Moved by Mrs. Roundtree, seconded by Mr. Rogish. All in favor say aye. Aye. As have it, the meeting minutes are approved. Mr. Manager, do you have any comments this evening? Mr. Chair, I have one comment this evening. Members of the board and for those of you in attendance, I'm pleased to recognize our three-chop district, Vice Chair Misty D. Roundtree and Sheriff Elisa Gregory at the same time. [00:03:30] So, Vice Chair Roundtree was elected in 2023, but she's been serving our Henrico community through her work as an attorney for so much longer than that time period. She's been a great advocate of the residents of the 3CHOP District through her listening and careful decision making. [00:03:49] And this is not just a county manager sucking up to his boss. Sheriff Gregory was elected in November of 2019, but started her career as a deputy at Jail East in the Sheriff's Office in 1998. [00:04:05] She has served our community for over 27 years, and she's done a tremendous job at leading her staff in our jail facilities for the last seven years. so vice chair roundtree and sheriff gregory have touched the lives of many in our henrico community through their work in creating conversations for mental health education and so much more so why am i sharing this because vice chair roundtree will be awarded the community advocate of the year award [00:04:38] and sheriff gregory will be awarded as the public servant of the year at the black girl magic image awards these awards will be presented in suffolk virginia on september the 13th these are national awards that recognize the achievements of women of color in public service it gives me great pleasure to recognize and congratulate vice chair roundtree and sheriff gregory well deserved on this accomplishment such recognition may be for a single act of service or an extended period of [00:05:14] service where the the actions are carried out in a manner that reflects positively on the residents or the employees and demonstrates a commitment to public service so please ladies and gentlemen join me in thanking vice chair roundtree and sheriff gregory for their service and commitment to our county i know that was a surprise uh to both of you i apologize i don't normally surprise at these board meetings. [00:05:51] Mr. Chair, I have no other comments. I appreciate that, Mr. Manager. I'm sure that my colleague and I echo the sentiment that you shared, taking to Vice Chairwoman Browntree, as well as our Sheriff, Sheriff Gregory. So thank you both for your commitment, your tenacity, and your dedication to our county and our community as a whole. [00:06:08] Colleagues, do you have any comments? One real brief one, Mr. Chair. I just want to call attention for the residents of Enrico County. This weekend we will be once again able to showcase not only what makes this county one of the jewels of our county, but our region where we'll be on national television welcoming 50,000 to 100,000 plus visitors over the course of the week to a facility right here in the heart of Enrico County at Richmond Raceway. [00:06:35] Encouraging, of course, residents who are going to be in attendance out there to enjoy themselves, enjoy the festivities, all that comes with race week. But if you were unable to make it there, please tune in as we, you know, it's infrequent. We see it within our ICO Sports and Event Center, and it looks amazing when it's on national television. [00:06:55] And here we have another opportunity again to be on national television. And then I'll close by saying there's a lot of folks. Mr. Manager, I know you're very well aware of it, but public safety officials from our police, fire, sheriff's office, DPW, DPU, that will be out there. our emergency management folks who have been out there for longer than just a few couple days, making sure it's a safe place for our residents and our visitors who visit this county. [00:07:19] So I want to thank those folks for the good work and encourage Enrico residents to tune in as we spotlight this county this weekend on national television. Thank you. Thank you so much, Mr. Schmidt. I want to recognize Leanna Hardy with Enrico Citizen, who's here. Mr. Manager, will you go through the agenda, please? [00:07:34] Mr. Chair, members of the board, as you dive into the agenda, you begin with public hearings rezoning cases and provisional use permits you begin with agenda item 155-26 out of the fairfield district with imago day school in which the applicant is proposing a private school uh miss moore i understand this case is being deferred to september the 8th yes that is a request in front of you all right sure thank you so much um um this is a public hearing [00:08:11] brother is there anyone here speak to this item is there anyone on webex speak this item there's no one to speak to this item um i have no questions uh the public hearing is closed uh i move that the rz2026-1676 amago day school be deferred to the september 8th 2026 meeting at the request of the african move by myself seconded by ms roundtroll and those opposed it's been approved next mr chair members the board is a uh agenda item 178-26 out [00:08:47] of the brooklyn district this is the richmond lodge of perfection with a request for a provisional use permit under chapter 24 the county code to allow masonic lodge on a parcel located on the east line of bethlehem road near its intersection with dickens road thank you mr manager as mentioned this request would allow the replacement and expansion of an existing masonic lodge that has been in operation on the property since 1969. [00:19:18] Thank you so much, sir. This is a public hearing. Is anyone present to speak to this item? Is