments, like yourself, to support the operations. Currently, Richmond City pays double what Henrico County does into GRTC's budget, and Chesterfield County pays even less, a very minuscule amount. [01:55:37] This inequitable contribution, despite regional mobility, and many people working and spending monies in the counties is unacceptable. A lot of us, again, as I mentioned, might live in the city, and because of food deserts and lots of other things, are spending their tax dollars, are working in Henrico County, and we're getting a lot of economic mobility, economic opportunities, by having the transit infrastructure built out in the county of Henrico. [01:56:06] As a resident in Perico, I'm hopeful that the county can step up and help GRTC stay fully funded and free. Again, the report from this board retreat this month was that there's going to be a $40 million deficit by 2031. [01:56:23] It would be embarrassing for the capital of the city to not be able to have a public bus infrastructure. By the end of the week, you all should receive an email from myself. Again, my name is Rachel Heffner with New Virginia Majority, inviting you to meet with some amazing bus riders who want to share the impact of free and expansive transit on their ability to work, attend school, and support the local economy, many of whom choose to ride the bus out of personal values and others who it is their only option. [01:56:51] We would appreciate a response from each of you so that we can continue to build a relationship and find a way to create a transit system that we can all be proud of. If anyone in the room would like to also participate and be a part of our power building movement to make sure that everyone has access to transit and is able to get to things like school, jobs, food, medical care, and all the other things, feel free to reach out. [01:57:16] Again, my name is Rachel Hefner with New Virginia Majority. Thank you. Thank you, ma'am. Next is Mr. Channing Perkins. Mr. Perkins? [01:57:45] Name is Channing Perkins. I live at 5250 East Branch Drive, Glen Ellyn, Virginia, 23059. Been living there since 1997. Before then, I lived in the Cedars of Innsbruck for seven years. [01:58:07] Before then, Sundance Station for about three years. Been a resident for almost 40-plus years. Seen a lot of changes. Seen a lot of mistakes, too. [01:58:26] We're in the midst of Goochland doing data centers. Our neighborhood backs up to 623 Landfill, Buckstone. County line was redrawn in 2004. [01:58:54] No buffer was put in, which should have. County knew, grew it, and 623 owned all the land behind us. And as soon as that line was redrawn, 623 submitted an M3 zoning case. [01:59:17] County didn't help us out at all. H.H. Hunt was just beginning to develop West End. The residents on the west end of, or the west side of Axe Handel, were all in Goochland. [01:59:37] They paid Goochland taxes, but used Henrico services. I don't know why the county didn't bother to negotiate with Goochland for a 50-foot buffer. Point being, 2025, you're running water and sewer trunk lines, water lines up. [02:00:05] It's cost you an extra couple of mil. Why? Because you didn't bother to do the buffer. He could have put, if he had the buffer, he wouldn't have had to buy the easements. It's intuitive thinking. [02:00:23] There was, and after Weston got built and approved, one point of ingress, egress. The board realized that there was mistakes made. They ended up revising the county code on ingress and egress. [02:00:46] I addressed the board, I believe, back in November, December. I was in touch with Ms. Roundtree, Mr. Hughes, about trying to make another point of access. Mainly so that fire and rescue first responders, in the event of bad inclement weather, could respond to somebody in need. [02:01:16] I'm 66 now. There are a lot of people back in the neighborhood that are a lot older than I am. What happens if they have a heart attack or a stroke? A storm comes through, knocks the tree down, takes a power line with it. [02:01:32] we've had three instances on cane road already this year two two trees that have fallen across the road the county didn't remove or didn't clear the pathway the residents did the first time there was no power lines involved second time it took power lines down and you can check with the police department they they had an officer there at the scene why were citizens allowed to cut up [02:02:09] a tree with downed power lines. Somebody's going to get killed. I got back in touch with Ms. Roundtree or Mr. Hughes about a simple solution. Bury the power lines just below Kane Road to the Kansas property. It's a quarter mile. I spoke with Dominion Power. They said if you declared it an emergency or a necessity, they could get it done in six months. I also [02:02:45] looked at the website. The charge is $25 a linear foot. I drove it by my car. It was close to 1,500 feet, maybe 1,600 feet, times 25, $40,000. I wasn't asking, maybe Mr. Hughes was confused what I was asking. I wasn't asking for the lines to be buried all the way up Cain Road, just to a point [02:03:17] where first responders could reach our neighborhood, even if they had to come through Shady Grove estates um the the next time that cane row was closed it was closed for hours thank god we had my condolences to jasmine woody mr perkins family and friends mr perkins you're at six minutes if [02:03:48] you could wrap it up um i believe i've got an additional five minutes that was uh granted to me and the clerk tanya uh bracket no sir all members of the public at five you're at six and a half but we did receive your packet if you if it helps um I had others that signed up and deferred their minutes to me that's not the way it works unfortunately sir get five minutes well I wish I had known that because I've got [02:04:20] the other things that are in your exhibits are I wish the county would smart not you want our support to go to Goochland where was your support for us Thank you sir. Why won't you be smart and look at Avonlea and lowering the cost for Avonlea and lowering the cost for Henrico. Thank you very much sir. All [02:04:51] right next is DeAndre Coles. Coles are you here? How you doing my name is DeAndre Coles. Sorry if I stutter a little bit I'm a little nervous. I stand before you today because I have been treated unfairly and unjustly in my Henrico department of social service case and my children continue to suffer as a result of it cps first became involved after my son was allegedly assaulted by my wife in march of 2024 during [02:05:30] that time i was falsely accused of inappropriate behavior towards my daughter these accusations were investigated and proven to be completely false and unception unception unception stated despite the police clearing me dss assumed by guilt it would not return my children while my When my children were in DSS custody, my daughter was molested by another child at a DSS respite home in May of 2025. [02:05:57] I found a police report regarding this incident which led to an emergency hearing at Henrico Circuit Court on May 13, 2025. During the hearing, the judge stated that while his jurisdiction was limited, he believed my children should be returned to me because I had done nothing wrong. [02:06:15] Yet, DSS continues to disregard this and has shifted the case goals from reunification to permanent foster care. In addition, despite my full compliance with every DSS requirement and recommendation, my unsupervised visits were revoked on September 26, 2025 by a caseworker by the name of Caitlin Bond. [02:06:38] Not because of anything I did, because my wife used my current addresses for benefits, even though we have not lived together for years. and being punished for another adult's actions even though i have family members ready willing and capable of caring for my children dss has ignored these options they refuse to place my children with my mother because of a drug conviction from 1995 despite her ability to provide a safe and loving home this is not simply a procedural issue it's a violation of my [02:07:13] constitutional rights under virginia code 20-124.3 i have fulfilled every requirement completed every program and continue to show up as a consistent and loving and responsible parent for furthermore my rights as a parent are protected under established case law troxell versus glainville 2000 the u.s supreme court recognized that parents have a fundamental right to make decisions concerning the care custody and control of their children and satosky versus kramer in 1982 the court ruled that the state must present clear and convincing evidence before interfering with parental rights. [02:07:51] In Regault, in 1967, the court emphasized that minors are entitled to due process protections and proceedings that affect their lives. DSS actions in my case disregard these protections and have caused unnecessary emotional harm to my children. My children deserve the freedom to grow up in a safe, loving home with a parent who has done nothing wrong. [02:08:12] Their right to be a stable family cannot be delayed. I'm asking the board to intervene in reviewing my case. I'm asking the DSS be held accountable for decisions that have prolonged unnecessary separation and caused emotional harm to my children. Lack of adherence to policies and procedures should never override true progress freedom of being with a willing and happy family. [02:08:35] Thank you for your time. Thank you, sir. Mr. Manager, before you call the next, are there more names? I just want to take a second for my colleagues' benefit and for the benefit of the audience. I have a previous commitment at 8.30. [02:08:52] I've been asked to speak at Glen Allen High School for a band competition. I accepted that appointment not knowing we'd be this long. So if I do leave in the next nine minutes, I just didn't want anybody to be surprised or look at it any other way other than trying to make another commitment. Sorry, sir. And I'm also going to turn it over to our vice chair, Mr. Cooper, to handle the rest of the meeting. [02:09:11] Thank you. All right. Mr. Chair, last speaker that we have signed up is Mr. Andrew Hickson. Mr. Hickson, are you here? Mr. Hickson, as you begin your comments, are you a resident of the county? No, sir, but I work in Henrico County. [02:09:28] I often shop and conduct business in Henrico County. All right, thank you. Before Mr. Hickson speaks, could I just note, Mr. Coles, I just wanted you to know that I saw that you were going to be speaking. I did speak with Ms. Brown, the director of DSS. I understand this is an ongoing case and that you do have representation. [02:09:46] So just that is the proper source of help that you can get. we're not situated in this body to be able to help, but please, and I don't want to reopen the comments, but please reach out to your attorney and discuss your case, because I don't want you to feel like you're not represented. We just cannot represent you. I hear you. I hear you. I hear you, and please share all of what you said with your attorney, because I trust that your attorney will [02:10:21] guide you in the right way to address those concerns. Thank you for coming. Mr. Hickson. Yes, sir. Good evening, Board of Supervisors. My name, as mentioned earlier, is Andrew Hickson. [02:10:37] And though I do not live in Henrico County, I do work in Henrico County. I do a lot of shopping and just traveling through Henrico County. And there's an issue that was brought to my attention recently that does concern me. The Bible gives the instruction in Jeremiah 29, verse 7, for citizens just to seek the