anyone online that would like to speak to this item? There's no one to speak to this item. Thank you, madam. Public hearing is closed. So moved. Second. [00:19:35] Moved by myself. Seconded by Reverend Nelson on the fifth side. Those opposed, approved. Next, Mr. Chair, 182-26 is a resolution for condemnation. this is for right-of-way in easements for the fall line uh trail project on one at one five seven four mountain road thank you fritz manager yes sir this board paper authorizes condemnation proceedings for properties needed for the construction of the fall line trail longdale phase project the county needs to acquire multiple easements across the property um owned by patriot llc located at 1574 [00:20:10] Mountain Road. Based on an independent appraisal, the county made an offer of $126,477 for the required property interest, but the parties have not reached an agreement. This board paper authorizes the county attorney to institute and conduct condemnation proceedings in accordance with the Code of Virginia. This board paper further authorizes and directs the county manager to continue to seek a voluntary acquisition of the right-of-way and easements to take all steps necessary to acquire the right-of-way and easements and to enter on and take possession of the require wider way and easements in accordance with the code of Virginia. All those in favor say aye. Aye. Approved. Thank you so much. Next, Mr. Chair, 183-26 is a resolution in this case for declaration of surplus property. [00:21:16] is a signatory authority for conveyance at 2510 hartman street which is in the fairfield district mr fritz thank you again mr manager this board paper would declare the vacant lot known as 2510 hartman street in the montezuma circle subdivision a surplus to the need of the county and authorizes the sale of the property to scarlet violet llc for 1900 which was the assessed value of the property when the buyer first offered to purchase it the buyer owns property across the street county has no need for this property the real property division has processed this request to the departments of planning public utilities and public works without objection the director of [00:21:55] real property recommends approval of the board paper the county manager concurs thank you so much sir answer any questions this is a public hearing uh is any person president like to speak to this uh is there anyone online like to speak to this there's no one to speak to this item thank you so much so quick question so i noticed that the buyer first offered to purchase the property yes and the question i want to know was the surplus property publicly offered for sale before negotiation began the single purchaser uh no they're typically not most of the time um you [00:22:30] know property um pretend but proposed buyers uh reach out to real property for whatever reason and inquire but it's typically not the process that we advertise it first and the reason i ask that is you know it's in a residential neighborhood correct mr curtis sir and so you talk about affordable housing have we considered whether surplus residential lots like this should be prioritized affordable home ownership like maggie walker land trust even neighborhood revitalization before we just or actually accept you know offers from persons without talking about this or offering to others yes sir mr chair thank you the question this [00:23:09] particular case uh scarlet violet llc owns a property at 2503 interesting interest interestingly enough the roadway bisects this parcel here which is part of 2503 so from our perspective she would be one of the highest property owners of interest who would probably make the most sense to acquire this parcel along with these adjoining property owners but she has expressed the interest [00:23:45] in it so that's why we pursued this avenue appreciate that yes i'd love to talk more about that if I could yes um mr. chair if I could I may be able to weigh in here too so the county does have a process by which surplus buildable lots that can have houses built on them are circulated through mr. Lebo shop for consideration of whether they could be used as part of an affordable housing opportunity I appreciate that clarification because of that speaks specifically to one I was trying to make um I wanted to furthest mr. manager at the next meeting such a [00:24:20] i don't want to prove it today certainly so um deferral requested to september the 8th yes sir all right mr chair if you would put that in motion i so move that we defer this item until september 8th meeting second move by myself second on the progress office i was opposed i have it deferred to september 8th all right next item on the agenda mr chair members of board 184-26 is a resolution this is signatory authority for a easement agreement with richmond affordable housing at 3909 mile road in the verona district mr fritz thank you mr manager this board paper [00:24:58] authorizes the chair to execute a permanent access easement agreement for 3909 mile road with richmond affordable housing and the entities responsible for the development of attainable rental rental housing known as carter woods real property department has processed this request through the departments of planning public utilities and public works without objection the director the director of real property recommends approval and the county manager concurs thanks i appreciate that sir uh this is a public hearing again is anyone present i'd like to speak to this item is there anyone online that would like to speak to this item there's no one to speak [00:25:33] to this item thank you madam public hearing is closed um mr reverend melson thank you moved by reverend nelson seconded by ms rogers on his side i have it approved thank you next mr chair members of the board you would move into public comments i do have a number of individuals that have signed up to speak uh this afternoon and we begin with jennifer lieberman miss lieberman are you here all right here she comes yeah hi my name is jennifer lieberman this speech is titled the extraction of purpose while cementing the foundation of death for the next generation [00:26:13] misty i am surprised with how you responded to the covid development last meeting as i can as i I am unaware how one can go from saying no to $800,000 houses to somehow convincing the developer saying yes to 20 of the 74 buildings priced in the likely $300,000 range with the rest being an undisclosed rent. [00:26:41] I'm also frustrated that it was per se suggested that I am against all housing, even though I've never said anything. I have spoken at length about economics, environment, and multi-use buildings to name a few reasons as to why I oppose most of the developments that come before the court. [00:26:59] I have also persisted with my belief that we need housing that is not only close to everything so people can abandon the car, but also housing that is more community-based, as unlike you all, so many don't have a third space. I'm also shocked that you said yes to this development and coddled the development, the applicant by saying that they have no control of the amount of children that will go to school that will come from this development. As I feel like there was something in your district just late last year where a bunch of parents came out and spoke against it. What made the COVID [00:27:36] development any different from the Westford Glen development? Those are pretty similar in terms of schools. So is it that it was just a smaller development or was it transactional? Furthermore, I am caught aghast that we had a recognition of environmental justice last meeting when you literally approved the destruction of the bastion of biodiversity just moments earlier. How can one be for saving the earth while also saying we need to separate ourselves from it by approving the destruction of it all? I even ponder on the idea that perhaps someone in government has a stake in dominion given that we've gotten rid of all the trees that provide shade that help reduce the [00:28:15] amount of electricity that gets used during the summer months. Lastly, I don't come here every two weeks to say the same thing over and over again to boost my ego. I come here to speak for the plants and animals that Henrico, like many counties, pledges to annihilate as it seems that we require constant development for incremental budgeting as Henrico refuses to explore different revenue routes. [00:28:39] I come here to seek metaphorical reparative justice for those abandoned and spit out by the machine that favors a source of energy that is comprised of a state of anguish and purposelessness. So my main point is, and I know I have a lot of fun with lettering expression, and I also cut myself off last time to be cordial to the applicant. So I will be quite blunt this time. [00:29:00] But if someone in the upper echelon of government wants to set Henrico County on fire, please go ahead and stoke that spark, as that is what you are insisting with your votes. Thank you. All right. Next, Sanja Buckner-Scott. Ms. Scott, are you here? Yes, ma'am, if you would go right to the podium. [00:29:25] Good evening. My name is Sanja Buckner-Scott, and I'm here today to speak with you all or to request an ordinance for trash and recycle cans. The neighborhood that I live in, we don't have an HOA, unfortunately. It's an older neighborhood. So, we have neighbors, and specifically my next-door neighbor has had their trash can and recycle can at the roads since February of 2023. [00:29:50] It causes havoc when, for example, yesterday when we have bad storms and so forth, the trash cans that are sitting there empty because our trash day is Wednesday, recycle day is on Tuesday. So, when the rain comes and when it blows the trash cans, if they're not home, then it leaves it in the roadway and so forth. [00:30:07] Also, with me being next door to them, what happens is the rain, if the flat part of the trash can is facing a curve and it moves into the curve, then the water backs up to my driveway. So then my only recourse is to cross my yard, go to their trash can, slide it back so the water can go down the curve like it's supposed to and like it was designed to go into the drain. [00:30:33] In the city of Richmond, my father lives there, and they have an ordinance for it. And prior to that, you would see trash cans out every day, weeks and months at a time. But once the ordinance was passed, I want to say it was right after COVID and so forth, you saw like a 95% compliance rate because of the fact I think a fee was attached or a fine was attached if you did not remove your can within the 24 hours after pickup. [00:30:59] And I think you could not have it put out 24 hours prior to pick up. So I really would like if the county could do something like that to just protect those that are in older communities that don't have HOAs to protect them and to make sure it can happen. [00:31:14] And especially some of the busier roads like Hungry Road, North Run Road, and others, when there's a lot of traffic. I'm in a subdivision, so it's a little different. But when you're on those main roads like that, and those trash cans sit out at time and time and time, when you're having traffic, schools getting ready to open back up, and things that, and you have kids out there, school