shalom or the peace or the welfare, the well-being of the city in which they live and work and conduct their business, and that's my purpose here this evening. Supervisors, I intend very much to be respectful in my comments towards [02:11:12] you, in spite of the fact that I'm sure there are many issues on which we can debate and disagree. Many of you, I'm sure, hold opposite political beliefs from myself, but I don't think that means that we can't be respectful towards each other. However, there are some citizens of our Commonwealth who do not share that same level of respect. [02:11:30] One of those citizens is a man by the name of Mr. J. Jones, who a couple of you have endorsed for attorney general, and I'd like to talk about that this evening. If you're not aware, J. Jones sent text messages to a colleague in the year 2022 in which he fantasized about the violent death of his political rival, his wife and their toddler-age children, whom he referred to as little fascists. [02:11:55] He also stated that he hoped that these children would die because, And I quote directly, only when people feel pain personally do they move on policy. I come to you this evening with what I believe to be righteous anger. I believe it is good to be angry at a bad thing. [02:12:12] To be unbothered by sin, I believe, is to lack a working conscience. And to be unfazed by violence, I believe, is to lack goodness. And if somebody can remain unbothered by these comments, I don't believe that they can be in any way a good person. I think we all agree that this language from Mr. Jones is disgusting. [02:12:28] I believe that his attitude is disgusting, and I think we all agree that this behavior is disqualifying of Mr. Jones. I know that, and I also know that you all know that as well. If he speaks and thinks this way in private, why should we trust him to hold public power in Virginia? [02:12:44] If he can speak so flippantly about the death of a colleague, then why should we trust him to be the top law enforcement officer in our state? Now, don't get me wrong, his words themselves are not violence. Words are not violence, but words such as the ones that he used can lead to violence, and that's a term we call incitement. [02:13:01] When Mr. Jones said that he would rather shoot Todd Gilbert than Hitler or Pol Pot, he wasn't simply referring to Mr. Gilbert, he was referring to Mr. Gilbert's ideas. And it became clear that Mr. Jones would celebrate the death of myself and my family simply because of the beliefs that I hold. Mrs. Roundtree, according to Jay Jones' campaign website, you have endorsed him for attorney general. [02:13:22] Mr. Nelson, I believe you have invited him to speak in. Yes, I definitely endorse Jay Jones. In your church. Yes, sir. He was there last Sunday. Thank you. But in light of all of this information, I would like to ask you, and I would like to beg you, to admit that you regret and take back that endorsement. [02:13:38] Do you still endorse the man who, if his fantasies came true, would celebrate the death of myself as a God-fearing, America-loving patriot? My hope for you, my hope for our commonwealth, my hope for our country, is that you would see Jay Jones just as the evil man that he truly is. We've seen his heart. We've seen his desires of his heart. And my hope is that you, alongside myself and many others, would, of course, pray for his spiritual salvation. I believe that is our number one priority. But also that you would do everything that you can to defeat him in November. And for those of you, Mr. Nelson and Ms. Roundtree, [02:14:14] who have endorsed him, I respectfully ask that you take back your endorsements, that you attract to those endorsements. And I think you know what decision you need to make. And as a public servant, I think you know that you need to make that decision publicly. Although the rest of you have not issued a formal endorsement of Jay Jones, as far as I can tell, none of you have denounced him either. And I ask you to do so for the same reasons I have encouraged Supervisors Nelson and Roundtree to do so. I believe it is your duty as a peace-loving American to keep violent men such as Jay Jones out of office. And I think if your reaction to his comments is disagreement and [02:14:51] debate rather than outrage. I believe that means something is deeply flawed about your moral character. And if you can't agree that this behavior is despicable and quite honestly downright evil, I'm almost done, it shows a lack of moral decence. Sir, you really, you are done. [02:15:08] The fact that, you know, the board allows individuals from other localities to come forward, you come forward, address the board on a matter that has nothing to do with any local That endorsements be retracted that's all right. I apologize members the board But I think sometimes you are entirely too too kind too kind to Listening to can we move on mr. Manager, please so that we won't say anything so next is miss Sarah Ramsey Miss Ramsey. I know you've been waiting patiently [02:15:40] My colleagues are trying to stop me from from saying anything, but no, I will not retract my endorsement I very strongly stand in support of Jay Jones and while I respect your personal offense at the words that he spoke privately to somebody else three years ago with no intent for incitement whatsoever, I am compelled to be more offended by the daily decimation of the Constitution and due process and very strongly on behalf of my Henrico constituents need to have an attorney general that is actually going to stand up for [02:16:19] protection and safety of virginians so thank you for allowing me the opportunity to clarify confirm and reaffirm my support for jay jones for attorney general thank you miss ramsey i know you've been waiting patiently i apologize um can you hear us now ms ramsey is on webex [02:16:45] victoria can you hear us yes i can sir ms ramsey you can speak ms ramsey okay so i know we've got some individuals in the audience we'll go back to ms ramsey we'll try her one more time is there anyone yes ma'am if you would if you would come forward please excuse me you are for this cough that came out of nowhere i'm good evening chairman schmidt [02:17:22] who has left a rhino supervisor nelson who represents the district that i live in supervisor roundtree who supported our residents speaking fully at the planning commission meeting other supervisors who have attended our community meetings and a community manager for tolkes as well thank you for supporting our communities along derbytown road we are proud of our present and wish to be even more excited about our future while i'm pleased with the withdrawal of the provisional use permit request by wagner i do want to thank you as a county for serving as a vanguard for opening the white oak technology park home to meta qts and iron mountain data [02:18:02] centers and would like to encourage continued attention to the issues we presented throughout the public and community meetings our concerns remain focused on the vulnerability of our county for large-scale data center projects ill-suited to be near residential areas and without consideration for the large environmental impacts Varina residents in particular already live with. [02:18:25] I would like for us to holistically continue to address a number of concerns, including zoning reviews, which are compatible with our current and future needs, environmental noise and energy concerns, issues tangential to data centers, including industrial off-site storage which data centers are securing through the purchase of parking lots and constructing large-scale storage units used to store equipment and junk which can also be eyesores and poor uses of our available land and i believe you just spoke about that in our felfare district as well [02:19:02] large swaths of agriculturally zoned areas quality of life issues that you're already addressing that we like to see continue to be on your radar, including the proliferation of vape shops, gas stations, and car washes in front of residential areas with no buffers. And I'd also like to see an expansion of pub distance and buffers, along with more attention to traffic concerns. [02:19:27] Attention to our Henrico County borders with encroachment issues concerning industrial data center and warehouse interest, which may move just up to the county line, but built in adjacent counties, which I believe others have spoken about. And it's my hope that we will continue to address these issues with high-quality plans, attention to vulnerable areas, and a balance of our industrial, commercial, and residential interests. And I forgot to leave my name. [02:19:56] Jacqueline Bruce, 3325 New Heritage Loop. Thank you. [02:20:08] miss ramsey can we circle back to you are you on now miss ramsey is having technical difficulties sir she's not able to speak across the loudspeaker all right well we look forward to seeing you at a future meeting miss ramsey is there uh anyone else that wishes to yes ma'am if you would go to the back right there that podium right there thank you mr manager uh good evening mr vice [02:20:42] chair and members of the board my name is jessica harrison 253 place i want to thank you for the opportunity to speak tonight i am here to ask for your support in opposing goochland's proposed technology overlay district and technology zone a plan that would allow a massive data center within one mile of 45 neighborhoods many of which are in henrico county while i understand goochland's desire for economic development this project poses serious risks to nearby families schools and our shared environment first placing such a large industrial facility next to established [02:21:19] neighborhoods threatens both property values and/or quality of life. The constant noise, lights, and 24/7 operations of a data center campus will erode the peaceful residential character that our communities have worked hard to build. Second, we cannot ignore the potential health and financial impacts. A campus of this size could include diesel backup generators that require frequent testing. Even limited testing releases pollutants known to cause asthma, heart disease, and cancer. [02:21:50] and with several schools nearby our children would be directly exposed to these risks data centers consume a ton of energy and energy is expensive the rising costs will most likely trickle down and increase costs for many of henrico's residents third the proposal allows for a small modular nuclear reactor or natural gas peaking plant there are no operational smrs in the united states today meaning there's no reliable data on their long-term safety or environmental impact a gas peaking plant would also bring new air and noise pollution [02:22:25] into our community allowing such zoning changes without clear evidence of safety is simply premature especially since it would put thousands of residents in henrico in an emergency planning zone and several schools as well and we would have to come up with emergency plans should a safety issue occur at the smr at the end of the day this project places a significant burden on henrico residents why goochland would receive any economic benefit had i known the home i bought a decade ago could one day be near a nuclear reactor [02:22:59] or within earshot of a data center i never would have bought it like many others i moved to western henrico to raise my family in a quiet safe and natural setting not within an emergency plan zone I respectfully urge you to work with Goochland to explore other locations or options with less residential impact. If that is not