buses and so forth, it can cause a serious issue. [00:31:36] And so I just would like the board to consider that. Thank you so much for your time, and thank you for allowing me the opportunity to speak. I got your email. I've received your email. Okay. I'll be reaching out to you about that. Okay. Thank you so much. Thank you all. All right. Next, Mr. Chair, members of the board, we have Corey Rutledge. [00:31:56] If you would go to the podium, sir. Hey, my name is Corey Rutledge. I am in the Three Chop District. I wanted to come today to talk a little bit about FLOC and those automatic license plate readers that have kind of been seeming to have been popping up a lot recently. [00:32:21] I know a lot of people have seen articles and stuff out there about them and about the constitutional protections and privacy and all this other kind of stuff that's going out there. But I wanted to bring another perspective from it. So I am an IT auditor. You know, I have to go in and check and make sure that people are following the rules where I work when it comes to IT systems and things like that. [00:32:48] I've worked for big companies here in Richmond. I've worked for the state for 11 years. So I've had a variety of experiences with what we call third-party risk management, you know managing vendors and things like that and i can almost guarantee you that any of the safety uh concerns that people have with or the constitutional concerns that people have with too much access being granted to police agencies other police departments uh maybe the federal [00:33:23] government ice those things like that are certainly happening and that there's not really that much checking going on above it i know that it's hard probably for the county or the police department to be able to go in and say hey show us evidence that other people are not accessing our data that's a very hard thing for not just local government and county and state government but bigger companies to do as well the other piece of it is from my professional opinion is in it auditing where in IT security we have what are called preventative versus detective controls, right? [00:34:00] So we're looking to see how do we prevent a cyber attack from happening versus how do we find out about it afterwards. It's always better to have a preventative control, right? So I think the money used to pay for FLOC would be better spent actually putting towards the community to maybe help people so that crimes are happening less rather than trying to catch something after it's happening. [00:34:26] My other concern with it is that I live right behind like Tuckahoe Middle and Ridge Elementary. The only two spots right by my house that have flock cameras are outside of apartments that are lower income apartments. [00:34:48] And there's none within any of the subdivisions or houses around. I don't think that that sends a great message out there to say we're going to put it right by apartments where maybe people have a harder time or they're making minimum wage or things like that. [00:35:07] I don't know that that sends a great message to say those are the only two spots in the area that have a camera. I'd also like to point to say that the CEO of Flock recently, I know he had his whole PR team go on and try to fix things afterwards. But he called people that were producing maps of where flat cameras are, because the public doesn't know exactly where they are unless they happen to see them. He called people that created those maps terrorists. And I just don't think that necessarily the county should be associating themselves with a company like that, that views [00:35:47] people that are trying to provide open source free information that people should have a right to know, I don't think that we should be associating ourselves with companies like that. It doesn't give me a great feeling about what they're doing with the data, what they could do with the data. It's a lot of trust placed in a, from what I know, a fairly new company, a fairly new area of technology, and it provides a lot of risk professionally and then also just personally. I just am not a big fan of it. So just wanted to express that opinion. [00:36:25] Thank you. Now, we don't have any other individual that has signed up to speak. Is there anyone else that wishes to address the board this evening? [00:36:59] Hi, my name is David Parker. I'm in the Varina district. Before I begin, Mr. Vitolkis, I hope you remember me. In the sixth grade, I interviewed you for our project, so I just believe that it's important for us to engage with children in local, state, and national politics. [00:37:21] So, yeah, thank you. I'll also continue by saying that I'm a senior aerospace engineering major at Tuskegee University, and I have many titles, but I'll just say that those are a testament to what the greatness that comes out of Enrico County. [00:37:38] So as the gentleman said before me, the flat cameras, I hate them, to be completely honest. We all think they're speeding cameras. Whenever people, you know, normal people that don't look into it, they think that they're speeding cameras, so they slow down. but they don't know that it's tracking their every movement every time they go past it. [00:37:57] They're an issue because it's essentially turning what our home is into a surveillance state. Whenever we go to these places, they walk past you when you're cutting grass, when you're taking pictures, and they've also been cited to have been accessed by police members. [00:38:18] I'm not saying that it's happening in our county, but police members across the country have been using those to track their, you know, ex-significant