possible then I ask you to partner with our district senator and delegate to advance legislation that protects bordering communities from harmful developments. [02:23:31] Decisions made in one county should never jeopardize the health safety character of another. Right now, both Guchelin and Hanover are pursuing massive data projects along our shared borders, projects that will profoundly affect Henrico residents, yet we have no voice in the process. [02:23:49] This must change. We need clear laws and safeguards to ensure our communities are protected before it's too late. Please help us preserve the short pump community so it remains a place our families can enjoy for generations to come. Thank you. Thank you for speaking. I don't know if I've spoken with you directly yet. I've spoken with a lot of three top constituents about this issue, both regarding Goochland and Hanover. [02:24:17] I've actually also spoken with the counterparts in Hanover and in Goochland, my counterparts on the boards there as well to express my concern about both of these projects. And they're both differently situated. The Goochland project obviously is coming up much quicker than the Hanover project. [02:24:35] But I just wanted to thank you for being here and especially waiting all of this time through a long meeting to make your comments. I will be continuing discussions with folks in the Wyndham community and other surrounding communities as well about the position that we're taking, and I share your concern, and I'm appreciative for all of the work that everybody is putting into it and the research and all of the information. [02:24:57] You guys are really digging into this, and that civic involvement is incredibly valuable, so thank you for being here. Is there anyone else that wishes to address the board this evening? Yes, ma'am. Good evening. My name is Amy Burrell, and I am a Varina District resident. [02:25:20] My speech is a little different from the other ones that you've heard tonight, but it would have been different if the data center had come before you. Dear members of the Haranko County Board of Supervisors, I am writing to express my sincere gratitude for your continued leadership and dedication to the residents of Haranko County. [02:25:41] Your service, stewardship, and thoughtful decision-making have significantly contributed to the well-being and progress to our community. Your responsiveness to community needs, commitment to fiscal responsibility, and efforts to foster a safe, inclusive, and vibrant county do not go unnoticed. [02:26:03] It is clear that each of you works diligently to ensure Haranko remains a great place to live, work, and thrive. Thank you again for your public service and for all that you do on behalf of the residents. Please know your hard work. [02:26:20] We appreciate it. Thank you. Is there anyone else that wishes to address the Board of Supervisors this evening? So I'm being told that Ms. Ramsey is back on. [02:26:37] Ms. Ramsey, are you on WebEx? Can you hear me? Ms. Ramsey, we can hear you. Fantastic. Thank you for giving me the opportunity to speak tonight. [02:26:56] Well, the floor is yours, ma'am. Okay. Thank you. I appreciate it. Good evening. Yes, I would like to request that if you are going to go out of your way to deliberately contaminate our public drinking water with a known neurotoxin that harms the brains of babies, then at the very least, let the mothers know that it's in the water so that they are not feeding it to their babies. [02:27:22] It's bad enough that you're deliberately adding a hazardous waste byproduct to the public water supply, But it's another thing to do this in secret. How would anyone know that you are deliberately contaminating our water with this neurotoxin when there is no ordinance? [02:27:42] You lied on the yearly water quality report, and you never sent out a public notice to the people when you decided on your own to add this contaminant back into the drinking water in 2024. If you think this additive-slash-discharge-slash-waste byproduct-slash-contaminant-slash-treatment-slash-chemical-slash-drug is so fabulous, then why all of the secrecy? [02:28:13] Why hide what you are doing from the public? Why hide who is ultimately responsible for this contamination in our drinking water? For those that may not know what contaminant I'm talking about, it's called hydrofluorosilic acid, which the county likes calling fluoride, in an attempt to deceive you into thinking that this contaminant is a natural mineral that they dug up somewhere in the Shenandoah Valley, when in fact it's a toxic discharge which comes from the fertilizer industry in Florida. [02:28:49] A state, which I may add, has banned the use of this discharge due to the neurotoxic harms to the human brain. Moreover, you don't have the legal authority nor the power to deliberately contaminate our public drinking water with this industrial discharge without so much as a vote. [02:29:12] Board of Supervisors, I implore you to come out of the dark ages. There is a better way to protect the teeth of poor people while at the same time protecting their brains as well as everyone's civil liberties. It's called toothpaste. [02:29:30] Hear me now. Governments. Hear me now. Governments who secretly go out of their way to add dangerous contaminants into the public drinking water while at the same time claiming that it's for your own good has never been on the right side of history. Again, if y'all think that this industrial discharge is so fabulous to ingest, then why won't any of you make a public declaration in support of pregnant women and babies ingesting this contaminant? Thank you. Thank you, Ms. Ramsey. Okay, [02:30:09] so victoria we don't have anyone else on webex right there's no one else to speak on webex okay no one else all