others, and also they were used in an AI way to put a family behind gunpoint, essentially, and they were innocent. So it's an important issue. I don't think that flock cameras need a place in our community. Moving forward, data centers, they're strained on the locality they drive up electricity prices they steal water from our people and our children [00:38:55] and they ruin the power grid by shifting the phase of the electricity there's a lot more science behind that but essentially it causes all your appliances to work over time and it reduces the lifespan of everything in your home that runs on electricity the majority of these data centers are in the east end where i live and it tells a tale of time and time again where people of lower income people of color are encroached upon by large businesses this is no difference than this is no different than memphis or utah where there are large data center projects that um they you [00:39:35] know they have these turbines and i'm in aerospace engineering they have these turbines that are constantly spewing out um disgusting gases like carbon dioxide um nitrous oxides which are they contribute to acid rains and they they just they contribute to a lot of pollution that um can bring a lot of health effects like um asthma and so we cannot claim that we want to keep him rico beautiful when we have these monstrosities humming away and they're taking our data stealing our data [00:40:10] online and then also taking our water and um providing a drought for our citizens and i don't forget that we had an issue back in the winter time. I was back in Alabama worrying for my family because they were out of water for days on end. And that's an issue when you have, in the middle of the summertime, when it's extremely hot and people need water, that you're telling citizens to conserve water. That's a shame. We shouldn't have to have this conversation. When we have [00:40:44] living people that need water to live, and you don't ask data centers to, you know, conserve your water you don't ask data centers to maybe shut off for a few days during the hot times where they're already putting off a lot of heat into the atmosphere so i hate data centers but i'll give in i'll you know i'll give a solution for you so i believe there should be a moratorium on the plans for data centers moving forward in the county and operations at current data centers [00:41:22] should be ceased until there's a plan in action to be able to observe how much water they uh, how much water they consume and how much electricity they consume. And, um, essentially we should transition into taking data centers out of our communities. I hope you all can learn from this as technology, although it plays a very crucial part in our lives, um, they should be observed and they should be, um, they should be, you know, recited by, um, a lot of experts that, [00:41:59] you know know what's going on and so that we can uh be able to understand this um technology thank you so chair before what's your name again sir david parker uh mr parker um mr chan can you come up for a second um i have a question for you you said you were back home you say you're back in alabama and you heard that we we you say here we went days without water yes yes you were in alabama and you heard here i was in alabama and henrico i've never had that issue in alabama but [00:42:38] i've heard this multiple times coming from henrico so you heard that in henrico county we went days without water in verona yeah yeah so what so hold on uh so a couple things because i can't just let you i could but i'm not gonna just let you come and say that without some facts behind it mr chan at what point this summer did we lose water correction so i said that sir if you don't mind please respectfully i didn't cut you off when you were talking hold on for a second [00:43:16] no let's clarify you said what go ahead i'm sorry i said that there was a notice sent out to citizens to conserve water not that their people were going without water during the summer all right that's not what you said though but we'll pause for a second mr chan what can you tell us about the voluntary water conservation efforts during the summer. [00:43:41] Yes, sir. So Himrico, in conjunction with regional other localities in the Commonwealth and working with the Virginia Department of Environmental Quality, we were all looking at groundwater levels as well as the river levels, like water levels in the James River. [00:44:03] And because of the extended hot weather, those levels went down and they reached a threshold, uh, by our permit that we would institute voluntary conservation measures and those voluntary conservation measures were across the county, uh, both industry, uh, and, uh, residential. [00:44:24] So it was for, we were asking everyone to conserve water business and re and residential. Yes, sir. All right, so we do know how much water we use in the tech park where our hyperscale data centers are. [00:44:47] And that is what? Yes, sir. So all of those connections are metered. And overall, all of the data centers within the county use about 500,000 gallons per day. for context the county overall uses like 30 to 40 million gallons per day and so that represents about less than two percent of the overall usage in the county all right hey I was just gonna say and this may be helpful I think I [00:45:22] remember you in sixth grade so we had a semiconductor plant at white oak they use significant amounts of water right now all of the data centers are using what percentage of the water that that semiconductor facility used uh so that facility uh was slated to use around 13 million gallons per day