right mr mr vice chair you would go into the general agenda agenda item 260-25 is a resolution for signatory authority it's a project that mr yob has worked on for quite a while appropriation of funding acquisition of a portion of 5301 francistown road abutting echo Lake Park. This acquisition property is in the Brooklyn District. Mr. Yob. Thank you, Mr. Manager. [02:30:45] Good evening, Mr. Vice Chair, members of the board, ladies and gentlemen. If I may set the stage briefly with this paper, about a year ago, not quite a year, Mrs. Martha Trevette Jenkins contacted me. She owned the small farm that is located at Springfield and Francistown Road. Many of you may have seen it. My daughter loved the cows that were there for the 34 years that I've lived here. [02:31:12] Mrs. Jenkins wanted that property conserved. She did not wish to sell it to developers. She wanted to sell it to the county and we were able to strike a deal with her and it would increase in fact our Echo Lake Park by about 70 percent in footprint. It abuts also Echo Lake Elementary. So with that ladies and gentlemen I'll read the paper but I think it's remarkable that miss jenkins chose that path to conserve this property with the county rather than sell it to a developer so this board paper authorizes and appropriates 2.15 million dollars for the [02:31:51] acquisition of approximately 28 acres of real property commonly known as 5301 francistown road this property abuts echo lake elementary and echo lake park the county wishes to acquire this property to provide a means for preservation of open space land, to set apart land for establishment of parks, recreational facilities, and playgrounds, to set apart land for and establish walking and bicycling trails, to locate, establish, and maintain public utilities if necessary, as well as to construct and alter public roads if necessary, including sidewalks along the fronting roads. [02:32:30] Resources for this project would come from the fund balance and the general fund by an inter-fund transfer to the capital projects fund i certainly endorse this and i have of course spoke to mr schmidt at length about it and i believe he is in favor of it as well with that i'll be happy to answer any questions you may have do the cows come with the land sir no sir the the cows have gone you know sadly mrs jenkins is getting on in her years and she is in rehabilitation right now i know she would love to share this moment with you but could not be here So, no cows, sir. [02:33:08] But on a serious note, though, could you prize those listening of the historical aspect of Echo Lake to the African-American community in Araiko? Yes, sir, Mr. Cooper, absolutely. Echo Lake Park historically was used by African-Americans in the community along Francistown Road. [02:33:24] There is a largely African-American community there, and there were baptisms conducted there. It was a space for the African-American community to recreate in that lake. And at that park, I'm not sure exactly when the county acquired it, but there's a good deal of history associated with it. [02:33:44] My own child spent many an afternoon there with her friends throwing sticks in the lake and watching the turtles and the fish. It's a beautiful place, and I'm glad we can conserve it, both for its history as well as for these uses for our residents, sir. [02:34:00] Thank you. Colleagues, any questions or statement from Mr. Yauvin? Steve, were you getting emotional talking about it? You know, I am because these kinds of things are important, and it's important that we know our history and that we save these things so that others can learn from them. [02:34:20] That's why Mr. Yob is one of my favorite county employees. Thank you for sharing that. I'm appreciative of the county actually having a mocker out there that kind of gives a kind of synopsis of that history. It's a park that I've frequented often as well with my family, walking around it with the lake, the picnic of Zeebo, if you will. [02:34:43] And it's important, to your point, that we make persons aware that we are equitable and we believe in equality, and we want to make sure that every community has the same opportunities and the same services. So I'm honored that that's what we are prepared to do. So anything else for my colleagues? [02:34:59] Yes, sir. Just for anyone that's listening, you know, this is a long-term play far as there is no capital project to expand echo lake park at some point you know the board can consider that in the future wrecking parks has quite a bit in the pipeline though no you got it is there a motion second second it's been moved by ms roundtree seconded by reverend nelson [02:35:31] thank you thank you mr yob uh next mr chair 261-25 is a resolution this is acceptance of open space easement woodland cemetery in the fairfield district another project you've been working on yes sir and this is also remarkable in that this will be the first county conservation easement of open land that we've embarked upon and this particular property is also a historic african american asset in that it was a burial place of many notable citizens including dr zenobia g gilpin [02:36:08] civil rights activist john mitchell as well as our own arthur ash we've been working with the cemetery foundation for the past several years to secure funding from the virginia outdoors foundation and we were able to secure a grant for them for 25 000 so they may improve their facilities and as part of that grant we as the county will be taking this conservation easement so with that little bit of background ladies and gentlemen this board paper would authorize the county manager to accept a deed of open space easement from the woodman restore woodland [02:36:47] restoration foundation for the purpose of protecting the historical and cultural resources of the woodland woodland cemetery in perpetuity woodland cemetery as noted is a historic african-american cemetery founded in 1917 by african-american newspaper editor and civil rights activist mr john mitchell and the final resting place of thousands of african-americans from our community including as noted arthur ash and dr zenobia g gilpin and i certainly am pleased [02:37:23] to bring you this paper tonight colleagues any questions or statements mr y'all so moved been moved by myself seconded by mr roguish all the favors i thank you so much next uh mr vice chair 262-25 it's a resolution this is uh tuckahoe creek park wilton landing uh determination as to whether it's substantially in accord with the comprehensive plan this park is in the tuckahoe district mr emerson yes sir thank you mr chair mr manager members of the board at the request [02:37:58] of the henrico county division of recreation and parks planning department in coordination with other county agencies conducted a substantially in accord study to determine whether a proposed site for use as a parking and a boardwalk trailhead for the tuckahoe creek park trail would align with the county's adopted 2026 comprehensive plan the site in question consists of four parcels located north and south of patterson avenue west of its intersection with west briar drive the subject parcels contain the former tuckahoe village recreation center [02:38:33] and undeveloped land within the flood plains and streams you did receive a copy of the of the department's study under a letter from the county manager so i won't bore you with the details this evening after reviewing the proposed location in the context of the existing and recommended land uses and other site characteristics and considerations staff concluded the proposed use of the site would be substantially in accord with the goals objectives and policies of the plan at their september 11th meeting planning commission concurred with staff's [02:39:07] recommendations finding the site substantially in accord i'm here tonight of course and mr al as run with reckon parks is present uh to assist in responding to any questions you may have regarding this uh the director of planning concurs with the finding of the planning commission and the uh county manager concurs thank you mr emerson mr rogers anything say first i just that i'm excited about this this is um over 20 acres of park space trail we're going to elevate a trail as you can see potential fishing pier [02:39:46] paddle launch, kayak launch, et cetera, that would get us into this creek. And so I'm excited about the fact that there's already a parking lot there. We're not building a – we're going to rehabilitate the parking lot, but we're not building a new parking lot. [02:40:03] There's already a parking lot there that we're putting parking on for folks. And I'm excited for this project to build this boardwalk and have access to the Tuckahoe Creek for people. So thank you, team. Colleagues, any questions or statements? if not mr roger with that uh some moves resolution is there a second second second first um move by mr roger second by reverend nelson all those in favor side resolution approved next mr vice chair 263-25 is a resolution approval of school board's retention of a portion of real estate sale proceeds [02:40:40] this is for 78 50 carousel lane the former mount vernon adult education center this building is in the brooklyn district mr tina thank you mr manager mr vice chair members of the board i am equally as excited as mr yob but for not as exciting reasons this is the third time that we have tried to sell this property so this board paper would approve the school board's retention of proceeds from the sale of 7850 carousel lane which is the site of the former adult education center which is now relocated at regency square on october 9th 2025 the school board approved the sale of the property to Middleburg Acquisition LLC for $5 million. [02:41:18] State law requires that the Board of Supervisors approve the school board's retention of all or a portion of the proceeds from the sale of surplus real estate. The Board of Supervisors previously appropriated $3.6 million from the prospective sale of the property to cover project shortfalls at Longin and Jackson Davis Elementary. [02:41:39] Accordingly, this board paper would authorize the school board to retain proceeds from the sale in excess of 3.6 so that is 1.4 the school board would retain if the board does approve the superintendent of schools the school board and the director of real property and the chief of staff recommend the approval of this board paper and the county manager concurs happy to answer any questions we've been working on this since the latter part of 2022. thank you so much um the new adult um center at regency is phenomenal so we definitely upgraded that space colleagues any [02:42:11] Questions or statements? Hearing none, can I have a motion? Second? Second. Moved by Ms. Roundtree, second by Reverend Nelson. All those in favor, please say aye. Aye. Those opposed? Ayes have it. Resolution is approved. And, you know, members of the board, just to be clear, the allocation of the additional funds, we've used $3.6 million, but the other $1.4 million will be programmed. For capital. One time capital use. Most likely project shortfalls like the previous amount. We'll report back with how that [02:42:50] used great um final item on the agenda mr vice chair members of board is a something we discussed in work session 264-25 resolution for signatory authority this is for the update of the proposed agreement with cumberland county for the reservoir at cobs creek mr chan thank you mr manager mr vice vice chair members of the board this is an authorization for the county manager to review update