and currently and and this is all combined because we do have data centers in uh the west the central and eastern parts of the county all together around 500,000 gallons per day. [00:46:04] Respect to you, young brother, and good luck to you this year at Tuskegee. Proud of what you're doing. Honored to have you living in Verona. These issues that you speak of are serious, and I too, like you, think that we have reached our max for expansion of data centers in our in our community um but i also have to make sure that [00:46:40] the facts are getting out there and um that's why i asked our dpu director to come up and share if you want to get more real data from enrico county i can get it to you we can get it to you um some Some of what you hear might not be all factual. [00:47:00] But respect, I hear you with Flock, I hear you about data centers, but I couldn't just let you say that stuff knowing that some of it was not accurate. So I just wanted to share that. Yeah, I understand that. I just wanted to, you know, understand are there any plans or actions in place for if there is a situation where, you know, the water levels get low again, do data centers get limited? [00:47:26] Do those industries get limited first before citizens do? I don't think that we will get to a point where we will ask any industry to stop before the citizens. But the summer is pretty much over. [00:47:42] And we have, I don't know, Bentley, if you want to talk. And Mr. Che, I'm sorry. I don't want to get into a back and forward with this young man. So let's do this. Whatever kind of questions you have, I'll get you to answer. All right? So I don't want to take over our meeting with a back and forward. so that's fine i'll get you the answer yes sir all right thank you yes ma'am good evening chair and members of the board my name is madison kuriger and i've been a henrico residence resident for over 20 years my background is in national security and i have worked with [00:48:18] artificial intelligence and emerging technologies in government and defense i'm here tonight to speak out about the proposed ordinance to authorize photo speed monitor devices in henrico school zones. I understand the goal, reducing speeding and protecting children around school areas, and I absolutely support that goal. But I think the proposal raises a larger question. How much automated surveillance are we comfortable introducing into our community in the name of public safety? I do not believe routinely photographing vehicles is the least intrusive [00:48:54] solution, especially when police officers will continue enforcing speed limits in these areas. I am also concerned that a private company will operate these cameras and receive 15% of the citation fees. A private company's compensation should not depend on how many violations an automated system generates. [00:49:15] The cameras may come at no upfront cost to Henrico, but that does not make them free. The cost is our privacy. Success should be determined by fewer speeding cars, fewer crashes, and safer children, not more tickets. [00:49:32] My concern goes beyond these speed cameras. Henrico already has automated license plate readers, including Flock cameras. As a law-abiding resident, I find this invasive. I should not have to be suspected of a crime to care that information about my movements may be recorded, stored, searched, or shared. [00:49:52] I am especially concerned about surveillance data being connected to a large privately operated network. If Henrico believes cameras are necessary, I would much rather see narrowly tailored systems that remain under local control. Residents also deserve transparency. We should be able to easily find out where these cameras are, what they collect, how long that information is kept, and who can access it. Henrico should maintain a public list of these systems and clearly identify them with signage. And if automated technology produces evidence against someone, there must always be a clear way to challenge it and a human being ultimately accountable for it. [00:50:32] One camera for speeding, another for license plates, another for public safety. Each one may sound reasonable on its own, but together we are normalizing a level of surveillance that I don't believe belongs in everyday life in Henrico. I am asking the board to pursue less intrusive solutions before adding more automated monitoring to establish stronger transparency and oversight for the surveillance technology we already have. [00:50:58] public safety matters but so does privacy due process and freedom to go about our daily lives without being routinely monitored for surveillance this significant i believe residents should have an opportunity to vote on whether we want it in our community just because we have the technology to watch other people does not mean we should thank you board this evening hey there this is [00:51:35] paul momquist i'm a resident of fairfield district and deputies go bring y'all a cute little article here in this moment um it's 30 30 years old it's an old style magazine and on the cover was one paul sawyer now paul sawyer when he ran the racetrack he made a conscious effort to make sure that the fans coming to the track were treated very well and were not gouged by business interests for profit reasons and so i think dan schmidt would especially appreciate it since he saw this [00:52:11] earlier races in town one thing that concerns me about the race this weekend as i drove over here by the racetrack i was amazed at the deplorable condition of richmond michael turnpike project is progressing at tree stumps trees down the ground weeds overgrowing it that's not going to make a