and execute a proposed water agreement with cumberland county originally negotiated [02:43:26] in 2011 as part of the creation of the virtual r hazlett reservoir at cobs creek under the proposed agreement hemorrhoid county would provide cumberland county up to 7 million gallons of water per day either from the reservoir or the james river at rates to be set annual with that i'll be happy to answer any questions that you may have thank you so much for saying um hearing that colleagues are there any questions or statements hearing none is there a motion to accept this approve this resolution so i move the resolution is there a second second been moved by mr roguis [02:44:01] second by miss roundtree all those favor say aye aye those opposed the eyes have it the resolution i is approved mr manager anything else this evening mr vice chair colleagues i do real quick couple things uh colleagues i didn't want to slow the meeting down earlier i do want to thank If we have any residents who will watch this or watch this or who are listening, those who participated in the Wagner Logistics data center case. [02:44:35] When we, back in May, set up provisional use permit application process for data centers, it was for cases like the one that we had heard that was withdrawn on yesterday. [02:44:56] give community opportunity to be able to speak to um whether or not they want to see this particular use in their community so community did uh participate uh primarily from new market village but also darbytown meadows and eagles nest winding um woods and so i just i want to shout those communities out because their voices um mattered and i really i really like the fact that even though others felt like they needed to come in and try to take over their advocacy or guide them [02:45:33] that they actually were advocating for themselves and for that I'm appreciative particularly of African-American communities that for so long persons felt like they had to come in and tell them what they needed to do so kudos to those communities for sharing what they thought was best for their community now i also want to add the caveat that um there will be future conversations uh about this particular project i mean this property not project um because the property is [02:46:12] still up for sale and so at any point for reeval where i think right now wagner has a contract for or is about to sign a contract and um there are permitted uses there so um you know the community needs to keep his eye on that i will be as well um and the developer also um has a um i think they will have to go through the bza and then for vesting rights they have a vesting right argument [02:46:49] and then it probably will end up in court if it if the bza does not approve it so the rezoning case is dead there are other options there so i challenge the community continue keep your eye open on this case. The Board of Supervisors, the case would have been withdrawn, but I'm certain that the reason it was withdrawn because most, if not all of us, were in opposition. The community [02:47:21] advocacy work led most to be in opposition, but there were some who supported. So I did get an email for some asking for accountability for the project decision. So if we did deny it, They ask for investment in the East End, a donation of at least $1 million to a dedicated East End Community Investment Fund, land use protection, written and binding promises that the zoning is the allowable use. [02:47:56] We can't bind up zoning to downgrade it unless we go through whatever. And whatever the process is, which I've not seen that done, doesn't mean that we can't do it. [02:48:15] And then a clear explanation of how we know it aligns with the county economic development. So I say it all that to say that not everybody that lived in that community was against it. We are investing a lot in the Verona District and East End Wrico. [02:48:37] And so those who signed off on that letter, reach out to me, and I can let you know what we're doing and if you have some ideas about some other things. Second thing I want to share before we leave, we found out earlier today, and it is now circulating around Chesterfield government posted about two hours ago, the passing of our colleague, James Jim Holland, who served on the Board of Supervisors in Chesterfield County. [02:49:08] A heroic fight with cancer that he's succained to earlier today. Five-term Board of Supervisors member, three times as chair. Served on the Region Tourism Board, Airport Commission, GRP, Plan RVA, Capital Region Workforce Partnership. [02:49:35] He was an Army vet. He was a professor at VCU, a well-known CPA. Just recently, Chesterfield named a recreation center after him appropriately. We are, and I hate the whole thoughts and prayers thing, but we definitely, his wife and his children are in our thoughts in Chesterfield County as well. [02:50:02] So I've been on the board. Actually, one of our board members retired, and then a couple of months later, he died. And then we did have a board member die in office. And so I know for my colleagues, it's tough in Chesterfield. [02:50:23] And so I just want to let y'all know we're there for you all in support. And shout out Jim Holland for the legend that he was and that he is. So I just wanted to put those two things on record. Thank you, Reverend Nelson. [02:50:39] I know for a fact that our colleagues share your sentiment. Those of us who've worked with him the last year and a half, our condolences definitely go to him and his family. to the county miss manager anything else any other comments somebody seven minutes somebody say something let's just make it three out of meeting let's do it no no we're dismissed ---------------------------------------------------------------------- Coraggio Consulting · aguyonx.com