very good impression for the tourists coming here to watch nascar the other thing is [00:52:42] the guardrails at carolina and laburnum and vauder and laburnum are in deplorable shape for months i don't know who's running the department of transportation but if you want to make henrico beautiful y'all really need to monitor what's going on with these guardrails i know y'all lowered the speed limit but it appears to me that the lower speed limit is just encouraging more damage to those guardrails and those intersections and actually along carolina where there's a nice Ripley effect where cars keep sliding into it. [00:53:18] One other thing, the gentleman that spoke on White Oak, when they built White Oak, I had a relative who worked there. They put in a 30-inch water pipe there, as I recall. I don't know if he knows that or not, and they used a lot of water. But there wasn't the uproar like the data centers are gathering, maybe because White Oak was producing a product many people could use. [00:53:42] And I think people are not convinced the data centers are actually producing a product that is good for their lives. And if the flock cameras are causing this much stern issues, the best way to find out is if when you use the flock cameras or any other red light, running light cameras, the public should be able to access who's being charged. [00:54:07] I would love to see which of my neighbors are getting popped for speeding, for running red lights, or have issues with flock cameras. And I have a very suspicious feeling that if that information got out, those fly cameras, those red lights, those speed humps, or whatever they are, will disappear overnight. [00:54:29] Anyway, have a good weekend at the races, and I hope Joey Logano wins. Bye. All right, is there anyone else that wishes to address the board this evening? Anyone on WebEx that wishes to address the board this evening? [00:54:45] There's no one to speak on WebEx. All right, Mr. Chair, members of the board, then you would move on to your general agenda. miss minor has the first item which is agenda item 185-26 this is a resolution authorizing reimbursement from the proceeds of a series of bonds sheila thank you good evening mr manager mr chairman members of the board this resolution would allow the county to reimburse ourselves from bond proceeds for any expenditures that we incur prior to the issuance of general obligation and water and sewer bonds planned for the spring of 2027. [00:55:21] this reimbursement allows staff to best manage cash flow without delaying projects unnecessarily due to cash flow issues however a resolution is required by the irs regulations in order to do so the director of finance recommends approval and the county manager confers i'd be happy to answer any questions thank you ms minor colleagues any questions from miss minor move the resolution thank you mr smith thank you mr roger's moved by mr. smith seconded by mr. roguers all of us say i as opposed i have it the resolution is [00:55:55] approved next mr chair members of board 186-26 is a resolution for award of contract this is for annual professional engineering commission services county-wide mr massey thank you mr manager mr chairman members of the board this board paper awards an annual contract to facility Dynamics Engineering Corporation provide annual annual professional engineering commissioning services. The county received 26 proposals and based on those interviews and review of those written proposals the selection committee selected Facility Dynamics Engineering Corporation as the [00:56:31] top-ranked firm. The directors of general services and the purchasing director recommend approval of the board paper and the county manager concurs. Thank you sir. Colleagues any questions? Hearing none is there a motion so second moved by mrs roundtree seconded by mr rogers all in favor so aye aye those opposed the eyes have it the resolution is approved next mr chair members of the board 187-26 this is an introduction of an ordinance to amend and reordain section 22-43 [00:57:06] titled preserved of the code of the county of henrico to allow the use of photo speed monitoring devices in school zones chief english thank you mr manager board chair members of the board This board paper introduces the advertisement and public hearing on September 8, 2026, an ordinance to allow the use of photo speed monitoring devices for purposes of recording violations of maximum speed limits at school crossing zones in accordance with Code of Virginia 46.2-82.1. [00:57:37] The ordinance would impose a civil penalty of $100 if a photo speed monitoring device finds a vehicle traveling at speeds of at least 10 miles per hour over the posted school crossing zone speed limit while such zone is active. Chief of Police recommends approvals of this board paper, and the county manager concurs. Thank you, Chief. Colleagues, any questions for Chief? So just so we're clear, the vote tonight is not on the ordinance itself. It is to set it for a public hearing session and a [00:58:11] vote next month is that correct that is correct okay and that is a maybe mr newbie this is a standard this is the process that has to happen when we're talking about in considering an ordinance that's correct by by state law the ordinance must be advertised at least twice in a public hearing held before the ordinance can be approved by the board and that's what this board paper does it sets it for that public hearing it requires the advertisement and so we've heard a couple of comments today that touched upon this issue um those aren't necessarily lumped in with the public hearing process for this vote so folks can should come out at the next hearing or make their [00:58:49] positions known at that actual public hearing that is allocated for that ordinance correct yes so the board can take notice of the comments that were made this evening and citizens can continue to comment by email phone etc before the public hearing and then the board will hold a formal public hearing on september 8th at this same time at six o'clock at your regular meeting at which citizens can speak directly to the ordinance okay and the proposed ordinance i know that in our materials that it states that a copy of the ordinance can be viewed at the county building between regular business hours is there some way that we could have it a little more easily accessible maybe on our website that proposed language yes so the actual ordinance [00:59:28] language will be on our website the clerk posted uh all public hearing items that are advertised so they're visible on our website okay are they current as of now i believe they'll be up by next tuesday i'm looking at our clerk she is nodding in the affirmative that they'll be up by next tuesday i see yes so the clerk is affirming that it will be on the website beginning next week okay she's saying yes to that okay and then the proposed ordinance sort of uh refers to it says and we we would be in compliance with the virginia code section which is what the general assembly [01:00:08] did there so it's sort of two steps one is the proposed language of our ordinance which refers to much more detailed language in the virginia code yes the virginia code has set very strong parameters on the use of these devices and the county's ordinance would require compliance with those standards and then last uh last but not least the proposed language in the ordinance does reflect the 100 fine because that is the statutory max by the current law in the general assembly cover yes the civil penalty that the maximum civil penalty allowed by law for photo enforcement is 100 of course an actual speeding ticket in school zone is much more than that [01:00:44] and then even though that is in the proposed ordinance part of the purpose of the public hearing would be that that night we could decide on a different number or decide yay or nay on the ordinance itself that is absolutely true the board could approve the ordinances drafted or amended at its pleasure thank you no other questions thank you madam um any other questions colleagues it's not as their motion one one comment mr chair um i will be reaching out to lisa tuckahoe residents that have spoken tonight um on this so i'm going to support the introduction of the ordinance um and then we'll get some more information over the next 30 days so motion motion [01:01:21] um i move the uh ordinance thank you mr rogers appreciate sir is there a second second second by mr. Schmidt all in favor of those opposed the ayes have it it's approved the order is approved next mr. chair members of board 188-26 is the resolution for signatory authority this is for acquisition of real property drainage and flood mitigation at 3004 emporia street which is in the verona district mr fritz thank you mr manager this board paper authorizes the acquisition of 3004 emporia street in the village green subdivision for drainage and [01:01:57] and flood mitigation the owner mrs johnson has agreed to sell the property to the county for 287 000 the directors of public works and real property recommend approval of the board paper the county manager concurs any questions thank you sir for that uh colleagues any questions for miss fritz hearing on reverend nelson so moved moved by reverend nelson is there a second second by mr rogers all in fibs i i oppose as have it the resolution is approved next ms chair members aboard 189-26 is a resolution this is for an award of contract for verina on the james phase one of [01:02:33] that project which is in the verona district mr zeno thank you mr manager mr chair members of the board this board paper awards a fixed price contract for one million six hundred twenty eight thousand four hundred and fifty dollars to suburban remodeling corporation for verina on the james phase one the project consists of brick masonry repair and reporting and cleaning damage wood replacement and refinishing window door and trim repair copper gutter and downspout replacement demolish and replacement of existing porches termite soil treatment and replacement of the existing concrete vault cap [01:03:12] work on the project is anticipated to begin in september and be completed within 270 calendar days the county received two bids and based upon a review of the bids src inc is the lowest responsive and responsible bidder the resolution also appropriates an additional 568 168 dollars for the project the directors of recreation and park and purchasing directors recommend approval of the board paper and the county manager concurs happy to answer any questions on this thank you sir colleagues any questions if not is there a motion thank you reverend elson second second by mr smith all those [01:03:51] I'm those eyes have it the resolution next mr. chair members aboard 190 - 26 is a resolution for an award of contract this is for the water treatment facility finished water and raw water replacement project this is in the Tuckahoe district mr. This is the control system for one of the five pumps that we have out there. The work includes providing and installing the new VFD and all necessary related electrical and control wiring and conduit. Work on the project is anticipated to begin in September and be completed within 330 calendar days. [01:04:49] With that I'll be happy to answer any questions that you may have.
